Bucwa, Ms H to ask the Minister of Higher Education and Training
(1)What is the future of the National Certificate (Vocational) programmes, in view of the declining numbers of learners enrolling for these programmes; (2) (a) how and (b) by which range of entities will the education and training needs of learners who leave school without a National Senior Certificate be addressed in future; (3) what are the envisaged numbers of learners who would annually be supported financially by her department over the medium term in their efforts to study at levels 2, 3 and 4 at (a) public technical and vocational education and training colleges and (b) community education and training centres?
Reply:
1. The declining enrolments in the National Certificates (Vocational) (NC(V)) programmes is indicative of the correction process in the Technical and Vocational Education and Training (TVET) college system. The qualification was not intended for matriculants. The target group was students who exited the basic education system but who needed to complete an equivalent of the National Senior Certificate (NSC). However, since the inception of the NC(V) in 2007, colleges enrolled learners who had already achieved an NQF level 4 qualification in the form of the NSC. Over the last two years, colleges have been advised by the Department to enrol only learners in the NC(V) who have not completed Grade 12. This position is based on the careful consideration of the utilisation of limited resources in the provision of learning opportunities for a wide range of young learners in the country, and will continue in future.
2. Learners without an NSC are able to enrol in the NC(V) in the TVET colleges, to complete the equivalent of the NSC qualification. This opportunity will be available in the foreseeable future.
Through Community Education and Training (CET) colleges, the National Senior Certificate for Adults (NASCA) has been developed to address the needs of out-of-school youth and adults who do not have an NSC. Funding is not yet available to implement the NASCA. The CET colleges through their Community Learning Centres are the entities for provision to out-of-school youth and adults.
Sector Education and Training Authorities fund various learning programmes such as skills programmes, learnerships, apprenticeships and other training programmes conducted in skills centres that cater for everyone including those who leave school without an NSC.
3. (a) TVET colleges currently offer the NC(V) qualifications at NQF levels 2 - 4, and the N1 - N3 Report 191 programmes at the same levels. The Report 191 programmes, also commonly referred to as the NATED programmes, do not constitute a qualification unless the two languages of Business English and Sake Afrikaans are also passed. The addition of these two languages culminates in the achievement of an NSC, but it is a different qualification from the NSC offered in Basic Education. The NSC in TVET colleges, which has its origins in the former Technical Colleges, did not allow students to directly access higher education programmes, and was loosely considered as a pass on the “standard” grade, in accordance with the higher, standard and lower grade passes applied at the senior secondary level at the time. Student numbers in the TVET NSC have dwindled, since the Department of Basic Education no longer allows for the combination of the N1 - N3 subjects with the current NSC subjects offered in schools, to award the NSC (matric) qualification at NQF level 4.
State funding for TVET college students will increase gradually over the next 4 to 5 years, whilst the new increased baseline funding is introduced into the system. All students enrolled in a TVET college, with a combined family income of up to
R350 000, will receive a bursary. NC(V) students, who meet the admission criteria of the college, can apply to enrol, in order to achieve the equivalent of the NSC offered in schools. The exact number of such enrolments in future cannot be clearly determined at this stage. The NC(V) enrolments for 2018 is 134 925. Should the demand remain, this figure can be maintained for the next 4 to 5 years.
(b) The Department funds all the students that are enrolled in Community Education and Training (CET) colleges for formal programmes at NQF level 1. The envisaged numbers of enrolments are as follows:

The current funding is neither per programme/learning area nor per student due to the fact that when the adult education and training function shifted to the Department in 2015, the Department inherited the funding arrangement that prevailed in the Provincial Education Departments (PEDs) and it was different across the various PEDs.
There is a process underway to develop new national Norms and Standards for the Funding of CET colleges. There is also a need to conduct a costing for the programmes/learning areas offered in CET colleges, as well as to quantify the funding requirements in the sector. These processes, once finalised, will assist in ensuring the equitable distribution of funds to CET colleges.

