On managing the protocol on Asbestos components in our various public health facilities, in terms of Government Notice R155, covering Regulation 2001 based on which Asbestos guide for Asbestos Regulation 2001 and guide for demolition work all issued in March 2003, a total of 4 394 public health facilities were inspected.

The situation is as follows:

Asbestos ceilings: 657 (see Annexure 1)
Asbestos roof: 571 (see Annexure 2)
Asbestos internal walls: 116 (see Annexure 3)
Asbestos external walls: 75 (see Annexure 4)

(b) The reason is that in most buildings, especially ceilings, were made of asbestos. We are following the protocol to deal with them as and when necessary according to the guidelines.

(1)What are the reasons that the head office of Alexkor SOC Ltd is situated in Johannesburg when it is a marine diamond company based in Alexander Bay in the Northern Cape; (2) whether Alexkor’s offices in Johannesburg and Alexander Bay duplicate any corporate services; if so, (a) what are the relevant details, (b) why are these corporate services being duplicated and (c) on what statutory grounds are these services being duplicated; (3) whether he has found that Alexkor SOC Ltd is financially secure and will have sufficient funds to continue its operations in the future; (4) whether any marine mining vessels have (a) been grounded and/or (b) not been granted permission to continue work for Alexkor SOC Ltd in each of the past three financial years and since 1 April 2017; if so, (i) why and (ii) what are the further relevant details in each case?

Response is based on information received from Alexkor

	Alexkor, as a result of the Deed of Settlement (DoS) entered into with the Richtersveld Community (RC) has been left with its only asset being the marine diamond mining rights in the Richtersveld. The marine and land diamond mining have been pooled into an uni-corporated structure called the Pooling and Sharing Joint Venture (PSJV). This is the structure that owns and operates the mine on the Richtersveld. Thus, Alexkor does not at present have any mining operations. Therefore Johannesburg is the best location while it is seeking opportunities to establish its own operations. The ease of access to mining houses and finance houses makes the location ideal, and this applies to other mining companies located in the city but with operations across the continent.

2.	(a)	No corporate functions are being duplicated. Although the PSJV is a self-contained entity in Alexander Bay, it is governed by its own Board consisting of three NEDs from both Boards of Alexkor and the RMC (three interim NEDs appointed by the Court on behalf of the RMC), and has its own employees. It is a Joint Venture and is not incorporated, neither is it bound by the provisions of the Public Finance Management Act (“PFMA”). Alexkor is therefore required to maintain a Head Office in Johannesburg to fulfil all the statutory requirements of a State-Owned Company.

3.	While Alexkor sole source of income is its share of the proceeds from the PSJV, it will continue to struggle to make ends meet as the PSJV has had challenges with a deep sea mining vessel being damaged and withdrawn from service and the land mining operation not yielding sustainable diamond volumes. At this stage, interest from cash holding is meeting the shortfall; however, a long term solution is being sought including acquisition of mining assets and value addition on current Richtersveld diamond production.

4.	(a)		The Minister of Public Enterprises has instituted a forensic investigation into, amongst others, the termination of three (3) shallow water mining contractors. The Department will be able to provide further details at the conclusion of the investigation.

Reply:

(a) Domestic waste within the public health facilities is transported by different local municipalities to the landfill sites within their areas of jurisdiction, as it happens with ordinary households. However, the following clinics do not get such a service from their municipalities:

What (a) are the immediate goals and targets that she, as the new Minister of Women in The Presidency, has set herself for the period 1 April 2018 until the next general elections in 2019, (b) will she be doing to ensure that during this period the intended framework on sanitary dignity for indigent women and girls is implemented as envisaged in the reply to question 237 for oral reply on 8 November 2017 and (c) steps will she take in the specified period to address the gender-based pay gap in the job market which sees women earning 27 percent less than men for doing exactly the same job?

a) For the period 1 April 2018 until the next general elections in 2019, The Minister of Women in the Presidency will strengthen and establish institutional mechanisms across government where there are none, review and resuscitate the coordination of the National Gender Machinery (NGM) and facilitate the establishment of the National Committee on GBV and Victim Support to address the increase of the scourge of gender based violence (GBV).

