Julius, Mr J to ask the Minister of Agriculture, Land Reform and Rural Development
Whether the Westonaria Agri-park in the Rand West City Local Municipality is operational and functional; if not, (a) why not and (b) what plans has her department put in place in order for the agri-park to be operational and functional; if so, (i) who are the beneficiaries and (ii) how did the beneficiaries benefit since the inception of the agri-park?
Reply:
THE MINISTER OF AGRICULTURE, LAND REFORM AND RURAL DEVELOPMENT:
Yes. In addition, the Department of Agriculture, Land Reform and Rural Development (DALRRD) has developed a detailed implementation plan for the Farmer Production Support Unit (FPSU) to be implemented by 31 March 2021 in order to further strengthen the services currently delivered from the FPSU. The plan is to provide additional production tunnels; upgrade the packhouse; and construct a new storage facility; security lighting; water reservoir and reticulation services; accommodation for FPSU Manager; mechanics workshop for local repairs and maintenance; and a shed for machinery and implements. The Gauteng Provincial Department of Agriculture and Rural Development (GDARD) will also deploy crop and soil scientists.
(a),(b) Falls Away.
(i) 87 farmers in a 20km radius have been profiled to make use of the facility. In addition, four cooperatives are currently active in the FPSU. The Voice-Out-Deaf and Boo-Letsholo Cooperatives have been operating from the site for approximately two-years, whereas the Seeds of Change Cooperative (occupying a 6000 m² shade net structure) and City Harvest Cooperative occupying the Vertical Chamber farming structure have both taken occupation of the facility during October 2019 after an open tender process was concluded. The Voice-Out-Deaf harvest kale, lettuce and spinach. This group also won the Provincial and National Female Farmer Award on the category of disabled people in agriculture. Boo-Letsholo plant only spinach.
(ii) Several farmers have benefitted from bringing their produce for storage in the FPSU packhouse prior to sending the produce to the market. Veterinary and Extension Support Services are also available to all farmers in the FPSU catchment area. Mechanisation support is available to farmers, the tractors and implements are currently stored off site at a municipal facility, pending the completion of the warehouse. A farmer training facility is available at the FPSU.

What (a)(i) challenges and (ii) lessons have been learned from the implementation of the One Household One Hectare Programme, (b) number of households participated in the programme in each province and (c) amount has been spent on the programme in each province in each year since the inception of the specified programme?
Reply:
a) The Department has completed the analysis of the Impact Evaluation Report and the following challenges and lessons were identified
(i) Challenges
- Respondents alleged that government does not conduct proper consultation;
- Unrealistic production plans;
- Generational gaps and lack of youth participation;
- Changing the nature of implementation models by the Department;
- Delays by the Department and appointed stakeholders;
- Lack of commitment from some household members;
- Insufficient funding/lack of stipend/salary;
- Lack of proper project site monitoring.
(ii) Lessons
- Going forward it will be necessary for the Department to develop an implementation plan which is shared with stakeholders prior to development, approval and implementation of new programmes to ensure critical support and ownership;
- The Department should ensure that beneficiaries’ representatives sign off the production plans following community meetings where these plans are presented for approval;
- It is the prerogative of each household to nominate who shall represent it, and the experience has been that elderly people are the ones who usually step forward. This does not mean that youth are not involved; youth who are interested will be involved through their households;
- Since most sites are existing and have been previously operational, production plans were based on the immediate needs of the beneficiaries.
- For the Department to speed up approval of quotations and payments and fast-track the supply of equipment and implements for beneficiaries, it requires the cooperation of all role-players, i.e. beneficiaries, site managers, accountants, suppliers. Continuous and open communication at all times amongst role-players is critical.
- Not all beneficiaries have shown lack of commitment or requested the payment of stipends – most have appreciated the support that government has provided in terms of production inputs, implements and mechanisation;
- The Department will have to strengthen its monitoring endeavours, which are through District Offices closer to clients.

Reply:
The Bakgatla-Ba-Kgafela Communal Property Association is registered in accordance with section 8(2) of the Communal Property Associations Act, 1996. Following the Constitutional Court judgement that ordered the Department to register Bakgatla-Ba-Kgafela as a permanent Communal Property Association, it was registered as such and allocated registration number CPA/07/1032/A. Please refer to the attached registration certificate.

