Hunsinger, Dr CH to ask the Minister of Transport
(1)What measures have been undertaken to replace SA Civil Aviation Authority’s Calibration Cessna Citation aircraft which crashed in January 2020; (2) whether there are any South African aviation companies that have both the aircraft and pilot’s skills that will ensure accurate calibration of the Republic’s main airports; if not, what is the position in this regard; if so, (3) were any of the specified companies approached to provide a quote on instrumentation calibration at any major airport; if not, why not; if so, on what date will operations commence?
Reply:
1. The SACAA went on an open tender to procure the services of a service provider who can provide calibration services to the SACAA FIU clients.The tender was advertised on 19 February 2020 and ultimately closed on 17 March 2020. A service provider was appointed according to the PFMA requirements and they commenced work on 22 August 2020. The permanent replacement has been halted for about 12 months due to financial constraints as a result of the Covid-19 pandemic.
2. As far as the SACAA is aware there is no service provider for flight calibration in South Africa other than the SACAA FIU, neither is there an aircraft in South Africa that is fitted with a flight inspection system.Flight Inspection requires specific flight profiles to enable specific tests to certify a landing system, these flight profiles are not common to general flying procedures and requires specific pilot training as the flight profiles are done at very low levels. Unless a South African pilot is conducting the same type of flying overseas, the SACAA is not aware that there are any SA pilots who are current on flight calibration flying at the moment.
3. The SACAA advertised an open tender and there was more than one SA company who participated in the tender. A South African company was eventually appointed even though they are using an aircraft and crew from Europe. The operations with the flight calibration service provider started on the 22 August 2020 and continuing.

- The list of police stations, is attached as Annexure A. All police stations have frontline service members, working in community service centres (CSCs), who have been trained in one or more of the following learning programmes:
Basic Training in Domestic Violence.

- Vulnerable Children
A directive was sent to all the SAPS provincial commissioners, indicating that SAPS members, who are deployed in CSCs and VFRs must be prioritised for training in victim empowerment, first responder sexual offences and domestic violence learning programmes.

Whether his department has distributed the Covid-19 relief grant to the taxi industry; if not, by what date will the specified measure be implemented; if so, (a) what (i) total number of taxi owners have benefited from the specified grant to date and (ii) criteria were used to identify the qualifying taxi owners and (b) who have been the recipients?
Reply:
1. The Department secured a once-off relief fund to the tune of R1,135 million, as part of government’s response package. The funds werebased on a principle of ex gratia payment and were not intended to compensate for loss of income. The following conditions were put in place for operators to qualify for the relief:
- The taxi operation must be formally registered as a business entity,
- The business must be registered for Income Tax and other applicable taxes related to running a business in South Africa
- The registration process should also include registration of employees with the Unemployment Insurance Fund, Compensation Commission etc.
- They must be in possession of a valid Operating License or receipt as proof of application for an operating license.
The qualifying criteria was developed as an opportunity to formalise the taxi industry. The benefits of using the relief process as a springboard towards formalisation is that, once the industry is formalised, it would be equipped for future participation in, amongst others, subsidisation. In this regard, the Department solicited the services of the South African Revenue Service as the vendor and Implementation Agency to administer the disbursement of the relief funds primarily due to their experience and capacity in dealing with such systems but also to authenticate the registration of these operators as business entities. Regardless of extensive consultationsbetween the Department and the taxi industry, the industry objected the conditions put in place as qualifying criteria arguing that the conditions were too stringent. The relief process has since stalled and the funds have not been distributed to date.
2. Therefore:
a) i) No taxi owner has benefited from the scheme to date
ii) Qualifying criteria are as per 1.1 to 1.4 above
b) Funds have not been disbursed todate

With reference to South Africa's Civil Aviation and Air Traffic Navigation Systems, (a) how are the standards of the Republic's airports maintained and (b) what are consequences when the standards are not maintained and/or complied with in respect of (i) instrument landing systems, (ii) very high frequency omni-directional range and (iii) distance-measuring equipment?

South African Civil Aviation Authority (SACAA)
a (i) (ii) (iii) The Air Navigation Service Provider (ANSP) and in this case the Air Traffic and Navigation Services (ATNS) is required to maintain Air Navigation Systems (Instrument Landing Systems (ILS), Very High Frequency Omni-directional Radio Range (VOR) and Distance-Measuring Equipment (DME) in accordance with ICAO Standards and Recommended Practices, Part 171 of the Civil Aviation Regulations and the SA-CATS 171. One of the SA-CATS 171 requirements is that all Air Navigation Systems must be subjected to periodic flight calibration, which is 150 days for the ILS and one (1) year for the VOR and DME. Each stipulated period has an automatic tolerance of 30 days. On expiry of the tolerance period, the ANSP can apply for 25 days extension if flight calibration of the system is not possible and provided that the system proved to be stable during three (3) consecutive flight calibrations which were conducted by an approved Flight Inspection Organisation. If flight calibration of the system is still not possible after expiry of the extended period, the ANSP can apply for an exemption for a period not exceeding 180 days.
b) The ANSP is required to switch off any Air Navigation System which cannot be operated in accordance with the prescribed standards and notify all users of the facility to avoid its usage in air navigation. This may result in some airports being downgraded. In addition, a NOTAM must be published to notify air crews of the status of facilities in the airports so that they plan their flights safeiy in relation to this status. Lastly the result of switching off the ILSes at airports means that pilots may not be able to land at airports when there are inclement weather conditions. However, operations at the airports can continue as required as there are prescribed safety standards that must be followed by pilots.

