What number of vacant funded posts are in the waste management department within the Ekurhuleni Metropolitan Municipality, (b) what are the grading levels of the posts and (c) how long has each position been vacant?
Reply:
a) Ekurhuleni Metropolitan Municipality has a total of eight hundred and nine (809) vacant funded posts in the Waste Management Department.
b) The Grade Levels of the positions range from Classic Scale 3 to Classic Scale 14.
c) All positions have been vacant since the approval of the organisational structure of the municipality in 2015.
1.1 A parliamentary question was received requesting the following:
(a) What number of vacant funded posts are in the waste management department within the Ekurhuleni Metropolitan Municipality?
(b) What are the grading levels of the posts?
(c) How long has each position been vacant?
1.2 Section 66 of the Local Government: Municipal Systems Act, 32 (Act No.32 of 2000) (“Systems Act”) provides that:
- “A municipal manager, within a policy framework determined by the municipal council and subject to any applicable legislation, must develop a staff establishment for the municipality and submit to the municipal council for approval.
- No person may be employed in a municipality unless the post to which he or she is appointed, is provided for in the staff establishment of that municipality.
- A decision to employ a person in a municipality, and any contract concluded between the municipality and that person in a municipality and that person in consequence of the decision, is null and void if the appointment was made in contravention of subsection (3)”.
1.3 The Regulations on Appointment and Conditions of Employment of Senior Managers, 2014 provides that:
(1) ”A municipal manager must, within 180 days of the promulgation of these regulations, review the municipality’s staff establishment having regard to the principles set out in these regulations, the functions and powers listed in Part B of Schedule 4, Part B of Schedule 5 to the Constitution, Chapter 5 of the Municipal Structures Act, and based on―
- (a) a municipality’s strategic objectives; and
- (b) a municipality’s core and support functions
(2) Notwithstanding subregulation (1), a municipality must at least provide for the following departments on the staff establishment to—
(a) provide development and town planning services;
(b) provide public works and basic services to communities;
(c) provide community services;
(d) manage the finances of a municipality; and
(e) render corporate support services.
(3) The municipal manager must review the municipality’s staff establishment within 180 days in any of the following instances:
(a) The election of a new municipal council;
(b) the adoption of the integrated development plan of the municipality as contemplated in section 25 of the Act;
(c) material changes to the functions of the municipality; or
(d) the determination of new municipal boundaries.
(4) The staff establishment must provide for―
(a) permanent posts; and
(b) fixed term posts.
(5) In the case of fixed term posts, the municipal manager must have due regard to the following:
(a) The financial implications of such post to the municipality;
(b) any existing contractual obligations of the incumbent manager and the financial implications thereof on the budget of the municipality;
(c) the need of the municipality to retain institutional memory and scarce skills, and to promote stability and continuity within the municipality; and
(d) the sustainability of the municipality.
(6) The municipal manager must, within 14 days of finalising the staff establishment, submit the staff establishment, a detailed report and recommendations on the draft staff establishment to the municipal council for approval.
(7) The report contemplated in subregulation (6) must outline the process followed in developing the staff establishment, which must include
a) a summary of the mandate and service delivery priorities of the municipality and how the proposed staff establishment addresses thes
b) a summary of the proposed posts that are envisaged to―
- materially change;
- change to a limited or non-material degree;
- be abolished; and
- not be affected by the changes;
(c) a motivation of the proposed changes, including an analysis of the strengths, weaknesses and limitations of the current staff establishment;
(d) job descriptions, duties, functions, competency requirements and responsibilities according to which one or more posts of the same grade are established, including the grading or relative size and value of a job;
(e) details of the financial implications of the changes including, but not limited to, the outcomes of job evaluation processes, remuneration costs for senior managers, costs for relocation, new facilities and equipment, if any;
(f) non-financial implications of the changes, including the impact on existing staff, key stakeholders and other processes within the municipality;
(g) a project plan that specifies the timeframes within which the implementation is envisaged take place; and
(h) the stakeholders and change management requirements.
(8) The municipal council must at its next meeting following receipt of the staff establishment, approve the staff establishment, with or without amendments, as proposed by the municipal manager”.
1.4 The following response was received from Ekurhuleni Metropolitan Municipality:

(1)(a) What is the total number of arrests that were made by the Rail Enforcement Unit of the City of Cape Town (i) in each of the past five financial years and (ii) since 1 April 2018 and (b) for what crime was each individual arrested; (2) will this rail safety model be rolled out to other provinces; if not, what is the position in this regard; if so, what are the relevant details?
Reply:
1. (a) (i) The Rail Enforcement unit was launched on the 27th October 2018 and has made 104 arrests since then till 31 March 2019.
(ii) See (i) above.
(b) Please refer to Annexure attached from Safety and Security Law Enforcement Services of the City of Cape Town for what crime was each individual arrested.
2. The rail enforcement unit is a jointly established and funded law enforcement pilot project for a period of 1 year between PRASA, Western Cape Department of Transport and the City of Cape Town. The agreement between the parties and the performance oversight is managed by the Rail Management Transport Task Team (RMTTT). This structure is constituted by core members that includes parties (PRASA, Western Cape Department of Transport and the City of Cape Town) to the collaborative agreement and the National Department of Transport. The RMTTT is chaired by the MEC for the Western Cape Department of Transport.
The success and effectiveness of the project will be evaluated by the RMTTT and a final decision to continue with the project will be made at the end of the 3rd quarter performance review and based on the funding availability and agreement by all three parties.
The decision to roll out of the project to other provinces is a decision that will be evaluated between PRASA and the respective local transport authorities and the provincial transport authorities based on the lessons learnt from Cape Town.

In addition the following should be noted:
In terms of Section 1(1) (x) of the National Water Act, 1998 (Act no. 36 of 1998) (NWA) the Minister owns the land on which a government waterwork is situated. The extent of the land required is determined scientifically up to the dam boundary line of each dam which includes the full supply level, the 1:100 year flood line and a buffer line. In terms of Government Immovable Asset Management ACT No 19 of 2007 (GIAMA), the disposal policies of the Department of Water and Sanitation (DWS) and the National Department of Public Works (NDPW) all excess land must be transferred to NDPW. The Minister only acquires the minimum land required for the government waterwork in order to manage, operate and maintain the dams. In relation to ownership, the
Minister has exclusive rights on the land within the government waterworks and the water source is regarded as national assets which must be protected in terms of the NWA.
(a)(iii) Refer to (a)(i) above.
(b)(i) The Hounorable Member is requested to note the following. The Value of each property owned by the Minister of Water and Sanitation which falls within a Government Waterwork must be determined by a Professional Registered Valuer. The Department is not in a financial position to determine the value of each property as yet and will need to seek the assistance of the Office of the Valuer-General to assist with the determination of the market related value of each property. The purpose of each property falling within a dam boundary line is to store bulk raw water. Refer to Annexure A for the value and purpose of each owed property.
(b)(ii) The Department is renting a total of 33 buildings. Refer to the table below (c) for the value and purpose of the rented properties.

(c)(iii) The Ministry occupies 529 m² which costs an amount of R204 188.71 at Block A, the Department occupies 3966 m² which costs an amount of R1 324 655.12 at Block G. The total space is 4495 m² at R1 528 843.83, monthly.

Reply:
The National Department of Health does not own any properties or buildings. All properties and buildings used or occupied by the National Department of Health are either:
- State Owned and managed by the Department of Public Works as custodian, or;
- State Owned and rented directly from the Department concerned where the Department of Public Works is not the custodian, or;
- Rented from the private sector, using the Department of Public Works as procurement agent.
For this reason, records are not available within National Department of Health to respond directly to the Honorable Member’s question of 1 March 2019. All contract data is held by Department of Public Works, who invoice the Department of Health for payment as follows:
- Quarterly in advance for State Owned buildings, or;
- Monthly in arrears for privately owned properties leased by DPW on behalf of National Department of Health.
It is suggested that the question be referred to the Minister of Public Works for a comprehensive response.

What is the lifespan of each of Eskom’s coal mines?
Reply:
According to the information received from Eskom
Eskom directly owns one mine, called Kilbarchan Colliery[1]. Indirectly, the utility owns some equity[2] in the cost-plus mines as a result of ownership of a portion of the mine assets through the cost-plus coal supply agreements (CSA).
Mining houses have the statutory right to mine the coal, and the statutory obligation to rehabilitate the mine. Eskom, through the CSA has the financial obligation to pay for these costs. The reserves dedicated to Eskom, can only be sold to Eskom. In a case where the mining house intends to transfer its rights and obligations, Eskom would have to provide consent. It should be noted that the CSAs do not include BEE ownership requirements as the last cost-plus agreement was signed prior to Eskom’s current BEE Policy.
Eskom does not disclose the lifespan of the cost-plus mines due to the following reasons:
- Production at some of the cost-plus mines will end before the CSA end date.
- As part of the life-extension projects, ongoing efforts to recapitalize some of the cost-plus mines will result in the stated life of the mine changing
- Some reserves in the cost-plus mine complex are not dedicated to Eskom.