The Minister will prioritise the mainstreaming of gender within the current planning, monitoring and evaluation system and ensure the development of a country gender-responsive planning, budgeting, monitoring, reporting and evaluation framework. This will ensure that South Africa’s gender policy priorities are translated into budget allocations at all levels of government.

Furthermore the Minister will ensure that social campaigns and community dialogues are conducted to promote and raise awareness on socio-economic issues that continue to keep the women subjugated to violence, and impoverished.

The following frameworks that will guide the country in advancing women’s empowerment and gender equality will be prioritised: Sanitary Dignity, Financial Inclusion, Gender Planning, Monitoring and Evaluation, and Gender Responsive Budgeting.

b) In November 2017, the DoW reported that on 10 October 2017 Cabinet recommended that the policy should be revised to become an Implementation Framework, recognising the spectrum of sanitary products available, the impact of the fiscus and be piloted in three provinces.

The following steps are going to be undertaken by the Department of Women (DOW) to ensure that sanitary dignity for indigent girls and women is achieved:

(i) Finalisation of the situational analysis reports obtained from research conducted in the pilot provinces of Eastern Cape, Mpumalanga and Kwazulu-Natal in quintile 1, 2 and 3 (no-fee paying) schools.

(ii) Obtain validation inputs from the pilot provinces so that the current baseline is meticulously revealed in order to determine what the gaps are and how to remedy the situation.

(iii) Conduct visits to observe and gauge the extent of the current manufacturing capacity of sanitary products, be they pads, menstrual cups or tampons). This involves visiting the mainstream producers like Kimberly Clark, Proctor & Gamble, etc. as well as emerging black women owned and led small to medium players in the space; who are producing at a lesser volume, but are able to generate employment.

(iv) Conducting further research culminating into 10 research reports on the status of sanitary dignity among other categories of target beneficiaries identified in the draft Implementation Framework, i.e.:

Women at Places of Safety;
Women at Correctional Centres;
Women at Tertiary Institutions;
Girls and women in State Institutions; and
Other categories in communities identified by local government and other role players.

(iv) Working with National and Provincial Treasuries on costing.

(v) Closely analyse and work out the finer modalities of the value chain manufacturing/production, storage, distribution and waste management; in collaboration with relevant departments within the established National Interdepartmental Task Team (NTT), as well as the Provinces.

(vi) Look at matters of school infrastructure and sanitation, within the context of Menstrual Hygiene Management and the relevant pedagogy on Sexual Reproductive Health and Life Skills Training.

The department is working on an incremental approach in provincial pilot initiatives, as advised by Cabinet so that a rollout can be immediately unleashed in areas where the state of readiness has been adequately assessed and assured. The framework will be scaled up in the pilot provinces in 2019/20.

Other activities leading to piloting of the implementation framework include 24 stakeholder consultations with the Provincial Task Teams, Private Sector companies in the value chain to ascertain areas of collaboration and meeting with national task team members. Private Public Partnerships (PPPs) are crucial if the project is to succeed so as to ensure a broad, collaborative and effective implementation. Four study tours on sanitary dignity will be conducted to five countries i.e. Botswana; Kenya, Uganda, India and China for a comparative analysis and best practice.

The activities outlined above are required to inform the intervention; and thus, the focus in 2018/19 is on evidence collection in order to develop an intelligently costed Implementation Plan and M&E plan.

