Reply:

There were two versions of the advertisement, namely (i) an abridged version that was published in the City Press / Rapport on 22 December 2019 and (ii) a comprehensive version that was published in the DPSA Vacancy Circular No. 02 of 2020 on 10 January 2020 and on the Departmental website and Intranet.

(i) CITY PRESS / RAPPORT

Chief Director: Advocacy and Mainstreaming, Rights of Persons with Disabilities (reference: DWYPD/002/2020). Preference will be given to applicants with disabilities.

Salary package: R 1,251,183 fully inclusive remuneration package per annum (salary level 14). National Office, Pretoria.

Purpose of the Post: to ensure maintenance and implementation of a 365 days integrated national disability inclusion campaign. Provide technical support for collaborative and coordinated implementation of the White Paper on the Rights of Persons with Disabilities.

Requirements for the Post: undergraduate qualification (NQF level 7) in Disability Studies, Economic Sciences, Human Rights Law, Social Sciences. Post-Graduate qualification (NQF level 8) in Disability and/or Management Studies will be an added advantage. Minimum of 5 years’ relevant experience at senior managerial level. In-depth knowledge and ability to apply international treaties and instruments impacting on the lives of persons with disabilities, understanding disability from a socio-political and human rights perspective, sound understanding of universal design and access theory and application, inclusive of reasonable accommodation support measures as well as advocacy and mainstreaming approaches.

Duties: To ensure maintenance and implementation of a 365 days integrated national disability inclusion campaign. Facilitate development of partnership projects aimed at accelerating and advancing the realisation of socio-economic rights of children and adults with disabilities. Reply:

The Recruitment process that was followed for the appointment of a person in the position of Chief Director: Advocacy and Mainstreaming, Rights of Persons with Disabilities was as follows:

1. Advertising

The post of Chief Director: Advocacy and Mainstreaming, Rights of Persons with Disabilities with reference no. DWYPD 002/2020 was amongst those posts advertised on 22 December 2019 in the media in the City Press / Rapport and the DPSA Circular 02 of 2020 on 10 January with the closing date of 31 January 2020.

2. Response handling

Response handling was done internally, all applications received were captured on the selection grid with a total number of 96 applicants.

3. Selection Committee

The selection committee appointed by the Executive Authority, consisted of three (3) members; namely a Deputy Director-General, (female) from the Department of Tourism as chairperson, Acting Chief Operations Officer (female) from the Department of International Relations and Cooperation and a Chief Director (male) from the Department.

The selection committee members, including the HR representative, signed the declaration form as expected to maintain confidentiality and objectivity.

4. Selection process - virtual

The selection committee did a pre-screening to include those applicants who were assessed as having met the minimum post requirements and have completed and submitted all required documents. The selection committee concurred commonalities to finally short list three suitable applicants.

5. Security Clearance and Reference Check

Security screening were conducted in collaboration with the Directorate: Security Management; and references checks were also conducted.

6. Interview process - virtual

All shortlisted candidates were subjected to a 60-minute similar technical exercise prior to their interviews that was intended to test relevant technical competencies of the job and each of the candidates were scored on the basis of their performance during their interviews to enable the panel members to recommend the successful candidate to the delegated authority for appointment.

The selection committee reached consensus at the end of the interview process on the nomination(s) to be made; the necessary motivation for the recommended as well as candidates not recommended were provided to the HR representative.

A runner-up candidate was recommended to be appointed in the event where the recommended candidate declines the offer for any reason.

The selection committee signed the certificate of confirmation of nomination for appointment to the advertised post with the necessary motivation.

7. Competency Assessment

The selection panel recommended the top two preferred candidates to attend the generic managerial competency assessment in compliance with the Department of Public Service and Administration Directive on the Implementation of Competency-Based Assessment.

8. Recommendations/Approvals

A request submission for approval of the delegated authority was prepared for appointment to fill the advertised post of Chief Director: Advocacy and Mainstreaming, Rights of Persons with Disabilities.

(a) What is the budget for monitoring and evaluation of the National Youth Policy (NYP) 2030, (b) who will be responsible for monitoring and evaluation of the NYP 2030 in her department, (c) how will her department ensure that disaggregated data will be accessed, and (d) what is the monitoring and evaluation cycle process for completing the monitoring and evaluation plan and template?

Reply:

a) The budget for monitoring and evaluation of the National Youth Policy (NYP) 2030 is within the budget of the National Youth Development branch in the Department. The total budget for the National Youth Development branch is R10 523 000. Of that amount, R3 134 000 is for goods and services. The monitoring and evaluation budget is within the goods and services line item.

b) The National Youth Development branch and the Monitoring and Evaluation unit in the Department will be responsible for monitoring and evaluating the NYP2030 and they will ensure collection, analysis and reporting of progress of high level output and outcome indicators tracking implementation of the National Youth Policy by government, civil society, and private sectors on a continuous basis. Data will be collated and the NYP2030 implementation reports will be consolidated on quarterly basis.

c) The Monitoring and Evaluation Framework has monitoring and evaluation tools to be used to collect selected data that is disaggregated according to age, gender, disability status, geographic location, and racial grouping.

d) The monitoring and evaluation plan and templates will be completed together with the Monitoring and Evaluation Framework by the end of March 2021. They will be consulted with relevant stakeholders, before being processed to Cabinet for approval. Capacity building sessions will also be held in all provinces with targeted implementing agents.

Reply:

A budget analysis has not been conducted to evaluate the costs of implementing the National Youth Policy:

a) The National Youth Policy specifies policy priorities for socio-economic development and empowerment of young people. An Integrated Youth Development Strategy (IYDS), which gives effect to the implementation of the National Youth Policy, is the one that would be costed.

b) The IYDS would be developed by the National Youth Development Agency (NYDA) and finalised by the end of March 2021. The nature of youth programmes, projects, and activities aligned to the National Youth Policy priorities will be specified in the IYDS. These programmes, projects and activities are the ones to be costed. A budget analysis will be available once the strategy is finalized, costed and approved.

