Reply:

Auditing process in relation to the total amount spent, amongst others, refer to in this parliamentary question is still under away, once the auditing process and all other process has been completed, the amount spent, will be submitted to Parliament as part of the Annual Reports, which will be tabled in Parliament.

Reply:

(1) No, the MDDA has not outsourced its stakeholder engagement function. However, when specialist skills or in-house capacity limitations require the services of an external service provider, specific activities may be outsourced with a defined scope of activities and time period. The only activity that falls within the stakeholder engagement function that has been outsourced is a pilot outreach/media literacy campaign that will be held in two provinces which has been awarded to Hummingbird Media.

   (a) The contract to Hummingbird Media was awarded in April 2017.

   (b) The cost of the pilot campaign is R485 000.00

   (c) The Chairperson of the Board signed the approval memorandum requesting the services of Hummingbird for the pilot campaign as, in the absence of a CEO, the Board was overseeing activities in the Agency in a caretaker role until the Ministry of Communications seconded an Acting CEO to the MDDA.

(2) Yes, Hummingbird Media has been previously awarded one contract from the MDDA.

(a) The previous contract awarded to Hummingbird Media covered facilitation of the MDDA strategic planning in September 2016 and input into the Strategic Plan and Annual Performance Plan for 2017/2018 – 2019/2020.

(b) The contract amount was R325 400.00.

(c) The contract was approved by the Acting CEO, Ms Thembelihle Sibeko.

(3) Yes, Hummingbird Media has used limited MDDA office facilities for the current pilot outreach/media literacy campaign.

(a) While a member of Hummingbird Media worked for a total of four days from the MDDA offices contacting stakeholders for the outreach planning process, she did not use MDDA facilities as phone calls to stakeholders were made using her cellphone.

(b) The same member of Hummingbird Media worked for a total of four days from the MDDA offices contacting stakeholders for the outreach planning process as the close liaison with the MDDA ensured that all stakeholders were covered.

(1) Yes

The issues of internal disciplinary processes and/or investigations is sub judice, therefore the FPB is not in a better position to release details in relation to (a)(b) at this stage.

(c) The investigations are at an advance stage

(d) The employee has consented to pre-dismissal arbitration and application has been lodged with the CCMA.

(2) Yes, with effect from 17 March 2017 pending the outcome of the disciplinary process.

(a) The details of the employee in relation to suspension cannot be disclosed as the matter is sub judice.

(b) Yes, they were receiving salaries.

a) The official was suspended on 17 March 2017.

b) The official is facing various charges of alleged misconduct, details of which are still confidential pending finalisation of the disciplinary processes. The suspension was to enable the Board to conduct an investigation on allegations of misconduct.

c) Mr Mmberegeni Dzebu.

d) The Council requested the then Minister of Communications to second an official to act as the CEO. Mr Dzebu was found to be a suitable person.

Reply:

1) Yes.

2)  No, the MDDA staff members were not required to put in extra hours to cover hours lost due to staff shortages to ensure that the entity’s mandate was fulfilled. However, it is understood that due to the vacancy rate, some staff members were required to take on extra duties during normal working hours.

3) Staff members were given a choice to take leave or to take cash in lieu of leave to assist in compensating for the extra workload due to the vacancies.

  (a) A total of 17 staff members opted to not take leave and to receive cash in lieu of leave.

  (b) The professional designations were Programme Managers, Project Officers and Administration staff.

4) No, the MDDA did not re-allocate the lost leave days.

(a) The lost leave days were not reallocated as the staff had been given the option for cash in lieu for the lost leave days.

(b) The affected staff were given cash in lieu for the lost leave days. All affected staff received the cash in lieu for the lost leave days in April 2017.

1. (a) and (b) The Chairperson of the Board of the Media Development and Development Agency (MDDA) has neither (a) acted on behalf of the CEO; nor (b) acted as the CEO of the MDDA in each of the past five financial years.

In the absence of the CEO between 1 March 2017 and 9 May 2017, the Board took a resolution, in the Board meeting of 01 March 2017, that the Chairperson of the Board is to assume the caretaker role over the existing management structure.

After the resignation of the CEO on the 28 February 2017, the Board requested the Minister of Communications via letter dated 2 March 2017 and at the bi-lateral meeting on 5 March 2017 for a secondment from the Department of Communications for an Acting CEO. After a further request to the newly appointed Minister of Communications, Mr Donald Liphoko was seconded to the MDDA as Acting CEO effective from 8 May 2017.

