DPW conducted physical verification and condition assessment on the entire portfolio of immovable assets consisting of Ninety Three Thousand Nine Hundred and Forty Four (93,944) buildings and improvements as per Section 13(d) of Government Immovable Asset Management Act (GIAMA). Reply:

1. The request from the Stellenbosch Municipality for the release of Erf 64, Kylemore is dated 02 September 2013 and the request for the release of the Remaining Extent of Farm 1339 and 1158/1, La Motte, Franschhoek is dated 15 May 2015, both received in the form of intergovernmental correspondence by post.

2. The Department is in discussion with the Stellenbosch Municipality and relevant Human Settlements entities in relation to the funding that is required for the purchase of these land parcels. It is also finalsing other investigations into its own requirement for these properties so as to arrive at an informed decision on their use.

3. The Municipality will be infomed of the decisions on the disposal of the properties upon completion of the relevant feasibility studies and confirmation of funding by the Municipality and / or relevant Human Settlements enties. It is anticipated that the requests will be processed within the current financial year.

Reply:

1. (a) Leasing is encapsulated in the Property Management Empowerment Policy of the Department which is still being developed and consulted with various stakeholders.

(b) The policy will be signed and adopted before the end of the year. In addition the Department together with National Treasury developed a Standard Leasing Framework which will be approved soon.

2. (a) & (b) Yes in terms of the policy there will be a qualifying criteria in accordance with BBBEE accreditation. The awarding of leasing opportunities and period of lease (tenure) will be aligned in accordance with BEE qualifications. The property sector code has been aligned to the generic codes of good practice in terms of the amended BBBEE Act to give effect to higher targets for Black Economic Empowerment in the property sector. The new Regulations for Preferential Procurement Policy Framework Act, were implemented on 01 April 2017 to give more weight to preferential points when evaluating the bids. In terms of the PPPFA budget can be allocated for set asides in the property environment to target designated groups.

Reply:

a) All 11 employees were charged with misconduct and subjected to formal disciplinary processes.

During the hearings, it was agreed between the parties that an opportunity to make representations be made available for consideration.

Please note that the Department is not at liberty to disclose the details of the settlement agreements due to signed non-disclosure agreements.

b) Four disciplinary hearings finalised and employees were given sanctions ranging from a written warning to two months suspension from work combined with final written warnings.

The disciplinary hearings for two employees could not be finalised due to death and retirement.

Five (5) cases are still pending finalisation of disciplinary processes.

c) The Department has taken a decision to subject all implicated employees to further training on the procurement processes in order to ensure that similar transgressions do not reoccur in the future.

Reply:

a) The Determination and Directive on Leave of Absence in the Public Service as prescribed by the Department of Public Service and Administration is utilised. An employee must submit his/her application for annual leave in advance, unless unforeseen circumstances prevent him/her from doing so. If confronted with unforeseen circumstances which necessitate the utilization of annual leave, the employee must personally notify his/her supervisor/manager immediately. A verbal message to the supervisor/manager by a relative, fellow employee or friend is only acceptable if the nature and/or extent of the unforeseen circumstances prevents the employee from informing the supervisor/manager personally.

An employee must submit an application for annual leave personally or through a relative, fellow employee within 5 working days after the first day of absence. If the employee fails to submit the application on time or compelling reasons why an application cannot be submitted, the supervisor/manager must immediately notify the employee that if such application is not received within 2 working days, the leave period will be regarded as unpaid leave; and inform the Human Resource division.

Should the employee default on the notification the relevant authority shall approve such absence as unpaid leave. The employee’s supervisor/manager/ Head of Department and/or his/her delegate must within two working days from receipt of the leave application form recommend/not recommend and/or approve/disapprove this leave application and submit to the relevant Human Resource division in the department.

b) Manual system for submission of leave is utilised. The capturing of leave and the management of leave credits are done on PERSAL (Personnel and Salary Administration System).

c) Each Unit has a leave administrator that submit on a weekly basis leave forms to HR with a leave register. HR checks the leave forms and registers as well as the leave captured for compliance with the relevant legislation. Reminders to submit leave timeous to HR are send every quarter to the whole Department to ensure that the system is always updated. Units that submit leave late are informed and repeat offenders are reported to Branch Heads. Disciplinary action can in terms of the Determination and Directive on Leave of Absence be taken against the employee and manager.

Reply:

Not all employees in the Public Service are required to submit financial disclosures of interest. In terms of the Public Service Regulations, 2016 only Senior Managers are required to submit financial disclosures every year by 30 April for the previous financial year. The new Public Service Regulations, 2016 also gave the Minister of Public Service and Administration the power to identify other categories that must disclose. The Determination on other categories of designated to disclose their financial interest and the directive on the form, date and financial interest to disclose on was signed on 16 March 2017. This determination identified other categories to disclose financial interest below the level of SMS:

  • Employees earning an equivalent of salary level 13 and above through the OSD or personal notches
  • Employees appointed at salary level 12 including those employees earning the equivalent of salary level 12 through the OSD
  • Employees appointed at salary level 11 including those employees earning the equivalent of salary level 11 through the OSD
  • Employees in Supply Chain and Finance Units, irrespective of their salary level

The submission date of 30 June 2017 and 31 July 2017 for the above-mentioned groups was extended to 30 September 2017. The e-disclosure system however remained open until 31 October 2017 for electronic submission of financial disclosures for these groups. Departments have until 31 December 2017 to finalise the checking of the information disclosed for the 2016/2017 financial year.

Senior Manger’s disclosure are submitted via the Head of Department to the Public Service Commission. All SMS in service as at March 2017 complied with the submission of their financial disclosures and the disclosures were forwarded before 31 May 2017 to the Public Service Commission

a) In the 2016-2017 financial year:

4 members of SMS were identified by the Auditor-General as having companies registered on the Central Supplier Database this is still under investigation. The PSR, 2016 prohibits public servants from doing business with an organ of state but did allow for 6 month transitional arrangement meaning doing business with an organ of state is only prohibited with effect from 1 February 2017.

1. (a) The Department’s internal investigating unit received twenty eight (28) allegations of fraud and corruption for the 2016/17 financial year. Of the total allegations received; twenty-three (23) investigations were finalised and the outcomes of the investigation were as follows:-

  • Five (5) cases related to non-adherence to Departmental policies and procedures;
  • Twelve (12) allegations, there was no evidence to substantiate the allegations made; and
  • Six (6) cases had elements of fraud and corruption.

(b) R 256,784,214.62* is the total monetary value of the allegations received and recorded.

2. Fourteen (14) officials were subjected to disciplinary actions for non-adherence to Departmental policies and procedures. Two (2) officials were charged for corruption, one (1) was dismissed and one (1) resigned before conclusion of the hearing. Charges are pending against one (1) official for corruption.

During the 2016/17 financial year the Department further finalised three (3) cases which were reported during the 2015/16 financial year resulting in two (2) dismissals for corruption and one (1) official resigning before the conclusion of the proceedings.

Another service provider, PwC was appointed to perform the preliminary investigation and this investigation is currently being finalised. It would not have been proper to terminate the contract whilst investigation was pending or Mazars was excluded as a source in the investigation. (1) With reference to the amended Construction Industry Development Regulations that was published for public comment in the Government Gazette No 38822 on 29 May 2015, what (a) is the current status of the proposed prompt payment regulations and (b) were the main points raised by the public through the consultation period; (2) by what date does he expect that the amended regulations will be enforced?

Reply:

1. (a) The draft Regulations on Prompt Payment and adjudication for the construction industry which were published for comment by the Minister of Public Works in Government Gazette 38822 of 29 May 2015 have been withdrawn. The Regulations were published in terms of Section 33 of the Construction Industry Development Board (CIDB) Act, 2000 (Act no 38 of 2000). The much anticipated regulations were aimed at introducing automatic interest on late payment as well as statutory mechanisms to ensure progressive payment to contractors for work done.

In following due legal processes, the Minister submitted the draft Regulations to the Office of the Chief State Law Advisor to test its Constitutional validity and whether the draft Regulations were not ultra vires (meaning whether the Regulations did not go beyond the scope of the empowering provisions of the CIDB Act).

(b) The comments received highlighted the need for greater alignment of the adjudication provisions with the existing legislative framework for the administration of contracts, as well as the powers of the Minister in terms of the CIDB Act. Specifically, key comments received include (i) there are potential challenges that would arise if main contractors are expected to pay a sub-contractor within 30-days. Where verification of work is required, this may result in bad quality work being delivered, and as such, main contractors may be reluctant to sub-contract. This scenario may lead to price escalations

as a strategy to minimize the risk to main contractors. It would give a wrong impression to service providers that the payment is due to them irrespective of quality of work; (ii) payment of invoice within 30-days of submission will be impossible to implement by the public sector versus the current practice of within 30-days of issuing progress payment certificates after invoice have been verified; (iii) since the Regulations were proposing payment by main contractors to sub-contractors, it is argued that the conditions of contracts between the main and sub-contractors should take precedence.