Whether, with reference to the reply of the President, Mr C M Ramaphosa, to the debate on the State of the Nation Address on 22 February 2018 to implement lifestyle audits, (a) he, (b) senior management service members in his department and/or (c) any of the heads of entities reporting to him have undergone a lifestyle audit in the past three financial years; if not, have any plans been put in place to perform such audits; if so, in each case, what are the details of the (i) date of the lifestyle audit, (ii) name of the person undergoing the audit, (iii) name of the auditing firm conducting the audit and (iv) outcome of the audit; (2) whether he will furnish Adv H C Schmidt with copies of the lifestyle audit reports?
Reply:
b) I have been informed that the Department of Justice and Constitutional Development has not conducted general lifestyle audits in relation to senior management. We have limited our policies and procedures to vetting processes and identification of risk, based on declarations of interest.
In terms of statistics relating to incidents of fraud and corruption, it seems that the risk exposure to the Department is not at senior management level but rather at middle management and lower levels and in specific in specialised environments.
The Department is in the process of reviewing its fraud and anti-corruption strategy and will consider such for inclusion in these specific environments.
c) The entities have reported as follows:
(i) National Prosecuting Authority: No lifestyle audits have been conducted in the NPA in the past three (3) financial years. Currently, there are no plans in place to conduct lifestyle audits.
(ii) Legal Aid South Africa: No, the Chief Executive Officer of Legal Aid South Africa as the executive head has not been subjected to a lifestyle audit for the past three (3) years.
However, the Internal Audit Department of Legal Aid South Africa conducted lifestyle audits for the past three financial years based on an assessment of potential risks from employees who are in direct interaction with clients or are handling financial transactions of the organization. The audits cover the following categories of staff, namely: Legal Practitioners; Paralegals and Administration Managers. In the 2018/19 financial year, a lifestyle audit is planned of all persons involved in procurement at national and provincial level, and will include members of the Bid Adjudication Committee and Bid Evaluation Committee.
(iii) Special Investigating Unit: Prior to the appointment of the Head of the Special Investigating Unit, Advocate JL Mothibi was subjected to a Vetting Process by the State Security Agency before he resumed his duty on the 1 May 2016.

Whether the (a) aviation irregularities and (b) accidents under investigation by the Clanwilliam SA Police Service (details furnished) under case number CAS114/04/2015 have been received by the National Prosecuting Authority (NPA) for further investigation and possible inquest/prosecution; if not, what is the position in this regard; if so, at what stage is the NPA investigation?
Reply:
The docket Clanwilliam CAS 114/05/2015 and supporting documents have been received and studied by advocates from my office. The documents indicate that there were three similar accidents, two of which were fatal. Queries were directed to the investigation officer to obtain further information, in the form of dockets and/or inquests, regarding these other accidents so that a final decision may be made upon consideration of all the relevant evidence.
I am awaiting the completion of these further investigations.