Kilbarchan Colliery is recorded in Eskom’s balance sheet under the subsidiary Natal Navigation Colliery. It is recorded at R1, while the associated rehabilitation liability has been fully raised in Eskom’s financial statements. ↑

Eskom’s balance sheet does not include the cost-plus mines because the direct ownership rests with the mining houses and their balance sheets. ↑

Reply:
1. The Inquest docket, Randfontein, CAS 501/04/2017, was opened after an explosion at Wilmar Continental Oils, Randfontein, at the SalVent Plant, where one person succumbed to his injuries. The case docket was discussed with the Senior Public Prosecutor (SPP), who instructed that the case be referred to the Occupational Health and Safety Department, in Johannesburg, for a report. The case docket was sent to the Occupational Health and Safety Department, on 16 July 2018. The report from the Occupational Health and Safety Department is outstanding.
2. In the interest of the case being investigated without fear or favour, the particulars of the investigating officer cannot be divulged.
3. Yes, the investigation of the case docket was finalised by the South African Police Service (SAPS) and referred to the SPP for a decision. The SPP instructed that the incident must be referred to the Occupational Health and Safety Department, for a report. This report is still outstanding. As soon as the report is received, the case docket will be returned to the SPP at the Randfontein Magistrate’s Caurt. The date of the finalisation of this case cannot be provided, as the court process is managed by the Department of Justice and Constitutional Development.

(1) (a) Internally within the Department of Public Works, all deviations processed, approved and recorded are reported on a monthly basis to the Department’s Standing Accountability Management Committee (AMC).
(b) Deviations that are above the tender threshold of one million rand (R1 million) procured from a sole source supplier or arising out of an emergency and approved by the relevant delegated authority within the Department, are reported to the National Treasury and the Auditor General of South Africa (AGSA) within the prescribed 10 days of such approval per case.
Deviations other than sole source or arising out of an emergency are considered by the relevant delegated authority within the Department and then recommended to the National Treasury for approval/support. The National Treasury supported deviations are then reported to the AGSA within 10 days of approval.
All reported deviations of the Department are published in the National Treasury website after approval.
(c) Internally within the Department all deviations’ registers and reports are presented to the AMC. Deviations that are above the tender threshold procured either from a sole source supplier or arising out of an emergency are reported to the NT and AGSA. All NT supported deviations that are not a sole source transaction nor arising out of an emergency are provided to the AGSA
The Chief Director: Supply Chain Management (CD: SCM) or his/her delegate accounts for all deviations that are presented at the AMC. The deviation reports to National Treasury and AGSA for all sole source procurement and those arising out of emergencies and which were approved by the relevant authority are signed off by the CD: SCM. Reports to AGSA for deviations that are neither sole source nor arising out of emergencies that are supported by the National Treasury are signed off by the CD: SCM.
(d) There is currently no specific regulatory provision or stipulation that provides for the reporting of deviations to the National Assembly Portfolio Committee on Public Works. However, the Department of Public Works is always prepared to respond to any invitation from the Portfolio Committee on Public Works in order to report on the deviations as and when the Committee is able to find a slot to deliberate on such.

(1) Whether the property that houses the Fairland Police Station, situated at the corner of 89 Sophia Street and 11 Avenue in Fairland, Gauteng, is owned by the State; if so, what are the details of the building maintenance planned by his department over the next 12 months; if not, (2) is the specified property leased; if so, what is the (a)(i) name and (ii) contact details of the owner of the property and (b) expiry date of the current lease agreement; (3) whether the maintenance of the building vests with the owner, the occupying department and/or his department; (4) whether the current lease agreement will be renewed; if not, will alternative premises be sought to house the police station; (5) whether a user asset management plan has been put in place; if not, why not; if so, is the plan being adhered to?
Reply:
1. The property situated at the corner of 89 Sophia Street and 11 Avenue in Fairland, Gauteng Province, which accommodates the Fairland Police Station is not a State-owned property.
2. Yes, the property is leased.
(a) (i) The property is owned by Batho Pele Projects, Close Corporation.
(ii) The Department of Public Works’ Property Manager, Mr Lufuno Nelwamondo, may be contacted for further details on this number: 011 713 6218.
(b) The lease is currently running on a month to month basis.
3. The maintenance of the building, as stipulated in the lease contract, is vested with the owner and not the Department of Public Works (DPW).
4. The DPW renews leases in line with clients’ accommodation needs. The South African Police Service (SAPS), as a client department of the DPW, has indicated a continued need for the property and therefore the DPW will seek to renew the lease with the lessor.
5. The client has submitted a User Asset Management Plan (UAMP) for the 2017/18 financial year and it is currently in place. The Department of Public Works is currently busy with the spatial planning processes.