Reply:

(1) The majority of the consultations included youth who are not affiliated to any organisation, with the exception of one webinar which only targeted youth from political and student formations. In many consultation sessions, including the provincial ones and received written responses, the majority of young people participated in their personal capacities. These included youth from various parts of the country who saw it as a moral responsibility to participate in shaping this important advocacy tool.

With reference to her reply to question 1801 on 7 August 2020, what are the details of the (a) urgent redress she demanded to be afforded to victims of forced sterilisation and (b) support that her Office has been giving to the specified victims who have been trying to access justice for more than 11 years?

Reply:

(a)

The Department of Women, Youth and Persons with Disabilities is engaging with the Department of Health on the Investigative Report of the Commission for Gender Equality on Forced Sterilisation of Women living with HIV and Aids. This collaboration is based on the findings and recommendations contained in the report to respond so that justice be served where there is proof of the violation of human rights and dignity, and reproductive injustices committed.

In this regard the redress must include the following that:

  • the Department of Health must facilitate engagement with the complainants so that where such violations were committed, the appropriate redress can be provided for;
  • there be an immediate review of the policy on sterilisation and if necessary, of the Sterilisation Act No 44 of 1998.
  • where necessary, the guidelines and protocols related to the issue of sterilisation be reviewed and amended in order to protect against any loopholes that could lead to such violations;
  • the Department of Health investigate the issue so that those doctors and nurses guilty of the alleged heinous acts be appropriately sanctioned.

The meeting between the two departments was to establish what interventions the Department of Health has made to date and to determine how the matter can be expeditiously addressed and redressed. The Department of Health informed the Department of the actions taken to date:

  • In February 2020, the Department of Health received the Report from the Commission on Gender Equality, following which the Minister of Health engaged the Chair, Deputy Chair and the CEO of the Commission for Gender Equality, seeking clarity on issues contained in the Report .
  • In order to better understand the nature and extend of the complaints and to take corrective action, the Department of Health is establishing a panel of independent experts from various fields to further investigate the matter.
  • The Department of Health will request through the media that women who feel that they have been sterilised against their will make representation to the Health Ombudsman confidentially, so that they are not prejudiced
  • The Department of Health is probing the consent forms for sterilisation to ascertain whether the provisions contained therein provide for and protect the principle of informed consent in all respects. The Department of Health indicated that the previous consent form has a few limitations which need to be strengthened and tightened to avoid any unintended negative consequences and that they are currently addressing these, including the recommendations from the Commission for Gender Equality report on language of counselling, and the provision of a “cooling off” period for the person seeking the procedure before it is actually performed, among others.

(b) The Department is unable to directly engage the alleged victims as they remain anonymous. It is envisaged that in working with the Department of Health the issue will be addressed though the interventions that the Department of Health is putting into place.

(1)What funding model will be used to finance the (a) National Council for Gender-based Violence and Femicide (GBVF) and (b) initiatives that were undertaken with the R17 million funding from the Solidarity Fund in regard to the National Strategic Plan used to support victims of GBVF; if not, what is the position in this regard; if so, what are the relevant details; (3) whether she will furnish Ms N K Shariff with information on how the Covid-19 relief funds were used to assist women through Pillar 4 of the National Strategic Plan; if not, what is the position in this regard; if so, what are the relevant details? Reply:

(a) The Department is in discussion with National Treasury on how the Council will be funded.

(b) The National Strategic Plan on Gender Based Violence & Femicide (GBVF-NSP) is still being costed. The costing will determine the model for funding that will be adopted.

(2) The R17m from the Solidarity Fund was allocated towards;

 Adding in the scale up of the GBV Command Centre to handle the increase in GBV related cases through the recruitment and training of social worker supervisors, trauma training for social workers and the procurement of equipment, data and furniture;

Supporting the 78 shelters under the National Shelter Movement and the 55 Thuthuzela Care Centres with funding for PPE and critical medical services; and 

Implementing a communication campaign to increase awareness and information about the services available at the shelters and the GBV Command Centre. 

(3) The COVID-19 relief funds were used for pillar 4:

The purpose of Pillar 4 is to provide Response, Care, Support and Healing to victims of Gender Based Violence. It further ensures that all relevant departments within the Criminal Justice System enhance their interventions to respond on time in an integrated manner, provide psycho-social support and eliminate or minimize secondary victimization.

A number of strategies and related interventions were developed and implemented to minimise the negative impact of COVID-19 on women. These included increases in social grants, the introduction of the Special COVID-19 Social Relief of Distress Grant, the distribution of food parcels and the establishment of homeless shelters.

Furthermore, according to the Department of Social Development COVID-19 Progress Report (August 2020) there are 134 GBV shelters in place as well as 193 new shelters which were established for homeless people, catering for 11 851 women and men as from April to July 2020.

Counselling and psychosocial services were provided, with 174 831 people reached from April to June 2020, for affected and infected persons and their families. The statistics from the Department of Social Development GBV Command Centre reveal that, since the lockdown, the Centre received 1 275 cases for GBV from March to May 2020. The Centre also received calls for counselling, and enquiries pertaining to substance abuse.

To address evidence of increased food insecurity and hunger of women and their families, the Department of Social Development led the distribution of food parcels to qualifying families. A total of 8 951 204 food parcels were distributed from April to August 2020.

The Inter-Ministerial Committee (IMC) is playing a key role by;

Monitoring progress made on the implementation of the NSP and enforces accountability and compliance with reporting across all government departments. The IMC Chairperson ensures that the Department receives updated weekly reports that are sent to the President on the implementation of the GBVF-NSP.

Whether, given that not much has changed between this year and the last in terms of the gender-based violence (GBV) cases reported in the Republic, her Office has taken any additional steps at monitoring incidents of GBV in order to protect the most vulnerable members of society, which is also aimed to yield different results; if not, why not; if so, what are the full relevant details?

