Land Transport Law Enforcement

This function falls under the competence of the Provinces and Municipalities: The National Land Transport Act, Section 85 (1) reads thus, in addition to the measures provided for in this Act with regard to law enforcement, the MECs and municipalities must take active steps to develop systems to improve land transport law enforcement in their respective jurisdictions. On that effect, as a National Department of Transport, we have requested this information from the provinces and we were given the total number of taxis impounded in the financial year 2013-14 currently. The monthly breakdown has been requested from the provinces and the response is still awaited.

Note, out of nine provinces, only seven provinces have been able to provide the information given below in time.

The South African National Taxi Council (Santaco) has established a Call Centre for the commuters to call in and report any reckless driving or if it is suspected that a driver could be under the influence of drugs or alcohol. If a call is received suggesting any of the above, the call centre staff will notify the nearest law enforcement agency for action to be taken.

Drivers are also trained on the aspects of customer care as part of improving the image of the industry in the face of the general public. A number of calls have been received from commuters expressing their appreciation in the manner in which taxi driven have improved in dealing with the commuters and the respect shown to them.

 (c) What has been the cost to her department in this regard to date?

Yes there were investigations conducted. (a) The investigations (i) commenced early in 2007 (ii) investigations ended on 24m October 2008. (b) Investigations were conducted by Ernst & Young. (c) Findings and results - Two employees of SACAA were involved in selling examination papers and answers (d) (i) As a result of the investigation, SACAA instituted disciplinary actions against these two employees "Examination Officers" who were charged with misconduct in that they "overrode IT systems, thereby breaching established examination processes" and failed to secure their logon details which allowed unauthorised access to the examination system. (ii) The names of the two employees are Mr Alec Mnisi and Ms Nancy Mashamaite.

(c) Ms Poppy Khoza was appointed by the Minister of Transport as the Acting Director from Z November 2012 until 30 October 2013,

(a) How many claims has the Road Accident Fund paid in the last three financial years where the amount paid exceeds the amount initially offered in settlement and (b) in each case, what were the (i) reasons for such increased settlements, (ii) initial amounts offered, (iii) amounts paid out and (iv) times which lapsed between (aa) the claim application date and (bb) the claim payment date?

(a) In order to approve efficiencies the Road Accident Fund (RAF) has implemented a process in terms of which the different components making up a claim can now be settled independently (part-settlement), e.g. a claim for past loss of earnings can now be settled whilst the claim for future loss of earnings may require further investigation, and, or assessment, resulting in a future settlement date of the aforementioned component of the claim. This process of part-settlement of the different components of the claim means that little value can be gained from comparing an initial offer (which may relate to only a specific component of the claim) with the final settlement amount (which may exclude the earlier settled component), because like-for-like amounts would not be compared. For this reason the RAF is unable to respond to the specific query.

(b) Due to the number of claims involved, the part-settlement process alluded to above, and the timing of the capturing of certain part-settlements on the RAF's claim system, it is impractical to respond to the remainder of the question, except for providing the below response to part (i) of the question as it relates to possible reasons (other than part-settlement) for the variance between an initial offered settlement and a final settlement amount.

(i) It is not uncommon for an initial offer amount on a component of the claim to be less than the eventual settlement amount. Some of the more common reasons for this include, but are not limited to, the following:

a. The RAF may have applied a percentage apportionment, based on the RAF's assessment of the claimant's contributory negligence, which apportionment served to reduce the amount of the initial offer. This apportionment may later have been reduced, or abandoned, following negotiation or receipt of new evidence:

b. Claimants are entitled to, and frequently do, amend their claims, either by increasing the amount already claimed under a specific component of the claim or by claiming a new amount under a new component. Such amendments are typically the result of the submission of new documentary evidence pertaining to a specific component of the claim; medico-legal reports; Serious Injury Assessment Reports; and, or. actuarial reports that are submitted after the initial offer, or that may be updated after the initial offer. The RAF assesses such additional submissions and may update the initial offer where indicated; and

c. The outcome of litigation, as regards the fault aspect (apportionment) and, or, the quantum of the claim could result in the apportionment being reduced or the quantum being increased, either of which may impact the final settlement amount.