(i) (ii) (iii) (bb) The Department of Public Works currently rents / leases a total of 2 550 properties.
(b) (i) The value ascribed to the property under the custodianship of Department of Public Works is about R126 billion and the properties are mainly utilized for service delivery by various Government Department and State organs.

(i) The Department of Transport and its managing entity, the Transnet National Ports Authority (TNPA), are responsible for all ports within South Africa.
(ii) The Department of Public Works is the custodian of public small harbours, public slipways and State coastal properties.
The Department of Public Works has not upgraded any of its existing harbours with respect to increasing the extent or size of these harbours. The Department is currently conducting a repair and maintenance programme to the Proclaimed Fishing Harbours in the Western Cape Province.

Whether, with reference to aircraft model Boeing 737 MAX 8 which crashed this month in Ethiopia and over the Java Sea in October 2018, (a) the SA Civil Aviation Authority is undertaking an audit of all aircraft of this model landing and departing any airports in the country, (b) what (i) is being done in this regard taking the recent two crashes into account and (ii) investigations are undertaken and (c) on what date will the results of such investigations be made available?

South African Civil Aviation Authority (SACAA)
The South African Civil Aviation Authority (a) identified one operator, namely Comair that currently has one (1) Boeing 737 MAX 8 aircraft in its fleet and the second aircraft was yet to be delivered when the accident occurred. Only one foreign operator used and flew this aircraft model into South Africa, namely Ethiopian Airlines.
(b) (i) the SACAA engaged Comair following the Ethiopian airline crash and the operator voluntarily grounded its affected aircraft. Ethiopian airlines also voluntarily grounded its Boeing 737 MAX 8 fleet. Ordinarily, the Department of Transport issues a Foreign Operator Permit, on recommendation of the SACAA, to all foreign airlines intending to fly into South Africa and through this mechanism, the Authority would know the model of aircraft intended to be flown into the country and would implement and enforce any existing national or adopted airworthiness directives, etc. It is important to note that with regards to this matter, the State of design and manufacturing, i.e. the Federal Aviation Administration (FAA), has subsequently issued a directive grounding all Boeing 737 MAX 8 & 9 aircraft globally until further notice.
(ii) currently no investigations are being conducted by RSA’s Aircraft and Incident Investigation Division because South Africa is not the State of Occurrence or Registry of the two accidents; RSA suffered no fatalities in the two accidents and RSA has not yet been requested to participate or assist in the investigation.

Reply:
(1) Yes, the Belvedere Building forms part of the Department of Public Work’s Cape Town Prestige Portfolio;
(2) (a) The Department of Public Works is responsible for the maintenance of the Belvedere Building;
(b) (i) Requests were received from both the Presidency, as well as Parliament for the utilization of the building. The matter has been referred to the in-house heritage architect for recommendation regarding the optimal future use of the building. The outcome will allow the Department to finalise the scope of work for the total refurbishment of the building, thereby addressing the backlog of maintenance required to restore the building;
(b) (ii) The time frames will be determined by the finalisation of the process in relation to part (b) (i) above;
(c) The South African Heritage Resources Agency (SAHRA) will be part of the project team in the planning phase of this project;
(3) (a) No, a Custodian Asset Management Plan (C-AMP) has not been put in place.
(b) Yes, a User Asset Management Plan (U-AMP) was compiled for the building. Heritage Western Cape does not take part in the formulation of U-AMPs and C-AMPS, as these mainly involve the Department of Public Works and client departments. Heritage Western Cape will be involved once the scope of work in respect of the refurbishment of the building has been established.
(4) To date, SAHRA have not yet been requested to do a survey of the building to establish the compliance of the building to the Act. SAHRA will be consulted in that regard.
(5) (a) and (b) The building is non-compliant to the Occupational Health and Safety Act, 1993 (Act No. 85 of 1993). However, all the fire-fighting equipment and signage is compliant for the building and day-to-day maintenance is being carried out as required. All matters of non-compliance will be addressed as part of the upcoming major refurbishment project.

