Esterhuizen, Mr JA to ask the Minister of Arts and Culture
With reference to the existing contract between his Department and the African Institute of Arts, Culture and Heritage (AIACH) regarding the King Dinuzulu Project and considering that all obligations have been met by the AIACH, (a) will funds be released to the AIACH in the current financial year for the Dinuzulu Exhibition augmentation and the first film and (b) what are the reasons for the delay in releasing the funding?
Reply:
a) No, funds will be released to the African Institute of Arts, Culture and Heritage until the institution complies with the contractual obligations and provides fully detailed information on how the allocated funds were spent on the project, and the beneficiary further furnishes the Department with satisfactory documented proofs such as invoices and/or receipts of expenditure with additional documentation on the utilisation of funds as requested by the Department as a prerequisite to release the funds to the project. Once all the required documents and information are submitted to the Department, then the funds will be released to the AIACH.
(b) The following are the reasons for the delay in releasing the funding to the AIACH:
- The beneficiary did not submit the audited financial statements which indicates that the funds already allocated to the project have been utilised in accordance with the signed Memorandum of Agreement (MoA);
- The financial report submitted is not substantiated by proof of expenditure such as invoices, receipts, bank slips, bank statements, etc., and based on the documents submitted by AIACH, the Department is not provided with the necessary assurance that the funds transferred were used in accordance with the agreement;
- The Department further noticed that some of the items bought for the project were not part of the signed Memorandum of Agreement and even the content of the narrative report is not aligned with the financial report provided by the beneficiary; and
- The Department is not clear when and where the exhibition will take place or whether it really took place or not.

Reply:
The Honourable Member will appreciate the fact that there is so much to be done to better the lives of our people. When honourable Members ask exactly the same question that was asked by another honourable Member from the same Caucus and it was responded to, I find it unacceptable.
Exactly the same question was asked by Honourable Walters of the Democratic Alliance in 2017. It was question number 347 and I responded to that question, nothing has changed.

What budgeted amount, differentiated in capital and operatonal, has been allocated to (a) the National Archives and (b) to each provincial branch of the National Archives for each financial year in the 2019/22 Medium-Term Expenditure Framework; 3. In what ways will the budget allocations for the 2019/22 Medium-Term Expenditure Framework assist the archives in (a) employing more highly trained and qualified staff members, (b) organising documents, (c) digitizing documents, (d) upgrading infrastructure and (e) dealing with the backlog of stolen, lost and incorrectly stored documents?

1. (a) The budget allocation for the National Archives for the 10 financial years is as follows:
(b) The National Archives and Records Service of South Africa does not have Provincial Branches. In terms of Schedule 5 Part A of the Constitution, Provincial Archives are a competency of each Provincial Government. Therefore, those nine Provincial Archives report exclusively to their respective legislatures and receive their allocations from their respective Provincial Treasuries through their Provincial Members of the Executive(MECs).
2. (a) .The total National Archives budget allocations for the 2019-22 Medium-Term Expenditure Framework is captured in the table below.

