Whether, with reference to the submission made by the Chief Financial Officer (CFO) of the SA Broadcasting Corporation in the Portfolio Committee on Communications’ meeting on 21 October 2015, she will provide a copy of the independent study referred to by the CFO which was conducted to benchmark the Chief Operating Officer’s (COO’s) salary increase; if not, why not; if so, by when will she provide the (a) specified independent study and (b) record of decisions related to the implementation of the recommendations of the specified study in respect of the COO’s salary increase?

Reply:

(a) The report is a confidential benchmark performed by an external service provider so that the SABC maintains its competitiveness.

(b) Records of decisions are confidential internal documents that should be kept as such.

Does the SA Broadcasting Corporation (SABC) negotiate with actors to determine the payment of royalties due to them when selling licensed content to other TV stations; if not, (a) why not and (b) are the specified actors paid a percentage of the profit emanating from the specified transaction; if so, (i) how is the percentage profit determined, (ii) how much (aa) does and/or (bb) can the SABC deduct from the selling price before allocating an amount of the profit towards royalties and (iii) how is this determined?

Reply:

(a) The SABC does not sell content, but licences it to other networks and operators. The current standard commissioning agreement makes provision for the amount to be negotiated or for a payment based on two per cent of the net licencing agreement profit made. At this stage the SABC makes provision for payment based on the latter number.

(b) (i) Net profit is calculated at gross licencing revenue less 35% of capped overheads.

(ii) As per the above

Reply:

(a) Subject to sub-regulation (2), of Section 22 of the MDDA Act 14 of 2002, funds contemplated in section 15(2)(a) of the Act must be allocated by the Board in accordance with the following percentages:

  • Community media projects: at least 60%
  • Small Commercial media projects: at least 25%
  • Research projects: 5%

(b) The reason for giving community media projects more funding is informed by Regulations in terms of Section 22 of the Media Development and Diversity Agency Act of 2002, as enacted in the Government Gazette No. 22570 of 10 October 2003.

Reply:

(1) (a) The total number of applications lodged at the 18 SKA area branches up to 30 November 2015 amounts to 2, 336 in total.

(b) (i) A total of 2, 074 qualifying applications has been processed up to 30 November 2015.

(ii) A total of 262 non-qualifying applications has been processed up to 30 November 2015

(iii) A total of 274 applications for the period ending 30 November 2015 stills needs to be processed.

(2) The reasons for the 262 non-qualifying applications to date are the following:

(a) Foreign ID’s (Total: 1)

(b) Unknown address (Total: 207)

(c) Total household income above income threshold of R3200 pm (Total: 54)

Reply:

(1) (a) The scope of investigation covers the supply chain processes followed by the Universal Service and Access Agency of South Africa in the appointment of Ernest and Young to oversee the procurement process and companies to supply digital terrestrial (DTT), direct to home (DTH), satellite dishes and antennas.

(b)(i) & (ii) The investigation is expected to be finalised by end December 2015.

(2) The sensitivities regarding the information contained in the final report will determine whether the report will be made public or not.

(1) Whether three companies (names furnished) have been instructed to produce set-top boxes (STBs) arising from the four Digital Terrestrial Television programme tenders; if not, what are the relevant details; if so, (a) how many (i) STBs and (ii) antennae from each tender were ordered from each of the specified suppliers and (b) what are the costs of the specified items of each supplier, (2) whether any orders have been placed with other suppliers beside the specified suppliers; if so, (a) with which companies have these orders been placed, (b) when were the specified orders placed and (c) what is the delivery date of the specified orders; (3) whether a non-disclosure agreement by the Universal Service Access Agency of South Africa has been imposed on (a) her department and/or (b) the specified companies who have secured orders in terms of the specified tenders?

Reply:

(1) USAASA, as an entity, is responsible for the procurement of STBs and has confirmed placement of orders with the manufacturers of:

(a) (i) One million five hundred thousand (1.5 million)

(ii) One million antennae

(b) Department is still in the process of engagement with USAASA regarding the purchase prices of STBs and accessories

(2) USAASA has confirmed placement of purchase orders with the manufactures from the established panel of suppliers of STBs:

(a) USAASA has confirmed placing purchase orders with three companies

(b) Orders were placed in August 2015

(c) Delivery of STBs is dependent on the manufacturers satisfying Conformance Regime and the testing of STBs on the network. Actual delivery is to consider a lag period of eight (8) to twelve (12) weeks from ordering of components by manufacturers from suppliers.

(3)

(a) Any agreement for the production and supply of STBs is between USAASA and manufacturers

(b) Any agreement for the production and supply of STBs is between USAASA and manufacturers

Reply:

The decision to broadcast the workshop was based on the view that the subject matter under discussion was topical and in the public interest, given the discomfort many individuals express at the seemingly unfettered practice of certain media organizations to publish whatever it pleases about targeted individuals, and the lack of recourse available to those said individuals.

The SABC did not charge any organization, a fee (or otherwise) to cover the event.

The event was deemed news worthy and warranted coverage.

Editorial decisions i.e. what to cover and why, is firmly vested in the newsrooms of the SABC News department.