De Freitas, Mr MS to ask the Minister of Transport
(a) Why was the contract with a certain company (name furnished) extended, (b) what are the terms and conditions for the extension, (c) what will his department put in place when the specified contract ends and (d) what are the costs involved?
Reply:
a) The original Open Road Toll Operations contract was for an 8-year operational period for the toll system operations and maintenance and Open Road Toll (ORT) back office component that includes the operations at customer service centers. The Transaction Clearing House and Violation Processing Centre portions of the contract was for 5 years. Agreement was reached between SANRAL and the toll operator whereby the 8-year component of the contract was reduced to 6 years and the 5-year components extended to 6 years. This agreement was approved by National Treasury.
b) The original terms and conditions of the contract remained in place. The relevant applicable time periods were adjusted as indicated above.
c) SANRAL is in process to develop a new toll operation tender and will commence with the tender process in terms of procurement requirements.
d) The terms of the contract including the pricing as per the original tender remains in place. There are no additional costs as a result of the adjusted contractual time periods

With reference to the leasing of infrastructure such as trains and locomotives by the Passenger Rail Agency of South Africa (a) in the past three financial years and (b) since 1 January 2019, what (i)(aa) leases took place in each month, (bb) is the value of each contract, (cc) were the infrastructure used for and (dd) are the reasons for these leases and (ii) on what date will each lease end in each case?
Reply:
a) PRASA does not lease infrastructure and trains/locomotives except for the interface arrangements with Transnet where PRASA and Transnet rely on the usage of each other’s infrastructure and the ad hoc locomotive support required by PRASA from Transnet from time to time, especially during peak periods.
b) No Leases occurred since 1 January to Date
(i) (aa) Due to the shortage of locomotives, PRASA leased locomotives for Main Line Passenger Services for the peak period from 15 December 2017 to 30 April 2018 at a cost of R44,975m.
(bb) R44 975 million
(cc) The locomotives were used by Shosholoza Meyl during the peak periods of December and Easter to transport long distance rail passengers.
(dd) This was a temporary arrangement to assist during the peak periods of December and Easter.
(ii) The lease ended on 30 April 2018.

What number of (a) primary and (b) high schools (i) are equipped with the necessary computer equipment and (ii) have teachers who are trained to teach computer skills and coding?
Reply:
(a) and (b) (i)
The Provincial Education Departments (PEDs) are responsible for providing schools with the necessary computer equipment. It is for this reason that the Department of Basic Education (DBE) does not keep updated information on the number of schools provided with the necessary computer equipment. Such updated information should be requested from the PEDs.
(ii) Besides training offered by the provinces, the DBE has trained 43774 teachers in computer skills. Furthermore, teachers will be trained on coding from June to September 2019.

(1) Are there any industrial producers of hemp in the Republic; if so, (a) what is the location of each producer, (b) how much is produced and (iii) what is the Rand value of what is currently being produced; (2) whether there are plans to expand the hemp industry in the future; if not, what is the position in this regard; if so, what are the relevant details? Reply:
1. Currently, hemp production is only authorised for research purposes under special conditions granted by the Director-General of the National Department of Health. The permit is issued in terms of Section 22A (9) (a) (i) of Medicine and Related Substances Act 101 of 1965. About nine permits are issued per annum. The majority of applications are from three provinces, namely KwaZulu Natal, Eastern Cape and Western Cape. Each site is largely confined to 2 hectares in size.
To date, the Department of Health has received and is still considering 36 applications for commercial hemp cultivation. The area to be cultivated ranges from 2ha to 20ha. The Department of Agriculture, Forestry & Fisheries is therefore unable to respond on the tonnage produced and its estimated rand value.
Hemp is still regarded as a drug, and thus regulated by two pieces of legislation, namely, the Medicine and Related Substances Act 101 of 1965 administered by the Department of Health and the Drugs and Trafficking Act, 1992 administered by the Department of Justice and Constitutional Development and enforced by the South African Police Services.
2. Government is working on several measures aimed at facilitating the establishment of a hemp industry with the intension of diversifying the agricultural sector and to create jobs.
The Department of Agriculture, Forestry and Fisheries collaborates with the following departments, Health, Trade and Industry, Environmental Affairs, Justice and Constitutional Development, South African Police Services, Agricultural Research Council (ARC) and the Council for Scientific and Industrial Research (CSIR) towards developing a new regulatory framework for hemp. Much progress has been made in terms of dealing with technical matters regarding production of hemp, research and technology development, commercial feasibility and other related matters. The Departments of Health as well as Justice and Constitutional Development have been requested to amend their respective legislation to facilitate commercial production of hemp and manufacturing of related products.
The Department of Agriculture, Forestry and Fisheries and the Department of Health are also developing guidelines for regulating the cultivation and manufacturing of hemp and hemp products. The two departments will make pronouncements once this process has been concluded.