3. (a) The department has appointed GTAC to undertake a workstudy exercise for the whole department including the National Archives. The National Archives is a Chief Directorate of the department. The workstudy is a review exercise intended to determine the organizational structure, human capacity, systems and procedures needed for the department to achieve its objectives. It aims to examine the overall functioning of the DAC including aspects such as the organisational structure, systems, operational processes, and employee morale for the purposes of improving service delivery. Also to ensure that the Department stays within the allocated compensation budget ceiling. It is after the results of this workstudy exercise whereby the issue of employing highly skilled and qualified staff will be looked at. It is my commitment to resource the National Archives with skilled staff in order to take the National Archives into the stage of the Fourth Industrial Revolution.
(b) In order to make records available for access by the citizens of South Africa it is necessary to arrange and describe the records after they have been transferred to the National Archives Repository. This means that they are sorted in terms of a file system used by the creating office, after which they are listed and a finding aid compiled. This finding aid is then available for researchers to use to identify the records that they are interested in. A new system called AtoM (Access to Memory) has been implemented by the NARSSA to assist the Arrangement and Description Archivists to ensure that the work that they do is available quicker to researchers, not only in the NARSSA Reading Room, but also online.
(c) The NARSSA acknowledges digitisation as strategy for preservation and access. During the period preceeding your question, the NARSSA developed its own Digitisation Strategy which was approved in 2013. The purpose of this strategy was to guide the process of digitising archival material. The first digitisation project implemented by the NARSSA was the Rivonia Trial Records (commonly known as Percy Yutar Papers). The total cost of the project was R161 040.00 The Nelson Mandela Foundation contributed R100 000, while the NARSSA paid R61 040. The project digitised 12 000 pages of records.
The National Automated Archival Information Retrival System (NAAIRS) was revamped from 2014 to 2017 in AtoM. 'AtoM' is an acronym for 'Access to Memory'. AtoM is a web-based archival description software that is based on International Council on Archives (ICA) standards viz. Encoded Archival Description, to make it easy for archival institutions to put their archival holdings online. The total amount for this upgrade was R10, 088, 232.37. Currently the public have access to the digitised Rivonia Trial Dictabelts on the NARSSA Website which is a result of the Revamping of the NAAIRS Project.
(d) The NARSSA has been allocated R160 M for the 2019-22 Medium Term Expenditure Framework for the construction of the new archival building. The allocation received by NARSSA will be utilised for the construction of a new modern and technologically advanced archival building, on the same and adjacent site of the existing Hamilton Street building; and the refurbishment of the existing facilities. Consideration will be given to combining the needs of an Offices of Record, National Film, Video and Sound Archives, Presidential Archives and a Records Centre together with those of the National Archives on the same site that are physically linked together in addition to off-site storage facilities for specialised collections.
(e) The NARSSA is not aware of any stolen or lost records. NARSSA has the following measures in place to ensure the safekeepeing of records.
- No researchers are allowed in the strongrooms where records are kept
- No visitors to the building are allowed in the offices of officials
- No bags are allowed in the Reading Room
- All strongrooms are locked and only designated officals can access the strongrooms, they are required to sign a register whenever access is needed.
- Researchers only have access to records in the reading room where they are under constant supervision by staff
- The Reading Room and other areas in the building are also monitored by CCTV cameras
- Client Offices (Government Departments) are required to complete a removal permit for records that they take from NARSSA. Client offices can only remove records that they have created themselves.
Over the many years that the NARSSA has operated, some records were misplaced. This is due to various factors including misplacement in incorrect boxes after use by researchers, and audits that are not conducted regularly due to staff shortages. The holdings of the National Archives Repository stretch over 66 000 linear kilometres, it is almost impossible to locate misplaced records, as was shown when six (later 5) interns were appointed to try and locate misplaced records identified by the Public Protector after they received a complaint from a researcher. The interns worked for one year and although they were able to locate a number of misplaced files, one is still outstanding. They were however able to find a number of misplaced files that were not previously known, including records related to Land Restitution e.g. file NA/15/6 parts 1 and 3 created by the magistrate Mapulaneng (Bosbkorand). The contract period for the interns lapsed on 4 March 2019, the work has slowed down considerably due to a lack of capacity.
To rectify the situation the NARSSA will have to invest in an Electronic Archival Tracking System, such as RFID, whereby each file will have to be coded and the system will automatically track the file in the NARSSA (A similar system was introduced in the UNISA Library a number of years ago). This system is also connected to the security system of the building and would alert officials if a file is removed from the building without permission.
It is without a doubt that the NARSSA is keeping its records safe, regardless of all the challenges experienced.

What is the annual budget allocated to each museum for maintenance?
Reply:
My Department is responsible for funding capital works projects, of entities reporting to me, which include national museums.
The Department of Public Works (DPW) as Custodian of all government buildings is responsible for their maintenance. Out of twelve (12) national museums DPW is only funding the maintenance of Robben Island Museum buildings.
The DAC committed funds for maintenance of national museums, the allocated annual budget to each museum is tabled below for the period 2017/18 to 2021/2022.