2. The position of CEO has been vacant since 28 February 2017.

3. (a) and (b) This is not applicable as, as stated above, the Chairperson of the Board was not acting as CEO of the MDDA. She therefore has only received compensation as Chairperson and not as CEO.

4. No, the position of the CEO will not be filled by end of Q1 of 2017/2018 as the MDDA currently does not have a quorating Board. The recruitment process has commenced which will be approved by a quorating Board.

Reply:

The Interim Board has been directed to review the governance framework and the related policies, the effectiveness of controls and systems as well as the alignment of policies with the work of the SABC. The outcome thereof will inform the kind and extent of the interventions to implement the recommendations of the Ad Hoc Committee on the SABC Inquiry.

The appointment of a permanent Board with the requisite skills will also strengthen good corporate governance and compliance. The Board will be expected to report to the Minister on a quarterly basis on the progress thereof.

Reply:

1. 

(a), (b), (c), (d) and (e) MDDA supported projects only account for the grant funds allocated by the Agency in each financial year.

(i) and (ii) The MDDA conducted a sample survey in 2016 in order to assess advertising support by the various municipalities across the country. There are plans to extend this survey to monitor and evaluate government support to all MDDA supported projects.

(iii) (aa) The survey covered currently and previously funded MDDA projects and did not focus on any specific financial year in which  MDDA projects were funded.

(iii) (bb) The amount spent on advertising by municipalities during 2016 in community and small commercial media, as ascertained through the sample survey, is shown in the pie chart below.

105 broadcast projects and 49 small commercial projects were asked to participate by returning answered questionnaire to the MDDA. Only 39 projects returned the questionnaire. (22 broadcast and 17 small commercial). 115 projects did not return the questionnaire.

2. The MDDA liaises closely with the Broadcast Unit in the Department of Communications in order to avoid any double dipping and to enhance support for applicants who have submitted requests to both institutions. Currently, the MDDA has signed a Memorandum of Agreement with the Department of Communications for the allocation of R20 million from the SABC for the roll out of digital broadcast equipment to 13 community radio stations that have requested support from the department. The MDDA also works closely with the GCIS in order to lobby for adspend support for the sector. The MDDA has not yet directly engaged with other government departments but lobbies support through various platforms and outreach activities.

1. The report was forwarded to the Department of Telecommunications and Postal Services to implement the recommendations from the investigation.

2. The Universal Service and Access Agency of South Africa is implementing the recommendations accordingly.

Reply:

  1. The investigation into the procurement process for government sponsored Set Top Boxes was commissioned by the Department of Communications and not the National Treasury. The report on the investigation was shared with the Department of Telecommunications and Postal Services and the concerned party, Universal Service and Access Agency of South Africa (USAASA) for implementation. The intention was to receive an update from USAASA on the implementation of the recommendations and submit a comprehensive report to both the Portfolio Committee of Communications and of Telecommunications and Postal Services.
  2. We are not aware of excerpts from the report being published on the departmental website.

(a) Which of the three set-top box suppliers who received orders from the Universal Service and Access Agency of South Africa (USAASA) on 6 August 2015 is taking legal action against (i) USAASA and (ii) her department for the cancellation and cessation of the assembly process, (b) what are the terms of the legal action being taken and (c) what has been the response of (i) her department and (ii) USAASA to the legal action?

Reply:

a) The three service providers, namely Leratadima Marketing Solutions, CZ Electronics and Bua Africa have separately declared a dispute for arbitration. So far only Leratadima Marketing Solutions has filed its claim in the Arbitration Foundation of Southern Africa. USAASA has not yet received claims of the other two service providers.

b) Leratadima Marketing Solutions claim is in two parts. In the first part it seeks an order declaring that USAASA is liable to pay Leratadima Marketing Solutions for variation in the foreign exchange rate, which occurred during the subsistence of the Purchase Order which Leratadima was executing. The second part relates to what Leratadima says is a consequential loss which it has suffered as a result of suspension of production.

c) USAASA is not contractually liable to the service providers to pay for the variance in the exchange rate. Insofar as the claim for consequential loss is concerned, the Supply and Delivery Agreements with service providers stipulate that neither party shall be liable for the special or consequential damages suffered by the other party arising out of the Agreement howsoever arising.