(1) What measures will her department take to help speed up drought relief funding to the farmers of the Northern Cape while they are waiting for the proclamation of the provincial disaster area to be gazzetted in view of the fact that farmers are currently so indebted that they cannot secure loans to buy feed resulting in farm workers being at risk of losing their jobs?
Reply:
a) The Department of Agriculture, Land Reform and Rural Development (DALRRD) has together with the Provincial Department of Agriculture in the Northern Cape reprioritized Casp budgets and set aside R30 million for provision of fodder for affected farmers as well as expansion of existing fodder production initiative of the province which include the planting of hay and lucerne by farmers along the Orange River. The boreholes have been drilled and equipped for water reticulation.
The Department has also collaborated with the National Disaster Management Centre (NDMC) to expedite the process of classifying and declaring a state of Provincial Drought Disaster to assist farmers to better negotiate for leniency with their financiers. The team led by the NDMC is currently conducting the verification exercise in the Province to ensure that Disaster Management Act is complied with. Following this verification, the NDMC will classify a provincial state of drought disaster.

An export protocol is located at the end stage of a continuum of activities aimed at securing market access. An export protocol can only be concluded once the trade negotiations are finalised. At any given stage there are trade negotiations with trading partners and these are invariably at different stages of advancement within the market access continuum. Some market access requests for some commodities are at questionnaire (initial) stage, others are at health certification (final) stage. However, there are requests where negotiations have stalled. Trade negotiations on sanitary and phytosanitary matters do not unfold in a straight-line trajectory as there is consistent exchange of notes on scientific and technical facets. Moreover, any projected or assumed pathway or timeframe may be impeded, interrupted or curtailed by a range of factors. The table provided responds to questions 1 (a) (b) (c).
The dates given in this response are dependent vary depending on the complexity of the matter, and therefore the time it takes for the importing country to complete its risk analysis processes. For example the request to export beef to the USA had been going through a “Rule Making Process” of the USA for almost 10 years and was not even concluded when South Africa reported its 2011 Foot and Mouth Disease outbreak in KZN; following this South Africa was told to start the process from beginning.
With negotiations, the department sends a reminder shortly after the initial communication, if there is no response from the trade partner. If after one (or two) reminders there is still no response, the file is closed unless there is an indication of interest from the local industry.

a) Letters seeking clarity on the wool exports and the health attestation were forwarded to the People’s Republic of China’s (PRC’s) General Administration of Customs of China by the department on the 12th of August 2019 and 19th of August 2019. A response to the letters was received through the South African Embassy in Beijing on the 22nd of August 2019. The interpretation of the response letter by the Embassy outlined that the Chinese government had replied with two main options for the South African government. The one option was to continue with the certificate as agreed upon before Announcement 122 of 23 July 2019. The second option was to propose a new health certificate. Pursuing the second option of proposing a new health certificate would have resulted in the suspension of trade on wool to PRC for the period of negotiation. The first option was the preferred option.
b) The situation is resolved. The industry has also accepted the option of South Africa continuing to certify according to the requirements as agreed before Announcement 122 of 23 July 2019. This option guarantees the clearing of the backlog created by the suspension of export of wool to China. However, the department, in line with Announcement 122 of 23 July 2019 is committed to continue engaging with the PRC on a new draft of the health certificate during a period where there would be minimal impact on wool exports to the PRC. The wool industry has affirmed this position and has requested that should discussions with the PRC commence, the industry should be consulted.
c) The Department held a meeting with representatives of Cape Wools and two wool buyer companies on the 15th of August 2019 to understand the challenges faced by industry. Subsequent to this meeting, a follow-up letter was forwarded to the PRC on the 9th August 2019. The Department also telephonically engaged the industry during the period when the response from the PRC was awaited. Upon receipt of a response from the PRC on 22nd August 2019, the industry was immediately informed telephonically and through an email. An official letter to this effect was also sent to the industry on 23rd August 2019. In its reply, the industry indicated that the existing health certificate will be utilized to address the backlog of wool exports in the stores.

What are the details of the institutional basis established by the formation of her department for a comprehensive approach to the economic development of the country’s rural areas, especially relating to the removal of constraints in accessing land, as declared by the President of the Republic, Mr M C Ramaphosa, on 26 June 2019?