With reference to his reply to question 1116 on 7 May 2018, by what date will the construction of the Sarah Bartmann Centre of Remembrance in Hankey, Eastern Cape be completed and (b) what will the running costs of the Centre be once it is operational; (2) Whether an operating agent has been appointed yet; if not, by what date will an operating agent be appointed; and if so, (a) what are the relevant details and (b) what are the relevant details of the tender process that was followed to appoint the operating agent?
Reply:
1.(a). The completion date for the construction of the Sarah Bartmann Centre of Remembrance is October 2019.
(b). The Department of Arts and Culture will be appointing a museum planner whose tasks include the development of an operational budget/running costs for the Sarah Bartmann Centre of Remembrance.
2.(a). No operating agent has been appointed, nor will an operating agent be appointed to manage the Centre.
(b). The Centre will be declared a Declared Cultural Institution, in accordance with the National Institutions Act, Act no 119 of 1998.

(a) At which voting stations were extra ballot (i) papers and (ii) books requested due to too few ballots being available for the number of voters on the voters’ roll during the 2016 Local Government Elections and (b) what are the full relevant details in each case?

During 2016 local government elections, reports of shortages of ballot papers and or books were recorded in at least 17 voting stations.
b) The applicable ballot provisioning in 2016 was based on an allocation of 100% of registered voters which also included a buffer allocation (as a consequence of rounding up of the number of ballots to the next 100 because books are printed in packs of 100). Voter turnout in 2016 was 58%. Shortages can therefore not be attributed to ballot printing shortages. The Electoral Commission is looking at additional ballot tracking mechanisms that will enable real time monitoring of ballot papers to obviate reports and perceptions of ballot shortages.

With reference to the reply of the Minister of Public Service and Administration to question 3797 on 21 December 2018, what was the total expenditure incurred by his department relating to the travel privileges contained in the 2007 Ministerial Handbook of former (a)(i) Ministers and (ii) their spouses, (b)(i) Deputy Ministers and (ii) their spouses, (c) Ministers’ widows or widowers and (d) Deputy Ministers’ widows or widowers (i) in each of the past five financial years and (ii) since 1 April 2018?
Reply:
Considering the extensive nature of the information required to answer the question by the Honourable Member, my office is working round the clock to verify the information and facts required but it is evident that it will take some time to conclude on this one. This is so because we will be taking people away from their stations on operation. As soon as that is done I will forward the Honourable Member the full and comprehensive response as required.

Grootboom, Mr GA to ask the Minister of Arts and Culture
With reference to the tragedy of the devastation at culturally historical town Wupperthal by a fire recently, how will his department assist in rebuilding this cultural site?
Reply:
The Wupperthal Moravian Mission station was declared a conservation area in 1999 under the National Monuments Act, Act No 28 of 1969. The act was repealed and replaced by the National Heritage Resources Act (NHRA), Act no 25 of 1999 in terms of which the management and safeguarding of South Africa’s tangible and intangible heritage is shared between the three spheres of Government. Heritage Western Cape is the Provincial Heritage Resources Agency (PHRA) responsible for safeguarding the heritage conservation of the Moravian Church in Wupperthal.
Heritage Western Cape is working closely with the Moravian Church, who owns the property, the Western Cape Department of Human Settlements, and the Cederberg Municipality in order to monitor the restoration work which is currently underway. Heritage Western Cape has visited the site as part of oversight. The South African Heritage Resource Agency (SAHRA) an entity of the Department of Arts and Culture stands ready to assist on this matter whichever way possible.

Reply:
In the past five years, my department has supported thirty five (35) Flagship Festivals and two hundred and thirty-eight (238) open call festivals.
The Entities reporting to my department, namely the National Arts Council supported fourteen (14) local music and art festivals.
The information below is a reflection of how we financially supported art festivals as well as amounts granted to each specified art festival.

Reply:
My department supported (i) twelve (12) local films and (ii) eleven (11) film producers in the past five years. The entity reporting to my department, namely, the National Film and Video Foundation (NFVF) supported 408 local films and 65 film producers.