Reply:

As I mentioned before “together with the SABC management we have resolved to delink the TV license requirement from the STB subsidy registration process”. No mention was made of a decision to waive the legal obligation of the television set owners to buy the required TV licence.

(1)  With reference to her reply to question 1965 on 30 September 2016, (a) what (i) is the current vacancy rate at the Media Development and Diversity Agency (MDDA) and (ii) positions are still vacant and (b) by what date will the specified vacancies be filled; (2) (a) how does the new organogram of the MDDA differ from previous organograms, (b) what impact does the new organogram have on the MDDA’s budget and (c) by what date will the new organogram be fully implemented?

Reply:

(1) (a)

(i) The vacancy rate has been decreasing steadily over the past two quarters of the financial year as a result of the focus being placed on appointing people to, in particular, critical posts. With the number of positions that have been filled from 1 January 2017, including that of Risk Specialist, Internal Audit Officer and Communications Officer, the vacancy rate is currently 35%.

(ii)  The vacant positions are Chief Executive Officer; Executive Secretary; Chief Financial Officer; Internal Audit Manager; HR Corporate Manager; Strategy, Monitoring and Evaluation Director; Project Director; Knowledge Management Coordinator; Research and Capacity Building Manager; Legal and Compliance Officer; Human Resources Officer; and Digital Media Coordinator.

  1. (b)

The MDDA had held off the appointment of executive positions, filling them in an acting capacity, to enable the incoming CEO to be part of the interview and appointment process. However, with the recent resignation of the newly appointed CEO, the priority is to fill key executive positions, to be followed by management positions and then junior staff. Candidates for the HR Corporate Manager have been interviewed and the MDDA is in the process of making an offer to the preferred candidate. The CEO position is expected to be filled by the end of the first quarter of 2017/2018 financial year.  The recruitment process for the other key executive, management and junior positions is currently underway with all positions to be filled by the end of quarter one of the 2017/2018 financial year.

2. (a)

The new organogram was drawn up to align it with capacity requirements of the MDDA strategy going forward and in response to challenges in the media industry, as well as meeting the need to reposition MDDA internally to become a knowledge-based organisation.  Executive positions, such as Strategy, Monitoring and Evaluation Director and functional positions, such as Digital Media Coordinator, have been included to meet this need.  

2. (b)

The two new positions, an additional Supply Chain Officer will assist with compliance, and the Travelling and Logistic Coordinator will assist with planning around travelling and managing stakeholder events and training sessions. This increased the personnel budget by R616 000.

                                                                                                

(2) (c) The new organogram will be fully implemented from 1 April 2017.

(a) Budget was R286 500.00

(b)(i) A proposal was submitted to the Research and Development unit according to the MDDA funding criteria and guidelines.

(b)(ii) The project proposal was submitted to the MDDA Board meeting held on 29 May 2013 for adjudication according to section 14(b) of the MDDA Act of 2002.

(c) Proposals are submitted according to the MDDA funding criteria and guidelines. Once the proposal has been received, the relevant unit prepares a submission for consideration and adjudication by the MDDA Board as provided in section 14 (b) of the MDDA Act of 2002. The Board makes the final decision to either approve or reject a project proposal.

(d) Name of the service provider is Chumani TS Networks.

(e) Total value of contract was R286 500.00.

(f) Total amount paid for work done is R143 250.00.

(2) The tender process was not followed on this occasion due the following reasons-:

  • Proposals are submitted according to the MDDA funding criteria and guidelines. Once the proposal has been received the relevant unit prepares a submission for consideration and adjudication by the MDDA Board as provided in section 14 (b) of the MDDA Act of 2002. The Board makes the final decision to either approve or reject a project proposal.
  • Based on the research proposal received, the amount is below the threshold for tender purposes as per PFMA and MDDA supply chain management policy.

With reference to the increase in available funding to support more projects as indicated in the Media Development and Diversity Agency’s (MDDA) 2015-16 annual report, how did the MDDA manage to achieve only (a) 24% in Programme 1.3 and (b) 43% in Programme 2 of its targets of disbursing funding during the specified period; (2) (a) what are the full details of (i) the 21 direct jobs created through the specified funding and (ii) where the direct jobs were created and (b) are the specified direct jobs all permanent positions; (3) (a) what are the full details of (i) the 155 indirect jobs created through the funding and (ii) where the indirect jobs were created through the funding and (b)(i) are the indirect jobs all permanent positions and (ii) by what method was it determined how indirect jobs were created?

Reply:

1. The increased availability of funds enable more projects to be approved but will not necessarily speed up the rate of disbursement, which is dependent on projects meeting compliance requirements for the release of funds. The disbursement of funds is directly related to the MDDA’s tranche release process which is a monitoring and control measure.

(a) The 24% disbursement of funds in Programme 1.3 reflects the accumulated amount of funds disbursed to all active projects over time; i.e. it is not limited to disbursement of funds to projects approved in 2015/2016. This slow disbursement of funds was due to the MDDA tranche release process and noncompliance in project reporting.

(b) The forty-three percent (43%) of funds reflected in Programme 2 were disbursed to community broadcast projects approved in 2015/2016. Projects are approved at quarterly Board meetings and therefore, due to the MDDA tranche process, projects do not receive the full amount approved in the year of approval.

(a)

  1. Direct jobs are those for which funding is approved as part of a grant approved for a project. These are critical anchor jobs that enable each project to be operational in order to generate income beyond grant funding. Such positions include station manager or publisher.
  2. The projects at which the direct jobs were created and the location of these projects are listed in the 2015/2016 Annual report from pages 52 -54 of the report.

(b) Yes, the direct jobs are permanent jobs. MDDA funding of these positions is for the duration of the grant.

  1. Indirect jobs are those positions created as a result of a project being approved, for example labourers who are employed during construction of broadcast studios or volunteers, such as volunteer reporters.
  2. The projects at which the indirect jobs were created and the location of these projects are listed in the 2015/2016 annual report from pages 52 -54 of the report.

(b)

  1. No, the indirect jobs are not permanent positions.
  2. The method used to arrive at the number of indirect jobs created is based on engagement with the broadcast equipment suppliers in terms of the workforce they hire to construct studies and an ongoing engagement with projects on the average number of volunteers per station.

(c) Yes, there were requirement that needed to be fulfilled by the service provider as per terms of reference:

  • Develop and implement an IT strategic plan in line with the agency’s business plan;
  • Develop, manage, monitor and report on IT risk processes;
  • Develop, implement and maintain a backup strategy;
  • Develop, implement and maintain an information disaster recovery plan;
  • Develop, implement, maintain and monitor IT policies, procedures or practices over all IT functions and activities;
  • Develop and implement a consistent and concise IT security policy including management over User Accounts;
  • Ensure maximum uptime availability of computer systems throughout the Agency;
  • Produce 6 service reports
  • Provide management support over the IT infrastructure services, including desktop applications, Local and Wide Area networks, IT security and the telecommunications infrastructure;
  • Develop and implement new systems in line with MDDA’s business plan;
  • With Management propose, agree and deliver IT services in accordance with agency priorities;
  • Initiates and implements improvements in all areas of IT responsibility;
  • Schedule backups of file servers and off -site storage for such backups;
  • Application software on file server;
  • Manage and control all system administration functions;
  • Print servers and printing devices; and
  • Manage and monitoring over IT assets within the agency.

(d) The value of the contract was R 259 153.92.

(2) From the monthly assessments of the service rendered the service provider was able to provide the services as per terms of reference but was not able to submit all service reports. All other tasks were completed apart from 4 out of 6 of the service reports were received. Quantitatively, 90% of the tasks were achieved and a handover report was prepared and presented to the newly appointed IT manager.

(a) Based on critical assessment of each project we have revised disbursement to three or two tranches, however on new projects that require monitoring it is four tranches.

(b) The MDDA increased on-site capacity building and support on reporting, this includes close monitoring of those projects that delay reporting, projects that are non-compliant are visited and given necessary support on issues such obtaining tax clearance certificates, holding Annual General Meetings and challenges with financial management and reporting.

The SABC is currently busy with the implementation of the performance management system to be implemented later in the year hence, no performance review on Mr Motsoeneng or any other employee of the SABC has been conducted. The quarterly review system is, however, done by individual line managers and in this case Mr Motsoeneng has not been in this (new) position for the period of 3 months.

SABC Current Affairs are operating normally and efficiently and there is no need for a review.

2. The disclosure of employee remuneration is against employee regulations. Further information about SABC employees’ remuneration may be obtained from the Annual Report which has been tabled in Parliament.