Reply:
This response is according to information received from the SOC:
1. The contract was signed by the Transnet Group Chief Executive.
(2)(a) The total contract value was R375 million.
(2)(b) The contract scope was as follows:
- Realisation of the General Freight Business volume targets for 2015/2016 and 2016/2017.
- Implementation of the processes and tools to ensure sustainability and capacity building; upgrade and embed operational capabilities on key flows to ensure execution as per plan (Replicate coal line approach).
- Validate long term demand as basis for the General Freight Business case.
- Build key account plans, commercial capabilities and technology solutions to drive the road to rail shift beyond 2015/2016.
- Identification of new markets and commodities that can be leveraged to produce additional General Freight Business volumes including new markets identified by TFR such as FMCG;
- Sales, marketing and commercial initiatives;
- Cost Sweep and Cash Lab (Including EBITDA uplift, monetization of non-core assets including property etc);
- Driver based budgeting;
- Project Management Office.
( a) Regiments Capital was paid R 55 984 621 for delivering services in terms of the contract. Matiase, Mr NS to ask the Minister of Rural Development and Land Reform
Why has her department failed to intervene and resolve the impasse at the Koegas Communal Property Association in the Northern Cape, where (a) there has been no general meetings to elect leadership and (b) a certain person (name furnished) allegedly takes unilateral decisions and leases the land to private farmers, without general consensus from other members of the community; (2) what steps does he intend to take to resolve this matter and ensure that there is development for the Koegas community?
Reply:
(1),(a),(b) The Department of Rural Development and Land Reform (DRDLR) intervened in the Communal Property Association (CPA) by appointing a mediator to regularise Koegas CPA between 4 June 2013 to 22 February 2014. A report produced by a panellist within the Land Rights Management Facility Mr Charles P Abrahams (from Abrahams Kiewitz Attorneys), who is currently a legal representative of the CPA, highlighted that the CPA has a dispute regarding membership based on the verification and settlement of the claim. There is dispute regarding the community that must benefit in terms of the claim that was lodged by Mr Barend Van Staden (Van Wyk). He claims that he lodged the claim for Griquas, Korana and San communities and not for Coloureds, and Tswanas and Xhosa speaking people as the claim had been settled on 4 June 2008.
The mediation regarding the CPA has failed as the Chairperson (Mr Barend Staden– Van Wyk) is insisting based on the recent response from attorneys dated 19 April 2018 that he did not claim for members registered on the CPA hence they are excluded from the CPA. DRDLR is intervening in the CPA, and other excluded members will be called for a community meeting to inform them of intervention measures made by the Department.
(2) DRDLR intends to take the following steps:
- place the CPA under administration in terms of section 13 of the Communal Property Association Act, 28 of 1996;
- during the Administration process, DRDLR will release the settlement grants in order to develop the farms; and
- allow Mr Van Wyk to institute the review regarding the correct claimant community to be referred to the Land Claims Commission Court to resolve the issue of the beneficiaries of the land claim.

