1a. The new Board of Directors of the SADPMR were appointed by the Minister of Mineral Resources on 1 November 2016. In exercising their fiduciary duties, the Board called for all the company policies to be presented to them. This was done in a Board meeting on 26 January 2017. Amendments were effected to certain policies, as discussed and agreed by the Board.

1b. The Assistant Company Secretary would be required to assist with training and development and facilitation with the organisation. The incumbent would need to support the Company Secretary particularly in the areas of writing, amending and collating Board and Committee policies and procedures. This required someone with an educational background.

2. Amongst a myriad of skills and qualifications, the Chairperson of the Board worked in the Department of Education for 26 years.

3. Whilst the incumbent and the Chairperson know each other of each other, there is no business or personal relationship between them.

Reply:

There are several interventions that can be taken to save jobs depending on the challenges faced by the company. These interventions may include but not limited to interventions as declaration signed by the stakeholders.

Sale of assets might be considered if jobs are to be saved and two parties agrees. This intervention will always be persued if there is high probability that jobs will be saved.

I revived the Mineral and Petroleum Board (MPB) with a mandate to focus on section 52 notices

The Department has served notices to most perpetrators as part of administrative enforcement but furthermore opened cases as part of criminal enforcement.

(a) How does his department intend to deal with zama-zamas and (b) how will the outputs of this plan be measured?

Reply:

(a) The department has established provincial illegal mining stakeholder forums in Mpumalanga, Free State, Gauteng and Northern Cape Provinces. Various stakeholders such as government departments (i.e. National, Provincial and local government), law enforcement agencies, mining companies, unions and associations, municipalities, certain SOEs, refineries and organized communities participate in these forums. Physical activities such as closure of open mine holes, arrests, prosecutions and convictions, deportations, disruptive operations and encouragement of land use/occupation have been conducted which led to a significant decrease of this practice. The illegal mining space is decreasing which result to illegal miners fighting for the remaining limited space and resorting to other crimes.

(b) The above mentioned Provincial Stakeholder Forums have action plans of which the output is measured against the action plan. Since the establishment of the Provincial Illegal Mining Stakeholder Forums progress has been made on combating illegal mining activities. The following has been achieved through the Provincial Illegal Mining Stakeholder Forums:

  1. Illegal miners were arrested and continued to be arrested and convicted.
  2. Illegal imigrants who are also involved in illegal mining activities were arrested and continued to be arested and deported.
  3. Mining permits have been issued to mining companies to conduct legitimate mining in areas that were infested with illegal mining.
  4. Most of the open holes and open shafts where illegal mining was taking place have been sealed, rehabilitated or closed.
  5. Land where illegal mining was taking place has been rehabilitated and used for development.
  6. People were employed through rehabilitation and shaft sealing projects.
  7. Conviction rates have increased from 2 months to 8 years.
  8. Reef outcrop and sub-oucrop areas where illegal mining was taking place has been succesfully mined and continued to be mined by legitimate mining companies.

Reply:

The Minister of Mineral Resources released a statement on 01 September 2016. This was followed by an interview on SABC news on 02 September 2016. The Minister was not speaking in his personal capacity but in his capacity as Chairperson of the IMC. On 13 April 2016, Cabinet established an IMC to consider allegations that certain banks and other financial institutions acted unilaterally and allegedly in collusion, when they closed bank accounts and/or terminated contractual relationships with Oakbay Investments. The Minister recorded recommendations made to Cabinet by the IMC as well as the related resolutions taken by Cabinet at its meetings of 06 July 2016 and 31 August 2016 respectively. The IMC made 5 recommendations to Cabinet. 4 of the recommendations were approved by Cabinet and 1 was referred to the President for further consideration as it was not within the purview of Cabinet to take a decision on the matter. The Minister is not at liberty to make any further statements on this matter.

     (i) The EMP provided an assessment on the potential impacts of the proposed mining activties, which therefore also provided measures to modify, remedy, control or stop any actions, or process which may cause pollution or degradation to the environment. Measures were informed by recommendations of the specialist reports undertaken amongst others, these includes, Floral assesment specialist report, Fauna assesment specialist report, Wetland assement specialist report, Air quality assement specialist report, Hydrological assesment specilist studies (Ground and surface water).

     (ii) Public participation was undertaken with land owners, Organs of State, Interested and affected parties, through newspaper advertisement, site notices, meetings, distribution of Background information Documents (BID) to both interested and affected parties.

They advise Minister on the political environment, legal and regulatory environment, compliance matters and corporate and commercial sectors. Mr Mabaso was employed in October 2015 and Advocate Kellerman in April 2016. Both advisors’ contracts are linked to that of the Minister with a contractual period of 3 years. Advisors are appointed and remunerated according to applicable rules as set out in the Public Services Act, the Ministerial Handbook and with concurrence of the Department of Public Service and Administration.

