Reply:
1. GCIS has a SCM Policy
GCIS has an approved supply chain management procurement policy that governs all procurement that is handled within the department. All procurement, be it advertising, communication, consultancy, business and advisory services are handled through this policy with is aligned with the Treasury Regulations on Supply Chain Management.
(2) GCIS does not keep records of the media related expenditures of national government department and SOE’s. GCIS can only provide records for its own expenditure and for those government departments and state owned entities that utilise the GCIS media buying service.
(3) GCIS does not have records of the amounts spent by national government and SOE’s expenditures. GCIS can only provide records for its own expenditure and for those government departments and state owned entities that utilise the GCIS media buying service.

a) (i) The private office does not have a separate budget from that of the Ministry.
(ii)The budget and the expenditure of the private office is included in the budget of the Ministry which is reflected in the Annual Reports of the 2014/15, 2015/16 and the 2016/17 financial years.
b) The remuneration of employees in the private office is included in the compensation of all employees in the department as reflected in the relevant annual reports.
The salary levels and job descriptions are in line with the guidelines provided by the Handbook for Members of the Executive as well as the Public Service Regulations.

Motau, Mr SC to ask the Minister of Communications
(1) (a) Why was the Northern Cape chosen for the Digital Terrestrial Television (DTT) migration roll-out and (b) what is the progress in this regard;(2) what are the major challenges that her department faces with regard to the DDT roll-out in the (a) country and (b) Northern Cape; (3) what number of set-top boxes (a) have been installed and (b) must still be installed in each province; (4) how far is her department behind schedule with the DTT migration roll-out; (5) how does the Government intend to support content development for the digital space created by digital migration and the roll-out of DTT?
Reply:
1. (a) The Northern Cape hosts part of the international Square Kilometre Array (SKA), which is an international radio telescope project undertaken in collaboration with other countries including the UK and Australia. Analogue television transmissions produce high levels of interference and as such they have to be switched off and replaced with digital television transmissions via satellite.
(b) To date, all qualifying households in the core towns within a Square Kilometre Array (SKA) have been connected to the digital platform. Subsequent to the installations of devices to all households’ in the core towns of the SKA; including Carnarvon, Vanwyksvlei, Brandvlei, Williston and Vorsburg; analogue transmission services have since been switched off. However, analogue transmission services could not be switched in other areas of the SKA due to households that do not qualify for government subsidised decoders.
2. (a) The major challenges relates to the lack of resources mainly funding.
(b) Majority of the areas in the Northern Cape are covered by Satellite network and currently, there is no stock to distribute to the qualifying registered households.

4. The department has not met the target in terms of
(a) the migration of five million qualifying households to receive government subsidised decoders;
(b) the migration of the majority of unsubscribed citizen who rely on the retail market to acquire migration devices
5. The Department is a policy maker and does not implement programmes on the ground. The department will ensure collaboration with relevant stakeholders such as the SABC and the industry to advocate for content development to feed the channels to be made available by digital migration. In 2018/19 the Department will develop a South African Audio-Visual content strategy to support the digital migration.

With reference to the reply to question 1958 on 16 October 2017, (a) which trade exchanges are currently in dispute, (b) what amounts are associated with each trade exchange and (c) which trade exchanges are currently before the courts?
Reply:
a) Currently there are no trade exchanges before the courts, but there exists a dispute which is not before the courts yet.
The background briefly:
The South African Broadcasting Corporation SOC Limited (“SABC”) through Metro FM concluded a Trade Exchange Agreement (“Agreement”) with RBA Developments JHB (Proprietary) Limited (“RBA”) for the exchange of value added services set out in Annexure “A” and Schedules II, III and IV of the Agreement. The salient terms of the Agreement are as follows:
- The Agreement commenced on 08 August 2016;
- The Agreement will terminate on 08 October 2016;
- The parties to the Agreement are the SABC and RBA;
- In terms of the Agreement the parties would perform the obligations set out in Annexure “A” including the deliverables set out in the trade exchange items schedule. A copy of the Agreement is attached herewith and marked as “Annexure A”.
b) The trade exchange value is R3 450 749.68 including VAT.
In terms of the Agreement, the parties agreed to jointly work together in delivering a fully furnished house as a prize giveaway pursuant to a competition to be run by Metro FM for its listeners. To this end each of the parties undertook to perform certain obligations to ensure the successful implementation of the competition and delivery of the house to the competition winner. The dispute is therefore that RBA was liquidated and MSP, which took over and agreed to step in and assist in completing the house and handing it over to the completion winner is now reneging on its initial undertaking. This has resulted in the house not having been handed over to the competition winner despite that the house was long completed.
Metro FM has received a demand from Legal Wise representing the competition winner claiming a handover of the house to the winner.
c) Save for the demand from Legal wise, no court pleadings have been served on the SABC yet. We are still in the process of engaging with MSP to try and resolve the matter amicably by handing over the house to the competition winner.