What are details of the criteria used by the Passenger Rail Agency of South Africa to absorb the existing security personnel?
Reply:
PRASA has a Recruitment and Selection policy which amongst other things details the minimum qualifications, experience and skills for advertised positions. It is also important to note that this was not an automatic absorption of security personnel, but a thorough, comprehensive and rigorous recruitment and selection process to identify fit for purpose security personnel.
In this regard, the minimum educational criteria was a Matric certificate or NQF Level 4 equivalent as well as minimum Grade C PSIRA registration. Other minimum requirements included clear criminal record with no pending cases, 6 months security operation experience, medically fit and clean bill of health. The candidates were also required to participate in physical activities including completing a 2.4 km run within a specified time frame.

Considering the need for social distancing to prevent the spread of Covid-19, (a) how are social distancing measures enforced on aircraft and (b) what measures are in place to prevent the spread of the coronavirus on aircraft?

South African Civil Aviation Authority (SACAA)
a) The front and back rowsof the aircraft are left open to ensure that if a suspected case is picked up on board the passenger will be isolated during flight. The 1,5 – 2metre social distancing is not applied inside the aircraft because the new generation aircraft are fitted withsophisticated air filters calledHigh-Efficiency-Particulate Air Filters / Arrestors (HEPA) which cleans the air in the aircraft every 3 minutes and purifies the air circulation with 99,99% efficiency. These filters have been proven through tests to provide air that meets the standards set for theatres in hospitals. This is a much higher rate of flow than people experience in other indoor environments and means that passengers are provided with about 80 times as much air as they need to breathe.
b) Additional risk mitigation measures are well articulated in the guidelines / protocols that were issued by the Minister of Transport and which are implemented by all air operators including airports. These protocols start as passengers arrive and enter the airport terminal building, to when the passengersaboard the aircraft and until they arrive at the destination. These measures include among others the following:
- Screening of passengers as they enter the terminal building;
- Compulsory wearing of masks;
- Filling in of health declarations and collecting information for contact tracing purposes;
- Markings of airport floors ensuring social distancing;
- Regular sanitising and washing of hands and disinfection of all touchpoints e.g. check in counters, boarding, baggage trolleys, security check points etc.;
- Self-service and contactless check-in and boarding processes;
- Staggered boarding and disembarkation of passengers;
- Compulsory wearing of masks on board an aircraft and throughout the journey;
- Limited movement on board an aircraft;
- On-board magazines distribution discontinued;
- Pre-packaged meals where they are served;
- Aircraft are disinfected before each flight, amongst others.

(1)On what grounds was parole granted to Theo Jackson and Willem Oosthuizen in the case commonly known as the coffin case; (2) What legal provisions did he and/or his department rely upon when the parole for each person was subsequently revoked; (3) What legal provisions may his department rely upon to revoke a person’s parole when parole conditions were not violated; (4) Whether he will make a statement on the matter?

1. The Witbank Parole Board granted offenders parole on the following grounds:

(i)Willem Oosthuizen
The offender has no previous conviction and has one disciplinary offence recorded against him. He underwent Anger Management and Cross Roads (life Skills) programmes and he also completed Human Resources Management N4. He qualified for twelve (12) months special remission of sentence and his support system is positive and suitable for parole requirements.
In addition, the offender was subjected to a compulsory pre-release programme and taking of DNA buccal sample. Parole was approved for
05 March 2020 to 26 October 2021.
(ii) Mr Theo Jackson
The offenderhas no disciplinary offence and no previous conviction recorded against him. He underwent Anger Management and Life Skills programmes and he also completed vegetables and plant production skills courses. He benefitted twelve (12) months special remission of sentenceand his support system is positive and suitable for parole requirements.
The offender was subjected to a compulsory pre-release programme and taking of DNA buccal sample.Parole was approved for 27 February 2020 to 26 October 2021.
However, it became apparent that placement on parole of these offenders was approved without their Correctional Sentence Plans being fully implemented as the Parole Board indicated that the offenders can do Victim Offender Dialogue at Community Corrections.