(1)What (a) are the reasons that certain trades with large employment numbers in the economy, such as joiners, plasterers and bricklayers, make relatively little use of the facilities of the Institute for the National Development of Learnerships, Employment Skills and Labour Assessments (Indlela) and (b) plans and targets have been developed to increase the numbers; (2) how is her department assuring that consistent assessment standards are guaranteed when assessors are required to undertake as few as one or two assessments per annum; (3) how are the full-time and part-time assessors used by Indlela sourced, remunerated and capacitated; (4) has she found that the equipment used during the assessment of apprentices is of a comparable standard and age to that which is generally used by the various industrial sectors for which tests are conducted; if not, what steps are being taken to overcome the challenges; (5) what amount has been raised by Indlela in accommodation fees for the (a) 2016-17 and (b) 2017-18 financial years?
Reply:
1. (a) The main reason for the proportional lesser use of the INDLELA facility for the bricklayer, plasterer, joiner and others trades is attributed to a positive policy change which established a common trade test certificate in terms of section 26D of the Skills Development Act (SDA). The common trade test certificate is for all qualifying artisan candidates and is issued by the Quality Council for Trades and Occupations (QCTO) since 2015.
The lesser use of INDLELA in 2004 can also be attributed to the amendment of the SDA to decentralise trade testing to Sector Education and Training Authority (SETA) accredited trade test centres. Since then INDLELA largely tested candidates in terms of section 28 of the Manpower Training Act (MTA) before it was repealed.
The repeal of the MTA in 2015 brought about a single trade test certificate in terms of section 26D of the SDA. All accredited trade test centres, including INDLELA, are able to test all types of trades and candidates.
Until the 2014/15 financial year, INDLELA was the main national trade test centre. Section 28 candidates who made up the bulk of the numbers mentioned above were largely from the Eastern Cape, Limpopo, KwaZulu-Natal, North West and Mpumalanga. The transition to a common trade test certificate dispensation and the implementation of section 11(5) of the Trade Test Regulations 2015, allows for all aspiring candidates all over the country to do a trade test at any accredited trade test centre in the country, not only at INDLELA.
(b) INDLELA has since shifted its priorities to focus on the trades in high demand. The Department is doing the following in order to increase participation:
(i) An integrated public awareness campaign focusing on the Decade of the Artisan and the World Skills South Africa competitions at Technical and Vocational Education and Training (TVET) colleges. The campaign aims to sensitise communities, learners and accredited training centres about the exciting careers in artisanship, including those with a declining uptake and the low cost of trade tests at INDLELA.
(ii) From year-to-year, the trade test fees structure at INDLELA is maintained as low as possible (between R250 and R400 depending on different trades) in order to encourage poor and low-income individuals to use INDLELA.
(iii) Since INDLELA uses only full-time permanently employed assessors, it depends on accredited training centres to send candidates to INDLELA for assessment in order to optimally use its assessors throughout the year. In spite of the inability of INDLELA to prescribe the numbers coming from these accredited training centres, it is projected that for the next five years (2018/19 to 2022/23) INDLELA’s trade test numbers on these trades will increase by approximately 10% per annum.
2. The National Artisan Moderation Body (NAMB) ensures that each accredited Trade Test Centre (including INDLELA) maintains internal moderation. This is further quality assured through the external moderation done by NAMB itself. Because of a large number of accredited trade test centres (435 in the 2017/18 financial year), NAMB frequently conducts quality assurance at these trade test centres to ensure that set standards of trade testing are maintained.
3. INDLELA assessors are full-time employees of the Department of Higher Education and Training, and are recruited and remunerated in terms of the Public Service Act, 1994 (No. 103 of 1994) and the Department’s policy on recruitment. Newly appointed assessors are mentored and monitored by experienced assessors and moderators before conducting assessments individually to ensure that quality is maintained. Through the Performance Management and Development System, the Department provides assessors with an opportunity to develop a personal development plan, which is aimed at addressing the skills needed to improve individual and organisational performance.
4. All trade tests conducted at INDLELA and other accredited trade test centres are aligned to the existing training schedules and requirements. It is a standard requirement that all trade tests must be aligned with the training content and the necessary equipment of the respective trade. The current trade testing equipment at INDLELA is sufficient for testing historical/legacy trades but not for the testing of the newly listed trade occupations.
To address this challenge, INDLELA has developed a recapitalisation plan, which focuses on improving infrastructure, workshop machinery, equipment and information technology over a 4-year period from 2017/18 to 2020/21. The sources of funding for the plan are SETA donations, which to date have contributed R23 million.
5. In the 2016/17 financial year, an amount of R394 933.00 was raised in accommodation and meals, and R397 991.00 in the 2017/18 financial year.

- Eastern Cape still has twenty five (25) schools without sanitation. However, these are at different stages of implementation.
- All schools have been provided with some form of electricity, either through grid connection, solar, generator or other means of electricity provision. The sector is however, continuously affected by instances of theft and vandalism of solar panels and cables, which renders schools previously provided, to be without service; and
- There is still 273 schools built entirely of inappropriate materials and the Department is in the process of soliciting additional funding to address the backlogs.

Reasons that led to delays and hence non-compliance with the targets set in the Norms and Standards for School Infrastructure are as follows:
- Procurement: There were delays in procurement of Implementing Agents;
- Rationalisation of schools: The key challenges for not meeting the targets are that some of the schools which have been identified are earmarked for school rationalisation as they either have a small number of learners or they are small and unviable. This process has had a delaying effect on the achievement of provision of basic services. The process of rationalisation of schools, involves closing and merging of small and unviable schools;
- Capacity: another challenge is the capacity of Implementing Agents, which results in delays for completing the projects;
- Land Issues: There are challenges in resolving land related issues (example: ownership, zoning) which are delaying the implementation of scheduled projects;
- Funding: There is lack of sufficient funding and the Department is currently soliciting additional funding to address these; and
- Final Accounts: Delays in final account and projects close-out challenges, where the projects are completed but the practical completion certificates are not yet issued to the Department.

Has the SA Council of Educators requested access to the (a) Child Protection Register and/or (b) National Register for Sex Offenders for the purpose of vetting educators in the past two years; if not, why not; if so, what are the relevant details?

