Whether there are any (a) environmental and (b) human risks involved when explosives are being used for illegal mining next to the FNB Stadium; if so, (i) what are the risks and (ii) what is his department doing to address the risks?

Reply:

(a) No.

(b) There are significant human risks.

(i) There are significant human risks are that the illegal miners can get injured or killed from the blast, inhale noxious gases from the explosion which can lead to death; can cause underground fires. Some of the stolen explosives are sometimes also used in blasting Automatic Teller Machines (ATMs).

(ii) The Department is working together with the all law agencies including the Hawks to arrest and recommend for prosecutions of illegal miners and the syndicate leaders. There is also Gauteng Illegal Mining Stakeholder Forum which consists of SAPS, Crime Intelligence, State Security agency; Mining Companies; Organised Labour. The Mine Health and Safety Council is developing a new standard for sealing of shafts that will minimise the risk of being re-opened by illegal miners and less susceptible to environmental factors.

With reference to section 54 of the Mine Health and Safety Act, Act 29 of 1996, to what extent has he engaged all role-players in the mining sector concerning the perceived (a) opaque reasons often furnished by his department to close mines that seemingly have an adverse effect on the health and safety of employees and (b) attitude of employers with regard to work stoppages?

Reply:

a) The Minister has previously engaged with stakeholders in the Mining Industry Growth Development Employment Task Team (MIGDETT) on section 54. There were also further engagement in the Mine Health and Safety Council. These structures consists of organised labour (NUM, AMCU, UASA, and Solidarity) employers (Minerals council of South Africa, South African Mining Development Agency). Mining companies either individually or collectively also meet with the Minister on section 54 enforcement.

b) There are general 3 types of response from the mining companies:

  • Some mining companies accept the section 54 as being positive and adding value to management oversight to non-compliance to the Mine Health and Safety Act.
  • Second group thinks that a different enforcement measure should have applied like section 55 instead of section 54. This group will accept the section 54 instruction with reservations.
  • The last group is very antagonistic and challenges the decisions of the Inspector in the Labour Court for the section 54 to be varied or set aside. There are companies that have even sued the Department for loss of production after they were issued with a section 54 instruction.

In light of the fact that mining is an industry with long-time horizons that require mining companies to project decades ahead when making adjustments (details furnished), what is the reason for the continued delay in the promulgation of key minerals legislation?

Reply:

The key reason for delay of the finalisation of Mining Charter, 2018 was to allow the mining industry stakeholders to reengage in an inclusive and meaningful discussion on issues of divergence to find a lasting solution. As a result, the Department of Mineral Resources has engaged extensively and meaningfully with all mining industry’s stakeholders, which was followed by community consultations led by Minister of Mineral Resources across all nine (9) provinces. The department has gazetted draft Mining Charter, 2018 on Friday, 15th June 2018 for public comments.

The Mineral and Petroleum Development Amendment Bill is currently going through the parliamentary process, and it is therefore out of the department’s influence. However, it is noteworthy to indicate that the National Council of Provinces has accepted the draft Bill and Provincial Legislatures are expected to provide their final mandates.

In light of the fact that 45% of global economic activity is ostensibly attributable to mining, what (a) percentage has mining contributed to the economy of the country in the past three financial years and (b) has he found to be the impact of legislation and regulations on the contribution that mining can have on the economy?

Reply:

a) Mining industry is one of the country’s key economic sectors with substantial contribution to economic growth and development, job creation and transformation, consistent with the government’s objectives to achieve more balanced economic and inclusive growth. In the past three financial years, the mining industry contributed R282.9 billion (7.8 percent) in 2015, R307.3 billion (7.9 percent) in 2016 and R334.7 billion (8.0 percent) respectively to gross domestic product (GDP). Mining contribution to Gross Fixed Capital Formation (GFCF) grew from 9.1 percent in 2015 to 9.3 percent in 2017.

b) The object of the mining and minerals legislation is to create a conducive environment for mining companies to access the country’s mineral wealth. It also strives to ensure that there is transformation in the mining industry through redressing of the past imbalances where the ownership was skewed in favour of the minorities with exclusions of the Africans. It also ensures that the mining industry contributes towards socio-economic development of mine communities and major labour sending areas as a form of compensating them for adversities associated with mining activities. It further provides for competitiveness of the industry through skills development and equitable representation in the workplace in line with demographics (both national and provincial).