What are the details of the support that his Department offers to South African authors?
Reply:
My department has a unit which deals with Books and Publishing, focusing on promoting a culture of reading, writing and developing authors, supporting initiatives that provide public platforms for authors working with the book sector stakeholders including authors to engender wider audiences for South African literature and enhance the development of a dynamic book sector.
The Department provides funding to individuals, institutions, community groups and organizations, including literature. It also provides financial support for creative writing including biographies and autobiographies. In addition, in the case of international partnerships, funds are allocated to authors to travel to international literary events and attend international Book Fairs and Festivals.
The Department in partnership with the South African Literary Awards, pays tribute to South African authors who have distinguished themselves as ground-breaking producers and creators of literature. The Department is further committed to financially supporting activities of the Writers Guild, the National Writers Association of South Africa, the African Women Writers Network, the Abantu Book Festival, the Mthatha Word Festival and National Book Week, the latter of which takes place in every September and is held in all Provinces. A campaign aimed at stimulating a reading and writing culture in all South African languages and to promote easy access to books.
The Department also provides support to the National Library of South Africa for the activities of the Centre for the Books as well as National Library Week activities and related publishing and literary initiatives including the Funda Mzantsi National Reading Competition which promotes reading among book clubs from all over the country. Together with the National Library, the Department is finalizing a strategy and programme of rolling out writing grants to aspiring writers and authors.

Reply:
There is no Public Service Co-coordinating Bargaining Council (PSCC) resolution that provides for movement from one salary level to another. Grade progression is done in line with PSCBC Resolution 3 of 2009 upon meeting all the requirement. The department implements the provision of Resolution 3 of 2009 accordingly.

1. The Old Ramkraal Prison is a Provincial Heritage site which falls under the Free State Provincial Department of Sports, Arts, Culture and Recreation (DSACR).
I would recommend that the Honourable Member request the information directly from the Department of Sports, Arts, Culture and Recreation in the Free State Province.

To ask the Minister of Arts and Culture: : (a) why has the cost to build the stone wall at the stone quarry on Robben Island increased so dramatically over the past three financial years, (b) what was the initial cost to build the stone wall and (c) what is the estimated cost to complete the wall?
Reply:
a. Reasons for the increased cost to build the stone wall on the Robben Island are the following:
- The nature of the proposed design which was to replace the bridged dry-stone packed wall with a concrete seawater barrier that would then be clad with a layer of gabions and the dry-packed bluestone on the island side and a pebble ramp on the seaside.
- Environmental provisions that included having to build only over a 6 months’ period outside the bird and penguin breed seasons.
- Further bridging of the wall as the project preparations including the sourcing of further funds, this was more severe during the June 2017 storm when the bridged opening increased by a further 20 meters.
- What Coega Development Corporation refers to as the ‘Island Factor is a logistics cost that had been underestimated by the consultants early in the development of the project that became an issue at procurement.
b. R10, 3 Million in 2015 was estimated at Preliminary design stage.
c. R28, 6 Million based on the lowest tender price.

(a). Why has the Chief Executive Officer of the Pan South African Language Board been on suspension for months and (b) on what date will the suspension (i) be lifted or (ii) the specified person be charged?
Reply:
a) The Chief Executive Officer of the Pan South African Language Board instituted legal action out of the Pretoria High Court under case no. 43870/18 as well as the Labour Court in Johannesburg under case no.J2689/18. In the circumstances, disciplinary proceedings cannot be commenced with, until these two cases have been finalised.
b) (i) The Johannesburg Labour Court matter was heard on the 07th of November 2018, the Department currently awaits Judgment. The Pretoria High Court matter will be heard again on the 04th of February 2019. The lifting of the suspension therefore will largely depend on outcome of judgment in each of these cases.
(ii) The specified person has already been charged.

Reply:
The art works that are found in government departments and held in the offices of Members of the Executive Councils are not under my department, as every government department has its own asset register.
Government departments do not use GRAP 103 in terms of asset management – there is a modified cash system to report in terms of cost price.