Reply:

Gender-based violence (GBV) is a social ill which continues to plaque South Africa and Government and civil society have to remain committed to making our country safe for women across ages, gender and sexual identities, disability and geographic location. Cases of GBV are reported to service delivery departments such as the South African Police Service (SAPS) and the Department of Social Development.

In March 2020 Cabinet approved the National Strategic Plan on Gender-based Violence (NSPGBVF) and the Minister in the Presidency for Women, Youth and Persons with Disabilities was tasked to Chair an Inter-Ministerial Committee (IMC) on the implementation of the NSP on GBVF and the National Council for GBVF (NCGBVF). Further, the IMC also include the Ministers of Justice and Correctional Services, Police, Pubic Service and Administration Social Development and Finance.

The IMC is responsible for providing leadership, enforcing and coordinating all efforts towards the implementation of NSPGBVF by all government departments. The Departments of Women, Youth and Persons with Disabilities and Planning, Monitoring and Evaluation have put in place a Monitoring and Evaluation Plan which ensures that weekly reports on GBVF are provided to the President.

Through the Emergency Response Action Plan (ERAPP) that was launched by the President towards the end of 2019, the number of shelters and care centres for GBV survivors were increased, the capacity of the police to deal with crimes of sexual violence as well as services to women who have to go through the criminal justice system were improved. All efforts are contributing in protecting the most vulnerable members of our society.

Since May 2020 the IMC have started implementing the NSPGBVF and all government departments will be accountable to Parliament on implementing the NSPGBVF.

1.1 The request received for Mendi name change to Digi Effect nullified the existence of the agreement between the Agency and Mendi Consulting Services. The above statement is supported by reviewing the records of the new name company:

1.1.1 The new company, Digi Effect was registered in 2015, it is not a new company which can proof that only the Name Change was effected on the registration documents.

1.1.2 The company registration and Income Tax numbers are different.

1.1.3 Lumka is not part of the directors of Digi Effects.

1.1.4 The directors of Digi Effect are not in the Mendi Consulting company registration document.

Therefore, management should urgently liaise with Mendi Consulting in respect of intention to terminate the contract.

1.2 As the Agency is in a process of terminating Mendi Consulting Services contract, we recommend that all the clients that are allocated vouchers via Mendi Consulting Services be reassigned to the next Service Provider(s) to who they are currently contracted to the Agency and approved to deliver that specific type of voucher. The progress of young people businesses is delaying due to such long outstanding issue.

2.3 Furthermore, as the name change dispute continued and non-release of payments by the Agency. The client’s websites and emails were disconnected on 31 March 2017 due to unpaid vouchers by the Agency. The client was provided with a Grant of R49 900 (R1 900 for working capital & R48 000 for mobile kitchen). He also wanted a branding voucher for his mobile kitchen and there was moratorium on branding to date. They advised him to do the business plan voucher and it was approved. Suddenly, he changes his mind that he doesn’t want the business plan voucher and the Branch wrongly advise him for a mobile kitchen business as he wanted Polish Manufacturing. The Branch mentioned to him that they will only fund the polish business if its SABS approved for safety reasons.

No fraud – Matter with the CEO and Audit Committee directed the CEO to discuss and convey the message to the client on 05/03/2018.

  • The grant is already close to the limit of R50 000 as only R100 short to reach R50 000. It is not possible for the Branch to issue a second grant as his business is not operating successfully.
  • An exception for the Branch prerogative to do a second application for him in case of additional working capital would have been exercised as he only received R1 900 for the working capital to a maximum of R5 000 (R3 100.00 would have been approved if the ceiling of R50 000 grant was not yet reached).

2. The request for Tender specification document did not request submission of references for clients and bank ratings for the tender process as purported by the Complainant.

2. John Mazibuko – 2nd Complainant (applied for both positions - Frontline Consultant & Center Administrator) written on the application for and his CV that he got BBA Degree in Project Management. However, there is no proof or evidence of such a degree in his application supporting documents.

Irregularities and corruption – Mbombela Grant Programme

1. There are irregularities and corruption committed by the NYDA Mbombela Branch employee Ms Lucretia Ndlovu.
2. Ms Ndlovu has assisted the business owner Mr Anthony Sibuyi with the process of obtaining the funds to open an eatery and internet café business from NYDA, irrespective of Mr Anthony Sibiyi age which is currently 45 years of age at the time of the application of the fund.
3. Ms Ndlovu has assisted Mr Anthony Sibiyi to fraudulently utilise his younger brother by the name of Mr Sicelo Jeffrey (Patrick) Sibuyi as the face of Mahlakule Enterprises in order to qualify for the funding. (However, the Caller did not provide the age of Mr Sicelo Jeffrey (Patrick) Sibuyi but advised that he is within the prescribed age to meet the requirements of the Agency.
4. Ms Ndlovu has been involved in a in a romantic relationship with Mr Anthony Sibiyi since December 2017 and the community is aware.

1. Sufficient evidence exists to confirm that the Client (Mr. Sicelo Jeffrey (Patrick) Sibiya) instructed the supplier whom the Agency initially paid to directly refund him the money. He did not collect any goods and services for which they had been paid for. It is established that fraud did take place, the Agency should institute the required sanctions as prescribed by Public Finance Management Act (PFMA) regulation on financial misconduct (i.e. commence civil recovery proceedings and criminal proceedings).



1. The matter should be immediately handed over to NYDA Legal team for further action as required by the Grant Policy section 26.3 that “the Grantee should be compel to repay the full grant, and section 26.3.1 that “the Grantee will not benefit from services of the Agency in future”.

2. Furthermore, the Agency’s employee Ms. Lucricia Ndhlovu is not directly involved or responsible for managing and administrating the grants. She is also no holding an influential role or senior role within the Branch to influence positive approval of the grant. There is no evidence that she could not have colluded with the client to defraud the Agency by fast tracking the payment of the grant.

