Yes, as per Government Gazette No 36597 of 24 June 2013 and Government Gazette No 36899 of 4 October 2013 members of the Defence Force Service Commission have been appointed.

    3095. Mr S Esau (DA) to ask the Minister of Defence and Military Veterans:

    With reference to her reply to question 1499 on 15 August 2013 and in respect of each specified member of the SA National Defence Force (SANDF) who lost his life as a result of the SANDF employment in the Central African Republic, has the process of allocating benefits been finalised by her department; if not, to which persons are benefits still outstanding; if so, what are the details of the final benefits that were allocated by her department?

    All payments from the South African National Defence Force Group Life Insurance Scheme and Group Funeral Benefits have been fully paid; however, not all the pension benefits that are administered by the Government's Employee's Fund (GEPF) have been finalised and paid to some beneficiaries. (See Appendix A)

    Appendix B depicts the details of all the paid out benefits; the details of the pension benefits administered by the GEPF are confidential.

    3081. Dr P J Groenewald (FF Plus) to ask the Minister of Defence and Military Veterans:

    (1) Why has the SA National Defence Force (SANDF) kept a certain person (name furnished) in their employ for so long despite his sentence for armed robbery;

    (2) whether the said person had security clearance; if not, why not; if so, what type of clearance;

    (3) how regularly is the security clearance of officers in the SANDF reviewed;

    (1) The South African National Defence Force has not been aware until now that the said person was involved in armed robbery. This is more so because the said armed robbery occurred in about 1993. This issue was in the domain of the SAPS. However, the SANDF is currently investigating how this oversight may have occurred.

    (2) The member has no valid security clearance at present. However, the member had secret clearance which has since lapsed as of 2005. Member has not re-applied for any clearance as yet.

    (3) Security Clearances are supposed to be reviewed upon expiry:

    · Secret clearances lapse after five years

    · Confidential clearances lapse after 10 years.

    · Top Secret expires also after 5

    (1) How does her department monitor and evaluate the transfer of knowledge and skills when consultants are employed;

    (2) is this condition clearly stipulated in consultants' contracts; if so, how is it stipulated? NW3426E

    (1) The end user (Services/Divisions) determines the need for the transfer of knowledge and skills prior to making submission to the Alternative Delivery Board (ASD Board) for approval of the contract. These factors are scrutinized by ASD Board where after guidelines and instructions are issued on how these initiative must be included into the drafting of the Mandatory Contract Requirements. The transfer of knowledge and skills is monitored by the end user during the execution of the contract.

    (2) Yes, the nature of the condition for the transfer of knowledge and skills is dependent on the type of contract that is negotiated. The need for the transfer knowledge and skills, as identified by the end-user and/or the ASD Board will be incorporated into the mandatory requirements for the contract.

    (1) (b) The Fund is administered by a Board which is supposed to be appointed by the Minister of Defence and Military Veterans

    (c) It is not clear where the Board has been reporting about its functions at least until 2012. Since the appointment of the current Minister, no report has been submitted to the Minister

    The Fund originated from funds collected from the public by various private/civil/ charitable organisations such as the Southern Cross Fund, Friends Circle of Benoni etc.

    (b) (ii)

    The current Board is, however, unable to provide information as to the exact amounts received from each of the institutions.

    At the time of responding to the Parliamentary Question, the current Board was not able to provide much information about its activities or the financial status of the fund, prompting my decision to institute an investigation in this regard.

    It will be difficult to confidently provide reliable and accurate information to the National Assembly until such time the investigation is concluded.

    (1) Whether the department has managed to acquire modern and up to date key equipment such as UAVSs, new log and APC vehicles, attack helicopters, mortar/artillery locating radar and the relevant integrated concept of Command, Control, Communications, Computers, Intelligence, Surveillance and Reconnaissance (C4ISR), resources which enable combat advantage on the battlefield – all of which are in increasing demand in peace missions: if not, why not; if so, provide relevant details in this regard.     Yes, even with the limited resources at its disposal, the South African National Defence Force (SANDF) has been performing its tasks and obligations with regards to borderline protection through Operation Corona.