(a) Yes, the services of the official were needed in order to ensure smooth continuity in the operations. At the time, the recruitment for the position was not finalised.
(b) Approval was sought and obtained from the Board of Directors to continue engaging the services of the official until 31 October 2017. Reasons for continuing with the services are as follows:
- The contract was supposed to end on 8 September 2017, however the Company Secretary took ill from 6 September 2017 and in her absence, there was no-one available with the required experience of working with the MDDA Board. The services of the official were therefore extended to enable ongoing operational support for the Board.
- Furthermore, the Company Secretary was appointed ACEO from 9 October 2017 and the added responsibilities at ACEO level meant that she would require secretarial assistance, both to support her in her role as ACEO and to take over the operational support of the Board.
- The contract has since been terminated.

2. The SABC draws a sharp distinction between political advertising (when it is permissible during an election period), and the day-to-day advertising by government departments and state institutions for which all media owners compete. Whereas the SABC does not charge politicians for interviews, its commercial division indeed competes for government advertising campaigns via the GCIS and/or directly from government departments. The advertising is assessed on the basis of its relation to government communication programmes or services.
3. In respect of the recent SABC3 interview, the SABC acknowledged in a media statement that there had been a breakdown in internal controls and processes and that steps were being taken to ensure that there is no recurrence.

1. The Department is still negotiating with the Department of Energy to transfer the current vehicle which she has been utilizing as the Minister. The details of the vehicle are not fully available for disclosure as the file is still at Energy but the car is Audi A8.

Whether the Films and Publications Board Appeal Tribunal heard any appeals against classification decisions made by the classification committees in respect of (a) publications, (b) films and/or (c) games (i) during the 2016-17 financial year and (ii) since 1 April 2017; if so, (aa) what is the total number of appeals that were heard, (bb) what were the reasons for the appeal in each case and (cc) what was the outcome in each case?
Reply:
a) During the 2016-2017 financial year, 2 (two) appeals for Films were received.
(b)Teenage Mutant Ninja Turtles: Out of the Shadows.
- The FPB rated the Film 13 V, the grounds for appeal from the distributor were based on unnecessary, over restricted age rating and argued for 7-9PG rating.
- The outcome of the appeal were that the Appeal Tribunal overturned the 13 V rating and granted a rating of 10-12PG V.b) Robinson Crusoe: The Wild Life
- The FPB rated the Film 7-9PG V, the grounds for appeal by the distributor were based on unnecessarily over restrictive age rating and appealed for a PG rating.
- The Outcomes of the appeal were that the Appeal Tribunal granted a rating of 7-9PG (excluded "V" as consumer advice)
(ii) Since 01 April 2017 only 1 (one) appeal for a Film received:
(aa) Only one, Despicable Me 3
- The FPB rated the Film 7-9 PG, the grounds for appeal by the distributor were based on unnecessarily over restrictive age rating and appealed for a PG rating.
- The outcome of the appeal was that the Appeal Tribunal overturned the 7-9PG and granted a rating of PG V.

a) The Government Communication and Information System (GCIS) has followed up on complaints laid by the Association of Independent Publishers (AIP) and the matter has been finalised.
b) (i) An internal investigation was conducted and finalised by (ii) departmental staff.
C) The agency has been excluded from the GCIS panel of service providers.
2. No, the GCIS has terminated business relationships with the agency.
3. (a) (b) The contractual period of the panel of service providers ran from September 2016 to August 2017.
(c) The GCIS Bid Adjudication Committee recommended the successful bidders to the Accounting Officer for award.

Yes, a panel of advertising procurement agencies was selected and constituted through a transparent tender process.

b) There was no stipulated contract amount for the panel of service providers tenders as the community print campaigns that GCIS implements are dependent on departmental requests. No reliable demand forecasts are available to plan a contract value.

(1) (a) An amount of R 3,262 000.00 was paid out in bonuses to employees in 2016-17 financial year.
(1) (b) The detailed information about a salary package of an employee is based on an employer- employee confidential information relationship. We can however refer the members to our Annual Report of 2016 2017 wherein the broad breakdown is provided and that information was subjected to an external audit process.
(2) The Public Service Regulations stipulates that a department may pay not more than 1,5% of its pay roll. GCIS uses that as a guide in projecting its anticipated bonus payment and based on signed Performance Agreement Operational Plans of each employee.
