I have been advised by the Department as follows: 

1). (a) Yes, Independent Communications Authority of South Africa (the Authority) has moved its Head Office to new premises situated in Eco-park (Centurion) Pretoria, after its lease agreement with Growth-Point Properties (Sandton) came to an end on 31 October 2018. Prior to the move, the Authority embarked on an open tender process in line with Public Finance Management Act No. 1 of 1999 as amended (the PFMA), the associated National Treasury Regulations (NT Regulations) and ICASAs Supply Chain Management Policy in order to appoint a provider for its head office premises.

(b). A lease agreement has been entered into with the new landlord to provide ICASA with office accommodation for a period of 9 years and 11 months with effect from 1 November 2018.

(2)The Authority is governed by the Public Finance Management Act No. 1 of 1999 as amended (the PFMA), and the associated National Treasury Regulations (NT Regulations). To this end (as stated above), the Authority embarked on an open tender process in line with the PFMA, the NT Regulations and ICASA’s Supply Chain Management Policy to procure the new office premises.

(3)The new premises have sufficient storage capacity for office equipment and documents.

(4)The Authority is a participant of National Treasury Traversal Contract – Transportation of Cargo and Furniture Relocation Services for the State for the period 1 April 2017 to 31 March 2020 (RT8-2017). Services for the relocation of furniture, boxes and other items were procured utilizing the traversal contract. This is in line with the PFMA, the NT Regulations and ICASA’s Supply Chain Management Policy.

(5) Given the amount of work required to complete the relocation process, it was necessary for some members of staff of work overt-time to successfully complete the relocation. The staff members who qualify for overtime were paid for the overtime worked in line with the organisation’s policies. For those staff members who do not qualify for overtime pay,

arrangements were made with respective line managers to get time off in exchange for overtime worked. There are no staff members who were required to assist with the relocation at their own cost.

a) Gazette No 3600 of 14 December 2012, Digital Migration Regulations, Paragraph 3 (1) states that “the date for the commencement of dual illumination period as well as the date for the final switch-off of the analogue signal will be published by the Minister in the Gazette”. The Minister is yet to set the deadline based on the revised delivery model and plan.

b) The Department has revised the delivery model which has since been approved by Cabinet. Although Cabinet has approved July 2020 as the date for analogue switch off, the Minister will monitor progress and after consultation with the Cabinet, gazette the date based on the progress made.

In line with the digital migration regulations, Minister will announce final switch off of the analogue signal in the Gazette.

What measures has the SA Broadcasting Corporation put in place to be responsive to the needs of the (a) deaf and (b) blind community?

Reply:

I have been advised by the department as follows: 

The SABC has ensured reasonable accommodation of deaf and blind employees. For deaf employees the SABC arranges interpreters during meetings and employee communication sessions. Sign language training is also provided to employees.

For blind employees the SABC has installed special software on their personal computers that translates written information into audio.

To cater for this target audience, SABC broadcasts a tailor-made programme aimed at the deaf community in the form of “Deaf TV”. This is a weekly show that broadcast on Saturdays. This programme is currently on repeat, due to the production company not wanting to continue with any further seasons. A new RFP for another programme to broadcast on SABC 2 has been released and will be for the deaf and blind communities. Daily Thetha, on SABC 1 also has sign language.

SABC News also accommodates viewers with hearing impairments by providing on-screen sign language interpretation on a number of News Bulletins in Prime Time.

The wall- to-wall subtitling is covered on the following local content genres on all channels:

  • Children’s
  • Local Dramas, Sitcoms and Soaps - All the local prime time soaps have wall to wall subtitling
  • Most Local Documentaries
  • Most Educational programming
  • A selection of Entertainment and Religious programming (including daily devotions)

I have been advised by the Department as follows: 

a) The SABC will be broadcasting the T20, 32 matches on SABC 3 between 16 November 2018 and 16 December 2018 with day games starting at 13:00 and evening games starting at 19:00. The T20 is a limited over series thus SABC will provide its mandated content. SABC and Cricket South Africa will be issuing the broadcast and game schedule during the week of 5 November 2018.

b) The SABC is not responsible for the technical aspects of the T20, but will make its services available at a cost to any entity who chooses to hire SABC equipment. It must be noted that the SABC broadcasts in-bound cricket and football matches which share similar technical requirements.

c) The SABC had no cash outlay for the season. The SABC will provide Cricket South Africa with promotional support for the T20 using its reach, platforms and available inventory.

1. The Authority introduced amendments to the End User Subscriber Charter Regulations during 2018 in order to address the concerns regarding unfair data expiry and Out of Bundle business rules.

2. No, (a, b, c and d) the implementation of the Regulations were taken for review (launched in April 2018) by some of the operators. This was settled on13 November 2018, to the extent that the Regulations will come into force with effect from 28 February 2019.

                                                                                                                                                                                                                                                          i) Group Chief Executive Officer - R7, 2 million if you take into consideration payment in lieu of the premature termination of the contract of employment.

ii) Chief Operations Officer – R15, 4 million (R 3, 9 million if you exclude the R11 million bonus pay out).

iii) Chief Financial Officer - R4, 1 million.

(a) (ii) The annual remuneration packages for each of the current Executive Directors of the SABC are as follows:

  • Group Chief Executive Officer - R 5,133,378
  • Chief Operations Officer – R 4,035,732
  • Chief Financial Officer – R 3,000,000

These packages are significantly lower than those of the previous Executive Directors and amount to 1.1% of the current salary bill.

(1) (b) (i) & (ii) The overall annual remuneration and benefits of the current SABC’s 10 Group Executive amounts to R24, 7 million. On average a Group Executive’s remuneration package is R2, 474,636.00 per annum. Previous Group Executive’s remuneration is contained in the SABC’s FY2017/18 Annual Report.

SABC has an extensive sound and audio visual archive of material which is available to the public and is in the process of being digitized so as to ensure its continued existence and accessibility.

Members of the public can buy material that the SABC owns rights to from the SABC local sales department. Additionally that content is also available to film/programme makers and other broadcasters to license for re-transmission.

A) Disciplinary Action Taken

From October 2017 to 30 September 2018 the SABC has instituted 65 Disciplinary cases against employees at all levels within the corporation. The charges in these Disciplinary cases ranged from dishonesty, negligence, contravention of rules and policies, gross negligence, non-compliance, dereliction of duties, etc. 8 Permanent and 27 Non-permanent employees have been dismissed after having been found guilty of the charges laid against them. Other outcomes consisted of verbal warning, written warnings and final written warnings.

B) Criminal Action Taken

Certain cases are currently under investigation by the SIU. The SABC is dependent on the guidance and advice of the SIU in these cases for example former CFO and former COO.

Criminal charges were laid against:

  • A case of fraud has been laid against an ex-employee as per SIU
  • 52 ex-employees dismissed for Medical aid fraud. The charges were laid by SABC Medscheme.
  • These criminal cases are still ongoing.

What (a) is the nature of complaint GAU2882/18 lodged with the Independent Communications Authority of South Africa and (b) steps has her department taken to (i) address the specified complaint and (ii) provide feedback to the complainant?

(a) ICASA received a complaint from Mr. Kobus van Zyl (the complainant) on 06 August 2018 wherein he mentioned that he has a fault complaint against Telkom. He indicated that his Telkom line had fault and was reported to MWEB on the 26 July 2018 and ref number MWB8173751 was allocated to his complaint. The relief sought by the complainant was to have a stable ADSL connection and that there must be no noise on the ADSL line.

(b) The complaint was acknowledged and escalated to Telkom for a response on 07 August 2018 in line with the End-User and Subscriber Service Charter Regulations of April 2016 (Regulations No.39898 of 2016). The complaint was allocated ref number GAU2882/18. Telkom was reminded of the pending matter on several occasions.

i) ICASA received a response from Telkom on the 11 September 2018 which was provided to the complainant on 12 September 2018. Telkom’s response confirmed the following:

  • that the fault was cleared and the line is repaired;
  • that the complainant confirmed that the line has been repaired;
  • that the credit amount of R175.72 has been arranged; and
  • that the complainant was advised of the outcome of his complaint.                                                                                                                       ii)  ICASA received a response from the complainant on 12 September 2018, acknowledging the resolution of his complaint.
  • ICASA is in the process of investigating Telkom’s non-compliance to the requirements of section 12 of the End-User and Subscriber Service Charter Regulations.
  • Mr Van Zyl will be appraised of the outcome of ICASA’s investigation and possible way-forward.