    The full deployment of the mooted troop companies has been hampered by the current reduction in personnel that is a result of the budget constraints.

    The total expenditure from the 2010/11 to 2012/13 Financial Years was R 1,1 Billion; and the total estimated expenditure for the current financial year is R 816 Million.

    Yes, an audit was conducted of all doctor's files in the South African Military Health Service (SAMHS) during the financial year 2012/13.

    (a) (i) and (ii)

    The audit initially revealed that three doctors had not re-registered with the Health Professions Council of South Africa for the year 2013/14.

    (b)

    · The registration of the first doctor was rectified after the Health Professions Council of South Africa acknowledged that it had incorrectly processed the registration date. The administrative error by the Council was rectified and a corrected registration certificate was issued by the Council to the doctor.

    · The one doctor was diagnosed with a chronic illness. A medical board was instituted that classified the doctor as permanently unfit for military duties. The member was separated from the South African Military Health Service on 31 August 2013.

    · The second doctor absconded from the Area Military Health Unit Eastern Cape on 12 June 2013. The salary of the doctor was stopped on 3 July 2013. The human resource process for the administrative discharge of the member is in the final stages of completion.

    Supply Chain regulations not adhered to (non-compliance with National Treasury Note 16A.3.2). The Department of Defence (DOD) did not obtain written price quotations and/or invite bids for aircraft leased via the Reserve Force Squadrons.

    National Treasury was engaged and it was agreed that the concept of a fixed rate for the payment of Reserve Force Aircraft (owned, leased or hired) is accepted. It was also mutually agreed that National Treasury (RT 61) Contract for the hiring of aircraft and helicopters must be used where appropriate. The concept of hiring of Reserve Force Aircraft must in future be subjected to a competitive bidding process. This matter has been resolved

    -

    Re-imbursement of cost of the Reserve Force pilots via the PERSOL system as remuneration. The PERSOL system is designed for the payment of salaries and not for the remuneration of services rendered for services/hiring of aircraft.

    The reimbursement will in future be divided into the payment of salaries through the PERSOL System and Invoice Administration System for the reimbursement for the use of the aircraft. This matter has been resolved.

    Findings and recommendations of the Board of Inquiry. The BOI was conducted to investigate all the Auditor General findings and to make the necessary recommendations to ensure compliance.

    The recommendations of the Board of Inquiry were implemented and all relevant roll players were tasked to finalise outstanding issues. This matter is still in process. Target date: 29 November 2013.

    Decisions regarding the designing of a new concept for the leasing of aircraft via the Reserve Force Squadrons. This is to draft a User Requirement Statement for Reserve Force Squadron Aircraft to incorporate the new concept and to meet the Air Force's needs and to ensure compliance with National Treasury prescripts.

    The User Requirement Statement for the Reserve Force Squadron was completed and is under discussion with National Treasury. National Treasury is currently surveying possible Service Providers' willingness to participate in accordance to the proposed concept. Target date: 29 November 2013.

    Weapons

    2009 (aa).

    (i) No prosecutions have been instituted on the two (2) weapons / firearms that were lost in 2009 as the Military Police are still busy with investigations. The SA Army is in the process of obtaining copies of Boards of Inquiry relating to the weapons that were lost in 2009 that were destroyed in a fire at the Army's Headquarters (Bester building). Information in the foregoing regard will be provided as soon as the process is finalized.

    (ii) No disciplinary steps have been taken because the loss is still under investigation by the Military Police.

    2010 (bb).

    (i) No prosecutions have been instituted on the (3) weapons / firearms that were stolen in 2010. Two (2) weapons / firearms have been found and the case is still with the South African Police Services (SAPS).

    (ii) Yes, disciplinary action was taken. Two members who were on duty when one (1) weapon / firearm were stolen from the guard room were charge and sentenced.

    2011 (cc).

    (i) No prosecutions have been instituted for the one (1) weapon / firearm that was lost as the SAPS is still busy with investigations.

    (ii) No disciplinary actions were taken against the two members who were responsible for the safekeeping of the weapon yet. The case has been referred to the Military Courts for prosecution.

    2012 (dd).

    (i) No prosecutions have been instituted yet for four (4) of the six (6) weapons / firearms that were lost during 2012.