- The Inter-Ministerial Committee (IMC) statement on 08 May 2018 was a pronouncement on the process that had been initiated by the Department of Water Affairs and Sanitation as part of the Nelson Mandela and Albertina Sisulu Centenary Program.
Standardisation of geographical names is an administrative process that starts at local and provincial level and is finalised at the national sphere of government, where the South African Geographical Names Council (SAGNC) makes recommendations for my approval or rejection. At the moment the matter is still the subject of public participation and discussion at local and provincial levels of government, and it is not possible to predict the final recommendations and the date it will be escalated to the national level of government for my consideration;
2. My department is not aware of any petition as none has been brought to our attention.
3. There will be no statement to make on the matter until the application is officially submitted through the SAGNC for my consideration.

What rationale informed the decision of the Government to rename the Medfontein building in Bloemfontein after Leabua Jonathan, (b) what are the details of the public consultation process that was undertaken in order to arrive at the decision and (c) was there no other person from the Free State who could have been honoured instead?
Reply:
(a).The decision to rename Medfontein Building to Leabua Jonathan was taken by the Mangaung Municipality, and the Minister of Arts and Culture did not play any role,
(b). The South African Geographical Names Council Act, (Act No. 118 of 1998), state that, the Minister of Arts and Culture is responsible for the approval of geographical names after receiving recommendations from the South African Geographical Names Council (SAGNC).
The SAGNC is responsible for geographical features of national concern including, but not limited to towns/cities, suburbs and any form of human settlement, post offices, stations, highways and government dams.
It should be noted that; buildings within municipalities are managed by the said Municipality, hence, it is therefore within the relevant municipalities’ authority to process the proposed request of renaming of buildings within its locality.
(c). The democracy and freedom we enjoy today was not only made possible by the efforts of South Africans alone. Our struggle was a humane struggle supported by progressive global community. Countries from the Southern African Development Community in particular paid the heaviest price. These countries were destabilized, their economies sabotaged and their territorial integrity violated on a number of occasions by the apartheid government.
To honour them in this manner amongst others, is a way of showing our appreciation to the contributions they have made in our struggle for freedom.

Reply:
1. My department appointed an Implementing Agent (IA) to turn the late Ms Winnie Madikizela-Mandela’s Brandfort house into a museum. On 13 March 2018, the IA entered into a Service Level Agreement with my department for a total amount of R1 926 705.81.
After finalizing a detailed Project Implementation Plan (PIP) and the design, the IA issued a tender advertisement and the details are as follows:
Date of invitation: 10-Aug-18
Compulsory briefing meeting date: 13-Aug-18
Tender closing date: 31-Aug-18
Validity period lapsing 90 Days (31-Nov-18)
Four (4) prospective tenderers collected the documents and only two (2) tenderers returned their priced documents, and the IA adjudicated them.
The adjudicated tenderers were found to be non-responsive and their tender prices (R 2 529 806.07 & R 2 964 420.64, respectively) were much higher than the approved budget.
The Department is in the process of consulting and deciding on the best option between increasing the budget to accommodate the market price indications and appointing the cheapest of the above tenders on the one hand and increasing the budget to accommodate the market price indications and authorizing Risimati (IA) to re-advertise immediately for a shorter period in accordance with its tender policy and procedures on the other hand.
2. (a)A total amount of R 305 756.42 has been spent in the project so far.
(b) The projected costs to completion is R2 529 808.07
3. My department wrote a letter of demand to the previous IA, Independent Development Trust (IDT), requesting the return of R1 264 573.42 being the balance for the said project. DAC has also been joined in the ongoing legal proceedings with IDT and its service providers.

(a)(i &ii). My department does not have any information on the erection of the statue of Leabua Jonathan in front of the building currently known as the Medfontein building in Bloemfontein, the department will contact the Provincial department requesting the said information and will forward it to parliament as soon as it is received from my counterpart (MEC) in the Provincial department.
It should, however, be noted that the decision to rename Medfontein Building after LeabuaJonathan was taken by the Mangaung Municipality, and that the national department of Arts and Culture did not play any role on that matter.

1. The art works owned by Government are not under my Department, but under the National Department of Public Works. Each Government Department is however, responsible for the art work in its possession, and the said art work must be recorded according to GRAP 103, as heritage assets.

- No art work owned by my Department has gone missing in each of the last five years and since 1 April 2018.