SACE RESPONSE
SACE wrote a letter to the Director General in the Department of Basic Education in 2017, to request assistance in engaging the Director Generals in the Departments of Social Development and Justice and Constitutional Development, with regard to accessing both the National Child Protection Register and the National Register of Sexual Offenses for purposes of determining fitness-to-practice prior to awarding the provisional or full registration status to the teachers.
This move was taken due to the limitations of access to the National Child Protection Register that only permits employers, concerned individuals, and designated child protection organisations to access this register. Similarly, the DBE DG would have facilitated the process of accessing the National Register of Sexual Offenses on behalf of SACE as well.
Subsequent to the request a joint meeting between the Department of Basic Education and Social Development and SACE was held to discuss access to the Child Protection Register. The Department of Justice and Constitutional Development was not available to attend due to competing priorities.
Progress has been made with regard to the National Child Protection Register in terms of developing a protocol and Memorandum of Understanding between these three institutions (SACE, DBE and DSD) so that SACE can access the register through the Department of Basic Education for purposes of assess to educators’ fitness-to-practice prior to confirming the professional registration status. This will also include an improved process of SACE submitting to the National Child Protection Register finalised educator misconduct cases that involve children under the age of 18 years.
Additionally, the Criminal Law (Sexual Offences and Related Matters) Amendment Act now allows access to the National Register of Sexual Offenses, amongst others, by amongst others licensing authorities, a parallel process has been initiated by SACE. SACE has written directly to the DG in the Department of Justice requesting access to the National Registers.

It is the responsibility of the Head of Provincial Education Department as the employer in terms of section 3(1)(b) of the Employment of Educators Act 76 of 1998 to implement policies with regards to the Code of Conduct, safety measures at schools and also to enforce disciplinary codes and procedures against all employees employed at the provincial level.

- 2014 - 15 financial year is 59;

e) The ASIDI programme only focused on providing sanitation facilities to schools that did not have any form of sanitation facilities. However, in the replacement of inappropriate structures, new sanitation facilities were provided which effectively replaced pit latrines. Further, in all schools provided with sanitation, pit latrines were replaced where they were in existence.

Whether the Government regulates transactions that involve foreign entities; if so, (a) what are the relevant details of the process, (b) which state entities are involved in the process and (c) what documentation is required to carry out such transactions?
Reply:
a) No, the Government does not generally regulate transactions that involve any entity, be it foreign or domestic, public or private. Aside from been very difficult (if not impossible) to do for any country or regulator, it is not clear what problem the Honourable Member wants Government to deal with, and therefore to regulate.
b) There are some sectors that may be regulated (e.g. financial or mining sector, but such regulating does not generally involve overseeing every transaction for any regulated entity, not even for an organ of state. Indeed, the audit process only focuses on a sample of transactions when auditing the financial statements of any entity – the audit process also relies on internal control systems to prevent wrongdoing. To the extent that there is any wrongdoing with regard to any specific transaction, the regulator will act when such transaction is identified.
c) If the problem that the Honourable Member is concerned about relates to illicit financial flows, then there are number of measures that are in place, either through the SARS (eg to deal with transfer pricing), the Financial Intelligence Centre to assess suspicious transactions, or the South African Reserve Bank when overseeing regulations in terms of the laws like the Currency and Exchange Act, 1933. Such measures apply to all companies, irrespective of whether they are domestic or foreign, public or private. To the extent that there is criminal wrongdoing, such activities are reported to the relevant criminal justice authorities like SAPS and NPA. In this regard, it should be noted that we have to be mindful that regulatory or enforcement activities do not cause undue delay for trade and economic activities, nor impose significant costs, as South Africa needs to remain competitive if it wants to attract investments and grow the economy more rapidly to create jobs and deal with problems of poverty and inequality.

The certificates issued by the Armscor Quality Assurance Representatives clearly illustrate the delivery address of the items accepted, and which are retained at contractor premises.