    (ii) No disciplinary actions have been taken yet against one member who is a suspect in the loss of these four (4) weapons / firearms. The case is still under investigation by the SAPS.

    (i) No prosecutions will be instituted pertaining to two (2) of the six (6) weapons / firearm that were damaged in an aircraft accident that took place in the Drakensberg mountains during December 2012.

    (ii) No disciplinary action will be taken pertaining the damaged weapons / firearms.

    2013. No weapons have been lost.

    (b). Ammunition. No ammunition was reported stolen / lost over the stated period.

    (1)(b) The purpose of the inquiry was to investigate and accordingly report, give opinions, make findings and recommendations on the alleged incident giving rise to the grounding of the submarine, SAS QUEEN MODJADJI 1, on 17 July 2012, including specifically whether all prescripts were complied with, what prescripts were lacking, the status of training and the technical status of the submarine.

    (2)(a) The Record of Proceedings of the Inquiry was completed on 12 September 2012. The Legal Review of the Record of Proceedings has been completed and the Inquiry is in the last phase of Review by the Convening Authority, before closure.

    Only once all the stages of the inquiry are completed can the report be regarded as final. The details of the inquiry are still subject to a review.

    (3)(a) No. The SA Police Service would only be required to conduct a criminal investigation had the Board of Inquiry led evidence of a crime having been committed. No such evidence was led.

    (b) No, no other organs of state are statutorily required to investigate incidents on board SA Navy submarines. The Institute for Maritime Technology (IMT) was however approached to provide expert advice on the incident and to provide evidence before the Board of Inquiry.

    (1) Crimes committed in each calendar year are as follows:

    (2) Many of these incidents are still subject to investigation by the Police or are still going through the trial process. It will therefore be difficult to provide a full account of each outcome and action taken at this stage in respect of all these incidents.

    (a) There is no 24 hour access control due to the non-availability of guards. Guard posts are available (52 posts), but they are not funded and thus cannot be filled.

    (b) There is an old perimeter fence around the base. However, it is not safe due to its age; it is rusted, and broken in some parts. Funds have however been secured to erect a security fence on the eastern part of the base during this financial year.

    (c) Yes, there is a Crime Prevention plan which makes provision for the following:
    ▪ An erection ASB WC security fence this financial year for the eastern part of the base

    ▪ and a boom gate with cameras and guards is planned to be operational from January 2014 (tender process at Simons's Town Procurement Centre). Access Control will be exercised where the boom will be opened through registered finger prints of the eligible persons who can gain access to the base.

    ▪ Crime prevention operations and patrols do take place at the Wynberg Military Base and in the general Area of Responsibility. This is executed by Wynberg Military Police Area Office according to their annual plan and weekly programs.

    (4) Yes the perimeter fence which is in a state of disrepair has been breached. Repairs are done by unit grounds men by means of patching the holes using old fence. The Department Public Works is responsible for the erecting of the fence. However, the unit managed to secure funds for erecting a fence of about 1,2km on the eastern part of the base and the boom system that will be in place by January 2014 amounting to R3m during the 2013/14 financial year only.

    (a) The Department of Military Veterans provided access to 100 military veterans for training in a skills programme that career paths towards the National Certificate: General Security Practice – NQF Level 3. The training was facilitated by an accredited company, with the course accumulating a total of 113 credits. All final certificates of credit award had been issued through SASSETA, to ensure that the certification complies with SAQA approval standards. The 100 learners have all been provided with employment in the security industry.

    (b) The Department of Military Veterans will provide training for up to 400 security officials to be employed by a private security company. All 400 personnel will be placed on a 1 year security Learnership to ensure that their course is duly SAQA accredited.

    Furthermore, Department of Military Veterans will in conjunction with the Department of Trade and Industry avail an opportunity for the training of up to 700 female military veterans in a sewing programme. The service provider who will provide training will be an accredited service provider sourced by the Department of Trade and Industry to facilitate that the course is SAQA accreditation compliant.