(c) The gender-based pay gap is a world-wide problem and the South African labour market is no exception. The fact that South African women earn less than men for doing the same job is unacceptable and illegal because it is prohibited by law. In fact, the Employment Equity Act (the Act) as amended in 2013 provides specific protection in Section 6(4) read with Section 6(5) of this Act, which states that a difference in terms and conditions of employment (inclusive of pay) between employees of the same employer performing the same or substantially the same work or work of equal value that is directly or indirectly based on any one or more of the grounds (inclusive of gender) listed in subsection 6(1) of this Act, is unfair discrimination. The principle of Equal Pay for Work of Equal Value is further unpacked in the Employment Equity Regulations, 2014, to provide implementation guidelines for employers and employees in the labour market.

It is clear that efforts to address the gender-based pay gap in the job market requires a multi-sectoral approach. Strategic partnerships with all key role players in the labour market are of critical importance. For example, joint advocacy campaigns between the Department of Women, the Department of Labour, Commission for Employment Equity (CEE) and Commission for Gender Equality (CGE) and the Commission for Conciliation, Mediation and Arbitration (CCMA) to promote the implementation of the Principle of Equal Pay for Equal Value should be prioritised to raise awareness and educate employees, in particular women, about their right to Equal Pay. At the same time, it is important to engage Organised Business and Organised Labour to demonstrate their commitment to implement the principle of Equal Pay for Work of Equal Value in their own workplaces by ensuring that they eliminate unfair discriminatory remuneration/ pay policies and structures which perpetuate gender-based pay gaps in the South African Labour Market. Pay Equity, irrespective of gender or race and other prohibited grounds, should be a priority on the Wage Negotiation Agendas of all economic sectors to ensure the eradication of gender-based pay inequalities in South Africa.

(1)	(a)	Yes, Denel has been in discussions with the government of Qatar.
		In 2017 Denel was approached by the government of Qatar represented by the Minister of Defence. The nature of the discussions were about Denel looking for loan funding. During these discussions, the government of Qatar indicated that they were also interested in Denel equity ownership.

1. (a) The Department of Public Works has been informed by the Department of Rural Development and Land Reform of land parcels within its portfolio that are earmarked for the resolution of land claims. The detailed list of properties under the Department’s custodianship earmarked for land claims is attached as Annexure A.

(b) (i), (ii) and (iii) The location of these properties is indicated in the list of properties attached.

(2) The land parcels have remained vacant, in the main, for the same reasons that vacancy exists in the bigger portfolio under the custodianship of the National Department of Public Works (NDPW). In this regard, and among other things:

the land in the portfolio is reserved to address future accommodation needs of national User departments, noting that well situated land is a scarce resource; and
the land in the portfolio is also kept in trust to address other key Government objectives, such as human settlements and land reform programmes in alignment with the requirements of the relevant departments running these programmes;

Notwithstanding the above, the NDPW seeks to let out all unutilised land with the objective of raising income to cover rates and taxes costs and to ensure the properties are secured through use.

(a) All 52 Metropolitan and District Municipalities are currently providing municipal/environmental health services. Municipalities are however all understaffed and underresourced to efficiently and effectively service the current population and the increasing number of business premises (formal and informal);

(b) The Department of Health has published and gazetted National Environmental Health Norms and Standards, 2015 ( Gazette No 39561 of 24 December 2015, Notice 1229 of 2015). Theaim of these Norms and standards is to promote and ensure compliance to environmental health related policies/legislation and to provide a national approach in standardizing activities in the delivery of Environmental Health Services and establish a level against which the delivery can be assessed and gaps identified. Municipalities are being audited annually since 2016/2017 against compliance with these Norms and Standards and are individually being assisted to improve their compliance thereto.

For optimal output and meaningful management that will improve service delivery, the Ministry of Health intends to request Cabinet to approve that Municipal Health Services be managed from the National Department of Health directly with a restructured system from National to Municipality and/or through controlling the allocation of resources especially budget that gets allocated to Municipalities to an extent that Municipalities will account directly to the Ministry. This will assist to monitor and enable the Ministry of Health to account on environmental health service delivery in the Country. Alternatively, and best still, is to change the law and have Environmental Health Practitioners (what used to be called Health Inspectors), to be directly hired by the Department of Health rather than municipalities.