3(a) How many rights were actually broadcast

    • 2014-15: From a total of 77 sports rights, 76 were broadcast;
    • 2015-16: From a total of 94 sports rights, 84 were broadcast;
    • 2016-17: From a total of 85 sports rights, 80 were broadcast;
    • 2017-18: From a total of 51 sports rights, 50 were broadcast.

(b) These sports events were broadcast by the SABC throughout each of the financial years 2014-15; 2015-16; 2016-17; and 2017-18, depending on the season of each event and specific event schedule. For example, PSL Matches, Nedbank NFD Matches, MTN8, Telkom Knockout were broadcast during the period from 1 April 2014 to 31 March 2015; the 2015 IRB Rugby World Cup – England was broadcast during the period from 18 September to 31 October 2015 and the FIFA U-20 World Cup – New Zealand was broadcast during the period 30 May – 20 June 2015.

Reply:

(i) In the in the 2013/2014 financial year the GCIS printed 702 photographs of members of the Executive were printed, in 2014/2015: 2978 were printed, 2015/2016: 900 were printed, 2016/2017 220 were printed and: 2017/2018

financial year 1719 photographs were printed.

(ii) In current financial year, 1 719 photographs of members of the executive have been printed.

a) (i) In the in the 2013/2014 financial year the GCIS spent R 28 080, 00 on the printing

of photographs of members of the Executive, in 2014/2015: R134 010,00 was spent, 2015/2016: R 45 000,00, 2016/2017: R13 200,00 and 2017/2018 financial year R103 400,00 was spent. In the current financial year, the GCIS has spent R35 797, 00 on the printing of photographs of members of the executive.

(ii) In the past five financial years GCIS has spent no money on the framing of members of the Executive, these costs are incurred by the departments to whom the photographs are supplied. In the current financial year the GCIS has spent R 5 402, 00 for the framing of photographs displayed in its own offices.

(iii) No costs for transportation of photographs have been incurred as clients have been required to collect photographs.

(iv) No cost for the installation of official photographs have been incurred as clients

are required to do the installations themselves. Those installed at GCIS offices were done by GCIS officials.

Whether any meetings were held with the International Telecommunications Union (ITU) prior to the announcement of the analogue signal switch-off date in June 2019; if so, what are the relevant details of the (a) meetings, (b) discussions at each specified meeting, (c) date on which the switch-off date was communicated to her department by the ITU and (d) requirements to meet the specified deadline?

Reply:

No, there were never any meetings with the ITU on the June 2019 switch-off date. ITU resolutions are communicated through World Radio Conferences held every four years or through specific Circulars sent by the ITU.

The ITU mandated analogue transition date was June 2015, which has since passed. Beyond this date, the ITU no longer provides protection for analogue services in the affected spectrum bands. Beyond June 2015, it is up to the neighboring member states to negotiate mutual terms to avoid causing interference with each other. The ITU can merely be informed for the record on the progress made regarding analogue switch off in the affected member states.

South Africa has set June 2019 analogue switch off target, it is not an ITU directive.

1. GCIS has a SCM Policy

GCIS has an approved supply chain management procurement policy that governs all procurement that is handled within the department. All procurement, be it advertising, communication, consultancy, business and advisory services are handled through this policy with is aligned with the Treasury Regulations on Supply Chain Management.

(2) GCIS does not keep records of the media related expenditures of national government department and SOE’s. GCIS can only provide records for its own expenditure and for those government departments and state owned entities that utilise the GCIS media buying service.

With reference to the reply to question 1958 on 16 October 2017, (a) which trade exchanges are currently in dispute, (b) what amounts are associated with each trade exchange and (c) which trade exchanges are currently before the courts?

Reply:

a) Currently there are no trade exchanges before the courts, but there exists a dispute which is not before the courts yet.