THE MINISTER OF AGRICULTURE, LAND REFORM AND RURAL DEVELOPMENT:
The President in the State of the Nation address indicated that government will immediately release State land for agricultural and human settlement in order to make a contribution towards acceleration of land reform to address the inequality in terms of ownership and use. Similarly, the President highlighted the need to urgently address issues of economy. As a strategic intervention on the delivery model, the President has indicated that government will adopt a district approach.
Land release
The departments of Agriculture, Land Reform and Rural Development together with other departments have identified state land that is suitable for agriculture and human settlement. Such identification has taken into consideration who is the holder of the land in question amongst the various spheres of government. Secondly such profiling will indicate the appropriate use of such land and its potential and whether such land is encumbered or not. Thereafter necessary processes of State land disposal will take effect.
Public works has identifies about 100 parcels of land where Restitution of land will be a beneficiary given that some of these properties are areas where communities were forcibly removed in the past.
Agricultural land therefore will enable those communities to engage in agricultural activities and government will give necessary support through its programs such as CASP, Letsema and Land care. A range of farmer support services will be provided for some from provincial departments of agriculture.
The combination of the two departments and the alignment of their programs will go a long way in creating viable farmer support to farmers. Building on the Agriparks, the department will focus on 27 Farmer Production Support Units (FPSUs) which are like service centres to support farmers with mechanisation, extension, market information, production inputs such as seeds and vaccines.
Honourable member, these FPSUs are located in the districts consistent with the President’s statement. Key to the functionality of the FPSUs will be the mobilisation of farmers to ensure that production is activated. The second phase will be the construction of production hubs such as storage facilities, pack houses as well as mini processing plants. However, this will be guided by the commodities that will be produced in those localities.
The department will engage municipalities and districts to activate farmers markets so as to create a value chain pipeline in the various localities. It is our view that these interventions by our department will make a contribution towards the development of economic activities in our communities especially in rural economies.

Animal welfare in South Africa, except for performing animals, is administered under the Animal Protection Act, 1962 (Act No.71 of 1962). The Department of Agriculture, Land Reform and Rural Development has not considered drafting a separate legislation relating to companion animals.

DAFF added the wildlife species to the list of Game animals regulated to under Animal Improvement Act, 1998 (Act No. 62 of 1998) for game farming production. The species were then declared in the government gazette dated 17 May 2019. Industry is registered in terms of the Animal Improvement Act, Act 62 of 1998 to represent game breeders societies to ensure genetic purity and sustainable utilization; do research on feeding and nutrition; define and measure traits of economic importance; and study regulatory gaps on game for food production.
(b) The DAFF did not conduct public consultation on the declaration of these animals.
(c) No research was undertaken by scientists in planning to have the game animals
declared in terms Animal Improvement Act, 1998 (Act 62 of 1998). These animals are landraces (endemic) to South Africa, hence the declaration of landrace (a kind of animal indigenous to or developed in the Republic). However, research will be executed on the species based on research questions in areas such as genetic purity, feeding and nutrition.
2. The Animal Improvement Act, Act 62 of 1998, provides for improvement of genetically superior animals to increase production and performance. This act is progressive, and can therefore not be implemented to the detriment of animal (biological) genetic resources. Declaration of the animals is aimed at ensuring that these landraces are conserved. It is also important to indicate that, due to changing farming systems in South Africa, game animals are included as these are already part of farm animal production systems in the country.

The former Department of Rural Development and Land Reform established at national level, has sub-programme called Rural Disaster Mitigation Services which is aimed at coordinating departmental disaster management related functions in compliance with the Disaster Management Framework of 2005. As a result, the Department allocates within its budget, funds for capacity building and disaster risk reduction that are implemented annually. The sub-programme is allocated a total amount of R15.4 million.
During unforeseen disaster events, the Department, upon declaration of a disaster reprioritization or funding within existing budget for relief efforts in consultation with relevant stakeholders is made to cater for the disaster.