(1)Whether he is aware (a) of the existence of a provincial heritage site, Canteen Kopje, in the Northern Cape, which is of archeological and heritage significance and is facing imminent destruction, (b) that research at the specified site began in the mid-20th century and has been on-going since 1997 (c) that various excavations in a number of locations at the site have revealed tools dating back 2,3 million years to the three phases of the Acheulean hand axe, Middle and Later Stone Age occupations, a Tswana/!Kora occupation relating closely to local communities and the remains of historic activities, (d) that a mining permit was issued in 2014 and the SA Heritage Resources Agency successfully acquired a Cease Works Order which was lifted in March 2016 after which work by a diamond mining company commenced on 16 March 2016, (e) that the current mining programme will, conservatively estimated, destroy up to 40% of the heritage site, (f) that the fenced-off area includes the excavation areas of the University of the Witwatersrand and of Toronto and the area developed for tourism, (g) that no heritage impact assessment or archaeological impact assessment was conducted and the mining company does not have a heritage permit, which is in contravention of the National Heritage Resources Act, Act 25 of 1999, (h) that there is a conservation management plan for the site and (i) that our country has a constitutional, legal and moral obligation and responsibility to preserve and protect the heritage resources and resources with archaeological significance; if so, what steps does he intend to take to ensure the protection and preservation of the specified heritage resources; (2) (a) how many schools for the visually impaired learners are registered with each provincial department of education and (b) how many appropriately trained educators in the field of braille are teaching at schools for the visually impaired?

With regards to the evaluation of safety at Lily Mine in Mpumalanga South Africa, the world and the community members of Mpumalanga were shocked with the incident that occurred in Lilly Mine in Nkomazi Mpumalanga where 3 mine workers went down 80m into a sink hole. The communities across the country shared a hope and anxiety of the families and miners at Lily Mine that are distraught. In your recent media and public announcement you made the point that it will take between 6 to 8 months for the rescue team to reach the container. Up to the date “The families of Mnisi, Mazibuko and Nyerende are still in our prayers and we trust that the emotional and psychological support they are receiving will assist them to cope with the traumatic experience.

Reply:

The question is:-

  1. Whether the department was aware that the container office was actually located in such a dangerous location.

A formal investigation is underway in terms of the legal provisions and will assist in identifying the underlying causes of the accident. On completion of investigation, recommendations will be made to prevent similar accidents.

   2. Is it your expectation the mine would have known that the container is in a dangerous location.

The above-mentioned formal investigation will assist in identifying the underlying causes of the accident.

   3. Has your department conducted assessment on other mines in the country to determine that no such dangers await other mineworkers?

The mine inspections and audits are continuously being conducted with the aim of preventing harm on the mineworkers.

In a case where sub-standard condition, act or non compliance to the provisions of the Mine Health and Safety Act is observed during a mine inspection or audit, appropriate actions are immediately taken to remedy such conditions.

  4. If yes which mines? If not why not?

The mine inspections and audits are conducted at all the operating mines.

  5.  Do we have assurance that such or similar accident will not revisit the country

We endeavor to prevent mine accidents from occurring and lessons learnt from the above-mentioned investigation will be used to improve safety in the mining sector.

   6.  Does the country have requisite skills to deal with disasters of this nature?

South Africa has the requisite skills to deal with disasters at mines and our country’s Mine Rescues Services (MRS) assisted in the Chile Mine disaster in which 33 trapped mine workers were rescued successful after 69 days.

  7. If yes where is it located, and why do we find ourselves in this situation like it is at Lily Mine where it will take close to a year to reach the container where miners are trapped?

At the Mine Rescue Services of South Africa. The rescue operations have not been abandoned but options which will ensure safe rescue operations are being pursued. This is as a result of the deterioration of ground conditions at the mine.

  8. If not why don’t we have such capacity?

South Africa has the requisite skills and capacity.

  9. Who is thus responsible for the situation that we find ourselves in?

The accident investigation will assist in identifying the underlying causes of the accident.

1. Yes. The Company lodged an application for a closure certificate in terms of section 12 of the Minerals Act and the closure certificate was issued on the 06th of December 2006.

(2)(a) As a closure certificate was issued, there are no rehabilitation activities taking place on the quarry area.

(b) The complaint lodged to the Department lead to the investigation which confirms that there is a need to work further on the area to address issues of concern and a meeting will be held during the second week of May 2016 to ensure that urgent steps are taken to address the rehabilitation of this abandoned quarry.

(c) The amount is not known at this stage and will only be known after the abovementioned meeting and concomitant site inspections.

3. Yes, warnings signs were put around the quarry and the safety trench were dig.

4. (a) Yes. A complaint was received from the Volksblaad. The complaint was about rehabilitation, safety of the people living in Heidedal and surrounding areas from the dangers associated with an unfenced and abandoned mining site, drowning of community members and various serious crimes been committed over the area.

(b) The site inspection was conducted as a response to the complaint. The complainant was advised that further investigations will be conducted and the outcome will be communicated.

(c) The investigation is being conducted which include consultation with the Department of Water and Sanitation, the Mangaung Municipality or the town council and the land owner. The outcome of the investigation will determine cause of action to be taken.

(1)(a)(i)(ii) To promote mining and address company issues relating to investment climate in the country in general, and to mitigate imminent of retrenchments.

(b) The Department is not at liberty to disclose the identity of persons involved outside of its employment.

(c) No person in particular. I identify challenges and act upon them in a manner I deem appropriate.

(2) As previously indicated, the Minister was accompanied by a senior official of the Department.  It is not normal practice for the Department to disclose the identity of officials who travel and accompany the Minister in their official capacity, as it may potentially compromise the performance of their official duties.