    Additional to this, the two Departments will also be facilitating training and development programmes for military veterans who intend to establish small and medium businesses. These programmes would then be used as platforms where new military veterans' co-operatives and business could be registered. In these instances, courses would not necessarily be accredited but would provide the entry point into business development opportunities, through accredited programme service providers.

    The Department of Military Veterans is also negotiating the provision of agriculture based courses for military veterans who are interested in small scale farming projects. Some of these courses do carry SAQA accreditation through the AgriSETA. The Department is targeting the provision of training for up to 500 military veterans in this regard.

    1) Yes, a Military ambulance transporting the former President Nelason Mandela experienced engine problems on 8 June 2013. A fully equipped military Intensive Care Unit (ICU) ambulance was immediately dispatched to replace the first ambulance; And a full complement of specialist medical staff inclusive of intensive care specialists and ICU nurses were also on board the second ambulance.

    The military ICU ambulance was also accompanied by a civilian ambulance and two response vehicles for the remainder of the journey to a hospital in Tshwane.

    All care was taken to ensure that former President Mandela's health was not compromised by the unforeseen incident; the doctors were satisfied that the former President suffered no harm during this period.

    2) The incident is not being investigated as the relevant details are known. The vehicle, a Mercedes Benz Vito, was completely serviceable at the time of the incident. A major service was conducted by a Mercedes Benz dealer on March 2013. The vehicle was taken back to the dealer to ascertain the cause of the breakdown, after which the cause of the engine failure was identified on 11 June 2013. The dealer indicated that the specific engine part did not form part of the normal checklist for the particular major service.

R10.489 million has been allocated to the training and development for Military Veterans as captured in the Operational Plan of the Chief Directorate.

    (b) The draft policy is in place and will be finalised as soon as National Treasury approves the Military Veterans General Regulations.

    In the interim, funding is also being sourced through alternative funding agencies to make provision for training and development to take place whilst the policy goes through its route to approval.     (1) In line with the National Treasury Practice Note No 3 of 2003 which defines "consultants" amongst others as consulting firms, engineering firms, construction managers, management firms, procurement agents, auditors, individuals, the department confirms that cost benefit analyses are done, but in instances where the outsourced service includes contracts, agency and support services e.g manufacturing and production of food products, provision of sanitary services, which is not the core business of the department then no cost benefit analysis would have been done. The latter refers to contactors, and not consultants.

    (2) (a) Consultants are not used for security services. Security services are utilized as Contractors under the DOD Item 35 budget code.

    (2) (b) Consultants are not used for cleaning services. Cleaning services are utilized as Contractors under the DOD Item 35 budget code.

    There is a clear distinction between the procuring of contractors (security and cleaning services) and consultants (specialized services) however the DOD Financial Management System groups all expenditure on Item 35 (Goods and Services) to include Contractors, Consultants, Agency and Support outsourced services.

    The life cycle costs can only be estimation and are not definite or actual. This can only be determined over the period of usage approximated at 30 years. Various variables such as mission profile of platforms, day to day deployment, defect repairs and logistic support (planned and ad hoc) can also influence costs. Given the current probe by a judicial commission any estimations and projections will be speculative and may be subject to misinterpretation and misleading.

    The Department is currently preparing its presentations and evidence to the Judicial Commission on the matters related to the procurement of the SDPs. The public pronouncements and comments that the DoD makes on these matters continue to form part of the evidence and submissions within the Commission. It is the view of the Department and its legal representatives that such information, in so far as it relates to the matters under consideration by the Commission, has the potential of compromising DoD witnesses and their evidence during the Commissions proceedings.

    The appointed staff complement for the Department of Defence is above 80%; However, the planned target for the filling of vacant and funded Public Service Act (Civilian) posts for the Financial Year 2013/14 is 743.

    The following measures were introduced to decrease the turnaround time for filling vacant and funded Public Service Act Posts:

    ▪ The authority to appoint Public Service Act Personnel on salary level 1-10 was decentralized to Chiefs of Services and selected divisions effective from 1 November 2012.

    ▪ Applications are shortlisted ten days after the closing date of the advertisements, and selection is conducted within ten days thereafter.

