Reply:

1. SA Express has lease Agreements with multiple leasing companies. The preferred lease structure by the airline is Wet Lease Agreement on an ad hoc basis. One of the advantages for leasing aircraft on an ad hoc basis is that the relationship is determined by the airline’s schedule requirement at a specific time. This structure is more cost effective.

As mentioned above, there is more than one leasing company the airline has a relationship with and Star Air Cargo is one of them.

For a lease company to qualify to be in the pool of preferred vendors for aircraft to be leased to SA Express, the airline conducts internal safety audits to ensure compliance with all legislative requirements. Furthermore, the SACAA also conducts independent audits. This is done to ensure safety of the passengers is not compromised and this is in line with one of the Airline’s values.

(1)(a) South African Express has a Wet Lease Agreement on an ad hoc basis with Star Air Cargo which was signed in February 2015 and the contract expires in April 2017.

(1) (b) Star Air Cargo was engaged to mitigate the inherent challenges of an aging fleet and scheduled and unscheduled maintenance of aircraft.

(1)(c) Due to the nature of the Wet Lease Agreement, SA Express signs Non-Disclosure Agreement with respective lessors in order to protect each parties’ “Intellectual Property”.

Investigation that was conducted on 21/10/2016 in Kempton Park at Edleen Primary School situated on corner of Klipspringer and Parklands drive in Ester Park. The inspector conducted an inspection at the above mentioned primary school at which there was a complaint of structural damage to the building. The main block, housing the boys toilets, have been locked due to a crack on the wall. Housekeeping of the store rooms in the classes is not being maintained and majority of classes have roof leaks. The inspectors were accompanied by the deputy principal Mr Ryno Rheeder and an employee, Mr Kennedy Ramoshaba, during the Inspection. Due to roof leaks, ceilings in various areas are no longer in a good condition. Toilet facilities were recently renovated and are in good condition, however, four of the toilets demarcated for the school boys are not in use due to cracks in the wall. There are five classes containing possible asbestos related material being used that are not in a good condition, the alleged asbestos walls are however painted, thus limiting the possible risk. The school needs to prioritise the assessment of those five classes containing alleged asbestos material. The School has been requested to furnish the inspector with an action plan that will be communicated to all the relevant stakeholders. A Contravention Notice has been issued relating to matters of non compliance. A follow up will be conducted in 30 November 2016 due to the fact that schools will be closed for December holidays.

Reply:

(1)(a)(i)(ii) Before the publication thereof for public comment, I deemed it necessary to present the Bill to some stakeholders, which included School Governing Body Associations and Education Sector Unions. Some of these stakeholders commented on the Bill during the presentations, and some subsequently provided the Department with written comments on the Bill. After all the options had been weighed up, it was decided that the comments submitted by these stakeholders should be considered and, where there was merit, incorporated into the draft Bill before the Bill is published for public comment.

The Bill must further be subjected to the Socio-Economic Impact Assessment System (SEIAS). This is a new requirement that was introduced by the Presidency this year for all new legislation and policy as well as amendments to existing legislation and policy.

(b) Some of the recommendations in the Ministerial Task team report that require legislative changes are still being considered and is subjected to a sector intensive internal review such as consultation with key stakeholders in the sector.

(1) The Department of Public Works (DPW) is currently not conducting maintenance to the buildings at the homestead of the President of the Republic of South Africa, Mr J G Zuma, situated in Nkandla, KwaZulu-Natal Province. As indicated in a previous reply to a similar Parliamentary question, the DPW has placed four general workers, employed on contract for three years, at the President’s homestead at Nkandla. Their main duties are to clean up and maintain the gardens at the State Domestic Facilities adjacent to the President’s homestead. These are facilities that are used mainly by the South African Police Services (SAPS). However, there has been an expense that has been incurred of R10,611.89 through the purchase of materials for maintenance work done on the VIP guard house at the homestead.

(2) The Department will be responsible for the maintenance of all security measures, which were installed in the homestead and general maintenance of all State properties; e.g. the Clinic, Pilot house and the houses for SAPS members.

(a) The Director-General of Basic Education has signed and submitted a Performance agreement. The HOD of Gauteng Department of Education, the Mpumalanga Department of Education and the Acting HOD of the KZN Department of Education have signed performance agreements. Only three Provincial Education Departments have responded..

(a) The Director-General of the Department of Basic Education had not received a performance bonus as he will be considered in the next cycle only because of his appointment in August 2015. The HOD of the Gauteng Department of Education did not receive a performance bonus for 2015/16 cycle, as he had completed a year in this position. The Acting HOD of the KZN Education department has not been assessed for the 2015/16 financial year. No responses from other Education Departments on this matter to date.

(1) What is the current status of the case that is before the Labour Court involving an employee of the Construction Industry Development Board (CIDB) who was dismissed in February 2015; (2) what (a) is the current status of the CIDB’s three-year review of the Infrastructure Delivery Management Tool which it has failed to achieve to date and (b) steps are being taken to ensure that this does not recur in the future; (3) what are the full details of the CIDB’s plans to address the six top areas of concern as identified by its organisation culture study?

The Minister of Public Works

(1) In May 2015, the Construction Industry Development Board (CIDB) filed a review application challenging the Commission for Conciliation, Mediation and Arbitration (CCMA) decision.

  • On 25 November 2015 the CIDB filed its heads of arguments followed by the lawyers of the employee in question a week later.
  • The matter is ready for hearing and both parties are waiting for the Registrar of the Labour Court to allocate a hearing date.

(2)(a) The Infrastructure Delivery Management Toolkit (IDMT) has its origins in 2001 when the National Treasury commissioned a review of the poor performance of provincial infrastructure delivery systems resulting in the establishment of the Infrastructure Delivery Improvement Programme (IDIP) and the Toolkit. The National Treasury enlisted the support of the National Department of Public Works (NDPW), the Development Bank South Africa (DBSA) and the CIDB as partners to the IDIP. The CIDB was responsible for the management of the content of the Toolkit, the hosting of the Toolkit on the CIDB website, and providing support and training on its implementation and rollout, where necessary.

The idea underlying the imperative of having the IDMT was to address the need for a documented body of knowledge and set of processes that represent generally recognised best practices in the delivery of infrastructure. It was to be focused on the delivery and life cycle management of public sector infrastructure. The Toolkit was therefore designed as a valuable resource to provide a national common knowledge base and set of practices to assist in delivering these services in a manner that is effective, efficient and consistent across provinces and departments. The Infrastructure Delivery Management System (IDMS) and the Toolkit have evolved over the years since their inception in 2004.

(b) In the past the IDMS and the Toolkit were revised and enhanced every three to four years, but National Treasury identified a need to separate the supply chain for goods and services from the supply chain for infrastructure to unblock some of the infrastructure delivery management chain challenges. As a result, the revision and enhancements of the IDMS and Toolkit had to be delayed to allow for the development of the Standard for Infrastructure Procurement and Delivery Management (SIPDM). The SIPDM is a National Treasury regulatory instruction issued in terms of the Public Finance Management Act, 1999 [Act No. 1 of 1999] (PFMA), and it will assist in ensuring support for the implementation of the IDMS.

The current 2010 edition of the Toolkit enhancement and revision is being reviewed under the auspices of National Treasury. The enhancements and revisions will focus on the following:

  • aligning the existing 2010 IDMS with the Standard for Infrastructure Procurement and Delivery Management (SIPDM);
  • aligning the current linear depiction of the IDMS to the new IDMS Control Framework, which emphasises the linkages between core delivery processes;
  • incorporate institutional capacity building approaches, methodologies and toolkits;
  • simplify existing delivery management processes and deliverables;
  • provide for the development and incorporation of Standard Operating Procedures from provinces;
  • standardise the ‘Supporting Information’ requirements;
  • capture and incorporate best practice methodologies and examples;
  • develop an information technology platform to serve as the single source for infrastructure delivery related information (i.e. an Infrastructure Delivery Management Body of Knowledge (IDMBOK));
  • incorporate local government infrastructure delivery requirements (where possible).

Once the enhanced IDMS and Toolkit are complete, they will be hosted on the CIDB website until such time that the prototype information technology platform is developed by National Treasury.

(3) The top six areas of the CIDB culture study are as follows:

  3. Leadership
  4. Structure
  5. Service Orientation
  6. Innovation

The CIDB’s plans to address the above are as follows:

CIDB has embarked on an organisational development methodology (OD exercise) which is a step-by-step process for assessing and re-shaping the structure and positions within the CIDB to better meet its strategic and operational goals. The integrative OD project plan is made up of 12 phases aimed at addressing not only the six top areas of concern as identified by the organisation culture study, but also areas for development as identified in the organisational architecture pilot study, CIDB five year review, 2016 employee engagement survey, etc.

Dimensional areas such as structure, leadership, learning and development and remuneration form the pivotal points of the organisation-wide OD exercise. CIDB had to first align the ‘hard issues’, i.e. mandate, strategy, processes, systems, structure and harmonise them with ‘soft issues’, i.e. culture, values, leadership, management style, communications, creativity and innovation. All these dimensions are addressed in the detailed OD project plan. For example, there is an exercise to review the existing processes and to develop the recommended business processes, dysfunctional aspects of work flow, structures and systems, and realignment with the envisaged operational realities/goals are aspects which are being attended to. There are also plans to digitise core business processes. Once this is done, it will assist the CIDB flow of communication, productivity and innovation as well as alleviate fraud and corruption.

In addressing learning and development issues, CIDB is in a process to finalise a new competency framework in order to be able to design the most appropriate competency assessment tools matching the competency framework for each level of employees. Once the competency gaps have been identified, the most appropriate training strategy based on the assessment gaps and outcomes will be developed. The development of the career-pathing framework is part of the training strategy design. It will further improve employee satisfaction, client satisfaction and service excellence. Furthermore, the newly developed training and development policy is also used as a vehicle by employees to continuously improve their competencies and academic up skilling.

In addressing some of the structure related soft issues, plans are also ahead to allocate tasks, reporting relationships and levels to provide means of achieving full CIDB alignment between people aspects and functions, or technical aspects. This will be addressed in the implementation of the structure design criteria and the new CIDB operating model.

Other related areas being addressed are job profiles, job evaluation and remuneration.

The OD exercise is seen by CIDB as a systematic approach for fundamental rethinking and radical redesign of business processes, eliminating non-value adding activities to achieve improvements in performance and productivity, efficiency in operational costs and turnaround times, customer service, quality and alignment of processes with the strategy.

Reply:

The Minister is aware of the meeting between the specified DAC official and the organisers of the Thank You SABC music concert which took place on 1 September 2016. The organisers insisted on the meeting with the official which took place on the side-lines of the launch of National Book Week, a DAC supported programme, which was held at the Apartheid Museum. The official concerned discussed the Thank You SABC project with the organisers and requested a project proposal and documentation from the organisers. A letter requesting support from the DAC for the event and two invoices by way of the requested proposal were received later on the same day. The official consulted with the relevant managers in the Department of Arts and Culture and the decision of the DAC was not to support the project.

Reply:

  1. A number of impact assessment studies have been conducted on the SKA site since 2006. The first Environmental Impact Assessment (EIA) study which focused on a 5km radius around the proposed KAT 7 radio telescope site was conducted in 2006 and a Record of Decision (RoD) was issued in October 2007. The second EIA study was undertaken in 2008, after the acquisition of the Meys Dam and Losberg Farms, which constitute the core site of the MeerKAT radio telescope. This study was undertaken to assess the impact of the MeerKAT. A RoD for this study was issued in July 2009. A Strategic Environmental Assessment (SEA) study is currently underway for phase 1 of the SKA project which is expected to begin in 2018.

Reply:

The Department of Basic Education (DBE) has not lost over the administration of the education system. However, the Department has recommendations that require short-term interventions and those that could be achieved in the long term. The Department has resumed the following actions on the recommendations that need short term intervention:

1. Performance Management:

The introduction of performance contracts for principals and deputy principals, in line with the DBE policy, in order to enhance accountability of educators. The Quality Management System (QMS) for assessing the performance of school-based educators was adopted at the Education Labour Relations Council (ELRC) in November 2014. It will be implemented in January 2017 after further consultation.

2. Amendment to Legislation:

The starting point of the reforms should be the amendment to the South African Schools Act and the Employment of Educators Act, in so far as it relates to the powers of the School Governing Bodies in appointment procedures. A draft Bill has been developed to deal with these amendments.

3. Amendments to current appointment procedures:

Amendment to current appointment procedures contained in Collective Agreements and the role Teacher Unions are being negotiated at the ELRC.

4. Introduction of Competency Assessment for School Principals:

Consultation on the guidelines for Competency Assessment is being finalised at the ELRC.

It was however found that: there is no first aid box/kit and no competent person to administer first aid; the fire fighting equipment are not serviced; copy of the act (Occupational Health and Safety Act) was not accessible to staff and the user of the premises failed to provide certificate of compliance for electrical installation. A contravention notice was issued to the employer.

Whether she visited the Hluhluwe-Imfolozi Game Reserve to assess the escalating incidence of rhino poaching (details furnished); if not, when does she plan to visit the specified game reserve?

Reply:

I have not recently visited the Hluhluwe-Imfolozi Game Reserve personally to assess the escalating incidence of rhino poaching. However, I am briefed on a regular basis by my staff regarding pertinent issues and am satisfied that all roleplayers, but more specifically the South African Police Service (SAPS) which has included the area in Operation Rhino 7 is focusing its efforts to intensify rhino protection in order to address the escalating security situation on site. The South African Police Service is also working closely with Ezemvelo KZN Wildlife and other role players within the security structure to ensure that our protection efforts bear fruit.

My latest briefing in this regard highlighted that:

1. SAPS has already made extra capacity available and has undertaken the responsibility of patrolling the Corridor Road (R618);

2. a command and control facility has been initiated at Hluhluwe-IMfolozi Park, similar to the one at the Kruger National Park;

3. replacement of the Hluhluwe-IMfolozi Park boundary fence has commenced, with Smart Fencing Technology being piloted on certain sections;

4. observation towers have also been built and funding has been allocated via an external project to fund the capacity to carry out the monitoring and surveillance;

5. a helicopter is based at Mpila iMfolozi Game Reserve to ensure rapid response;

6. night operating equipment has been distributed to Hluhluwe-IMfolozi operations staff;

7. all Hluhluwe-IMfolozi gates have monitoring systems in place;

8. a human resource redeployment and recruitment plan has been developed and submitted for implementation and funding to address operational vacancies;

9. Ezemvelo KZN Wildlife is in the process of dehorning identified, strategic small rhino populations in KwaZulu-Natal; and

10. the Provincial Cabinet has resolved to set up a task team via the KwaZulu-Natal Joint Crime Prevention Cluster, to investigate possible actions to combat and refocus efforts to tackle the increased poaching of rhino in KwaZulu-Natal. This task team has a six months mandate to come up with recommendations to the Provincial Cabinet.

With reference to his reply to question 1007 on 25 April 2016, what are the full details of the exceptional circumstances under which he granted citizenship to certain persons (names and details furnished)?

Reply:

Section 5(9) of the South African Citizenship, 1995 (Act No. 88 of 1995) (‘the Citizenship Act”) stipulates that the Minister may under exceptional circumstances grant a certificate of naturalisation as a South African citizen to an applicant who does not comply with the requirements of subsection (1)(c) relating to the residence or ordinary residence in the Republic. Furthermore, subsequent to the refusal of an application for naturalisation, an applicant may approach the Minister and submit a motivation containing material information for consideration as to the existence of exceptional circumstances justifying the granting of citizenship by means of naturalisation.

Mr Gupta and family submitted their motivation which presented exceptional circumstances for the consideration of the applications. This included presenting the company Oakbay Investments (Pty) Ltd which has interests in various sectors such as media, information technology, real estate, mining and related activities. The supporting documents submitted included the Department of Trade and Industry (DTI) company registration, as well as the formal registration and shareholding coupled with tax payments to and registration with the South African Revenue Services (SARS). The company also submitted supporting documents reflecting employment of approximately 7000 permanent employees.

The fact that Mr Gupta and family contribute to the economy of South Africa, provided substantive grounds for consideration of their application for naturalisation under exceptional circumstances as stipulated in section 5(9) of the Citizenship Act.

Reply:

1. (a) Yes, Judge Motata is still on special leave with full pay.

(b) The complaints that were lodged against Judge Motata were referred by the Judicial Service Commission to a Judicial Conduct Tribunal to be investigated and reported on. The proceedings by the Judicial Conduct Tribunal were kept in abeyance following a series of legal challenges relating to the constitutionality of section 24 of the JSC Act which empowers the Tribunal President to appoint a member of the National Prosecuting Authority to collect and adduce evidence on behalf of the Tribunal. Following the conclusion of the legal challenges at the Constitutional Court, Judge Motata launched his own application challenging the constitutionality of the amendments passed by Parliament in 2008 which brought about the complaints handling mechanism against Judges. This application has resulted in the proceedings at the Judicial Conduct Tribunal being postponed until the finalisation of Judge Motata’s application.

2. The matter is to be determined by the Judicial Conduct Tribunal however Judge Motata’s special leave is not subject to a condition that Judge would have to repay the moneys earned if he is found guilty of gross misconduct by the Judicial Conduct Tribunal.

3. The total amount that has been paid to Judge Motata for the period 01 January 2007 to 31 October 2016 is R13 919 622 .36

Reply:

The South African delegation attended the 45th Annual Rainbow Push Coalition Convention upon Ministerial invitation by Reverend Jesse Jackson, a founder and President of the Rainbow Push Coalition. It must remembered that Rev Jackson is one of the human rights activists who contributed immensely to the liberation struggle in Africa, and South Africa in particular.