2. The Minister received the legal opinion from the Office of the Chief State Law Advisor (the legal opinion) which emphasised that the Regulations were ultra vires and if challenged would not pass the Constitutional validity threshold. In essence, the legal opinion advised that the prompt payment and compulsory adjudication provisions of the draft regulations were substantive in nature and could not be categorised as any other matter for the better execution of the Act or in relation to any power granted or function or duty imposed by the Act (see section 33 (1) of the Act). The Chief State law advisor applied a restrictive approach for interpreting wide empowering provisions in respect of the making of the regulations and concluded that the draft regulations:

  • extended the scope or general operation of the enactment;
  • supported attempts to widen the purposes of the Act;
  • provided for substantive matters relating to the law of contract as opposed to administrative measures to implement the substantive matters provided in the Act; and
  • could not be categorised as authorising the provision of subsidiary means of carrying into effect what is enacted in the statute itself and covered what is incidental to the execution of its specific provisions.

(b) The purpose of accommodation charges, whilst engendering the culture of total
cost of accommodation within user departments, is to collect enough revenue, at
minimum, to sustain the entity’s portfolio at a specific level.

The current rate charged for state owned accommodation is based on the original calculations as performed in 2005 when certain accommodation budgets were devolved to Client Departments. In calculating the baseline information, the Department considered the different facility types in its property portfolio. It was not possible to calculate this amount on a per-property basis owing to the magnitude of the portfolio and the specific information that was not available at that time. This was done for all facility types which resulted in different rates proposed per facility type. The average rate was calculated at R23.74 per square meter (m2).

Although the average rate per facility was R23.74m2, the Department of Public Works could only devolve the funds it had in its Maintenance and Property Rates budgets baseline. The distribution of funds per Client Department had to be scaled down to fit into this baseline and was reduced on a pro-rata basis. The average of R23.74m2 was therefore reduced to R4.74m2 at introduction and has escalated to an approximate amount of R16.00m².

The amount devolved (and subsequently charged back) was not enough to cover the self-sustainable target level. As part of the devolution framework, it was indicated that the Department would have to receive at least a 15% growth on this amount to reach the desired funding level by 2017. At that point, it would be possible to maintain properties at its current level. During the time lapse from 2006 to 2017, the portfolio would further deteriorate except where specific intervention took place. This is referred to as “backlog maintenance” which would be funded separately.

While it is possible to indicate how much each department is currently paying, it is not possible to aggregate the information down per facility or per Province as the amount is paid on National level.

The abovementioned devolution and charge-back methodology is being reviewed currently with a view to align with operatinalisation of the PMTE.

(b) The Department of Public Works is still finalizing the process of attaining approval for the payment of Performance bonuses for the 2016-17 Performance Management Cycle. The information as requested is thus not available at this stage.

(2) (a) The actual amount for payment of Performance Bonuses is not available as yet, but the established principle will be adhered to, i.e to limit the payment of Performance Bonuses to 1,5% of the Departmental remuneration budget.

1. Yes, the Department has identified and programmed backlog in the area of construction infrastructure projects deemed essential to be cleared year on year basis.

2. Definition of backlog:

Backlog in terms of infrastructure projects is defined as a number of projects that remained on planning phase for a period exceeding two years after issuing of procurement instruction and construction projects on construction phase for a period exceeding two years of construction period.

3. Essential and/or Major

The department has no classification of projects. It works according to prioritisation from client departments. Statistics of backlog are as follows:

3.1 Projects on planning stage for 2016/17

Total = 1134 (Annual target was 15% of 1134)

(a) Performance reported in 2016/17 was 159 representing 14% of 1134. That implies that 94% of the annual target was achieved.

(b) Annual target for 2017/18 remain 15% (146) of the 975 remaining backlog in line with availability of budget from clients for the construction phase.

3.2 Projects on Construction Phase for 2017/18

  • Planned Maintenance = 24

4. The annual target for 2017/18 is 75% (32) of 44 backlog projects identified and programmed.

5. Backlog projects in construction phase is caused by under-performance of contractors appointed for execution of the work, heritage compliance requirements, litigation processes, contract disputes and subsequent cancellations. Normal process of sourcing the replacement contractor had to be followed without deviation. In terms of CIDB regulation the department can only initiate the appointment of a replacement contractor after six months of cancellation. This waiting period contributes to backlog statistics.