The decision of the Witbank Parole Board was referred to the Correctional Supervision and Parole Review Board (Review Board) in accordance with section 75(8) of the Correctional Services Act, 1998 (Act No. 111 of 1998) and this meant that the decision of the Witbank Parole Board was suspended pending the decision of the Review Board. Section 75(8) provides as follows:
(8) A decision of the Board is final except that the Minister, the National Commissioner or the Inspecting Judge may refer the matter to the Correctional Supervision and Parole Review Board for reconsideration, in which case—
(a) the decision of the Board is suspended pending the outcome of the decision of the Correctional Supervision and Parole Review Board; and
The decision of the Witbank Parole Board was referred to the Review Board because Restorative Justice process was not held between the offenders and the victim as prescribed by their Correctional Sentence Plans and that the victim was not given a chance to make representations to the Witbank Parole Board in line with section 75(4) of Act 111 of 1998 read with section 299A of the Criminal Procedure Act, 1977 (Act No. 51 of 1977).
Parole placement was not revoked due to the fact that the offenders had violated parole conditions but it was revoked because the decision of the Witbank Parole Board in respect of these offenders was referred to the Review Board in line with section 75(8) of Act No. 111 of 1998.
A parolee remains a sentenced offender and parole is a privilege and not right that an offender can lay claim to.

With regard to the total number of firearms handed over to SA Police Service during the firearm amnesty ending May 2020, what total number of the firearms (a) have been tested through the Integrated Ballistics Identification System, (b) have been linked to the commission of a crime, (c) have been destroyed and (d) are subject to a license renewal application?
Reply:
a) A total of 7 170 amnesty firearms were tested through the Integrated Ballistics Identification System (IBIS), up until 31 May 2020.
b) The Forensic Science Laboratory (FSL) linked a total of 108 amnesty firearms to previously received ballistics cases, by means of the serial numbers. One amnesty firearm was linked to a previous case, by means of ballistics.
c) No firearms, which were handed over to the South African Police Service (SAPS) during the firearm amnesty, which ended on 31 May 2020, have been destroyed.
d) No firearms, which were handed over to the SAPS during the firearm amnesty, which ended on 31 May 2020, are subject to a license renewal application.

In light of the fact that his department reported that it would progressively roll out the Border Management Authority (BMA) in phases and that the President, Mr M C Ramaphosa, has signed the Bill into law, what are the relevant details of the plans of his department to roll out in order to ensure a successful implementation of the BMA over the medium term?
Reply:
The Border Management Authority (BMA) Act of 2020 establishes the BMA, which will be responsible for the implementation of border law enforcement functions, except customs functions, at Ports of Entry and within the maritime and land border enforcement areas of the country.
A BMA Road Map is in place, which will guide the roll-out of the BMA over the short-, medium- and long-term. This 15- year road map is being implemented in an incremental manner over of six (6) phases. The immediate focus in 2020/21 and 2021/22 will be on the first three (3) phases that address:
- Phase 1: Completing tasks from the Pre-Establishment Phase;
- Phase 2: Undertaking tasks linked to the Planning and Establishment Phase; and
- Phase 3: Commencing implementation of the Phase dealing with Initial Roll-Out of the BMA.
Each of these phases have specific identified tasks. Within the context of the limited funding made available to the BMA over the current 2020 MTEF of R109,5m, these priorities and tasks will be flexibly executed. The objective over the current term of government, i.e. 2020 – 2024, is to roll-out the BMA to eighteen (18) Ports of Entry and five (5) segments of the land border enforcement area.
Presently the Department of Home Affairs is focusing on the following immediate tasks:
- Finalisation of key BMA legislative instruments which will enable the implementation of the BMA, i.e;
- The BMA Commencement Proclamation; and
- A Section 97 Presidential Proclamation pertaining to the transfer of border law enforcement functions from relevant organs of state to the Minister of Home Affairs, who in turn will delegate these functions to the BMA.
- Preparations for the recruitment and appointment of a Commissioner and two Deputy Commissioners for the BMA. This is key as the Commissioner, in terms of the BMA Act 2020, is legally mandated to recruit and appoint officials of the BMA and the officers of the BMA Border Guard.
- Finalisation of separate Implementation Protocols, as required by the BMA Act 2020, between the BMA and the South African Police Service (SAPS), South African Revenue Service (SARS), and the Department of Defence. These Protocols will inform the working relationship between the BMA and these organs of state.
- Urgent finalisation and implementation of a BMA Border Guard mobilisation, training and deployment strategy which will be implemented for the initial roll-out in 2020/21 across targeted segments of the land border law enforcement area.