Assets are physically verified by Armscor verification officers on an annual basis, and reports in this regard are published.
The process of verification of assets was audited by Armscor’s Internal Audit Division during 2016/17, and action plans relating to the recommendations for the improvement of the verification process are in the process of being executed.

(i) The World Economic Forum (WEF) on Africa meeting was held in Abuja, Nigeria from 7 - 9 May 2014. The first day of the WEF on Africa meetings fell on the same day as the South Africa’s National Elections, 7 May 2014. Ministers were required to be present at their voting stations on the 7th May and there were no commercial airlines that could accommodate the time scheduling of the delegations especially considering that the WEF meetings had already started. Therefore it was proposed that the delegations from the three departments attending the WEF, namely National Treasury; Department of Trade and Industry; and Department of Cooperative Governance and Traditional Affairs; equally divide the total cost of R807 326.00 for a charter, between the departments.

The system keeps records of applicants’ details in a unique identification code, commonly known as a reference number. With regard to the presentation by the Electoral Commission of South Africa (IEC) to the Portfolio Committee on Home Affairs on 27 February 2017, what (a) are the reasons that the Mpumalanga province number of special votes for the 2016 Local Government Election was considerably higher than that of the other eight provinces, (b) additional resources were allocated to Mpumalanga for the home visits for special votes and (c) number of home visits were not conducted due to lack of staff?

The Electoral Commission responded as follows:
a) Section 55 of the Local Government: Municipal Electoral Act 27 of 2000 provides that a voter who is unable to cast his or her vote on voting day at the voting station in the voting district where he or she is registered may apply to cast a special vote within that voting district prior to voting day by applying for a special vote in the prescribed manner, which includes submitting a paper application form to the municipal office of the Electoral Commission, applying electronically via the on-line special vote system, or via SMS (for voting station special votes only, but not home visits).
Importantly, no reasons are required to be furnished by a special vote applicant when applying for a special vote at the voting station. In the case of home visits the applicant needs to be a voter who cannot travel to the voting station owing to physical infirmity or disability.
In the 2016 Local Government Elections (LGE 2016) in Mpumalanga, 86% (174 336) of the total of 202 646 approved special votes were voting station special votes; 14% (28 310) were home visits – compared with the national average of 44% being home visits and 56% being voting station special votes. Evidently, in Mpumalanga the vast majority of special vote applications were for voting station special votes, rather than home visits.
In accordance with the legislation, the Commission does not require special vote applicants to provide a reason when applying for a special vote. The Commission has thus not collected evidence with which to analyse the relatively high number of special votes in Mpumalanga in LGE 2016.
b) 2 409 additional voting officials were added to the initial allocation of 5 326 to cater for the approved special votes at voting stations and home visits in Mpumalanga in LGE 2016.
c) Adequate voting officials were allocated in Mpumalanga in LGE 2016 to ensure that all approved special votes were conducted within the timeframe specified in the election timetable.

b) The department through its Front Offices receives passport applications and urgent issuance requests as citizens submit their applications. There are a number of reasons advanced by various citizens who seek urgent assistance by the department. However, there is no recording of these requests which details the reasons for these outcries. Generally, the following examples can be indicated as reasons for urgent requests:
- While the citizen was processing his or her travel with the airline and Immigration Services at the airport he or she was told you need to have more than two pages left on the passport in order to travel with a passport.
- A citizen only realised in the morning of travel that the passport was missing.
- A citizen only realised in the morning of travel that the passport has been erroneously cancelled on the system while valid for another few years.
- A citizen lost his or her passport a night before or on the day of travel. A citizen is a business person who is involved in international engagements and has a trip to undertake but cannot find or has misplaced the passport.
- A citizen has just received an emergency that involves a relative who needs support or to be brought back from outside the borders of the Republic.
Amongst the greater concerns from citizens on issues raised as demand for immediate travel, is financial commitments as well as financial loss implications should they fail to travel under the circumstances.