6. These challenges will be addressed by the infrastructure delivery management system (IDMS) which the department is in the process of institutionalising and establishment of pre-approved panels of contractors and consultants.

7. Please find attached hereto a list of projects identified as infrastructure backlog of projects in construction phase for 2017/18 and projects that were on planning phase in 2016/17 and full reasons for the delay in each case.

Furthermore, doors and fanlights did not have blinds.

2. Yes, an open tender process was followed to appoint the service provider who installed the blinds at the parliamentary villages.

Whether, with reference to the Public Service Vacancy Circular No 32 of 2017, where his department advertised a vacancy for Deputy Director: Intergovernmental Relations (Post 32/101 Ref 2017/42), stating that potential candidates only require a Matric certificate and no specific managerial experience, the requirements for the specified position are in line with his department’s guidelines regarding the appointment to that level of employment; if not, how will his department remedy the situation; if so, what are the current guidelines that his department uses for the appointment of Deputy Directors in terms of (a) tertiary qualification/s, (b) general work experience, (c) managerial experience and (d) experience in the field?

Reply:

As per the initial written response of the Director-General addressed to Ms D Kohler, MP on the same matter, the Department advertised the position of Deputy Director: Intergovernmental Relations (Ref: 2017/47) with relaxed minimum appointment requirements. The advertisement of the position with relaxed qualifications followed internal approval processes after the Department sort and received a legal opinion from counsel who was briefed through State Attorney in relation to an employee who is in possession of matric certificate with more than 10 years’ experience at a Deputy Director level within Intergovernmental Relations unit. The legal opinion advised the Department to absorb the employee into a permanent employment on the basis of an established case of a reasonable expectation for a permanent appointment given the period in which the position was renewed over the years

Although counsel has advised the Department to absorb the employee without following recruitment processes, an option which is permissible in law, the Department deemed it necessary to promote competition and advertise the position with relaxed minimum appointments in order to accommodate the employee in question. The relaxation of qualifications is meant to create an opportunity for the employee to apply and compete with others for the position without a guarantee of an employment.

The Department has however abandoned the process of filling the position with relaxed qualifications.

(1) With reference to his reply to oral question 106 on 7 June 2017, (a) what are the reasons that the 1 299 properties became illegally occupied and (b) have any officials been held accountable in this regard; (2) What are the names of the top ten landlords of his department’s properties in each province?

Reply:

1. (a) As part of ensuring that the Department has an asset register that is compliant with the Standards of Generally Recognised Accounting Practice (GRAP), an asset verification processes needed to be undertaken. Whilst conducting the verification process, the Department came across some anomalies which required further investigation. Illegal occupation of State-owned land came out as one of the results of the investigation and this lead the Departments need to establish the OBB Project to ensure that the said anomalies are addressed.

Following this, various reasons were identified as the cause for the illegal occupation of State properties, these include:

  • Properties which have been unlawfully and / or to the detriment of the State been disposed of to other entities, private individuals, companies or trusts;
  • Properties which have been otherwise transferred incorrectly / unlawfully
  • Properties which have been occupied unlawfully or encroached upon;
  • Properties which have been donated for non-valid reasons
  • Opportunists and land grabbers purporting to be land owners of state owned land, selling and letting out to unsuspecting applicants.
  • State owned properties abandoned and left unattended and unsecured by Client Departments
  • Sub-letting of State owned properties

(b) The investigations into the illegally occupied properties is a detailed and time consuming process. It further requires that thorough investigations be
conducted in identifying those who are found to have played a part in the said properties being illegally occupied. To this end, no officials have been held
accountable as yet as investigations into the illegally occupied properties are on-going.

Due to a number of role players and stakeholders involved, the Department is still trying to collate the information and come back to the honourable member with a comprehensive and accurate information.

Reply:

Council for Built Environment (CBE)

The CBE has no financial crisis, besides the pressure on the budgets due to the growth in the organisation and inflationary expenditure escalations.

Construction Industry Development Board (CIDB)

The CIDB has never been at any stage deemed to be in financial crisis. This is further supported by the Auditor-General’s audit reports which consistently assessed the CIDB’s financial viability to be good.

Agrement South Africa (ASA)

ASA does not have any financial crisis.

Independent Development Trust (IDT)

IDT does not have any financial crisis. It has had going concern challenges at the beginning of 2017/18 financial year due to a budget deficit, which had no initial committed funding from National Treasury or the Department of Public Works. The National Treasury has however since committed to fund the deficit of IDT for the METF period. This is in terms of Section 4 of the 2017 Appropriations Act. Further, the entity is currently reviewing its Operating Model and Turnaround Plan in order to embolden its future financial viability and sustenance.