(1)Whether the National Treasury will offer any form of Covid-19 financial and/or other relief to small businesses; if not, why not; if so, what are the relevant details; (2) whether the Covid-19 financial and/or other relief will only be allocated to qualifying small businesses according to the Broad-Based Black Economic Empowerment Act, Act 53 of 2003, as amended; if not, what is the position in this regard; if so, (a) on what statutory grounds and/or provisions does he or the National Treasury rely to allocate Covid-19 financial or other relief only to small businesses according to the specified Act and (b) what form of Covid-19 financial or other relief, if any, will be made available to other small businesses?
Reply:
1. Yes, the President announced financial relief matters by Government to small businesses and individuals on 24 March 2020,two or three days before the first lockdown, and a second round of measures on 21 April 2020. A loan guarantee scheme was launched on 4 May 2020 and amended on 27 July 2020.National Treasury is part of Government, and does not act separately from it, but administers two of these measures whilst other departments administer others. I will deal with these two measures, and not those that are administered by other departments on behalf of Government. Bear in mind that with the totally unexpected COVID-lockdown that the country had to suddenly impose at midnight 26 March 2020, we had to find mechanisms that could reach thousands of businesses quickly, hence the intervention via the tax system and banks.
The first set of measures dealt with a number of tax measures to provide financial relief to small businesses, which were announced by the Minister of Finance on 24 March and 21 April 2020. These include tax deferrals for pay-as-you-earn payments and for provisional income tax payments for businesses with a turnover of less than R100 million, a four-month exemption from the skills development levy and an expansion in the employment tax incentive for four months, which will apply to all employees with a monthly income of up to R6 500. These provisions are included in the Draft Disaster Management Tax Relief Bill and the Draft Disaster Management Tax Relief Administration Bill, which have been passed by the National Assembly. The second measure is the COVID-19 loan guarantee scheme for eligible small businesseswhich came into effect on 12 May 2020, details of which were jointly announced by National Treasury, South African Reserve Bank and the Banking Association of South Africa. The loan guarantee scheme is an initiative for banks to provide loansfrom their own funds to their customersto eligible individuals and businesses, and where the banks take the first set of losses up to 8,5%, with the rest of the losses guaranteed by government.Since updating the initial criteria at the end of July, funds borrowed from banks through this scheme can be used for operational expenses or to restart their businesses as soon as lockdown restrictions applicable to the business is lifted. Loans are capped at R100m per loan and may be offered as syndicated loans by the banks were the loan amount exceeds R50m. Government and commercial banks are sharing the risks of these loans. Initially, the National Treasury has provided a guarantee of R100 billion to this scheme, with the option to increase the guarantee to R200 billion if necessary. It should be emphasized that this is a loan guarantee scheme and not a grant, and that funds for the loans are from participating banks and not Government. It is also the intention of the National Treasury that such lending should not be made recklessly, and that the loans that will be paid back to the respectivebanks. National Treasury does notintend for the entire R200 billion to be called in full, since it will have a negative impact on the fiscus nor for this or any other scheme to ever cover the full extent of losses incurred by businesses due to the COVID-19 pandemic.

(1)Whether her department has allocated a budget for the construction of houses in Nieu-Bethesda in the Eastern Cape; if not, why not; if so, (a) what total number of houses will be built, (b) what progress has been made with regard to the various approvals including Water Use Licence Authorisation and (c) on what date is commencement envisaged; (2) whether, with reference to delays that may persist for more than six months, her department has contingency plans in place to assist with temporary relief housing for families who have nowhere to live, given that no houses have been built in the past 24 years in Nieu-Bethesda; if not, what is the position in this regard; if so, what are the relevant details?
Reply:
(1) The Eastern Cape Department of Human Settlements (ECDHS) approved funding to the amount of R1 708 350, 70 for the planning and design stage of the construction of houses in Nieu-Bethesda in the Eastern Cape. The planning and design stage is scheduled for completion by March 2022. The budget for internal services infrastructure will be allocated in 2022/23 financial year (October 2022) and the budget for the construction of houses will be allocated in the 2023/24 financial year.
(a) The initial number of houses to be built was 250, however, the project scope had to be reduced to 173 due to the surrounding wetland. Upon submission of the Basic Assessment Report (BAR) to the Department of Economic Development, Environmental Affairs and Tourism (DEDEAT), the project was further reduced to 100 erven in order to move the development to a safety zone, further away from the wetland.