    During March 2013 the Department had advertised 63 vacant posts of which shortlisting and placement is in process, during the month of August 2013 the Department will be advertising the last batch of vacant posts. Our target is to fill 80% vacant post by the end of 2013

    (1) In light of the availability of the South African Military Health Services (SAMHS), (a) what services related to (i) health assessment and (ii) health care are being outsourced and (b) for what reason(s):

    (2) has there been any instances of (a) a lack of specific services within the SAMHS or (b) dissatisfaction with the SAMHS?

    (1) (a) (i) The SAMHS conducts all health assessments with the exception of ad hoc referrals for audiology assessments, due to a shortage of posts and adequate numbers of audiologists in the SAMHS.

    (ii) The SAMHS shall, as far as professionally and administratively practical, make use of its own facilities. If the service is not available, local and provincial Department of Health services must be used as well as other such facilities as may be at the Surgeon General's disposal, for treatment of patients. The SAMHS may also authorise the admission or treatment of such patients at any hospital or institution that may be designated by the Surgeon General for that purpose. The latter is applicable to places where no military health facilities are available or where the SAMHS is unable to effectively treat the patient concerned due to a lack of facilities or specialised knowledge or due to transport difficulties where time and distance are relevant factors.

    (b) With reference to the paragraph above, outsourcing is done for certain diagnostic services from clinics where such equipment/capability does not exist to facilitate diagnosis, or from hospitals due to unforeseen equipment failure, or for highly specialised services. Outsourcing is also done for certain specialist treatment. Hospitalisation of patients where SAMHS cannot provide a 24-hour service. This includes maternity services. The main consideration being time, distance and cost to a military hospital. Optimal health services are also hampered due to facilities which are not properly supported by the Department of Public Works eg the repair and maintenance programme at 1 Military Hospital.

    (2)

    a) A lack of certain services in the SAMHS is largely restricted to equipment failure, facility maintenance and repair and or availability of a Health Care Practitioner for a particular speciality (eg neurosurgery). This is mitigated through the use of public and/or private facilities.

    b) Dissatisfaction is largely attributed to service where demand exceeds SAMHS capacity to provide the service. Capacity constraints include sufficient Health Care Practitioners, availability of pharmaceuticals/medical stores albeit budget

    constrains or supplier performance.

    Neither (a) the Minister of Defence and Military Veterans, (b) nor her deputy minister, or (c) any specified officials and (d) any other persons have been issued with a government or official credit card during the period 1 April 2010 up to the date or are in possession of such cards issued during an earlier period. For this purpose the Department of Defence strictly adheres to the Cabinets Decision taken on 4 November 1998 whereby it was decided that "all Government credit cards issued to political office-bearers, Directors-General and any other affected officials at National, Provincial and Local levels of Government be withdrawn".

    Other Cards

    Multi Service Aviation Cards are utilised by the Department of Defence (South African Air Force) for the purpose of aviation related expenses such as fuel, landing fees, parking fees, etc. These are not per se a credit card issue to an individual, as it is issued per aircraft registration number. Arrangements for aviation services are made by means of agents in different countries where services are required and payments in respect of the expenses incurred are done by the Department of Defence based on invoices submitted by the Aviation Agent which is appointed by means of an official contract.

Members who are successfully streamed for the fighter line will then complete Fighter Orientation Course (FOC), Hawk Conversion Course (HCC), Operational Training Course (OTC) and then finally Flight Leaders Course (FLC) to be competent as a fighter pilot.

    · The cost of repairing the fence and the brass coupling is still being determined by the Department of Public Works.

    · Estimated value of the copper wire alone is R46 000,00 at the upper antenna farm. The cost for repairing the amplifiers, electrical power cables and property is still to be determined.

    Answer 2: Yes all incidents of copper theft were reported to the Military Police or SA Police Services (SAPS) as they occurred. The following Military Police OB reference numbers or SAPS case numbers refer:

    Answer 3: To date all incidences of copper theft were reported to the Military Police and in some cases to SAPS. Investigations are still underway and in some cases specific suspects are being investigated by the Military Police. Details of these investigations are sensitive at this stage.

    In March 2013 four suspects were apprehended by SANPARKS personnel in connection with the copper theft at the upper antenna farm at Silvermine and handed over to the Muizenberg SAPS. They were later released by the SAPS when it was discovered that they were all minors.