AGRICULTURE
1(a) Cabinet invoked Section 100 (1) of the Constitution of South Africa on the Provincial Administration of the North West Province in May 2019. President Ramaphosa then established an Inter-Ministerial Task Team (IMTT), chaired by Minister Nkosazana Dlamini-Zuma, to address matters relating to the administration in North West. The IMTT was supported by the Technical Task Team (TTT) comprising of Directors-General (DGs). The TTT recommended that a forensic audit and investigation be conducted into the appointment and operations of Agridelight, which was an implementing agent for North West Department of Rural, Environment and Agricultural Development (READ) projects.
The Department of Agriculture, Forestry and Fisheries (DAFF) engaged the National Treasury (NT) in September 2018 to conduct a forensic audit on the indicators of possible fraud, financial irregularity, financial mismanagement and corruption relating to the appointment of Agridelight. This audit and investigation had to delve into subsequent operations and activities of projects funded through Comprehensive Agricultural Support Programme (CASP) in READ. The National Treasury began with the forensic audit and investigation in November 2018.
To date, satisfactory progress has been made on this forensic audit and investigation. The DAFF Audit Committee was briefed on the progress made relating to the process. The National Treasury will conclude its work in due course.
(b) This is the only forensic audit and investigation that is currently being conducted by the DAFF and the reason are outlined above.
2. All matters related to this forensic audit and investigation will be dealt with in terms of decisions by Cabinet which invoked Section 100 (1) of the Constitution of South Africa relating to Provincial administration of the North West Province.
RURAL DEVELOPMENT AND LAND REFORM
(1) (a) There are 43 allegations scheduled for investigation on the rolling annual case management register. In addition, the Special Investigating Unit (SIU) was authorised to conduct investigations in terms of the following Presidential Proclamations:
Proclamation No. R. 53 of 2012 for Restitution matters;
Proclamation No. R. 7 of 2014 for State Information Technology Agency;
Proclamation No. R. 599 of 2015, and amendment to Proclamation No. R. 7 of 2014, to include Deeds matters; and
Proclamation No. R.24 of 27 for land reform matters.
(b) The Department has a duty to investigate allegations of irregularities, including fraud, corruption, financial mismanagement, financial irregularities and mismanagement, amongst others. The allegations investigated were received from the Anti-Corruption Hotline managed by the Office of the Public Service Commission, management, whistle-blowers, officials of the department and members of the public. Alleged offences based on these reports include amongst others fraud, corruption, financial mismanagement and maladministration. The investigations conducted by the SIU are carried out in terms of Proclamations by the President as provided in the Special Investigating Units and Special Tribunals Act No 74 of 1996.
2. The investigation reports of the Department are confidential and are generally not shared with the public; however requests for access to the reports may be made in terms of the applicable law, namely the Promotion of Access to Information Act 2 of 2000.

b) Currently the earliest (long serving) case dates back to 1998. It becomes difficult to state how long a case can stay at the Land Claims Court solely because a litigant sues the department or Commission based on a decision taken by a Commissioner. Once that decision is reviewed/ set aside or corrected, for example, in acceptance/ gazetting of a claim, such a litigant will then compel referral of the claim to the Land Claims Court under the same case number as the initial case, then there might be other interlocutory applications on the same case requiring a number of various actions or directives to be issued by the judge or bring certain things to be done e.g Research / Mapping or valuation of lease rights.
c) The total number of the Land Claims Court Judges known to the Commission is (Four) being:

Since 1994, neither the Department nor its entities have conducted a study into the possibility of procuring 100% of food consumed locally.
There was no compelling reason for undertaking such a study. However, the Department undertakes studies on food security levels, agricultural production trends, and agricultural trade patterns. In circumstances where there is comparative disadvantage and domestic consumption exceeds production such as in the case of wheat, the country imports the balance.

Reply:
(1) (a) The close out report on all contracts undertaken by Agridelight Training and Consulting has not yet been furnished by the company. This was despite several requests from the Department to the Implementing Agent. In a bid to resolve this matter, the Department is in a litigation process with the Agridelight to source this document. The matter is before the Court and in line with the directives on Section 100 Intervention.
The total amount of all transactions between the Department and Agridelight Training and Consulting contract from 01 November 2014 to 31 October 2017 is R604 048 828.18 as per the financial systems report. The figure includes 10% Management Fee for Agridelight.
(2) Bahwaduba and Tlhabologang Abattoir projects have not yet been completed. This is due to the fact that, upon expiry of the Agridelight Project, the Department attempted to appoint the service provider who was appointed by the Agridelight to complete the project. However, the service provider in question was not, and is still not compliant to the CIDB grading requirement (expired CIDB Grading Level to low) for the value of the project that he was being appointed for. Furthermore, the service provider’s tax compliance matters were not and are still not in order as prescribed by the Treasury Regulations.

(2)(a)(b) Section 11(1) of the Restitution of Land Rights Act requires the Commission to publish in the gazette all land claims that are deemed compliant with Section 2 of the Act. To not publish claims that are deemed compliant with the Act will constitute non-compliance with the Act. The Commission has not conducted any scientific studies to determine the impact of the gazetting of claims on affected properties. However, even if such studies were to confirm a negative impact of gazetting of land claims on property values, such impact would not be reason enough for the Commission not to execute the legislative imperative as imposed by Section 2 of the Restitution of Land Rights Act.
(3) (a) Section 11A of the Restitution of Land Rights Act provides for Withdrawal or Amendment of a gazette notice ONLY where either a party affected by the publication, typically a land owner, makes representations to the Commission with information conclusive to the Commission that the claim is non-compliant or the Commission, through detailed investigation, finds information that indicates that the claim is non-compliant.
Since the decision to withdraw a gazette notice is tantamount to the dismissal of the claim, the Commission follows a 2 stage process which is in line with the provisions of administrative justice towards claim dismissal.
In the first stage, the Commission provides the claimant with the notice or letter of an intention to dismiss the claim where after the claimant is provided with a minimum of 30 days to provide the Commission with conclusive reasons and or additional information that may convince the Commission not to dismiss the claim.
The 2nd stage consists of the issuing of the final dismissal letter where the notice period lapses without the claimant providing convincing additional information or where the information so provided is not convincing.
In all instances affected land owners are made aware when land claims are dismissed or when land claimants opt for other forms of settlement such as financial compensation.
(b) The Commission does not gazette invalid claims.

1. A number of organs of state in the three spheres of government (national, provincial and local) are constitutionally empowered to hold land for service delivery objectives. To the extent that the departments falling under the Ministry of Agriculture, Land Reform and Rural Development hold vacant land, there’s no plan to transfer such vacant land to government departments. The plan is to transfer such land to prospective land reform beneficiaries. Our policy however provides for the donation of land falling under our custody to other government departments, in instances where such departments identify such land as suitable for their service delivery objectives.

The aspirant beneficiaries of the programme are farmers/producers that are currently farming and could not have stopped their operations as the funding model’s intention is to support expansion of their operations towards commercialization, so the suspension would not adversely affect them negatively.
3.(a) Why could the review process not be conducted while continuing with the programme?
The review could not be conducted while continuing with the programme because there were policy and approval processes gaps that would have negatively affected further implementation should the programme had proceeded in its current form. In addition to that, the Department did not want to continue processing applications through a system that has gaps.
(b) On what date did the review process start?
The first meeting of the Task Team to review the funding model took place on 11 December 2018.
(c) How long is it anticipated to take to finalize it and?
The Task Team completed the assessment of gaps and the proposed revised model at the end of May 2019. However due to the merging of DAFF and DRDLR, the then DAFF’s Task Team work was extended to include members of the DRDLR to integrate the two processes and develop the policy and proposed funding model. The due date for the finalization of this task team work has been extended to the end of July 2019 and present to the Minister and thereafter Cabinet.
(d) When would the farmers start submitting applications going forward;
Once the Cabinet has approved the policy that guides this funding model. The revised model will specify clearly the date when the farmers may start sending applications through.

No statutory service provider has been appointed in terms of section 3 (1A)(b)(ii) of the Agricultural Product Standards Act 119 of 1990, however, assignees have been designated by the Minister in terms of section 2 (3)(a) of the said Act as far back as 1991 until recently in 2016. A total of 7 assignees have thus far been designated to conduct inspection on regulated agricultural products destined for export and those that are sold locally. The empowering section that was used in the designation of assignees is the very same section 2 (3)(a) of the said Act. The obligations, duties and rights of parties, the assignee, the regulated community and that of the Honourable Minister, are set out in the said Act.