On what basis does the Health Professions Council of South Africa recruit senior managers for a proposed new structure?

The Council’s new Organisational Structure was finalised as part of Phase One of the Turn Around Strategy. The implementation of the entire organisational structure including Top 20 Senior Management forms part of Phase Two which is scheduled to take 12 months and the process commenced in January 2018.

The Senior Management Positions have been assigned exclusively to the Human Resources and Remuneration Committee (REMCO) of Council in consultation with the independent consultants (i.e. Fevertree Consulting).

The principles of recruitment are still being finalised by REMCO and will be submitted to the Executive Committee of Council in May 2018 for onward submission to Council at its next meeting scheduled for 28 June 2018.

It is important to note that in order to ensure fairness and transparency the current Management Structure of Council is not involved in the top 20 recruitment process.

Once Council has approved the placement principles, Parliament will be advised accordingly.

Alexkor SOC did not concluded a contract with a company namely Scarlet Sky Investments (SSI).The pooling and sharing joint venture (PSJV) between Alexkor SOC and the Richtersveld Mining Company (RMC) who in terms of Clause 13.3 of the Unanimous Resolution is responsible for the marketing of the diamonds concluded a contract with a company Scarlet Sky Investments 60 PTY LTD, since 2015.

(a) With regards to Reunion Houses, Residents were invited to purchase houses from 2000 until 2004 (most house were sold in this period).

(b) In 2004 a general moratorium was issues by DPE to stop all sales of state properties, and residents that were still waiting to purchase were affected.

In terms of the General Manager Legal Services, Adv P Khumalo: The Council, in considering the MTT Report and following due process, acted as follows –

(a) In the matter related to disciplinary/ incapacity action as a result of the complaints in the MTT Report, it was evident that most of the complaints dealt with in the MTT Report relates to matters that had transpired prior to his appointment to the HPCSA, therefore Adv P Khumalo was exonerated. The decision was communicated to the incumbent and formal correspondence had been drafted to officially close the matter.

(b) On the question of whether it is in the interest of the HPCSA for Phelelani Khumalo to remain part of the organisation, in particular as part of its senior management, Council exonerated Adv FP Khumalo on the basis that the issues listed in the MTT report occurred prior to his joining HPCSA. This question therefore becomes irrelevant.

(1)With reference to the SA Law Commission (SALC)’s work (details furnished) into end-of-life decisions and the SALC not making any recommendation on active voluntary euthanasia, (a) what is the policy position of his department on (i) managing the pain of terminally-ill patients and the doctrine of double effect, (ii) withholding and withdrawing life-sustaining treatment from patients at the request of a patient who is mentally competent to make such decisions (aa) personally or (bb) by means of an Advance Directive, commonly referred to as passive euthanasia and (b) would his department support the introduction of legislation on assisted dying, commonly referred to as active voluntary euthanasia; (2) whether he has found, in the interest of patients, their families and medical practitioners, that there is a need to clarify all or some of the aforementioned matters legislatively to ensure greater clarity and protection for all concerned; if not, what is the position in this regard; if so, what are the relevant details?

(1) (a) The policy position of the Department on -

(i) Managing the pain of terminally-ill patients is obtained from the World Health Organisation's resolution of Palliative Care. Terminally-ill patients must be provided adequate analgesia to stay from pain until the end.

(ii) withholding and withdrawing life-sustaining treatment is a decision taken by the treating doctor and must only be based on his or her clinical evaluation and not on anybody's request.

(b) No.

(2) Our policy on terminally-ill patients is adequately outlined in the Palliative Care policy.

Reply:

(a) Ash removal, if the ash is generated from coal, happens in the same way as domestic waste removal. It is removed by municipalities to dumping sites as it happens with ordinary households. No other ash is generated from our facilities because incinerators or other combustion waste treatment facilities have been shut down. However the following facilities are not receiving the service from their municipalities:
