Reply:

(I) The Department of Mineral Resources and Energy is the competent authority to deal with environmental compliance and enforcement as per the Provisions of the National Environmental Management Act (Act 107 of 1998) as amended.

(b) (Notices 31 L)ln most cases, the right holders have not revised their Financial Provision annually as per the regulations, and in some cases where they have not paid the determined shot fall in the Financial Provision. In cases of section 28 Directives, Right holders who were found to have potentially cost significant Environmental pollution and Degradation.

(c) Holders were issued with instruction in terms of section 31 L of NEMA to make representation and further to revise and pay Financial Provision to address the shot fall. Where potential Pollution/Degradation was identified, the holder will be directed to submit a plan to prevent or minimise future Pollution/Degradation.

(d)(i)(ii)Holders have since addressed the infringements and in some cases they have made arrangements to gradually address the infringements. The Department continues to monitor and enforce the level of compliance and where necessary take appropriate steps.

Reply:

(1) The department is processing the above-mentioned applications in terms of Section 24 of the Mineral and Petroleum Resources Development Act, 200B (Act 2B of 2002).

Sea Concessions Ba and 9a are the Converted Mining Rights that were issued in terms of Minerals Act 50 of 1991 and were converted in to new order rights in terms of MPRDA.

Sea Concessions 5a, 6a and ?a were issued in terms of the Minerals Act, and the company applied for conversion in terms of the Transitional arrangements of the MPRDA.

Sea Concessions Sa and 9a were granted in terms of section 23(1 )(a)-(f).

(2) The Department rely on the provisions of the MPRDA to process all Applications

Reply:

(1) Yes, Eskom's compliance with the minimum emissions standards (MES) is currently being monitored by the Department of Environmental Affairs. The draft IRP 2019 explored scenarios wherein through the energy mix, we reduce the aggregate emissions profile of South Africa's energy generation sector. In order to mitigate against high emissions, provision is made for other technologies to meet the supply/demand gap, taking into account the technical and economical characteristics of each technology.

(2) An analysis has already been done based on the IRP Update. Job creations is one of the objectives under the IRP Update process

Reply:

(1) The forensic report will be tabled in Parliament once all the necessary internal governance processes are completed.

(2) Appropriate action and sanction will be taken against those found to be implicated in due course.

(a) Given that the civil litigation and parallel criminal investigation processes are at a sensitive and critical stage and we would not want to jeopardise the case it is thus that further details in relation to name of the implicated parties will be disclosed at an appropriate time.

(b) The timing of the disciplinary action will also be based on the outcomes of the parallel civil litigation and criminal investigation process currently under way.

(3) (a)(b) It is the intent of the organisation to fully pursue appropriate civil and criminal action without any fear or favour with the intentions of ensuring restoring good governance and curbing any harmful acts of dishonesty and associated activities in our State Owned Entities.

(i)(ii) Details pertaining to this process will be disclosed in due course given that the civil litigation and parallel criminal investigation is at sensitive stage.

(4) In line with legislation and best practice the entity intents to fully ensure that all costs incurred by the state in relation to this matter are recovered from those that are found to be implicated in the sale of the strategic reserves. Reply:

a) There are no official rooftop solar 1nstaiied capacity numbers as most of these installations were considered "generation for own use" in line with the old Schedule 2 of the Electricity Regulation Act (ERA) which exempted !hem from the requirement to be licensed or registered. Realising the impact these installations are likely to have on capacity planning, power systems operations and personal safety, in year 2017 the Department amended Schedule 2 of ERA therefore compelling these facilities to be registered or licensed with National Energy Regulator of South Africa (NERSA). NERSA is in the process of finalising the registration processes and rules, which will enable formal collection and analysis of information and data or. distributed generation.
The South African Photovoltaic Association (SAPV!A) estimate installed rooftop solar capacity in the country to be about 280MW.

b) There are no official number of hours as the installed capacity of rooftop solar is not known.

(b) The "Joint working committee" from SFF and Nilepet thus constituted for the "Nile-Orange Energy Project" appointed Centurion Law Firm, South Africa:-

(a)(b) to perform the function of Legal Services Advisory in order to assist with the completion and submission of Exploration Production Sharing Agreement (EPSA) after following due process.