The background briefly:

The South African Broadcasting Corporation SOC Limited (“SABC”) through Metro FM concluded a Trade Exchange Agreement (“Agreement”) with RBA Developments JHB (Proprietary) Limited (“RBA”) for the exchange of value added services set out in Annexure “A” and Schedules II, III and IV of the Agreement. The salient terms of the Agreement are as follows:

  • The Agreement commenced on 08 August 2016;
  • The Agreement will terminate on 08 October 2016;
  • The parties to the Agreement are the SABC and RBA;
  • In terms of the Agreement the parties would perform the obligations set out in Annexure “A” including the deliverables set out in the trade exchange items schedule. A copy of the Agreement is attached herewith and marked as “Annexure A”.

b) The trade exchange value is R3 450 749.68 including VAT.

In terms of the Agreement, the parties agreed to jointly work together in delivering a fully furnished house as a prize giveaway pursuant to a competition to be run by Metro FM for its listeners. To this end each of the parties undertook to perform certain obligations to ensure the successful implementation of the competition and delivery of the house to the competition winner. The dispute is therefore that RBA was liquidated and MSP, which took over and agreed to step in and assist in completing the house and handing it over to the completion winner is now reneging on its initial undertaking.  This has resulted in the house not having been handed over to the competition winner despite that the house was long completed.

Metro FM has received a demand from Legal Wise representing the competition winner claiming a handover of the house to the winner.

c) Save for the demand from Legal wise, no court pleadings have been served on the SABC yet. We are still in the process of engaging with MSP to try and resolve the matter amicably by handing over the house to the competition winner.

(1) (a) Why was the Northern Cape chosen for the Digital Terrestrial Television (DTT) migration roll-out and (b) what is the progress in this regard;(2) what are the major challenges that her department faces with regard to the DDT roll-out in the (a) country and (b) Northern Cape; (3) what number of set-top boxes (a) have been installed and (b) must still be installed in each province; (4) how far is her department behind schedule with the DTT migration roll-out; (5) how does the Government intend to support content development for the digital space created by digital migration and the roll-out of DTT?

Reply:

1. (a) The Northern Cape hosts part of the international Square Kilometre Array (SKA), which is an international radio telescope project undertaken in collaboration with other countries including the UK and Australia. Analogue television transmissions produce high levels of interference and as such they have to be switched off and replaced with digital television transmissions via satellite.

(b) To date, all qualifying households in the core towns within a Square Kilometre Array (SKA) have been connected to the digital platform. Subsequent to the installations of devices to all households’ in the core towns of the SKA; including Carnarvon, Vanwyksvlei, Brandvlei, Williston and Vorsburg; analogue transmission services have since been switched off. However, analogue transmission services could not be switched in other areas of the SKA due to households that do not qualify for government subsidised decoders.

2. (a) The major challenges relates to the lack of resources mainly funding.

(b) Majority of the areas in the Northern Cape are covered by Satellite network and currently, there is no stock to distribute to the qualifying registered households.

4. The department has not met the target in terms of

(a) the migration of five million qualifying households to receive government subsidised decoders;

(b) the migration of the majority of unsubscribed citizen who rely on the retail market to acquire migration devices

5. The Department is a policy maker and does not implement programmes on the ground. The department will ensure collaboration with relevant stakeholders such as the SABC and the industry to advocate for content development to feed the channels to be made available by digital migration. In 2018/19 the Department will develop a South African Audio-Visual content strategy to support the digital migration.

(1) With reference to the reply to question 1458 on 16 October 2017 and the fact that the full amount has not been provided to the Portfolio Committee on Communications, what total amount has been paid by the SA Broadcasting Corporation (SABC) for all litigation involving a certain person (name furnished) since the 2013-14 financial year; (2) whether the SABC intends to recover these monies from the specified person; if not, why not; if so, what are the (a) relevant details and (b) time lines in this regard? Reply:

1. The SABC records pertaining to the total amount paid by the SABC for all litigation involving the former COO from 2013/14 financial year to date are detailed in the spreadsheet attached hereto as annexure1. The total cost of the invoice might increase as other matters are ongoing.

2. All litigation matters involving the former COO are subject to investigation by the Special Investigation Unit (SIU). The SIU will determine whether or not to pursue the individual concerned for the recovery of any monies in this regard, as well as the timelines for this exercise.