Reply:
Over the last few years, we have engaged the Cape Town Philharmonic Orchestra and KwaZulu-Natal Philharmonic Orchestra around the issues of funding of Orchestras. Our point of departure is informed by the understanding that the resources allocated to us must be used prudently and spread fairly across the sector in the whole country.
For a few years in the past we used to fund the two Orchestras cited above. This was unfair practice.
We engaged them and inform them that this practices is unsustainable and unfair because it is only two provinces who are benefiting out of the nine.
We informed them that the Department of Arts and Culture has taken a decision to fund only a National Orchestra and the Cities in which the Orchestras are based will have to fund them.
To this extent out of their own volition, the City of Johannesburg decided to put aside an amount of 20 Million Rands (R20 Million) to fund the local Orchestra.
We call and encourage all the Cities and Provinces to fund their own Orchestras.
Of critical importance in this process is the transformation of the Orchestras to reflect the South African demographics. South Africans across the board must embrace and support them, however this support will come through when people feel the sense of ownership.

Reply:
(1). All forty nine [49] senior managers employed by the Department of Arts and Culture as at 30th April 2017 disclosed their financial interests for the 2016/17 financial year .
(2). Falls off as all SMS complied.
(3) (a). Only one employee has been suspended
(b). The employee is at an SMS level. The suspension was effected on 1 December 2017. To date, 29 June 2018, the suspension is for seven (7) months.
(4). The total cost amounts to R 595 855.75

Reply:
1. (a) There was no decision taken regarding a fixed date to implement the South African Language Practitioners’ Council Act, Act 8 of 2014 because there is no budget to implement the Act.
2. According to the Act, the Council should be funded with the budget appropriated by Parliament. In line with this aforesaid requirement, the Department has approached Treasury for the budget to establish and fund the Council, but to no avail.
3). The Department will make a statement on the matter when the budget is available.

Reply:
The Ministerial Handbook outlines provisions for international travel for members of the executive and their family members. Members of the Executive are regularly invited to participate in international conferences or forums in order to promote a South African agenda and brand that benefits or showcases the country.
Ministers and Deputy Ministers must approach the President in writing, two weeks in advance of a planned official visit abroad, to request approval for the intended visit and the appointment of an acting Minister.
Section 3 stipulates provisions that allows for Ministers and Deputy Minister’s to be accompanied by their spouses or an adult family member, subject to relevant processes and approvals of an official trip abroad.
The department covers the cost of travel once all processes, policies and approvals have been adhered to and applied and this is subject to the availability of funding.
However, the Auditor General audits, amongst others, expenditure related to travel expenses borne by the department and produces audited opinions on departmental Annual Reports, which is tabled in parliament annually.

Reply:
1(a). To date, no incident of racism was reported to the human resources office of my department, however, it should be noted that (1) one incident of racism was reported at the National Museum in the year 2017/18.
(b). The department received a complaint from a whistle blower complaining about racism at the National Museum. The Chairperson of the Council was instructed to investigate the allegations. The Council conducted investigation and recommended that disciplinary processes be implemented, against the allegations levelled at the official.
2. Yes, the incident was investigated, the official had since resigned from the National Museum.

What number of cases relating to the Prevention and Combating of Corrupt Activities Act, Act 12 of 2004, as amended, have been referred to the (i) South African Police Services (SAPS) and (ii) Directorate for Priority Crime Investigations (DPCI) by (aa) his department and (bb) each entity reporting to him for further investigation since the Act was assented to and (b) what number of the specified cases have (i) been investigated by SAPS and DPCI, (ii) been followed up by the respective accounting officers and (iii) resulted in a conviction in each specified financial year since 2004? NW1791E.
Reply:
(aa). The number of cases that were referred for criminal investigation to the South African Police Services (SAPS) and/ or Directorate for Priority Crime Investigations (DPCI) by the Department are six (6) in total. All criminal cases reported are still in progress.
(i). Frequent follow-ups were made by the Department with the abovementioned authorities under (aa).
(ii). The dockets are not yet ready for conviction but some are at advanced stages as the Department had an opportunity to interact with the National Prosecution Authority officials.
bb.(i) Nine (9) cases were referred to the SAPS
(ii) Four (4) cases were referred to the DPCI
(b)(i) Four (4 ) cases have been investigated by SAPS and DPCI
(ii) Regular follow-ups are made by the accounting officers.
(iii) No convictions in each specified cases as eight cases are still under investigations.
One case was unfounded and subsequently closed by the SAPS early 2018

Whether all national departments are complying with the implementation of the Use of Official Languages Act, Act 12 of 2012; if not, why not; 2. Whether his department is monitoring compliance with the specified Act in each instance; if not, why not; if so, is his department providing support to all departments in this regard; 3. Whether he has found that all provinces have adopted and effectively implemented language policies in accordance with their Provincial Languages Acts; if not, what steps has his department taken to ensure compliance?
Reply:
1. No, many national departments still experience capacity problems with elementary stages of complying with the Act. For example, most of them do not have language policies and those that have, are experiencing implementation challenges. Some of such challenges are self-inflicted due to unrealistic language policies. The Pan South African Language Board (PanSALB) an entity of my department, recently called all departments and public entities to report on their status quo, where it became evident that many departments and entities simply copied the Act without applying their context. It is where PanSALB decided to workshop them on language policy writing and implementation plan, and the workshop was held on 23 March 2018.
2. Yes, PanSALB is monitoring compliance, hence the Public Hearings mentioned above. PanSALB has provided support in the form of a workshop to all departments and developed policy guidelines.
3. Some provinces have implemented and others are still struggling to implement:-
- Gauteng Provincial Languages Act has been approved but not yet implemented as the Department of Sports, Arts, Culture and Recreation is still working on its regulations before implementation by provincial government departments.
- The Eastern Cape’s Use of Official Languages Act has been approved and enacted by the Eastern Cape Provincial Legislature. The 2nd of July 2018 was communicated to the Eastern Cape Office of PanSALB as a possible proclamation date of the Act.
- The Western Cape Province has the Provincial Languages Act and the provincial language policy. The Act is fully implemented by all provincial government departments.
- Limpopo Province also has a Provincial Languages Act which is being gradually implemented.
- Free State Provincial Languages Act was only approved in 2017 and implementation has commenced.
- KwaZulu-Natal province does not have a language Act, but has the Use of Official Languages Bill which will be finalised into an Act.
- Mpumalanga, Northern Cape and North-West provinces also have language Acts, that are being implemented.

Reply:
1. The Departmental Internal Audit unit works on an approved plan and the same with forensic through allegations. Accordingly, a lifestyle audit would be prompted through an allegation or from an assessment that would follow from the financial disclosures that the National Department of Public Service and Administration (DPSA) does and this would come through Deputy Director-General: Corporate Services who is responsible for disclosures.
2. No lifestyle audit has been done in the last three financial years.

The Performing Arts Centre of the Free State (PACOFS) will be guided by its policies and disciplinary code in instituting consequence management against any member of PACOFS who is found to be responsible for incurring irregular expenditure.

Reply:
(a)(I). The process of constituting Councils is prescribed in relevant enabling legislations that compel the Department to ensure that issues of diversity are addressed. The process of appointing Councils also prescribes that an open and transparent process is followed and as such the shortlist of recommended candidates is only drawn from the public nominations received. All efforts are made to ensure that diversity considerations are made in terms of age, gender, race, class and geographical spread during the selection process.
II). PACOFS Management
The Council of PACOFS will ensure that issues of diversity are addressed when filling the following managerial vacancies:
- Chief Executive Officer
- Technical Director
- ICT Manager
- Marketing Manager
(b). Leadership vacuum is a major contributor to the instability at PACOFS. To this end, my Department is working closely with the Council of PACOFS to complete and finalise the litigation cases which have held up the filling of critical leadership positions. Further, we have granted the Council of PACOFS permission to utilize the previously ring-fenced funding to upgrade the infrastructure of the entity which will enable the PACOFS to host national and or international programmes.
(c). The Performing Arts Centre of the Free State (PACOFS) will be guided by its policies and disciplinary code in instituting consequence management against any person found to have brought PACOFS into disrepute.