Reply:

1. There is no limit on the number of times funding is allocated to a small community print media project through the Media Development and Diversity Agency (MDDA). Funding is allocated after a detailed assessment has been conducted on the basic needs of the applicant and a situational analysis by the MDDA. Consideration is taken based on available budget in each financial year.

 a) There is no limit on the number of times funding is allocated to a small community print media project through the Media Development and Diversity Agency (MDDA). The current funding cycle is allocated to cover a period of 12 months, however the grant agreement is signed to cover 18 months in order to allow ample time for reporting, capacity building and compliance.

 b) Details are covered in the grant in aid agreement and a sample of an existing agreement can be made available on request. Funding is allocated in tranches to ensure compliance and monitoring.

 c) Projects that are recommended for additional support must have demonstrated good management practices and have complied with the previous grant agreement. Monitoring is an ongoing process taking place in various forms, including desktop and telephonic assessment, validation of reported information and site visits.

2.

a) Yes, the MDDA has in instances in the past five financial years allocated more funding to small community print media projects than what the applicants requested.

b) Yes, the MDDA has in instances since 1 April 2016 allocated more funding to small community print media projects than what the applicants requested.

  (i) The MDDA Board considers and approves additional support to that requested by the project based on an in depth assessment of the needs of the applicants, and taking consideration amongst others the socio economic challenges of the applicant.

(ii)

(aa) For Q1 and Q2 of 2016/2017, the MDDA did not allocate more funding to the small community print media projects than what the applicants requested. However, the Board approved increases to the recommended budgets submitted by the project team in the following cases: Seipone News, Ikhwezi News, Seipone Times, Glimpse Magazine, Disability Magazine, Amandla Magazine, and Lekunutu News. The Board approved these increased amounts based on needs assessment during adjudication.

(bb) The amounts (aaa) requested and (bbb) allocated and (iii) motivation for the variance in each case are provided in the table below.

1. (a) (i), (ii), (iii), (iv) and (v) The MDDA publishes advertising revenue generated by each small community print media project which is supported by the Media Development and Diversity Agency (MDDA) via the Milele Group and the Government Communication Information System (GCIS) in its annual report. These are available on request. The MDDA does not have direct access to detailed advertising income until it receives annual reports from media buyers and the GCIS. To provide a comprehensive breakdown per community print project requires a survey in order to give justice in responding to this question as we do not have readily available information within the specified time.

(b) Information on advertising revenue generated by each small community print media project which is supported by the MDDA via the Milele Group and the GCIS is consolidated on an annual basis for publication in the MDDA annual report. The MDDA does not have direct access to detailed advertising income until it receives annual report from media buyers and the GCIS. To provide a comprehensive breakdown on advertising revenue generated per community print project since 1 April 2016 requires a survey in order to give justice in responding to this question as we do not have readily available information within the specified time.

2. (a) Yes, the MDDA has succession plans in place to assist small community print media projects in mitigating instabilities affecting the delivery of planned targets, via established partnerships to capacitate the print sector on content development. These partnerships include arrangements with Soul City, AIP, SAASTA and SEDA, ongoing engagement with the Big4, ongoing engagement with the GCIS on media buying and planned engagement with SALGA and all state organs on media buying.

(a) NexTV CEO Africa 2016, was an exclusive event that brought together the Anglophone and Francophone markets of Sub Saharan Africa to discuss strategic ventures, regulatory issues and will be a fantastic accelerator for business and for lobby in the broadcasting industry going forward. Minister Faith Muthambi was invited to participate and give a keynote address at the opening session of the two-day summit, where she addressed delegates on the digital television revolution in Africa.

Reply:

(a) The SABC monitors television audiences in terms of monthly audience share.

(b) Advertising revenues are presented excluding Agency Commission, Credit Notes, and Compensation. The revenues received by the organisation fluctuate according to seasonality and available spend by advertisers.

What were the monthly (a) listenership and (b) advertising revenue figures for each SA Broadcasting Corporation radio station since 12 May 2016?

Reply:

(a) Radio audiences are measured quarterly and not monthly. There was a significant change in radio audience research methodology during the period in question (from previous SAARF RAMS to BRC RAM) and the findings are thus not comparable. The following graphic was derived from the first BRC RAM research released in August 2016.

 

(b) Advertising revenues are presented excluding Agency Commission, Credit Notes, and Compensation. The revenues received by the organisation fluctuate according to available spend by advertisers.