As per the response to question 232 on 25 February 2015, the SABC did commission a service provider to determine the accuracy of the above quoted amounts as a consequence of the AGSA qualifying the disclosure. Funding is allocated in four tranches and each tranche is released after satisfactory reporting and compliance with the Grant in Aid Agreement and monitoring. Due to cost saving, site visits are conducted once during the life cycle of projects. Project report on quarterly basis, this is another form of close monitoring. All Radio Stations are monitored on the following: i. Attainment of intended project objectives as of inception ii. Governance and institutional stability iii. Financial Management iv. Financial Sustainability and revenue generation v. Community Participation vi. Partnerships vii. Compliance and non-compliance with the Grant in Aid Agreement i. MDDA conducts monitoring on all the funded community radio stations. The dates for monitoring are determined based on the status quo of the projects, funds disbursed and the reporting cycle of each project. Due to cost saving, site visits are conducted once during the life cycle of a project (Average project lifecycle would normally be 14 months). Oversight monitoring is conducted if there is delayed reporting. ii. Reply:

(a) The MDDA has a grant funding cycle that that runs from 12 to 18 months. Projects are monitored twice during the project funding cycle. Funding is allocated in four tranches and each tranche is released after satisfactory reporting and compliance with the Grant in Aid Agreement and monitoring. Due to cost saving, site visits are conducted once during the life cycle of projects. Project report on quarterly basis, this is another form of close monitoring.

(b)  All Radio Stations are monitored on the following:

i. Attainment of intended project objectives as of inception

ii. Governance and institutional stability

iii. Financial Management

iv. Financial Sustainability and revenue generation

v. Community Participation

vi. Partnerships

vii. Compliance and non-compliance with the Grant in Aid Agreement

(c) i. MDDA conducts monitoring on all the funded community radio stations. The dates for monitoring are determined based on the status quo of the projects, funds disbursed and the reporting cycle of each project. Due to cost saving, site visits are conducted once during the life cycle of a project (Average project lifecycle would normally be 14 months). Oversight monitoring is conducted if there is delayed reporting.

Reply:

(a) (i), (ii), (aa), (bb), (cc), (dd).

The Department of Communications did not commission any consultants or external third parties to undertake the task of revising and drafting the Policy amendments that were submitted in February 2015 and finally adopted by Cabinet on the 4th of March 2015. The task was undertaken by the internal Policy Unit personnel of the DoC and the DTT PMO under the supervision of the Acting Director-General and the leadership of the Minister.

(b) (i), (ii) and (c)

The only point at which external parties were engaged in the formulation of the policy amendments was to solicit the inputs from the consultation session that was held with industry and various stakeholders in the broadcasting sector. This mainly occurred at a workshop called by the Minister to revive the Broadcasting Digital Migration (BDM) Policy and to assist the DTT PMO team to finalise the Policy amendments and attended by several representatives of companies and industry groups from the electronic manufacturing sector.  The details are as follows:

The Minister of Communications received the report from the National Communication Task Team (NCTT). The report is currently being evaluated. Reply:

(a)  (i) Tshwane TV

No. Tshwane TV has been having compliance challenges with regards to community participation since the 2012/13 financial year. The problem started after the Licensee’s first Annual General Meeting (AGM) in 2011 which then resulted in two controlling structures that were elected in two different AGM’s. The Authority tried to assist the Licensee to convene a properly constituted AGM that would elect a recognized controlling structure in accordance with the Licensee’s founding documents.

The mediation process was abandoned after one of the parties took the matter to Court and a default judgement was then awarded. The Authority is currently assisting Tshwane TV to put structures in place in order to comply with all aspects of their service license pertaining to community participation.

(ii) Soweto TV

Yes. Soweto TV held two annual meetings during the four financial years in question.

(iii) Cape Town Community TV

Cape Town TV reported that they have held two annual meetings for the four financial years in questions. However, ICASA is still awaiting the necessary documentation to confirm this.

(iv) Bay Community TV

Yes Bay Community TV held two annual meetings during the four financial years in question.

(b)   Therefore the mainstream newspapers referred to are commercial newspapers that fall under the following stables: Times Media Group; Caxton, Independent News and Media SA, and Media24.

(1) With reference to the funeral of the late multi-award winning traditional music presenter (name furnished) of uMhlobo Wenene FM under the SA Broadcasting Corporation (SABC), what (a) procedure and (b) criteria is used by (i) her department and (ii) SABC to decide which funerals to broadcast live and/or cover widely;

Reply:

It is the prerogative of the Inter-Ministerial Committee on State Funerals, together with the Presidency, to declare the status of funerals, whether they are national or provincial.

The SABC is then obliged to follow the broadcast coverage, as prescribed in the regulations pertaining to official funerals.

Irrespective of the individual (or public appeal or popularity), the broadcast parameters are clearly stipulated in the regulations.

Whether a funeral is covered “live” or not, is not at the discretion of the SABC, but what is dictated in the regulations.

In the case in question, the deceased was neither honoured with a State or Provincial funeral status.

The SABC did however cover the announcement of his death widely on all our platforms. Television and radio carried extensive obituaries. All the memorial services were covered in all the news bulletins as was the actual funeral.
