With reference to the court decision in Glencore Operations South Africa Proprietary Limited Coal Division v Minister of Mineral Resources and Others (JR91/2014) [2016] ZALC JHB 49, dated 3 February 2016, where the decision was handed down to impose an administrative fine of R500 000 on the South Witbank Colliery after a worker died in a mine accident, (a) why did (i) he and (ii) the Mine Health and Safety Inspectorate (MHSl) fail to submit answering affidavits when the specified colliery challenged the decision in court, (b) how has the MHSI changed its operating processes to avoid this precedent being used by mines to avoid fines in future and (c) what amount is to be paid back to the mine as a consequence of the specified judgement?
Reply:
(a) The Department instructed the State Attorney to oppose the matter. A legal counsel was appointed for the matter and consultation took place between him and the Department. Counsel requested certain information from the Department and such information was provided. There was no feedback from the State Attorney on the matter until judgment was granted. The Department has requested the Chief Litigation Officer in the State Attorney's office to investigate the circumstances that caused the non-filing of the answering affidavits.
(b) The MHSI will, as soon it receives outcomes of the above-mentioned investigation, assess if there is any need to change its operating processes. However, as it stands the current operating processes followed by the MHSI in this regard are adequate and do not require any changes.
(c) The Department has paid to Glencore an amount of R696, 828.77. This amount is inclusive of R500, 000.00 administrative fine repayment and interests at 15, 5% per annum from 02nd August 2013, as per the court judgment.

- The Department continuously conducts audits and inspections at all the mines, including the stated mines, to ensure compliance with the legal provisions mainly regarding prevention of fall of ground, transport equipment and machinery accidents as well as exposure of employees to noise and dust (including silica dust).

The trackless mobile machinery accidents are also the major contributor of fatalities, disabilities and injuries in the mining sector. It is against this background that the Department has been implementing measures including reviewing the relevant legal provisions to protect the health and safety of the mineworkers.
(a) These regulations are expected to be effective and should result in decreased fatalities and injuries. The department will monitor the situation continuously.
(b)(i) and (ii)
Yes, it is envisaged that the prevention of accidents as a result of compliance to the regulations will ultimately reduce capital expenditure and cost of maintenance because there will be far less production interruptions and less money spent to repair vehicles that have collided. However, the loss of life is of utmost importance and cannot be equated to costs or profit at the mine.

The current Medium Term Strategic Framework (MTSF) aptly identifies the need to consider the compliance burden and complexity of laws and regulations, and the need to improve consistency and remove unnecessary obstacles to business development. In this regard, capacity has been created in the Presidency to carry out thorough impact assessments of both new and existing legislation and regulations, in order to ensure alignment with the NDP and reduce the risk of unintended consequences.
Government will also streamline and improve the efficiency of regulatory processes, in areas such as building licences, environmental impact assessments, company registration, tax compliance, work permits for scarce skills, mining licences, water licences and access to municipal infrastructure services.
The regulatory burden reduction strategy cuts across a number of legislation/regulatory instruments that are not only administered within the DMR. Capacity for a comprehensive regulatory burden reduction strategy has resultantly been established at a central point in government and constitutes a requirement for the legislation development within government.

A. 2014 China Mining Congress and Expo (Tianjin-Beijing, 21 - 22 October 2014)
(i) The purpose of the visit:
China Mining is a standing item on the international promotional programme of the DMR. Minister Ramatlhodi led the Department’s participation in 2014. The DMR has participated in the past five sessions of China Mining, including the 2014-15 financial year. The assessment is that it will continue doing so, because the Conference offers South Africa an opportunity to engage with the investment community in the mining sector and to promote the country as a top mining investment destination.

(b) The stakeholders has met and developed terms of reference which were approved by MIGDETT principals. These are currently implemented.

Is there any work that is being done by his department with regard to the challenges posed by transfer pricing, mispricing, as well as tax-base erosion and price fixing with other affected or relevant departments like the Department of Trade and Industry and the National Treasury; if not, why not; if so, how much ground has been covered?
Reply:
The Department of Mineral Resources participates in the Inter-Ministerial Committee of Revitalisation of Distressed Mining Towns, which has initiated a process to investigate transfer pricing and related matters. The National Treasury and South African Revenue Services are leading this process.

(a) (b) The Department and entities (Council for Geoscience, State Diamond Trader, Mintek, South African Diamond and Precious Metal Regulator and Mine Health and Safety Council) reporting to the Minister of Mineral Resources have never prematurely terminated the services of any employee who is on contract since 2008/ 09 to date. Therefore, has never had to make any pay out.