    The withdrawal of the members of the South African National Defence Force in the Central African Republic, (CAR) following the rebels' engagements on the 23rd March 2013, was as a result of deliberations of the Military Command Council (MCC) on the 28th March 2013. The discussion and decisions on the MCC, provided the basis for the recommendations made to the Minister and subsequently the Commander in Chief to sanction the withdrawal of the troops fort the CAR. Parliament was duly informed of this decision in line with the requirements of the Constitution.

    1 (a) Reasons for allowing use of military base:
    ▪ Chartered aircrafts for the Presidency
    ▪ Landing and flight of official guests (particularly for Presidents and Ministers)

    ▪ Charter flights for operational purpose and for transporting VIPs that are authorized to use the airbase.

    Whether National Key Point air bases have critical zones that are marked for non-interference by private planes: if not, why not; if so, what are the relevant details?

    No; the air bases do not have any critical zones marked for non-interference by private aircraft. South Africa utilises International Civil Aviation Organisation (ICAO) classification of airspace that categorizes airspace as either controlled (military/civilian), uncontrolled, danger, prohibited or restricted airspace. Military air bases are not currently registered as National Key Points. Thus, the airspace around air bases is classified as military controlled air space through which civilian aircraft may transit, subject to military Air Traffic Control (ATC) services during the bases' ATC hours of duty. Outside of the base ATC hours of duty, the military airspace is considered as uncontrolled airspace and aircraft transit through the airspace as per the procedures for unmanned aerodromes as published in the South African Air navigation regulations (ANR's).

    (1) (a) Yes, there are standard operation procedures regarding Fly Zones for Aircraft.

    (1)(b) Yes, there are standard operation procedures for intercepting non-compliant aircraft.

    (1)(c) Yes there are procedures for escorting non authorised private aircraft. Acting against non-complaint aircraft will normally be limited to escorting them out of the restricted airspace and in very specific instances may entail the aircraft being instructed to proceed to a pre-determined "force-down" airfield (could be a military airbase) under military aircraft escort, where they will be then instructed to land and be handed over to the relevant state authorities for further processing. Acting against non-compliant aircraft in a lethal manner will only be considered in very extreme circumstances.

    (2)(a & b) Testing and practicing of these procedures will always be done before the actual implementation of specific high-risk airspace restrictions. The last high-visibility event, for which nationally declared airspace restrictions was implemented, was during the Orange Cup of Nations held during January 2013.

    (3)(a) The Air Force responsibilities are to force down non- compliant aircraft under military aircraft escort and under exceptional circumstances we may shoot down the non-complaint aircraft.

    (3)(b) Upon landing the non-complaint aircraft are then to be handed over to the relevant state authorities (SAPS, SACAA, SARS, Customs and Excise etc) for further processing. The DOD&MV have no further responsibility in the prosecution proceedings, if prosecution is required.

    (3)(c) Since the prosecution process regarding non-compliant aircraft takes place outside SANDF domain, the seniority level for specified disciplinary actions are unknown.

    ▪ RSA Presidential flights as per Cabinet Memorandum.
    ▪ Foreign diplomatic flights used solely for State purposes as approved by the Department of International Relations and Cooperation.
    ▪ Foreign Military flights as approved by Defence Intelligence in conjunction with State Security Agencies.
    ▪ State owned aircraft, except those owned by the National Carrier.
    ▪ Chartered Civilian aircraft on contract to the South African National Defence Force.
    ▪ Aircraft engaged in mercy flights including those used in search and rescue operations.
    ▪ Aircraft taking part in official South African Air Force/Government organized functions as approved by the Chief of the South African National Defence Force (e.g. Aerospace and Defence expos or official Air shows.

    ▪ The AFB Waterkloof may also be used:
    - As a diversion airfield for commercial aircraft.
    - To perform flight inspections of navigation aids as per agreement with the South African Civil Aviation Authority.

    4). Yes. An Environmental Contingent Team comprised of members from First City Regiment (an

    Infantry Reserve Unit) has been established, which takes out anti-poaching patrols in the area.