Fraud and Corruption at Empangeni Branch

Mabika Clan (Pty) Ltd is a sewing and embroidery company operating at Esikhawini. The business applied for R50 000 grant at NYDA and when doing follow-up on the application Thwala and Nkululeko (Branch Manager) confirmed that they lost all my documents. I heard a rumor on my lecturer saying Mabika Clan was also on the list of beneficiaries on Sihle Zikalala presentation meeting. Then I went to NYDA in Durban they also confirmed that Mabika Clan is one of the beneficiaries at NYDA.

I hope my case will be taken seriously or I will try to find alternative ways to deal with the matter.

Email from Operations Unit - Working with NSFAS during application process , our mandate was to help them with applications only - Then send the applications to NSFAS for reviewing and awarding - NSFAS does not tell us who they have awarded or who they did not- We don’t get in anywhere in awarding of NSFAS students, that’s purely done by NSFAS only- Our role was just to assist with the applications only, and those applications were send to NSFAS- If this applicant has queries he must contact the NSFAS and again- Student applying for NSFAS does not automatically mean that the student will get the funding I have just checked now we don’t anyone by the name of Nyangiwe in the NYDA, and even those graduates that were hired to do NSFAS applications there is no Nyangiwe, maybe this Nyangiwe belongs to NSFAS because we used to have NSFAS people vising our branches as well during the application process.

Email was forwarded to NSFAS to check their records on 26 July 2019 and they have requested the Client to contact them directly of which he did upon our advice.

The Caller stated that the 5 Co-operatives had complained that they had not received everything as per the quotations they had provided to Ms Maepa and indicated that “the individual who was supposed to cut the bushes had arrived. However, had not cut the bushes and nothing had been done; they had received smaller size uniforms than requested and had only received a part of the fencing as well as only received part of the seedlings”. The Caller further mentioned that the 5 co-operatives had produced their own quotations; however believed that Ms Maepa had submitted entirely different quotations. The caller had been uncertain where the quotations could be obtained.

Incentiv8 is offering students a rate of return of up to 200%. This return is not payable earlier than 6 months. Students pay a monthly premium to the company and then upon graduating from their degree they receive a lump sum that totals more than their initial premiums. This lump sum offers returns from 40% up to 200%. Believed to be a ponzi scheme due to high rate of return and the fact that the company is using non-claiming students’ premiums to pay out lump sums to students that are gradating. This is unsustainable and many people will lose money.

Re: Suspicious Activity at NYDA - INTERNAL REPORT - In February of 2019, I started the process of applying for a grant from the NYDA offices in Pretoria. Since then I have called in to the gentlemen and exchanged texts to which many things have been said. I was even sent through a proof of payment to my phone to let me know my supplier was paid then it was quickly retracted as I was told it was another company that had used the same supplier which had been paid out. I then asked how they knew and to which I received no response. I have also tried to contact other people from the branch who then emailed me the exact same Proof of payment i had received from the gentlemen, to which it was then said again that it was not my payment but that of another client that had been made.

. The Whistle-blower reported that irregularities are taking place within the Infrastructure Department, regarding Tshepiso (no surname provided), in charge of the NYDA Apprenticeship Programme, for unethical conduct regarding him displaying favouritism towards certain applicants based on ethnicity.
. The complainant is alleging that there are 19 students in the apprenticeship and all of them do not have Diesel Mechanic Qualifications.
. The complainant further state that all these 19 students paid a Lecture in Gauteng for N2 Certificates, and they only go to sign the attendance register.

iv. There is no direct evidence linking any of NYDA Officials to have committed misconduct as far as this Apprenticeship programme is concern, including NYDA Official.
v. In terms of the statement acquired from Apprenticeship beneficiary they indicate that believe that they are a part of the this programme, hence they have all the required qualification in terms of the Advert.

There is sufficient proof to substantiate the allegation that Vuyo Wallance colluded with her Sister Ms Nomfundo Mdluli to misrepresent the Agency that his Sister pose as a Landlord. This assertion is supported by the following:

1. Reason for Contract Termination 1 - Fraud committed - The evidence shows that the conduct of the Student amount to concealment of facts by submitting his Sister banking details – its Misrepresentation - which lead to broken trust between him and the Agency.

2. Reason for Contract Termination 2 – Period / duration of funding lapsed - The Scholarship Conditions as per Standard Scholarship Fund Agreement - Section A(1) states that “The Scholarship will be awarded for the duration of study only for full-time study and may in the sole discretion of NYDA be renewed for the subsequent year/s. The Agency funded the student for a period of 4 years and now it will be the 5th year for a 3 to 4-year Undergraduate Degree. Perpetual funding is prohibited by the conditions of the Scholarship. If the Agency fund him again, that is viewed as a perpetual funding.

Following the release of the report by the Commission of Gender Equity with regard to the treacherous and inhumane sterilisation of HIV-positive women, some dating back to 1997, what steps has she taken to ensure that (a) no woman is ever forced to undergo this dehumanising practice and (b) those responsible for this are made to account?

Reply:

The report by the Commission on Gender Equality (CGE) was released in February 2020 and I immediately responded with a media statement. I expressed my deep concern at these human rights violations and reproductive injustices committed against women living with HIV through these acts of forced sterilisation. The South African Constitution guarantees the rights of all women the right to dignity, life and bodily integrity. The Sterilisations Act of 1998 provides for the protection of rights of women to make informed choices about sterilisation and the responsibility of health professionals in this regard. Therefore, I called for urgent redress to be afforded to these women whose rights were violated.

At the same time, I also applauded the recommendations of the CGE report that the National Department of Health must facilitate dialogue between themselves and the complainants in order to for them to find ways of providing redress to the complainants.

 

The Department of Women, Youth and Persons with Disabilities calls upon medical professionals to work with the Department to protect and uphold the rights of all women including women living with HIV in South Africa.

Reply:

In exercising its mandate, the Commission on Gender Equality (CGE) recently requested the Department to respond to a set of questions on the implementation of targets on the GBVF Emergency Response Action Plan (ERAP); and processes followed regarding the development of the Gender-based Violence and Femicide National Strategic Plan (GBVF-NSP) and the establishment of the National Council for Gender-based Violence and Femicide (NCGBVF).

The Department provided a comprehensive response to the CGE.

Furthermore, the Department popularises the hot line number 0800 007 709 on GBV for the CGE during the Covid-19 lockdown. This intervention allows the commissioners at provincial level to respond in line with Pillar 4: Adequate Care, Support and Healing.

Also, the CGE and the Department are collaborating in the following ways:

  • Both share each other’s statements with various stakeholders.
  • Share calendar of activities and concept papers.
  • Exchange reports and utilise our reports in particular on GBV areas and made referrals on cases.
  • The CGE participated in the civil society (CSO) webinar on “The Roadmap to the establishment of the National Council for Gender-based Violence and Femicide” held on 13 June 2020.

The CGE is currently involved and participating actively in the NSP Pillar Interim Task Teams (ITTs) working sessions set up to develop the implementation plans for the popularisation and roll-out of the NSP during the lockdown period.

Reply:

1.Cabinet established the Inter-Ministerial Committee (IMC) on Gender Based Violence and Femicide which will play a key facilitation and political liaison role in the National Council for Gender Based Violence and Femicide (NCGBVF) processes; The National Council which will be tasked with the implementation of the National Strategic Plan (NSP); and take recommendations made at the 2018 Presidential Summit against GBVF forward; The Department of Women, Youth and Persons with Disabilities (DWYPD) recently met with civil society sector to engage and forge a roadmap for the establishment of the National Council; The Webinar resolved to extend the deadline for the establishment of the National Council to provide Civil Society Organisations (CSOs) the opportunity to consult extensively with their constituencies and communities on processes to be followed towards the establishment of the National Council – that includes discussions on the National Council terms of reference and selection criteria for the representatives. The parties agreed on a timeframe of 3 months following the Webinar.

2.The Department of Social Development (DSD) has appointed the National Development Agency (NDA) as an implementing partner for funding of CSOs from the Criminal Asset Recovery Account (CARA) Funds. The contract between DSD and NDA was signed for R95 million for funding of Civil Society Organisations (CSOs) which render services to victims of crime and violence including victims of gender based violence as well as implementing mentoring programme for emerging CSOs. The NDA advertised the call for proposals in January 2020 and the total of 589 proposals were received by closing date. These proposals were evaluated by the inter-sectoral evaluating team comprised of representatives of NDA, DSD and the Interim Steering Committee on GBV and a total of 312 CSOs were recommended for funding. The process of verification for all the recommended CSOs has been conducted and the process of contracting as well transferring the funds to qualifying CSOs is underway.

3.In order to enforce accountability, coordination and leadership, the multi-sectoral GBVF Fund was established by the Interim Gender Based Violence and Femicide Steering Committee (IGBVF-SC) in order to urgently respond to the GBVF crisis and to support interventions rolled-out within the Emergency Response Action Plan (ERAP). Amongst others, the objectives of the a multi-sectoral GBVF Fund are to: a) provide a vehicle for the private sector to respond to the national emergency response on GBVF campaign in a coordinated and strategic manner; and b) provide a vehicle for the private sector to be able to effectively monitor and efficiently spend funds in this regard.

In order to facilitate this process, on 13 December 2019, the South African Business Coalition on HIV/AIDS (SABCOHA) was approved by the Department of Women, Youth & Persons with Disabilities, through recommendation by the IGBVF-SC, as the agency to establish the multi-sectoral GBVF Fund in line with the terms of reference crafted by the IGBVF-SC. SABCOHA proceeded with getting approval to open a separate bank account in line with its internal and banking governance requirements. Once established, the NCGBVF will be the custodian of the multi-sectoral GBVF Fund; and will work together with CSOs to develop guidelines for management of the fund based on feminist principles.

Whether her Office has a safety plan for orphaned and vulnerable youth exiting Child and Youth Care Centres once they turn 18 years old and are no longer protected by the Children’s Act, Act 38 of 2005, and subsidised by the State to stay in the specified centres; if not, why not; if so, what are the relevant details of the specified safety plan?

Reply:

The Department of Women, Youth and Persons with Disabilities does not render direct services to orphans and vulnerable children (OVCs), but supports the work done by the Department of Social Development (DSD) in this area.

The DSD has the mandate to deliver direct programmes to the OVCs. The DSD runs Child and Youth Care facilities (drop-in centres) as per Chapter 14 of the Children’s Act, Act 38 of 2005. This includes managing child and youth care centres as indicated in Chapter 13 of the Children’s Act.

A Child and Youth Care Centre (CYCC) is a facility which provides residential care to more than six children outside the child's family environment in accordance with a residential care programme suited for the individual. In terms of section 191 (3) of Chapter 13 of the Children’s Act, these centres offer: (a) therapeutic programmes designed for the residential care of children outside the family environment; (b) appropriate care and development for children with disabilities or chronic illnesses; (c) therapeutic and developmental programmes; (d) treatment of children for addiction to dependence-producing substances; (e) treatment of children with a psychiatric condition; and (f) assistance to persons when in transition or leaving a child and youth care centre after reaching the age of 18.

Children who have reached the age of 18 years do not exit the Child and Youth Care Centres if they are still within the education system. However, in instances where they are not within the education system or they have reached the age of 21, they are proactively prepared through the “permanency plans” and “individual development plans”, that are developed as part of the national norms and standards for CYCCs in terms of the Children’s Acts section 194 (2) of Chapter 13. The “permanency plans” and “individual development plans” are tailor made to respond to the individual needs of the child, but allow the children to acquire life skills training; job skills; financial support/ bursary and or access to education and training institution. All these programmes are intended to ensure independent living.

The Department of Women, Youth and Persons with Disabilities advocates for improved continuous services for orphaned and vulnerable youth and facilitate access to skills training for those exiting Child and Youth Care Centres, through referral to organisations rendering relevant appropriate services.

The Umsobomvu Youth Fund was established in January 2001 with a mandate to create a platform for job creation, skills development and transfer for South Africa’s young people.

The National Youth Development Agency (NYDA) Act which was passed by Parliament in 2008 formed the NYDA as a merger between the Umsobomvu Youth Fund (UYF) and the National Youth Commission (NYC) and in terms of section 21 of the Act dissolved the UYF and NYC.

  (1)  The balances of the Umsobomvu Youth Fund were therefore transferred into the NYDA as per section 21 of the NYDA Act. The UYF has therefore been dissolved and has a balance of zero.

With reference to her department’s mandate to champion the advancement of women’s socio-economic empowerment and the promotion of gender equality, what steps and/or programmes has her department undertaken in collaboration with other government departments, such as the Departments of Justice and Health the SA Police Service, to sensitise government officials in respect of the needs and challenges of the lesbian, gay, bisexual, transgender, intersex, queer/questioning, asexual community?

Reply:

The department is aware that LGBTQIA+ persons have different safety and security needs than that of cisgender women based on how laws, policies, practices and systems are conceptualised on the basis of heteronormativity.

The Department since 2016 has been rolling out Community Dialogues to understand the lived experiences including challenges of communities and do a needs assessment. To this end sector specific dialogues including LGBQTIA+ sector have been conducted. The dialogues are implemented in partnership with local civil society organisations and government departments including Police; Justice and Health. The findings of the dialogues have generally been shared with departments particularly those involved in service delivery.

The department together with National Treasury is working on the institutionalisation of the Gender-Responsive Planning, Budgeting, Monitoring and Evaluation, and Auditing (GRPBMEA) framework into departmental strategic plans, and annual performance plans. The first attempt focused on enabling gender responsive budgeting through sex disaggregated data. The success of this process will lead to the elevation of mainstreaming of gender non-conforming persons’ in the work of government officials.

The department continues to oversee, guide and work in collaboration with the Interim Steering Committee (ISC) for Gender Based Violence and Femicide (GBVF), including relevant government departments in ensuring the adoption of the GBVF NSP. The GBVF NSP development processes have been finalised.

The department consulted on the GBVF NSP the DGs Clusters on 1) Social Protection, Community and Human Development (SPCHD) where the departments of Health and Justice are members and 2) Justice Crime Prevention & Security (JCPS) where Justice and Police are members.

Issues of LGBTQIA+ persons have been elevated in the GBVF NSP. The interventions raised in the GBVF NSP include the roll-out of sensitisation and training programmes for frontline government officials on victim-centric, survivor focused services, with a specific drive to promote gender diversity and obliterate negative social norms and attitudes.

The rollout of social behaviour programmes portraying positive images of gender equality, sensitive reporting on LGBTQIA+ communities will further enhance social cohesion and combat harmful gender stereotypes that perpetuate patriarchal norms. This also includes a standardisation approach to the sheltering system so as to address needs of the LGBTQIA+ community.

A national study to understand the extent of violence against LGBTQIA+ persons is also set to be conducted to raise awareness of the needs and challenges of the LGBTQIA+ sector. Such surveys basically include training workshops for officials involved in data collection on understanding the sector, appropriate language and principle of intersectionality.

Reply:

a) During the process of developing a Gender Based Violence & Femicide-National Strategic Plan (GBVF NSP), an urgent need arose that required concerted, focused and results-oriented emergency interventions at all levels of society.

b) In September 2019, there was a noticeable spike in the national interest with several high level femicide cases raising awareness of the on-going scourge of violence against women.

c) The Emergency Response Action Plan was developed in response to the September 2019 femicide related incidents and the call for urgent action by civil society, whilst the NSP is being concluded.

d) The Emergency Response Action Plan (ERAP) is aligned to priorities raised in the National Strategic Plan (NSP).

e) Article 4 point H of the Presidential Summit states that the national multi-sectoral coordinating body shall develop a National Strategy with Action Plan for Gender-Based Violence and Femicide not later than six months after its establishment.

f) Currently, the NSP is serving through Cabinet processes. Once Cabinet approves the NSP, the Department of Women, Youth and Persons with Disabilities (DWYPD) together with the Department of Planning, Monitoring and Evaluation (DPME) will develop and monitor the implementation framework for the NSP.

g) The NSP implementation framework will provide more details in terms of interventions to be delivered, indicators, targets and responsible stakeholder(s).

h) The NSP implementation framework will build onto, consolidate and expand on the key interventions of the Emergency Response Action Plan (October 2019 – March 2020).

i) Some of the interventions in the Emergency Response Action Plan that are on-going in nature (that is going beyond the life-span of the Emergency Response Action Plan) will be phased into the NSP implementation framework.

j) Over and above the NSP implementation framework the proposed National Council for Gender Based Violence and Femicide once established, will develop its operational plan.

Reply:

(a) 

Following the Presidential Summit a proposal was tabled and adopted on 15 November 2018 to use the Steering Committee that was responsible for organising the Summit, as the core for the Interim Steering Committee.

Initially, the Interim Steering Committee deliverables were supposed to be concluded within six months in line with article 3 of the Declaration amongst other articles. The article purports for a National Strategic Plan to end Gender Based Violence & Femicide (NSP GBVF), and a Multi-Sectoral Structure to serve as a Council. The rationale was three-fold: (1) Continuity; (2) Operational coherence; and (3) Pragmatic sense given the short duration for the structure. Once the task is concluded the committee would be disbanded.

The process of drafting the NSP took longer than anticipated due extensive consultation sessions that were required across all relevant sectors and all 9 provinces. This impacted on the establishment of the Council, as in principle strategy informs structure. An additional responsibility was entrusted on the Interim Steering Committee to oversee the crafting and implementation of the Emergency Response Action Plan (ERAP) to end Gender Based Violence and Femicide. The ERAP was announced by the President on 18 September, and is being implemented over six months between October 2019 and March 2020.

b)

The Cabinet processes are at an advanced stage regarding approval of the NSP and Council. Once the proposed council is endorsed, the nomination process will be embarked upon towards the establishment of a National Council to end Gender Based Violence and Femicide.

In light of the escalating violence against lesbians, gays, bisexual, transgender and intersex people, has she considered advocating in Cabinet for amending the (a) existing legislation and (b) Criminal Law Amendment Act, Act 38 of 2007, to include harsher minimum sentences for corrective rape and/or hate crimes in general?

Reply:

(a)

There is adequate legislative framework that provides protection of the human rights and dignity of lesbian, gay, bisexual, transgender, intersex and queer, or commonly referred to as the LGBTIQ, sector. Their rights are human rights too as entrenched in Chapter 2 of the Constitution, in particular s9 (3) on the issue of non-discrimination on the basis of sexual orientation.

South Africa became the first country in the world to outlaw discrimination based on sexual orientation. We are also the fifth country in the world and the first country in Africa to legalise same-sex marriages.

Furthermore, in 2003 South Africa enacted the Alteration of Sex Descriptors and Sex Status 49 of 2003, which allows citizens to change their descriptors on their identification documents. The Promotion of Equality and Prevention of Unfair Discrimination Act, 2000 governs the judicial interpretation of the Equality Clause. In 2005 the promulgation of the Judicial Matters Amendment Act of 2005 changed the legal status of intersex people in South Africa. The amendment saw the Promotion of Equality Act and Prevention of Unfair Discrimination Act 4 of 2000 amended at section 1 by the insertion the definition of “intersex” and the definition of ‘sex’ to include intersex.

This demonstrates that our biggest challenges lie beyond legislation. Discriminatory societal beliefs influence attitudes, perspectives about lesbians, gays, bisexual, and transgender as well as intersex people, and attribute those to culture. For example, in some communities, Intersex infants are seen as ‘bad omens’, some perceive the infants as punishment from God and a curse on the family tree. The on-going dialogues conducted by the department seeks to address these stereotypes.

(b)

Our immediate task is to work collectively in closing the gap between legislation and implementation, through intervention mechanisms to protect the rights of the LGBTIQ+ sector.

The Department of Women, Youth and Persons with Disabilities is also a member of the National Task Team on gender and sexual orientation-based violence established by the Department of Justice and Constitutional Development in 2011.

The National task Team, which is constituted by government departments, chapter nine institutions and civil society organisations that specialise in issues related to LGBTI persons is currently developing a National Intervention Strategy for the LGBTIQ+ sector.

Members of the Criminal Justice System are equal partners in this dialogue. The courts have been playing an important role in enforcing the law to protect citizens against hate crimes, and in handing down harsher minimum sentences for corrective rape. Our mandate is that of advocacy, and we will continue to play an advocacy role in this regard.

(a) A procurement transaction of R165 000 was detected by the Auditor-General which indicated a suspected conflict of interest between an employee and a service provider. It is at this stage not possible to determine how much the said employee may have benefited, if at all.

(b) The NYDA commissioned an internal audit investigation based on the suspected transaction and has suspended the employee and lodged formal disciplinary processes.

a) The Department of Women, Youth and Persons with Disabilities (PWYDP) has not conducted any research why there seems to be an escalation in the incidences of men killing women in South Africa.

b) The Department has not conducted any research to establish why the prevalence is higher than in the rest of the world. However, South Africa has various sources of Violence against Women administrative data that are used by the Department to inform policy making and programme implementation. These include household surveys e.g., District Health Surveys (DHS-StatsSA), The South African Police Service (SAPS) crime statistics collated from Sexual Offences Courts, Victim Empowerment Centres, Thuthuzela Care Centers, Hospitals, Shelters (state and NGO run) and Research institutions.

Sector specific administrative criteria and methodologies are applied in recording of administrative data. Recording is from different sectoral indicators perspective and programme areas. Data sources are focused on criminal judicial responses and emergency short term responses to violence against women.

The Department is currently facilitating a process of conducting a prevalence survey in the next financial year.

What programmes does her department have in place to preserve, advance and promote women’s dignity and health, particularly during critical feminine cycles when indigent women and girls cannot access the much-needed products such as sanitary pads?

Reply:

The Department of Women, Youth and Persons with Disabilities (DWYPD) has developed an Implementation Framework on Sanitary Dignity in an effort to ensure that indigent girls and women are afforded the opportunity to manage menstruation in a knowledgeable, safe and dignified manner. This Framework was launched on 28 February 2019 and approved by Cabinet on 18 September, 2019. The DWYPD is responsible for the coordination, monitoring and evaluation of the Framework. The key objective of the Framework is to provide for an integrated and coordinated responsive Government programme aimed at the provision of sanitary products free of charge to indigent girls and women in order to achieve universal access to sanitary products to the most vulnerable women and girls. In South Africa, 26% of women aged 9-49 years live below the food poverty line. Therefore the priority persons who will benefit from the implementation of this Framework are indigent women and girls who have reached puberty, commenced menstruation and who:

  1. attend schools ranked at quintile 1, 2 and 3, special needs schools and farm schools. The option of expanding to quintiles 4 and 5 will be based on the results of a needs assessment and availability of resources;
  2. attend Post-School Education and Training institutions[1];
  3. live in child-headed households;
  4. have been admitted to any state-owned institutions, hospitals, orphanages, places of care, prisons and places of safety;
  5. vulnerable indigent women and girls not in State Institutions.
  6. have been identified by an Indigent Sanitary Management Committee (ISMC) or Provincial Sanitary Dignity Committee (PSDC), provided that the relevant ISMC or PSDC must submit a motivation to the Sanitary Dignity Oversight Committee (SDOC) for the inclusion of such persons as beneficiaries of this Framework and such persons may only be provided with sanitary products if so, approved by the SDOC.

