Reply:

(1)(a) The investigation into the case docket, KwaMashu CAS 503/06/2015, was concluded and a court date was set for 24 April 2017, at the Ntuzuma Regional Court.

(1)(b) The charge in the case docket is Rape, in terms of Section 3 of the Criminal Law (Sexual Offences and Related Matters) Amendment Act, 2007 (Act No 32 of 2007).

(1)(c)(i)(ii) The details of the investigating officer cannot be disclosed, in order to allow the investigation to be conducted without fear or favour.

(2) Yes, one suspect was arrested.

(3)(a)(i)(ii) Yes, the suspect was interviewed on 19 November 2015 and appeared before court on 23 November 2015.

(3)(b)(i)(ii) Yes, the victim was interviewed on 29 June 2015 and 7 July 2015 and the witnesses were interviewed on 29 June 2015, 20 January 2016, 5 March 2016 and 1 April 2016.

(4) The SAPS’s investigation has been concluded and the matter is on the court roll for trial.

(1)What are the reasons for the insistence by the Station Commander at the Primrose Police Station that she is incapable of answering questions and that all questions relating to the functioning of the specified police station should be sent to the provincial office; (2) why does the specified station commander continuously refuse to meet with a delegation of public representatives who want to conduct an oversight visit in accordance with the principles of the Constitution of the Republic of South Africa, 1996?

Reply:

1. The Station Commander was contacted telephonically by Councillor Tetzani, on 2017-03-01, who indicated that a Democratic Alliance (DA) delegation intended visiting the station and putting questions to the Station Commander, Colonel Vesi. The Station Commander welcomes the visit, but has indicated that questions related to the station, should be directed to the Provincial Office, as this is standard practice in the South African Police Service (SAPS).

2. The Station Commander has never refused to meet with any political delegation. Please refer to the attached correspondence which documents a meeting conducted with the Station Commander on 27 May 2016.

(1) Whether, with regard to the spate of farm attacks in January and February 2017, he will appoint a specialised unit to investigate the specified attacks and the senseless murder of farm workers and farmers, if not, why not; (2) whether his department has conducted any study to determine the reasons behind the criminal behaviour; if not, why not; if so, what are the relevant details

Reply:

(1) The South African Police Service (SAPS) does not have specialised units to specifically investigate crimes committed on farms and small holdings (farm attacks). Crime committed on farms and smallholdings has, however, been identified as a strategic priority and is being dealt with as such. The prevention and combatting of these crimes has been included in the Annual Operational Plan for the 2017/2018 financial year of the Division: Visible Policing and is also being addressed in the Rural Safety Strategy. The investigation of these crimes is also prioritised at provincial level and, depending on the complexity and nature of specific crimes, the investigations are conducted by Provincial Investigation Units, which resort under the direct command and control of the Deputy Provincial Commissioner: Crime Detection.

(2) A scientific study to determine the reasons behind the criminal behaviour during the commission of these crimes has not yet been conducted, but the modus operandi and the circumstances under which these crimes are committed, are constantly being analysed by Detective Service, Crime Intelligence, the Crime Registrar and Visible Policing, in order to implement specific operational and tactical plans for the prevention, combating and investigation of these crimes.

A.   The Danger Allowance Dispensation was terminated in 2001 in the South African Police Service (SAPS) with the conclusion of Safety and Security Sectoral Bargaining Council (SSSBC) Agreement 4 of 2001.

Agreement 4/2001, introduced a Service Allowance,taking into consideration the unique situation of the SAPS with regard to the affordability of the danger allowance and other allowances. The Agreement was a consolidation of the Danger Allowance, Special Danger Allowance and Standby Allowance into one amount of R400,00.

B.   The amount has never been reviewed since 2001, and it is currently on the agenda of the SSSBC, for review.

A.  The Prevention of Organised Crime Act, 1998 (Act No. 121 of 1998) provides for asset forfeiture in respect of the proceeds of crime or instrumentalities of crime. The Service may conduct investigations where a person has allegedly benefited from crime. The outcome of such investigations must be reported to the Asset Forfeiture Unit of the National Prosecuting Authority to facilitate the forfeiture of assets.

B.  Section 23 of the Prevention and Combating of Corrupt Activities Act, 2004 (Act No. 12 of 2004) provides that the National Director of Public Prosecutions (“NDPP”), may apply to a judge for an investigative direction in respect of a person who maintains a standard of living which is not proportionate to his or her past or present income or assets.  If the application is authorised, the NDPP may question the suspect or any other person to produce evidence or to answer questions.

With reference to paragraphs 14.8 and 14.9 of the recommendations contained in the report compiled by CPN Forensic and Accounting Services on 23 April 2014 into alleged irregularities at SA Police Service (SAPS), did the SAPS initiate an investigation in terms of the Public Financial Management Act, Act 1 of 1999 and the Treasury Regulations into possible fruitless, wasteful and irregular expenditure with the awarding of a scarce skills allowance to certain persons (details furnished); if not, why not; if so, in each case what was (a) the outcome of each investigation and (b) what further action was taken?

Reply:

(a) No investigation was initiated in terms of the Public Finance Management Act, Act 1 of 1999 and the Treasury Regulations, as there was no (a) fruitless, wasteful or irregular expenditure with regard to the awarding of the scarce skills allowance.

14.8 Mr Nkgodi

At the time of him being awarded the scarce skills allowance, Mr Nkgodi was already performing the respective duties classified as scarce skills. He had completed three years of service performing those duties, although he did not possess any formal relevant qualifications. Prior and during his deployment in the Questioned Documents Unit, Mr Nkgodi received extensive training and development, as well as mentorship and guidance, upon completion of such training.

SAPS Directive with reference 4/2/1 dated 13 November 2006, paragraph 8, reads as follows:

“where internal training is provided to an employee in order for him to perform the required duties in a scarce skills occupation category, such training/qualification will be recognised for the payment of the allowance to the employee”

Taking the above into consideration, internal training combined with his three years of experience in the field, qualified Mr Nkgodi for the allowance.

14.9 Major General Shezi

At the time of receipt of the scarce skills allowance, Major General Shezi was responsible for Quality Management within the Forensic Science Laboratory (FSL), as a Control Forensic Analyst. She was in possession of a BSC degree from the University of Durban Westville, which is the required qualification, as well as relevant experience in the field, dating back from 1996. She was also a trained DNA expert, responsible for the Quality Management System of the Biology Section of the FSL.

Major General Shezi qualified for the scarce skills allowance in terms of the Scarce Skills Policy, read with SAPS directive 4/2/1, dated 13 November 2006, paragraph 4.1 which reads as follows:

“4.1 The Minister, in terms of the powers vested upon him, approved the payment of a monthly scarce skills allowance to the following occupational categories:”

Reply:

(1) The South African Police Service (SAPS) keeps figures of incidents of violence on farms and smallholdings per financial year, based on a manual system, for operational purposes.

(1)(a) A total of 60 murders on farms and smallholdings were reported during the 2014/2015 financial year.

(1)(b) A total of 49 murders on farms and smallholdings were reported during the 2015/2016 financial year.

(2) The Rural Safety Strategy has not been implemented in full at all identified rural and rural/urban police stations.

(2)(a) The annual target for the implementation of the Rural Safety Strategy in the Annual Performance Plan for 2016/2017 of the SAPS is that 759 of the 879 identified rural and rural/urban mix police stations must implement the Rural Safety Strategy by 31 March 2017. At the end of the second quarter of the 2016/2017 financial year a total of 783 rural and rural/urban police stations had already implemented the Strategy. This means that the target was exceeded by 24 police stations.

(2)(b) The implementation of the Rural Safety Strategy is part of the Annual Performance Plan of the SAPS and the target for 2017/2018 has not been finalised.

(2) No suspects have been arrested yet and the investigation is still proceeding.

(3)(a) No, if any suspects are interviewed prematurely, it will hamper the investigation and possible crucial evidence may be tampered with or destroyed.

(3)(b) One witness has been interviewed.

(4) It is anticipated that the investigation will be concluded by the end of January 2017.