What (a) amount in funding did his department contribute towards equipping two groundwater boreholes which were handed over to the Beaufort West Local Municipality in the Western Cape by the Council for Geoscience on 13 February 2018, (b) amount did his department spend on the handing-over ceremony and (c) are the details of the procedures followed to select the service providers for the handing-over ceremony?

Reply:

a) The groundwater was discovered by the Council for Geoscience (CGS) during the execution of the Karoo Deep Drilling baseline and geo-environmental study for the purposes of possible shale gas exploration. Two high-yielding boreholes were donated (at no cost to the municipality) to the Beaufort West Municipality who incurred the cost of the pumping infrastructure for one of the borehole. Although the CGS spent just over R495 000 to drill the two boreholes, the value of the water provided to the water-scarce municipality (to assist just over 44 000 people) is in the order of R1 million per month and could easily reach about R13 million a month based on level 6 water restriction rates for the Western Cape Province.

b) The CGS spent about R423 000 towards the handover ceremony. Flight and accommodation of CGS personnel have not been included in these calculations.

c) The CGS selected the service providers through the Beaufort West Municipality supplier chain department. The procedures were followed accordingly.

Noise

A letter was sent to the company regarding the findings of the inspection and the company was directed to communicate with residence of Vaal Eden around the mining areas in order to resolve issues relating to mining. The company was also directed put in place a monitoring programme for dust and noise.

24 August 2017

The complaint was about illegal mining taking place on the area, dust, noise and accumulative effects of mining affecting the road. The findings of the inspection were:

  1. There was no illegal mining activities identified within the Vaal Eden area
  1. Dust pollution was identified however, it was being managed and monitored according to the approved EMP.
  1. Noise pollution was not encountered except from the trucks utilizing the Vaal Eden road
  1. Accumulative effects of new mining activities and negative effects emanating from trucks on the Vaal Eden road have been encountered however, the Free State Provincial Department of Police Roads and Transport are currently repairing and filling pot holes along the road

The company will be monitored continually to ensure compliance to the approved documents.

a) NSome companies have extended the 60 days consultation period to look for alternatives to save jobs.

b) Through Future Forums companies continue to identify and implement cost containment measures. The companies will include and implement turnaround strategies.

c) The development of the plan for utilization of the rehabilitation funds for concurrent rehabilitation is at an advanced stage.

d) The Department is developing a draft framework for consultation with stakeholders to enable a seamless transition to mitigate the impact of retrenchments as well as the economy.

e) Companies have implemented voluntary severance packages measures. Furthermore, employees have been deployed to other operations within the groups.

f) Companies have implemented their commitments as per the Social and Labour Plans this includes emotional, financial and employment counselling to assist retrenches to re-enter the labour market. In some reskilling has been provided.

g) Addressed as part of Mining Charter amendments pending court case.

h) Alignment of business processes underpinning Section 52 of MPRDA and Section 189 of LRA is being undertaken.

i) Promoting investment and market development

The Department of Mineral Resources in partnership with the dti, DST and State Agencies have developed institutional mechanisms for the development and facilitation of mining investment as Chaired by the DMR.

The DMR has led investment promotion efforts through policy advocacy and brand position at key international mining investment forums including Africa Down Under in Australia, and the China Mining Expo. We further plan to participate in the Mines and Money Conference in London, the Prospectors and Developers Association of Canada (PDAC) conference in March 2018. On these missions the DMR has worked with relevant government departments to identify projects in South Africa and to support their projects in and outside of the Country. 12 junior miners accompanied the Director General to China Mining Expo and are in the process of following up on fledgling deals developed. The same approach was undertaken for the Platinum Group Metals Workshop taking place this week in Moscow. It is the aim of the Department to support a small group of these to travel to London to market their deals and find mutually beneficial partnerships that will bring more investment and jobs into South Africa. Locally the Minister has led consultations with the Black Business Council and the Platinum Industry amongst others to address constraints and leverage from opportunities to bring further investment into South Africa’s mining sector.

j) Where there’s a threat of job losses parties continue to communicate such in a responsible and sensitive manner.

The Council for Geoscience’s seismic stations indicate that the tremor occurred on the 8th August 2017 at 23:47:23. The tremor was a magnitude 2.3 and occurred within a depth of 3.4km

The Council for Geoscience has not established causality between the stated tremor and either previous or current mining activities.

The Council for Geoscience keeps records of all tremors.

(a) What is the total number of jobs that have been lost in the mining industry since 27 April 1994 and (b) how many of those jobs have been lost due to mechanisation and/or automation?

Reply:

(a) A total of 147 187 jobs have were lost by the first quarter (ending March) of 2017, from a total of 611 018 in 1994.

(b) The Department does not have those figures, but the impact of mechanisation on job losses has been very minimal. Most of the jobs were lost due to decline in ore grades, reduced prices resulting from weakened demand, all of which led to operations’ restructuring.

(1)Why has he not finally declared a restriction or prohibition on the granting of any rights or permits in terms of section 49(1) of the Mineral and Petroleum Resources Development Act (MPRDA), Act 28 of 2002, in relation to the (a) the buffer zone around the Mapungubwe National Park, which was initiated by the former Minister of Mineral Resources, Advocate Ngoako Ramatlhodi, by the publication of his intention to declare a restriction and prohibition in the Government Gazette 38004 of 12 September 2014 and (b) the Chrissiesmeer Biodiversity Site, which was initiated by the former Minister of Mineral Resources, Ms S Shabangu, by the publication of her intention to declare a restriction and prohibition in Government Gazette 34051 of 11 March 2011; (2) given the environmental significance of the wetlands and grasslands in the Wakkerstroom area and the extreme sensitivity of those wetlands and grasslands to prospecting and mining, why has he not exercised his discretion in terms of section 49(1) of the MPRDA to declare a restriction or prohibition against the granting of new prospecting and mining rights in that area?

Reply:

  1. The Minister will exercise his discretion in terms of Section 49 (1) of the MPRDA for mining in the area subsequent to the submission of a technical report currently been compiled by the Joint Planning Task Team comprising officials from the Department of Mineral Resources, Department of Environmental Affairs and Department of Water and Sanitation.
  2. On the strength of the information received, the Minister is considering to restrict the granting of any right over the properties within a buffer zone of the Mapungubwe work Heritage site. The environmental sensitivity of the wetlands and grasslands as well as the overall occurrence of certain species were duly considered when the area was declared to be a buffer zone. If the area falls outside the buffer zone as declared, the necessary studies shall be conducted and the result thereof shall be presented for further consideration by the Minister. The restriction would not constitute prohibition and each case will be considered on its merits.

1. The 2017 manual in terms of section 14 of the Promotion of Access to Information Act, Act 2 of 2000 has been approved by the Information Officer of this Department and is in the process of being published on the Department’s website.

2. In terms of the 2017 manual, the following listed documents are automatically available:

 (i) all registered rights granted in terms of the Mineral and Petroleum Resources Development Act 28 of 2002 (the “MPRDA”);

 (ii) all applications for rights listed in (I limited to the extent that confidential information contained in such applications will not be made available without the prior consent of the applicant concerned;

 (iii) Environmental management programmes approved in terms of the MPRDA and National Environmental Management Act No. 107 of 1998 (“NEMA”);

 (iv) Environmental management plans approvedin terms of the MPRDA;

 (v) Social and labour plans approved in terms of the MPRDA escluding commercial, confidential or financial information;

 (vi) Mining work programmes and prospecting work programmes approved in terms of the MPRDA excluding proof of financial ability;

 (vii) Draft versions of the documents listed in (iii), (iv) and (v) submitted to the Department of Mineral Resources for approval is subject to the limitation in (ii) above;

 (viii) Environmental authorisations issued in terms of NEMA;

  2. Failure to submit Environmental Management Programme (EMPr) or submission of an EMPr that fails to meet the requirements of the Mineral and Petroleum Resources Development Act,2002 (MPRDA), failure to apply for Environmental Authorisations;
  3. Failure to submit proof of access to financial resources as required by the MPRDA;
  4. Areas applied for already encumbered by another permit or right.

3. Underground mining in excess of 2400 metres below surface for Gold ore and Silver ore