Reply:
1. Currently, hemp production is only authorised for research purposes under special conditions granted by the Director-General of the National Department of Health. The permit is issued in terms of Section 22A (9) (a) (i) of Medicine and Related Substances Act 101 of 1965. About nine permits are issued per annum. The majority of applications are from three provinces, namely KwaZulu Natal, Eastern Cape and Western Cape. Each site is largely confined to 2 hectares in size.
To date, the Department of Health has received and is still considering 36 applications for commercial hemp cultivation. The area to be cultivated ranges from 2ha to 20ha. The Department of Agriculture, Forestry & Fisheries is therefore unable to respond on the tonnage produced and its estimated rand value.
Hemp is still regarded as a drug, and thus regulated by two pieces of legislation, namely, the Medicine and Related Substances Act 101 of 1965 administered by the Department of Health and the Drugs and Trafficking Act, 1992 administered by the Department of Justice and Constitutional Development and enforced by the South African Police Services.
2. Government is working on several measures aimed at facilitating the establishment of a hemp industry with the intension of diversifying the agricultural sector and to create jobs.
The Department of Agriculture, Forestry and Fisheries collaborates with the following departments, Health, Trade and Industry, Environmental Affairs, Justice and Constitutional Development, South African Police Services, Agricultural Research Council (ARC) and the Council for Scientific and Industrial Research (CSIR) towards developing a new regulatory framework for hemp. Much progress has been made in terms of dealing with technical matters regarding production of hemp, research and technology development, commercial feasibility and other related matters. The Departments of Health as well as Justice and Constitutional Development have been requested to amend their respective legislation to facilitate commercial production of hemp and manufacturing of related products.
The Department of Agriculture, Forestry and Fisheries and the Department of Health are also developing guidelines for regulating the cultivation and manufacturing of hemp and hemp products. The two departments will make pronouncements once this process has been concluded.

None. The Department of Agriculture, Forestry and Fisheries does not own any buildings, properties or facilities. The Department of Public Works’ mandate is to be the custodian of all national governments’s fixed assets which are vested under Republic of South Africa, for which other legislation does not make another department or institution responsible.

The Department of Agriculture, Forestry and Fisheries as a tenant is currently occupying 43 leased properties. The Department of Public Works, as custodian of office accommodation and functional accommodation in the Public Service, is leasing the properties for the Department of Agriculture, Forestry and Fisheries and has entered into lease agreement with the concerned landlords.
(b) (i) Value and purpose of each owned property
The Department of Public Works will have to provide the requested information from its records, as the party to the lease agreement signed with respective landlords. The information on its Property Management Information System (PMIS), might include (e.g. Basic property description, ownership, property usage, SG diagrams, locality maps, building plans etc.)
(ii) Value and purpose of rented property
The rented properties that are being rented by the Department of Public Works for the Department of Agriculture, Forestry and Fisheries are being utilised for office accommodation. The Department or Public Works will have to obtain the value of the leased properties from the concerned landlords.

1. The Department rejected approximately 1760 applications applied for change in land use rights in an attempt to retain agricultural land for food security. Among others legislations, the National Department of Agriculture, Forestry and Fisheries administers the Subdivision of Agricultural Land Act, Act 70 of 1970 to protect agricultural land for food security. The Act is applicable nationwide on privately own land and the area in hectares that was at issue are indicated in the table below.

(1) Whether the Government is concerned about the increasing wheat consumption linked to population growth and increasing urbanisation, as local production is continuing to decrease while imports increase annually; (2) does the Government intend to implement any measures to assist technically with the production of wheat to improve the profit margins and outputs to make wheat a viable crop to farm; if not; how does he intend reversing this situation in which the country will have to import at least 1,8 million tons this year to meet the local demand; if so, what are the relevant details? Reply:
1. The Department of Agriculture, Forestry & Fisheries is concerned about local wheat production since wheat is the second most important grain crop produced in South Africa (after maize). Local production averages 2.3 million tons which is far below the levels of consumption which is provided for through importation of approximately 1.7 million tons per annum.
2. Wheat farming in South Africa is confronted by high production cost, fluctuating commodity prices, climate change, outbreaks of pests and diseases and many other challenges. The Department of Agriculture, Forestry and Fisheries supports wheat producers with technical advice which includes cultivar choice, production site selection, soil preparation, cultivation practices, pest and disease control measures, harvesting, as well as postharvest practices. The Agricultural Research Council (ARC) is also conducting breeding programmes for wheat. These programmes are aimed at developing appropriate and high yielding cultivars. There is also more focus placed on developing cultivars that are drought tolerant as well as those that are pest and disease resistant.
Private and public sector stakeholders are also working with government to increase productivity and competitiveness of the wheat industry. One such initiative is the Wheat Breeding Platform which aims to serve as a pre-breeding facility which develop suitable varieties at a rapid pace which are then available to industry for further targeted breeding.
In addition, a statutory levy was introduced to provide research and technology development funding for open pollinated cultivars. This will also encourage seed growers to make the latest breeding material available to South African farmers.