(c) Centurion Law Firm was the only company contracted to SFF.

(i) Centurion Law Firm rendered Legal Advisory Services. Whether he has a plan in place to ensure the safety of mine workers. Particularly when trade union members and workers decide to embark on a strike while they are underground; if not. why not: if so. what are the relevant details?

Reply:

The legislation compels all underground mines to ensure that all employees are brought to surface as soon as possible at the end of their shift, as per regulation 4.1.1 in force in terms of Schedule 4 of the Mine Health and Safety Act No 29 of 1996, as amended. The primary objective of this regulation is to prevent mine employees from being exposed to a dangerous environment for long periods of time unnecessarily. In this regard, the Department will encourage the mine employers to ensure compliance with the respective legal provisions.

Also, any dispute between the labour and employer must be resolved by using the established negotiation processes. The Commission of Conciliation Mediation and Arbitration (CCMA) can also be called to assist when there is an impasse between the two parties. Again, I want to stress that labour must refrain from underground sit-in and rather apply for a protected strike as enshrined in the Labour Relations Act

(1) The Republic of South Africa has entered into three instruments with the Democratic Republic of the Congo in the energy sector, namely:
(a) Treaty on the Grand Inga Hydropower Project between the between the Government of the Republic of South Africa and the Government of the Democratic Republic of Congo {29th October 2013)
(b) (i) Agreement between the Government of the Republic of South Africa and the Government of the Democratic Republic of the Congo regarding the Cooperation in the Field of Energy Resources {09lh September 2014); and (ii) Memorandum of Understanding between the Government of the Republic of South Africa and the Government of the Democratic Republic of the Congo with respect to the Grand Inga Hydropower Project in the Democratic Republic of the Congo ( 12th November 2011)

(2) All the instruments mentioned in (1) were tabled in the National Assembly.

(3) None.

(4) The project time line at this stage is by 2030.

Reply:

1) (a) (i) The Government has not made any investment in the energy resources for 2017/18 financial year (ii) Only SFF, CEF Group subsidiary had invested in South Sudan during 2018/19 financial year.


(b) The Nile-Orange Energy Project (NOEP) is an ambitious strategic project spread in full Hydrocarbon value chain and currently ongoing in South Sudan between South African Government (Represented by Strategic Fuel Fund) and South Sudanese Government (Represented by NILEPET which is a National Oil Company of South Sudan). The cooperation is aimed at assessing and determination of technical, commercial and economic viability of the Nile Orange Energy Project spread in its entire component.

(b)(aa) To date Strategic Fuel Fund has spent R18.5 million towards developing the initiation note, this expense is made up of internal salary costs of experts, travelling, lodging and miscellaneous associated activities, deemed absolutely essential for execution of project.

(b)(bb) The partnership with South Sudan holds significant promise as it addresses in part South Africa security of feedstock supply challenges and provides a mechanism that acts as a natural hedge and reduces South Africa's exposure to oil price fluctuations.

(b)(cc) The National Treasury Framework for Infrastructure Delivery and Procurement Management gated framework is being followed and adhered to. All Project stage gates will be followed during the execution of project in future.

2) Process to depute experts and companies to conduct Pre-feasibility and feasibility studies is underway and findings /recommendations will be known at the end of feasibility studies only.

(1) What is the status of the Thyspunt site, in the Kouga Local Municipality, which was intended to be the site of the nuclear build programme; (2) why are public participation processes around the specified site continuing; (3) what is the status of the nuclear build programme? NW1481E

Reply:

1. Thyspunt remains one of Eskom's suitable sites to host a nuclear power plant. It has undergone extensive environmental studies in the form of environmental impact assessment and nuclear site safety review by independent consultants. Eskom has submitted nuclear site installation license (N ISL) applications for Thyspunt in order to get the site ready for any South African future nuclear power plans.