Layout Plan Approval |
A large portion of the land bought by the Beyers Naude Local Municipality (BNLM) for development has upon investigation proven to be undevelopable due to an existing wetland that covers much of the area between Nieu Bethesda and Pienaarsig. The seasonal nature of the wetland was deemed to be problematic for development and has reduced the remaining developable land to only 100 erven that can be accommodated within the demarcated area. This required the town planner to go through several layout changes before the ideal layout could be agreed on with the available land. These options also had to be discussed with the community on more than one occasion. The Layout Plan is currently with the BNLM and will be subjected to the requisite approval processes. |
Environmental Impact Assessment (EIA) Approval |
The Basic Assessment Report was revised and submitted to DEDEAT. Thereafter, the DEDEAT will issue a Record of Decision (RoD). |
WULA |
The Water Use Licence Application (WULA) documentation had been prepared for the original layout plan but a wetland was discovered on the initial project area. The discovery of the wetland prompted a revision of the WULA study. The revision of the study is underway. |
Engineering Designs |
The preliminary engineering designs for the provision of bulk infrastructure services were completed in May 2015. Following the identification of a wetland on the planned development area, the final engineering designs had to be amended. |
Land Survey |
A Land Survey had already been done on the original layout plan on which some land portions were later declared undevelopable due to the wetland. The Land Surveyor will survey additional areas which were not initially included in the planned developable area. |
(b) The planning stage will be completed in March 2022 due to the process of Water Use Licence Application (WULA) and the Environmental Impact Assessment (EIA) approvals. It is envisaged that the installation of services will start in October 2022 and the Construction of houses in April 2023.
(2) Yes, there is a contingency plan in place in terms of which the ECDHS, (Sarah Baartman Regional Office) has requested the Dr Beyers Naude Local Municipality to identify the destitute and vulnerable families in the area, who will be allocated with Temporary Residential Units (TRU). To this end, the municipality has identified and profiled seven destitute families who are scheduled to receive their TRUs by end of October 2020.

Whether the National Forensic Science Laboratories are accredited by the International Organization for Standardization; if not, why not; if so, on what date was each laboratory accredited;
Reply:
(1).Internationally, the accreditation of laboratories is a voluntary scheme, which is open to any laboratory performing testing and/or calibration. No current legislation exists, which requires accreditation as a prerequisite, for acceptance of scientific test results in legal proceedings when the credibility of the results can be proven according to full traceability of processes and materials, used to produce a result or finding.
Currently, the South African Police Service (SAPS) Forensic Science Laboratory (FSL), is not an accredited laboratory, as per ISO 17025:2017. However, it is working towards obtaining accreditation, as a laboratory testing facility. Such accreditation status only provides a benefit, in terms of the Accreditation for Conformity Assessment, Calibration and Good Laboratory Practice Act, 2006 (Act No. 19 of 2006).
The FSL has a developed a Quality Management System (QMS), which is in line with ISO 17025:2017, through which the credibility of the results can be proven. Forensic analysts in the environment, are subjected to forensic training and mentoring programmes, prior to performing duties independently. Cases are subjected to peer review, as part of quality control. The FSL also participates in a proficiency testing programme, to provide confidence in test results and to monitor the performance of analysts.
The methods employed for analyses within the FSL are internationally accepted and have been used for many years. The methods are largely based on a qualitative comparison analysis, using certified reference materials, which are fully traceable.
The accreditation status does not prevent the FSL from providing forensic services, as Courts of Law will evaluate all the evidence and decide, on a case to case basis, the acceptability of the scientific evidence submitted.
(2) The Ballistics Section of the FSL is not registered with the Association of Firearms and Toolmarks Examiners (AFTE). The AFTE registers individuals and not institutions. It is not compulsory to be an AFTE registered member, to conduct forensic ballistics examinations, in South Africa. The fact that the Ballistics Section of the FSL is not registered with the AFTE, has no impact on the duties conducted by the personnel of the Ballistics Section, nor their testimony in Courts of Law.

The types of awareness campaigns, which will be used by the South African Police Service (SAPS), to successfully communicate the firearm amnesty 2020/2021 to the public, are as follows:
▪ Announcements on all the SAPS social media platforms.
▪ Live reads through the South African Broadcasting Corporation (SABC) radio stations, from September 2020 to December 2020, promoting the image of the SAPS and creating awareness of the firearm amnesty, as well as the purpose thereof.
▪ Television campaigns, for example, Squeeze Back, on the SABC television channels, in November 2020, promoting the image of the SAPS and creating awareness of the firearm amnesty, as well as the purpose thereof.
▪ Television campaigns, in the form of Digital Brand Integration, in September 2020 and October 2020, promoting the image of the SAPS and creating awareness of the firearm amnesty, as well as the purpose thereof.
▪ National printed media campaigns- announcements in September 2020, in the form of strip advertising in the Caxton Group, knock and drop newspapers.

Masipa, Mr NP to ask the Minister of Agriculture, Land Reform and Rural Development
Whether, in light of her department not extending the four-month national state of disaster beyond 4 July 2020, she will provide details of the (a) consultations that took place with both the provinces and the agri-businesses affected by drought in this regard, (b) prevailing climatic conditions, land care report and veld management conditions that guided the termination of the national state of disaster whilst many provinces are still grappling with the disaster and (c) dam levels of the drought-affected provinces; (2) whether she has found that the prevailing conditions are conducive for productive farming; if not, what is the position in this regard; if so, what are the relevant details?
Reply:
(1)(a) Yes.Though the declaration (termination or extension thereof) of a national state of disaster lies with the Ministry of Cooperative Governance and Traditional Affairs (CoGTA), consultations were made with all relevant sectors. It was agreed that while implementing drought assistance to the affected provinces, it is also timely to implement adaptation as drought seems to be a frequently recurring if not permanent feature currently. As such, sectors should move towards strengthening adaptation and mitigation strategies so that farmers can be resilient to withstand future droughts. It is also important to note that the drought funds allocated to provinces that they had applied for, they are currently implementing, despite the national state of disaster terminated.
(b) In terms of the prevailing conditions, winter rainfall areas received a mixture of normal to above normal rainfall in June and the beginning of July. Water restrictions remain in place in some provinces while the average level of major dams has increased in most parts of the country. The veld is generally in reasonable condition in many summer rainfall areas. However, farmers are encouraged to supplement feed for their livestock. Livestock is in fair to good condition. Veld fires have been reported in some provinces and farmers were advised to be on the lookout for warnings to stop the outbreaks and spread.
Comparing the vegetation to long-term average, the Normalized Vegetation Index (NDVI) difference map for June shows that vegetation activity was much lower over the western and northern parts of the country while central parts experienced much higher vegetation activity.In summary, seasonal rainfall forecast is anticipated to be above normal in early spring over the south-western and southern parts of South Africa as well as during spring over the eastern parts and south-western parts of South Africa. The monthly advisories issued by Department of Agriculture, Land Reform and Rural Development (DALRRD) encouraged farmers to continually check updated advisories, seasonal forecasts and utilize 7 day weather forecasts for short term planning.
(c) Information received from the Department of Water and Sanitation showed that in most provinces dam levels are either similar or higher compared to July of 2019 and 2020 including the drought-affected provinces.
2. The decision to terminate or extend the national state of a disaster lies with the Ministry of Cooperative Governance and Traditional Affairs (CoGTA) in consultation with relevant experts; therefore, the Minister of CoGTA is best placed to respond to this part. The consensus reached is that the country, after considering all facts needed to strengthen implementation of risk reduction strategies.

Whether he will consider an instruction that in cases where women were married by way of a Nikah or Muslim marriage the proposed entry widowed instead of the present entry never married should be used on Muslim death certificates; if so, by what date can the specified proposal be implemented?
Reply:
I wish to point to the honourable member that the designation of “never married” does not affect people in Nikah or Muslim marriages only.
A broad range of South Africans are affected by this problem.
- Prior to 1994 various laws were used by the different self governing territories or Bantustans wherein each had their own act. When they were amalgamated in the broader South Africa after 1994, they were not on National Population Register.
- Unfortunately when a marriage does not appear on the National Population Register (NPA) the person’s marital status is technically unknown. Hence their death certificates at death, their certificate reflected as never married.
- This affects people who stayed in Bantustans and those from the Indian Community whose marriages were never re-registered on the NPA after 1994.
- Since the introduction of Recognition of Customary Marriages Act. Act 102 of 1998 the government managed to re-register some. Those not yet re-registered still have this unfortunate designation.
- The Department acknowledges this problem but opted for a wholesale change in the entire marriage regime by developing a totally new policy. We don’t believe a piece meal solution will help.

Based on the broken trust relationship between the organisation and the employee, a mutual separation agreement of three months was entered into. He was paid an amount of R564 300, 00 before tax.
Ms Sibongile Jabulile Tlhako was the Executive: Supply Chain Management. Her contract terminated on 05 August 2018. She was suspended and charged on allegations of poor management of contractors and other irregularities in the Supply Chain Environment. Upon receiving the charges, she requested to get into mutual separation agreement with the organization, which the then CEO approved at 3 months to avoid the costs of a lengthy litigation. The decision was also taken to ensure that the organization could speedily appoint a replacement considering the significance of the SCM division within SITA. She was paid an amount of R291 710, 04 before tax.
Mr Johnson Mzuvakile Dyodo’s case related to conflict of interest and procurement irregularities. During the disciplinary hearing proceedings, the parties came to an agreement to mutually separate on the basis of broken trust relationship. He was therefore paid his salary for the month of termination and an additional month’s salary as notice period. Her contract was terminated on 31 July 2018 and paid an amount of R468 187, 32.
Ms Fikiswa Njongwe was dismissed on 31 July 2017 following forensic investigations. She challenged the case at CCMA which resulted in an award in her favour including interest of what was owed. The legal department filed for a review at the labour court, however, was advised to rather engage in a settlement with Ms Njongwe. The settlement was made on June 2020 and the amount that was eventually negotiated and paid out was R1 m lower than the CCMA award. She was paid an amount of R1 521 716, 69.

1. The Department of Small Business Development (DSBD) is not responsible for the National Credit Guarantee Scheme as it is being implemented by National Treasury with the Reserve bank through the Commercial Banks.
2. The Department of Small Business Development (DSBD) was not requested to provide inputs in the development of the Loan Guarantee Scheme. However, since it became apparent that the National Credit Guarantee Scheme is not succeeding to fund mainly black owned small businesses that are continuously being rejected despite the relaxation of the funding criterion, the Department together with the Small Enterprise Finance Agency (sefa), have tabled a proposal to National Treasury to accommodate Khula Credit Guarantee (sefa subsidiary) to participate in the National Credit Guarantee Scheme in address the apparent market failure. The proposal is awaiting the decision of the Minister of Finance.

What are the reasons that her department has been telling persons who apply for the disability grant to rather apply for the R350 social relief of distress grant?
Reply:
During the lockdown levels 4 and 5 restrictions imposed to prevent the spread of the corona virus, SASSA offices were initially closed, and when they were opened under level 4 restrictions, only limited services were offered. As a result, no applications for disability grants could be dealt with, as the assessments, which are done at health facilities, could not take place. The medical assessment is a prerequisite for any disability grant application.
When level 4 regulations were announced, it was unknown how long the restrictions would remain in force. This resulted in some staff members advising potential applicants for disability grants to apply for the special relief grant of R350, in an effort to ensure that they would at least receive some income for the period until the disability related services could commence once again.
However, under level 3 restrictions, SASSA has started reintroducing disability related services, and accepting applications once again according to an approved strategy. This means disability services will be limited where there is a dependency on health facilities.
In order to facilitate access to assessment services, SASSA has engaged with the Provincial Departments of Health to identify facilities where assessments can be done by the SASSA contracted doctors. Where this is not possible, SASSA has identified spaces within the local offices for assessments to be undertaken. Despite these measures, services cannot yet be offered at full capacity. This will be progressively increased, in line with available resources.

a) The Department of Small Business Development (DSBD) has not only advocated for the interest of women, youth and persons with disabilities in economic participation but has set specific targets to actively support businesses owned by women, youth and persons with disabilities included across its agencies.
The Department and its agencies (SEDA and sefa) have the following targets that are applicable for both financial and non-financial support across its implemented programmes:
Minimum of 40% of small-businesses supported must be women-owned and managed;
Minimum of 30% of small-businesses supported must be youth-owned and managed; and
Minimum of 6% of small-businesses supported must be owned and managed by persons with disabilities
In its reporting, the Department and its agencies report on progress that has been made in achieving these targets.
b) The DSBD actively participated and contributed to the development of the National Gender-based Violence and FemicideStrategicPlan (GBVF-NP) 2020-2030 especially Pillar 5, which deals with economic empowerment and the specific targets as indicated in (a) above are factored in the Plan as part of the department’s contribution.
c) The Department has no mandate to fund land acquisition, however the department and its agencies support small-scale agribusinesses in the areas of enterprise development, access to market support, and business infrastructure including equipment support (specific to agro-processing).

In light of the suspension of the Township Enterprise Fund, what plans does her department have to redress the spatial inequality faced by township businesses as township entrepreneurs struggle with poor infrastructure, access to formal supply chains, lack of networks and access to information?
Reply:
Before the declaration of National State of Disaster, Cabinet approved the Township and Rural Entrepreneurship Programme (TREP) on the 4th of March 2020 as a programme to support township and rural entrepreneurship. After the National Treasury reprioritised the national budget to fund the priorities that directly assisted the country to respond and mitigate against the impact of Covid-19 pandemic both on health and livelihoods of South Africans, the Department like most others was required to reprioritised its revised allocation in line with priorities focus areas. The Department in its priority interventions included the TREP as a priority programme that is funded through the adjusted Budget. The following interventions under TREP were implemented jointly with the agencies (Seda and sefa):
- Autobody Repairers and Mechanics Support Scheme;
- Bakeries and Confectioneries Business Support Scheme;
- Clothing, Textile and Leather Business Support Scheme;
- Personal care (Hairdressers) support programme; and
- Butcheries support programme
In addition, the department also implemented the Informal Business Support programmes that prioritised businesses located in townships and rural areas, such as:
- Spaza Shops and General Dealer Support Programme;
- Tshisanyama and cooked food support programme;
- Fruits and Vegetable Hawkers and Butcheries Support Programme.
Therefore, the suspension of the Township Entrepreneurship Fund has not suspended the Department’s support to township and rural based businesses in a form of a dedicated programme.

Reply:
a). To address capacity challenges in the KwaZulu-Natal (KZN) province, the Air Quality Management Office was re-established in July 2020, with the appointment of a Director who will be responsible for Air Quality Management. In addition, an official was transferred horn the national Department B work in the Province. The process to develop the Air Quality Management Plan (AQMP) has been initiated by the Province.
(b). The Act does not explicitly state a deadline for the submis9ion of an AQMP. However, it was expected that when the Act was promulgated, all spheres of government would develop or initiate the process B draft their AQMPs.
©. In the absence of an AQMP, KZN is implementing the current air quality national legislation, i.e. Air Quality Act and the associated regulations.
(d)(i) Ambient monitoring is conducted by all sphere of government and there are a fair number of monitoring stations that are located in KZN. Of the 136 government-owned ambient air quality monitoring stations across the country, 25 of these are located in KZN province (the province has 5 stations under its control, eThekwini Metropolitan has 14 stations, the City of uMhlathuze has 3 stations and Msunduzi local municipality has 3 stations).
(ii). All spheres of government have comprehensive air quality monitoring of PM10 and PM2.5 across the country, as per regulations in accordance with the National Environment Management: Air Quality Act, 2004 (Act No. 39 of 2004). Of the 136 government-owned monitoring stations, nearly all of them monitor PM10. The monitoring of PM2.5 is still confined to the national priority areas and metropolitan municipalities, as the ambient monitoring standard for the pollutant was promulgated years after stations had been commissioned. However, the number of stations monitoring PM2.5 was significantly increased in 2016 through a national project initiated by the Department of Environment, Forestry and Fisheries. As part of this initiative, 20 dual PM10PM2.5 monitors were rolled out into the national monitoring network to support municipal stations that were missing such Pm10/PM2.5 monitors, or had old monitors that needed to be replaced.

The rationale behind the phasing out (or banning) of plastic carrier bags and plastic flat bags that are not manufactured from recyclate is to promote resource efficiency (that is, the use of recyclate as opposed to virgin material); improve waste management and create a demand for waste materials; increase circularity, recycling and recovery and to improve the design of environmentally sound bags and mitigate the economic impact of an outright ban of plastic carrier and flat bags.
This rationale is the result of extensive research and consultation with relevant stakeholders as well as consideration of international research and best practice.
(2). The Department has to consider the implications of any proposed policy interventions and the costs attached thereto as well as transitional measures. One of the critical stages of the Socio- Economic Impact Assessment System procedure is the identification of options, alternative, the implications (social and other) and the costs thereof. À policy recommendation needs B be guided by inter alia, evidence, B avoid unintended consequences. The Department is thereof e currently pursuing a study on single-use plastic products that would inform the policy direction. However, in the interim, the Extended Producer Responsibility is being put in place to manage items such as straws and cutlery. In this regard, the Department has been engaging industry and continues to do so. In addition:
(a).the Department has included straws as part of products to be controlled under Extended Producer Responsibility.
(b). the Department has included plastic cutlery as part of products to be controlled under the Extended Producer Responsibility.

What number (a) of litigation matters with regard to forced and/or coerced sterilisation have the National Prosecuting Authority dealt with in the period 1 January 1996 and 31 December 2019 and (b)(i) of the specified matters were settled out of court and (ii) what did the specified settlements entail; (2) what number of (a) non-disclosure agreements were signed in relation to the out-of-court settlements and (b) these cases were finalised in court; (3) whether any damages were awarded to complainants; if not, what is the position in this regard; if so, what are the relevant details?
Reply:
1. The National Prosecuting Authority (NPA) does not keep statistics/data on forced or coerced sterilisations on its integrated case management system. It should be noted that litigation arising from such forced or coerced sterilisations would normally be civil litigation matters, between the parties, as is the case with similar claims for medical negligence or medical malpractice, with corresponding claims for damages.
Claims for damages would be based on the fact that for a person to undergo the process of sterilisation, informed consent ought to be obtained. Using force or any other form of coercion is prohibited and amounts to a violation of a person’s human rights.
2. The NPA does not monitor or keep statistics on civil litigation matters and therefore it is not the appropriate institution to provide the requested information.
3. As mentioned, the NPA does not monitor or keep civil litigation statistics. However, in order to assist, it should be noted that the Commission for Gender Equality (CGE) recently released its Report on the Forced Sterilisation of Women Living with HIV/AIDS in South Africa (Complaint Ref No: 414/03/2015/KZN). In the report, the CGE makes a number of recommendations, including further engagements with the Health Professions Council of South Africa (HPCSA) and the Department of Health. The CGE has also stated that it will present its report to the South African Law Reform Commission (SALRC) for possible amendments to legislation. The SALRC has indicated that it has not as yet received the CGE Report in this regard. The Department of Justice and Constitution Development will follow-up with the SALRC once the report reaches the SALRC.