Reply:
The Department of Agriculture Forestry and Fisheries does not own land but administers it on behalf of the Department of Public Works. The land is leased to prospective producers as per prescripts defined and agreed to. The implementation of assistance to prospective producers is based on a grant system and thus does not conform to the definition of subsidising production or initiation of production enterprises.
It should be noted that in terms of the World Trade Organisation, South Africa is categorised as a developing country and provision of grants to support production is allowed.

One of those is ‘’Vessel Chartering “which allows for fishing vessels to be chartered between Contracting Parties.

In accordance with section 39 of the Marine Living Resources Act, 1998 (Act No.18 of 1998) (“the MLRA’’), a foreign vessel license is issued to the vessels before any fishing activity can take place. In addition and in accordance with section 13 of the MLRA, a Permit to Undertake Commercial Fishing of Large Pelagic Longline is issued to the Right Holder, permitting the vessel to harvest the Large Pelagic species allocated to the Right Holder. Lastly, a Fish Processing Establishment permit is issued to the vessels as they process fish on board. The vessels are subjected to the applicable domestic legislation and permit conditions, including a Vessel Monitoring System and additionally, foreign fishing vessels are required to have 100% Observer coverage.
Noting South Africa’s obligations to the ICCAT and IOCT, all the catch and observer data accrues to South Africa.

Steenhuisen, Mr JH to ask the Minister of Agriculture, Forestry and Fisheries
(1) (a) On what date did his department last conduct an audit of artwork owned by Government which is under his department’s curatorship and (b) what are the details of each artwork under the curatorship of his department according to the Generally Recognised Accounting Practice 103; (2) whether any artworks under his department’s curatorship have gone missing (a) in each of the past five financial years and (b) since 1 April 2018; if so, what are the relevant details?
Reply:
For the past ten (10) financial years artwork was not identified as a high risk area to be audited and therefore no internal audits were conducted of artwork owned by Government which is under the Minister’s department’s curatorship. Although no internal audits were done there are regular stock takes of assets performed by the Directorate: Asset Management. The latest stock take conducted on the artwork in the Ministry office in Cape Town was on 20 September 2017 and no discrepancies were found.
Currently there are five artwork paintings and all five of them are currently in room 106 in Cape Town. Please refer to the attached document for the details as per the stock take conducted on 20 September 2017.

(1) (a) What number of inspector positions exist in the Directorate Food Safety and Quality Assurance and (b) what number of posts are (i) filled and/or (ii) vacant; (2) Whether any work of the Food Safety and Quality Assurance is outsourced; if not, why not; if so, (a) what kind of work is outsourced and (b) what is the budget for outsourcing?
Reply:
- (a) The Directorate Food Safety and Quality Assurance does not have positions or designations of inspector posts in their establishment since in the main it is the policy development unit. The Directorate utilizes a matrix of inspectors residing within the Directorate Inspection Services and the designated assignees to enforce the two legislations (Agricultural Product Standards Act 119 of 1990 and the Liquor Products Act 60 of 1989). There are currently 39 inspectors who are responsible for inspection of certain regulated products and the exercise of an oversight role over the activities of the designated assignees. (b) there is a total of (i) 30 (thirty) filled posts and (ii) 9 (nine) vacant posts.\
- (a) There is no work of the Directorate Food Safety and Quality Assurance that has been outsourced. However, the Agricultural Product Standards Act 119 of 1990 does allow the designation of assignees to complement the inspection services. There are currently seven assignees in terms of the Agricultural Product Standards Act (b) the designation does not cost the department anything.