DWYPD leads the implementation of the Framework with the support and guidance of the multi-sectoral government national task team. DWYPD has participated the following interventions:

  1. The implementation of the framework is a phased in approach and has started with girls in quintiles 1-3 schools. DWYPD submitted a request to National Treasury for the 19/20 financial year to pilot the sanitary dignity implementation framework in quintiles 1-3 schools. The National Treasury made an allocation of R157 million through provincial equitable share to either the Department of Education or the Department of Social Development. The provinces are currently implementing the programmes and DWYPD is responsible for coordinating, monitoring and evaluation. An additional request has been made to National Treasury for the 2020 MTEF and consultations are underway.

2. Submission made to the independent panel of experts for Zero VAT on sanitary products by the Department with many other stakeholders ensured that sanitary pads and panty liners have been zero VAT rated since 1 April, 2019. Currently, the Department is investigating whether the VAT is being implemented and how it has changed the lives of women and girls.

3. Development of Standards for Water supply, sanitation and hygiene (WASH) March 2019. These standards were developed by the Water Research Commission and piloted in 10 schools in the Eastern Cape. The Department formed part of the team that developed the standards.

4. As part of advocacy and awareness raising, DWYPD held a National Launch of the Sanitary Dignity Programme in Mkhondo Local Municipality in Mpumalanga on 28 February 2019, as well as Provincial launches in Eastern Cape in Makana Local Municipality on 13 April 2019 and E-Thekwini Metro on 3 May 2019. During these events girls were provided with the sanitary towels.

5. The DWYPD has partnered with various government partners, development partners, private sector companies and non-profit organisations who have supplied sanitary pads, education sessions on menstrual health and WASH. These partnerships are continuous.

6. Development of standards for the reusable pads. The Department participates in the technical working group on norms and standards. The group is led by the South African Bureau of Standards (SABS). The standards were published for public comments on 25 July 2019 and closed on 25 September, 2019.

Reply:

The Department does not provide safe homes or shelters for abused women and children. The Department of Social Development (DSD) provides funding to the shelters for victims of crime and violence. A shelter is a residential facility that accommodates all victims of crime and violence as well as their care. DSD has also established the Khuseleka One Stop Centre model to provide services by various stakeholders to the victims of crime and violence including domestic violence. It is a community-based center where victims of crime and violence receive services through a multi-disciplinary approach comprising teams of social workers, nurses, doctors, police officers, court preparation officers and prosecutors.

In addition, DSD sets up White Doors/Safe Spaces of Hope to provide temporary shelter and a safe space to victims of gender based violence, mainly, the most vulnerable groups such as women and children but not excluding men. The White Door is a 72 hours’ facility responding to the challenge of accessing available shelters for victims whose lives are in danger. This service serves as an emergency temporary intervention and in some cases overnight (24 hours), containment facilities offering accommodation and practical support to the victims. White Doors/ Safe Spaces are established to counteract gender-based violence and to encourage community participation whereby community members identify houses within their communities to be utilized as safe spaces for victims of violence for crisis interventions.

What (a) programmes to assist female victims of violence and abuse do her department and the entities reporting to her currently have in place and (b) is the purpose of each programme?

Reply:

The Department since 2016 has been rolling out National Dialogues on violence against women and children (VAWC) to better understand the lived experiences of various communities given the uniqueness of their context. So far, dialogues have been held in Limpopo, Mpumalanga, Northern Cape, Eastern Cape, North West and Western Cape as part of the 365 Days of Activism programme. This is a programmatic approach to raising awareness on violence against women.

The Department of Women (DoW) has made concerted efforts to engage various stakeholders particularly men’s organisations to partner with the Department as advocates for no VAWC. During the month of August, the Department also hosted a series of dialogues with women across all sectors. These included women in business, women living in rural areas, women in academia and a dialogue with men and boys. On the 9th of August, the department launched the Gender Based violence Robot to heighten awareness on early warning signs of domestic violence. The Robot has contact details of services available for victims of violence.

The dialogues are implemented in partnership with Premiers offices and local civil society organisations (CSOs) to ensure continuity and sustainability of community based interventions developed dialogue events by the Province, municipalities and implementing partners.

DoW is also a member of the Inter-Ministerial Committee (IMC) on the Root Causes of Violence against Women and Children which was established by the Cabinet in May 2012 to develop a comprehensive strategy to deal with this scourge. A Program of Action (POA) emanating from the work of this Committee, has been developed and is currently under review to close gaps identified though a diagnostic review process.

The Minister is in the process of reinstating the Gender Based Violence Council which will include government, NGOs, NPOs, and business so that we can have co-ordinated programs as per the CEDAW, AU and SADC protocol.

We are also trying to develop new indicators for reporting on crimes against women because presently crimes that are reported are those that are in the police systems.

A well-coordinated and reconfigured gender mainstreaming will help us to respond to all forms of violence and discrimination against women.

Reply:

1. (a)(i) There are two Deputy Directors – General (DDGs) in the Department.

(ii)There are six Chief Directors in the Department and two Chief Directors in the Ministry whose employment contracts are linked to the term of office of the Minister.

(aa) The two DDGs and six Chief Directors are all employed on permanent basis. One of the DDG is currently the Acting Director General.

(b) Two DDGs are women and six Chief Directors are women. Out of eight Chief Directors; two are currently on suspension. There is one Acting Chief Director in the position of the suspended Chief Director: Cooperate Management; and no one acting in the position of Chief Director: Stakeholder Coordination and Outreach. Subsequently; there no capacity in the Stakeholder Coordination and Outreach Unit particularly the coordination of dialogues which are facilitated by the office of the Minister.

2. There are no entities reporting to the Minister in the Presidency responsible for Women. The level of human resources head is Deputy Director and if there is a need he reports to the Minister.

Reply:

a) The Department is unable to respond to section (b) of the main question as there is no phenomenon such as female gender mutilation.

b) Forced marriages are not allowed and it’s the same as kidnapping, abduction therefore we have a court ruling on the Jezile matter.

c) Child marriages are within the purview of the department of Home Affairs and the question should be directed to that department.