(b) Heterosexual parents
The birth of the child from heterosexual parents shall be registered in terms of the Birth and Death Registration Act (1992). c) The agreement between the United Nations and Ukraine to employ the MI-24 helicopter is a legal agreement and a third party such as the Republic of South Africa is not privy to the contents of the costs contained in the agreement.
d) The Rooivalk helicopters are a resource that is dedicated for employment by the Force Intervention Brigade. Should the helicopter be withdrawn, the ability to employ Combat Air Support will no longer be directly available to South African Forces. The Rooivalk helicopter is armoured and can withstand light weapons fire and is utilised to gather intelligence by making use of its sensors. The helicopter is able to interdict targets with a high rate of fire in dense jungle terrain that ground forces are unable to reach.
The Rooivalk helicopter is a force multiplier to the Force Intervention Brigade and the risks associated are: reduced intelligence gathering capability, reduced fire power and the absence of an air interdiction capability will seriously reduce the combat potential of South African Forces to stabilise conflict affected areas in the Democratic Republic of Congo. Should the helicopter be withdrawn, the Force Intervention Brigade’s morale and confidence will be impacted on negatively.

Reply:
(1)(a-b) A total of 23004 foreign nationals were found by Inspectorate to be illegal in the country during financial year 2016/17and were deported to their country of origin. A more in depth analysis would need to be undertaken to determine how many of these deportees had expired visas and those who entered illegally.
(2)(a-b) All 731 Inspectorate officials in the country conduct duties that require them to actively detect foreign nationals who are in South Africa illegally as well as conduct investigation to any contraventions of departmental legislations. They are therefore not an office bound unit except for when they complete case files attached to their duties.

b) He had been in the country for 3 years and 10 months. He has also been in possession of a Permanent Resident Permit for 1 year, 4 months and 13 days.
c) Mr Butt’s citizenship was granted prematurely through miscalculation by Ferreirasdorp Office in 2006. This resulted in the erroneous issuance of the naturalisation certificate. The Department noticed that various applications from Ferreirasdorp Office were not compliant with regulations and an investigation unfolded in this regard. The office manager resigned hereafter and the office was closed due to maladministration issues.
As a result of this situation, a legal opinion was sought. The legal opinion was that all applicants who had been granted citizenship without meeting the requirements but who then qualified, provided there was no fraud or other unlawful behavior on the part of the applicants in applying for naturalisation. No fraud could be proved, hence the naturalisation status quo should be maintained and deprivation should not be processed.
2. No, there was no appeal escalated to the Ministry.

During 2017/18 financial year, a total of 2 693. 77ha were ploughed and planted in both the Local Municipalities broken down as follows: - Dr. J.S. Moroka (1 032. 7ha) and Thembisile Hani (1 661.07) Local Municipalities. In the current financial year, 2018/19, only 3 ha were cultivated in Thembisile Hani Local Municipality and ready to be planted.
(b) Total amount of hectares that have been;
(i) Planted over the past three (3) financial years: 2015/16; 2016/17 and 2017/18
The total hectares planted in the past three years in Dr. J.S. Moroka Local Municipality amounted to 3 231.92ha and for Thembisile Hani Local Municipality 3 561.96ha. These amount to a total of 6 793.88. Maize is the main crop grown in these two Local Municipalities.
(ii) Ploughed over the past three (3) financial years: 2015/16; 2016/17 and 2017/18
The total hectares ploughed in the past three years is the same for both in Dr. J.S. Moroka Local Municipality and Thembisile Hani Local Municipality which are:- 3 231.92ha and 3 561,96 respectively, amounting to 6 793.88 in total.
(iii) Harvested over the past three (3) financial years: 2015/16; 2016/17 and 2017/18
The average yield in these two Local Municipalities is estimated at 2.6 ton/ha. However, during 2015/16 financial year, the Province experienced severe drought conditions and this has resulted in significant yield reduction.
During 2015/16 and 2016/17 financial years a total of 1 576.964 tons were harvested. The total tonnage harvested from the Local Municipalities is as follow:-
- Dr. J.S. Moroka 845.853 ton
- Thembisile Hani is 731.111 ton
Harvesting for maize planted during 2017/18 financial year, will only commence in May / June 2018.