Included in this mandate is the provision of accommodation through state owned and leased properties, construction of new accommodation, major refurbishment of existing properties and management of municipal services. State-owned accommodation charges are billed quarterly in advance in line with the devolution framework principles adopted effective 1 April 2006. The process that is followed to recover monies relating to private leases, municipal services, client infrastructure spending (Capital allocation) and other recoverable infrastructure projects (referred to as PACE and CA) is as follows: PMTE pays lessors, contractors and municipalities on behalf of user departments; At the end of the month, the recoverable costs are consolidated per client; Invoices are then issued to clients in arrears; User departments have 30 days to settle debts in terms of the PFMA; However, in practice clients take an average of 60 days to settle the PMTE claims. As at 22 August 2017, R3.814billion was outstanding from national departments and other organs of state (Annexure: A). In line with established inter-governmental cooperation principles, the PMTE has regular interactions with user departments for the recovery of outstanding debts and is assisted by the National Treasury.

Has there been any incidents of maladministration (a) identified and (b) reported in the (i) department and/or (ii) any of the entities reporting to him; if so, (aa) what action has been taken against the perpetrators and (bb) what measures have been taken to prevent the same from happening again?

Reply:

(i) The Department of Public Works

(a) For the 2016/17 financial year the Department of Public Works Anti-Corruption Unit received Twenty-eight (28) validated reported allegations of maladministration. Of the twenty-eight (28), Seventeen (17) were finalised, one (1) is at a reporting stage and ten (10) are currently at fieldwork stage.

The finalised seventeen (17) investigations related to:-

  • 3 incidents of overpayments to service providers;
  • 1 incident of preferential treatment of a service provider;
  • 1 incident of irregular lease tender contract;
  • 3 incidents of Irregular appointments of officials
  • 5 incidents of procurement irregularities
  • 2 incidents of irregular submission of fraudulent invoices
  • 2 incidents of corruption

(aa) Emanating from the finalised investigations Seventeen (17) disciplinary recommendations were made, of the disciplinary actions recommended, eleven (11) are finalised resulting in two (02) final written warnings, nine (09) written warnings while six (06) disciplinary cases are still pending.

The Branch Corporate Services has also instituted 91 disciplinary actions against officials of the Department for various misconducts, resulting in two (2) dismissals; one (1) demotion; one (1) suspension without pay; nine (9) final written warnings, one (1) resigned before sanction; fifteen (15) written warnings; four (4) verbal warnings; 0ne (1) referred to new employer to institute action; thirty-six (36) not found guilty / lack of evidence and twenty-one (21) matters are still pending.

(bb) The Department has developed and implements a fraud risk management program. Amongst the important aspects of the fraud risk management plan is the maintenance of a fraud risk register. All areas of internal control deficiencies which makes the Department vulnerable to fraud/corruption/maladministration are incorporated in the fraud risk register and relevant Branches are requested to develop mitigating plans to address the fraud risks identified. This implementation of the mitigating factors are monitored through the Department Governance Structures such as the Risk Management Committee and Accountability Management Committee.

(ii) (aa) What action has been taken against the perpetrators

Possible fraud pertaining to procurement was discovered during investigations in 2014/2015 financial year, and a disciplinary action was instituted against the relevant official who resigned before the commencement of a disciplinary hearing. In 2015 a criminal case was opened and the Police docket is currently with the Commercial Crimes Unit of the Prosecuting Authority for a decision. Further investigation and the collation of documentary is underway in preparation of a criminal hearing.

(bb) What measures have been taken to prevent the same from happening again?

Various key vacancies have also been filled and therefore duties are properly segregated which prohibits incidents like this happening again. The filled positions includes the Chief Financial Officer, Finance Manager, Accountant and Supply Chain Practitioner. An update of all finance policies have been undertaken to ensure that all policies align to the most updated National Treasury instruction Notes as well as Legislation. These measures have ensured that there are no new irregular expenditure transactions incurred in the current year.

The staff alleged to have committed maladministration were taken through a formal disciplinary hearing process and appropriate action taken against them as per the recommendations of the disciplinary hearing process. This is a normal process through which all alleged cases misconduct (maladministration) were and are handled within the entity.

Additional to the preventive action taken on the recommendation/s of the disciplinary hearing process, and depending on the nature of the act of maladministration, a number of preventive interventions are in place ranging from deepening performance management, fraud prevention and general information sharing through internal communication and targeted training.