The 45th Session of the conference provided a unique platform for the South African delegation to learn international best practices in respect of various social development areas such as racial, social and economic justice and social cohesion. Others includes strategies to address homelessness, the scourge of alcohol and substance abuse; violence against women and children, particularly in African American communities, youth development and improvement of access to education for disadvantaged communities. The delegation interacted and exchange ideas with young men and women from different countries including African Americans and the Diaspora.

(b) (i) The delegation was comprised as follows:

  • Ms Bathabile Dlamini, MP Honorable Minister of Social Development;
  • Ms Constance Nxumalo Deputy Director-General: Welfare Services;
  • Mr Oupa Ramachela Acting Deputy Director-General: Corporate Services;
  • Mr Abram Phahlamohlaka: Chief of Staff
  • Ms Mamokoena Mefolo: Director: Protocol Services.

(b) (ii) The two Deputy Directors-General provided support to the Minister on substantive issues while the Chief of Staff provided speech writing and administrative expertise to the Minister and the Director: Protocol Services provided both the secretariat and protocol support services.

(c) The cost came out of the Ministry budget. In an effort to contain the expenditure for international travel, particularly given the weak rand-dollar exchange rate, the Minister and the delegation utilised a cheaper airline and accommodation recommended by the Mission. The total cost of inclusive of airline tickets for the Minister and delegation, accommodation and ground transport was R547 413.19.

(d) The Minister and the entire delegation were accommodated at the Hyatt Regency McCormick Place, which is the hotel where the conference was held. The hotel rates for all delegates were negotiated by the conference organisers, the Rainbow Push Coalition.

  1. (a) The priority areas for the Funza Lushaka bursary did not specifically include the fields of special educational needs, braille and sign language education in the past three academic years. This is because universities have not offered the fields of special educational needs, braille and sign language as major subject areas in the Bachelor of Education (B Ed) degree and Post Graduate Certificate in Education (PGCE) up to now. However, there are universities that are preparing for the introduction of full programmes in this regard. It is for this reason that the Department has included an emphasis on bursaries for inclusive education in the 2017 Funza Lushaka Policy.

(b) As stated above universities have not offered the fields of special educational needs, braille and sign language as major subject areas in the Bachelor of Education (B Ed) degree and Post Graduate Certificate in Education (PGCE) up to now. There are therefore no students who graduated with these as major subject areas.

In light of her department’s budget report which reflects a saving of more than R1 billion due to lower than anticipated social grants that were paid out, (a) how many people are intended to be social grant recipients but are not on the system to receive grants, (b) why are they not on the system and (c) what steps will she take to ensure that every person that must receive a social grant is in the system and duly receives the grant?

Reply:

(a) Each year grant projections are done by the Department of Social Development together the South African Social Security Agency (SASSA) and National Treasury. These projections are based on a number of factors, including historical trends and micro-simulation which takes into account the demographics and economic circumstances of the country. The Department had targeted some 16.97 million beneficiaries across all grants for the 2015/16 financial year and reached 16.83 million beneficiaries, which is 99.1% of its projected target.

(b) SASSA is successfully meeting its targets. The 140 thousand difference between those projected and those reached falls within the 1% margin of error that the Department had set itself during the financial year for the projections. Similarly, more than 99% of the total R130 billion social grants budget was utilised, resulting in the R1 billion savings (which is less than 0.77%).

(c) In addition to the very vast footprint of SASSA which comprises of 389 offices and 1 163 service offices across the country, the following initiatives aim to ensure that every citizen has access to social grants. These include:

  • The Department of Social Development together with SASSA and the National Development Agency implement the Mikondzo programme. This programme focuses on taking all social development programmes to the people, through engagement with communities. This programme includes door-to-door interventions to identify and assist any citizens who could qualify for services, including social grants.
  • The ICROP programme. This is a planned outreach programme where SASSA services are taken to areas which are under-serviced or where the distance to the nearest SASSA office is very far. This ensures that everyone has access to SASSA services
  • The Regulations to the Social Assistance Act, 2004 were amended in 2008, to allow for applications for social grants to be taken for citizens who do not have identity documents or birth certificates for the children under their care.
  • SASSA has a programme which focuses on the uptake of child support grants for children aged between 0 – 1 years of age. This is done as all research has indicated that the earlier the child support grant is paid, the better the long term benefits for the child.
  • Communication programmes are constantly run to publicise the requirements for social grants, in particular the requirements of the means test.