2. Site approvals for nuclear power plants, the Environmental Impact Assessment (EIA) by the Department of Environmental Affairs (DEA) and Nuclear Installation Site License (N ISL) from National Nuclear Regulator (NNR) are long-lead items. Consequently, the NNR is continuing with Eskom's application for NISL. The public hearings are an integral part of this NISL process.

Since receipt and acceptance of the Nuclear Installation Site Licence applications, the National Nuclear Regulator (NNR) has been seized with its internal technical review process of the Thyspunt site application, which is a lengthy and thorough process focusing on technical, scientific and onsite assessments amongst others.

The reason for holding NNR public hearings around the Thyspunt during this time is that NNR has completed its internal review process of the Thyspunt site application and is now embarking on an external consultation process to listen to health, safety and environmental concerns related to the application from interested and affected parties. The NNR embarks on this process to ensure that its regulatory decision making is independent, robust and transparent.

3. In terms of the Nuclear Energy Policy for 2008, the new nuclear build programme is still part of the energy mix. The Nuclear Energy Policy provides the government vision for developing extensive nuclear energy programme and to become self-sufficient in all aspects of the nuclear value chain for peaceful use of nuclear energy.

The nuclear build programme is informed by the Integrated Resources Plan (IRP). NEDLAC is in the process of finalizing IRP. In September 2019, the Integrated Resource Plan will be tabled in Cabinet for approval. The Integrated Resource Plan considers a diversified energy mix that include cleaner coal, nuclear, gas, hydro, renewables and battery storage. The outcomes of the revised IRP, will determine how the nuclear new build programme becomes phased in future. Government policy position is that South Africa will acquire nuclear at the price, pace and scale that the country can afford.

What (a) is the incidence level as a percentage of mineworkers of (i) pneumoconiosis and (ii) silicosis in South African mines, (b) steps is his department taking to reduce the incidence levels of these occupation related diseases and (c) is the trend of the specified diseases in the mining sector over the past 10 years?

Reply:

(a)(i) The incidence level as a percentage of mineworkers with pneumoconiosis is 0.01 % reported from the 2017 annual medical reports and 0,00% in 2018.

(a)(ii) silicosis is 0.13% in 2017 and 0.09% in 2018.

(b)The department has carried focused audits and inspections on airborne pollutants in all the regions. The department has reviewed the Guideline on Airborne Pollutants in 2017/2018 financial year which was popularised industry-wide during 2018/2019 financial year. The department is monitoring airborne pollutants overexposures through occupational hygiene statutory returns on a quarterly basis. During the 2014 OHS Summit the South African Mining Industry, (State, Employers and Organised Labour) committed to reduce the Occupational Exposure Levels (OEL) of airborne pollutants by 2024 to reduce occupational lung diseases. The mining sector is engaged at annual Occupational Health Dialogues and quarterly regional tripartite forums to deliberate on programmes initiatives to reduce the incidence of occupational lung diseases (OLD) at mines.

(a) The Republic has rare earth mineral resources (i) Found in the Western Cape Province on the farms, Steenkampskraal and Zanddrift, while surrounding farms are being explored for them (ii) the value of the resources is not known (iii) At the Steenkampskraal mine, the quantity is estimated at 605,000 tons at an average grade of 14.36 percent and total rare earth content of 86, 900. tons but, it is not known for Zanddrift.

What steps has his department taken to encourage the retraining of mine workers by mining companies in order to adjust to (a) automation and (b) new jobs?

Reply:

The MPRDA provides for submission of a Social and Labour Plan (SLP) which is one of the requirements of the granting criteria. The Human Resource Development (HRD) is one of the elements of the SLP. Its key objective is to ensure that mining right holders provides for training of employees and community workers. The training provided is aimed at improving the skills base such that productivity is improved. Furthermore companies must provide portable skills which prepares employees to compete in the broader labour market. In order to realise the HRD objective, mining right holders must invest a minimum 5% of leviable amount (excluding the statutory skills development levy) on essential skills development.

Whether his department is taking any steps to include the youth in the mainstream economy and job creation to ensure active youth involvement, particularly local youth, if not, why not, if so, what are the relevant details, (2) what measures wi\\ his department put in place to develop and assist young people into active participation in the mineral resources and energy sector?

Reply:

  1. The department has developed Youth Policy in the Energy Sector. The policy seeks to attract young people and create an environment that enables youths to reach their potential in the energy sector. The policy is aimed at addressing amongst others; employment creation, youth economic participation and access to business opportunities, speed up transformation in a way that will benefit young people, enhance skills development to ensure that young people are equipped with necessary skills to enter energy sector job market and access to business opportunities throughout the value chain, outreach projects, youth volunteerism on energy projects, and public private partnenhip.
  2. There are different measures in place to develop and assist young people to participate in the energy sector:

the measures are as follows:

  •  Learners Week (LFW) Programme - The LFW programme is a department’s flagship project focusing on awareness on careers in the energy sector, The programme aims to promote skills development amongst the youth by creating awareness and exposure of career opportunities within the Energy sector for learner doing Science, Technology, Engineering and Mathematics (STEM). The programme targets 250 learners from five provinces per year, whereby the Department of Education in the provinces identifies 50 top Grade 11 12 learners in quintile 1-3 schools doing STEM to pa#icipate in the programme. This year alone the department through our partners (private energy companies) will give 56 bursaries to learners from disadvantage communities to study engineering, computer sciences and other related energy programmes.
  • Integrated Energy Centre Programme - The Integrated Energy Centre (leC) is aimed at enhancing access to energy, stimulate enterprise development and job creation. The IeC trades in petrol, diesel, liquefied petroleum gas, convenience shop and other services such as internet café in other instances. This programme is a partnership between the Department and oil and gas companies The Depa#rrent has established a youth owned Integrated Energy Centre enterprise which will trade in Liquefied Petroleum Gas in Makhado Local Municipality, Limpopo. This enterprise is expected to be operationalized by July 2019. There are different IeC fuel service stations around the country whose ownership and management include young people.
  • Youth in Energy Dialogues - Youth in Energy Dialogue encompasses youth from different facets with interest in the energy industry and encourage youth to participate in the energy sector as entrepreneurs, investors, professionals, and leaders within the energy field. The dialogues take advantage of th opportunities in the energy sector and how to access them. The dialogue further explore how young people fit into the growing industry and I\ow they can better their industry reach and growth potential to take advantage of this growing sector. The programme showcase opportunities in the energy sector,
  • School Ener9y Days — School Energy Days is aimed at providing and exposing learners in Grade 09 to 11 rural areas in particular studying Science, Technology, Engineering and Mathematics to careers, opportunities in the energy sector and other energy related information. The department hosts approximately four School Energy Days per year from different provinces in pannership with different Stakeholders and expose them on career opponunities in the energy sector. The event is an appropriate platform to interact with learners on career development, economic development issues and information dissemination on variety of energy issues aimed at:
  •  
  • Encourage learners who take STEM to choose energy related career development path
  • Promotion of sustainable use of energy iesou‹ces; and
  • Encourage participation of young people located in rural and developing areas in business opportunities within the energy sector.

In this financial year alone, the Department has already conducted two school energy days in the Eastern Cape with the target of about 700 learners.

(c) Yes, the distance complies with Regulation 17.7(a) of Mine Health and Safety Act No. 29 of 1996.

(d) Project 1: Construction of an E-Learning Centre in Wesbank Community in 2015

The centre combines E-Learning (learning through Information and Technology) and library services on the boundary of a school for easy access to the community and learners from neighbouring schools, in terms of a broader need for new facilities at old schools. The Community Learning Centre is established at Hoofweg Primary School, Wesbank. Wesbank is an under-resourced area with a high crime rate, overcrowded schools, high unemployment, and low occurrence of employment opportunities. A large majority of the residents have not completed high school and the unemployment rates reach at least 43%.

Social Benefits:

  • Leverage teaching through building a culture of learning in the home
  • Using parents’ and children’s literacy to leverage learning
  • Locate Community Learning Centres at primary schools

Educational Benefits:

  • Integrated print and digital media lessons
  • Equivalent emphasis on books and computers
  • Multiple modes of learning
  • Measurable outcomes

Holcim spent R2.9 million towards this initiative.

Project 2: Construction of a Library

The library is the second phase of the above-mentioned E-Learning Centre project. The library will be constructed adjacent to the E-Learning Centre. Implementation of this project is due to start at the beginning of 2019. The budget committed is R5 million.

Project 3: Khayelitsha Capacity Building for Disadvantaged Youth

The Khayelitsha ‘100-UP’ Programme is an initiative driven by the University of Cape Town. It aims to build the learning capacity of youth and to assist them enter institutions of higher learning through various training programmes.

In conjunction with UCT, Holcim’s contribution will fund training for the youth of Khayelitsha. Implementation of this initiative will commence at the beginning of 2019. The committed budget is R810 000.

Whether there are any (a) environmental and (b) human risks involved when explosives are being used for illegal mining next to the FNB Stadium; if so, (i) what are the risks and (ii) what is his department doing to address the risks?

Reply:

(a) No.

(b) There are significant human risks.

(i) There are significant human risks are that the illegal miners can get injured or killed from the blast, inhale noxious gases from the explosion which can lead to death; can cause underground fires. Some of the stolen explosives are sometimes also used in blasting Automatic Teller Machines (ATMs).

(ii) The Department is working together with the all law agencies including the Hawks to arrest and recommend for prosecutions of illegal miners and the syndicate leaders. There is also Gauteng Illegal Mining Stakeholder Forum which consists of SAPS, Crime Intelligence, State Security agency; Mining Companies; Organised Labour. The Mine Health and Safety Council is developing a new standard for sealing of shafts that will minimise the risk of being re-opened by illegal miners and less susceptible to environmental factors.

With reference to section 54 of the Mine Health and Safety Act, Act 29 of 1996, to what extent has he engaged all role-players in the mining sector concerning the perceived (a) opaque reasons often furnished by his department to close mines that seemingly have an adverse effect on the health and safety of employees and (b) attitude of employers with regard to work stoppages?

Reply:

a) The Minister has previously engaged with stakeholders in the Mining Industry Growth Development Employment Task Team (MIGDETT) on section 54. There were also further engagement in the Mine Health and Safety Council. These structures consists of organised labour (NUM, AMCU, UASA, and Solidarity) employers (Minerals council of South Africa, South African Mining Development Agency). Mining companies either individually or collectively also meet with the Minister on section 54 enforcement.

b) There are general 3 types of response from the mining companies:

  • Some mining companies accept the section 54 as being positive and adding value to management oversight to non-compliance to the Mine Health and Safety Act.
  • Second group thinks that a different enforcement measure should have applied like section 55 instead of section 54. This group will accept the section 54 instruction with reservations.
  • The last group is very antagonistic and challenges the decisions of the Inspector in the Labour Court for the section 54 to be varied or set aside. There are companies that have even sued the Department for loss of production after they were issued with a section 54 instruction.

What (a) amount in funding did his department contribute towards equipping two groundwater boreholes which were handed over to the Beaufort West Local Municipality in the Western Cape by the Council for Geoscience on 13 February 2018, (b) amount did his department spend on the handing-over ceremony and (c) are the details of the procedures followed to select the service providers for the handing-over ceremony?

Reply:

a) The groundwater was discovered by the Council for Geoscience (CGS) during the execution of the Karoo Deep Drilling baseline and geo-environmental study for the purposes of possible shale gas exploration. Two high-yielding boreholes were donated (at no cost to the municipality) to the Beaufort West Municipality who incurred the cost of the pumping infrastructure for one of the borehole. Although the CGS spent just over R495 000 to drill the two boreholes, the value of the water provided to the water-scarce municipality (to assist just over 44 000 people) is in the order of R1 million per month and could easily reach about R13 million a month based on level 6 water restriction rates for the Western Cape Province.

b) The CGS spent about R423 000 towards the handover ceremony. Flight and accommodation of CGS personnel have not been included in these calculations.

c) The CGS selected the service providers through the Beaufort West Municipality supplier chain department. The procedures were followed accordingly.