It bears noting that in many instances the RAF settles claims for more than what was originally claimed.

a) All the toll levied at any state toll road in South Africa, including the GFIP, is paid over to SANRAL as per the SANRAL Act. These monies are utilised by SANRAL to pay all costs associated with the toll road including the servicing of debt, repayment of capital cost, maintenance requirements, operational costs, lighting and Intelligent Transport Systems and Incident Management Systems.

b) The Contractor providing electronic toll collection system is Electronic Toll Collection (Pty) Ltd a company registered in South Africa.

(a)The Department is currently working with Statistics South Africa to collate data for all motor vehicle accidents occurred in (aa) 2012-12. (bb) 2012-13 and (cc) 2013- 2014. The data processing will commence once the data capturing is completed.

a) Members of the Public can renew their vehicle licenses at any Post Office in South Africa as well as at Municipal offices and Provincial Road Authorities.

b) (i) (aa) There are Agency Agreements entered into between Provinces and Municipalities as well as Post Offices.
 

(bb) Regular inspections take place to ensure that service level agreements are adhered to.
(ii) These partnerships were entered into, during year 2002.

The Merchant Shipping Act is very specific on the definition of an accident and a serious injury. In addition, the Act is equally specific on what must be reported to the Authority in terms of section 259 and refers to a casualty resulting in loss of life or serious injury.

Therefore not all incidents noted are reportable to the Authority by definition.

The Merchant Shipping Act does not have a definition of small scale fishers and therefore Local General Safety Certificates do not reflect this designation.

For the purpose of this response the Authority has assumed that all fishing vessels of less than 10m nil length are in the small scale category.

The figures are derived from an analysis of accidents reported in this category of vessels.          

 

 

       
       
       
       

 

(e)        Due to excess off-peak capacity on weekends on Metrorail, other passengers were not affected by the arrangement.  The Shosholoza Meyl service was a chartered service and did not affect scheduled services and other passengers were accommodated on the scheduled trains. a) The Province of KwaZulu Natal is using a Pro License computerised learners licence system in all their Driving License Testing Centres: Western Cape and Eastern Cape each have 3 Computerized Learners License Test, Limpopo, North West, Northern Cape, Mpumalanga and Free State have two sites per province. Gauteng has about 20 sites that uses eNaTIS computerized Learners License Test and all this are currently pilots sites.

b) The system was designed in terms of the current K53 Motor Vehicle Driving License Manuals. She system randomly select questions from a pool of 1 500 questions that an applicant for a learners license must answer. The sequence of the question and their answers are not similar in a particular test.

c) (i) (aa) The setting up cost is R 900 00 per site.

(bb) A year's maintenance is included in the initial setting up costs listed above

(ii) The Computerised Learners License Test is a module within the eNaTIS system d) The roll out of the system started around 2011/2012 financial years to date

(a) Why did the Passenger Rail Agency of SA (Prasa) contravene its supply chain management policy in the acquisition of locomotives as highlighted in the Auditor- General’s report of 2013-14 and (b) what (i) processes, (ii) procedures and (iii) mechanisms have been put in place so that such contraventions do not reoccur in future?                                                                           NW659E

(a)        I am told that Prasa followed a fair and competitive process in the acquisition of the locomotives, however, Prasa acknowledged the weaknesses identified by the Auditor-General of South Africa and corrective measures have been taken to prevent similar occurrences.

(b)        The Supply Chain Management (SMC) Policy of Prasa subscribes to the tenets of the PFMA which requires that all acquisitions should be procured in a fair, transparent, competitive and cost-efficient manner. The following has been put in place to prevent contraventions of the SMC policy through tightening the entire value chain.

  1. Processes

                  The process followed in the acquisition of locomotives was fair and transparent since it was published in the media with clear Prasa requirements in terms of the types of locomotives required. A review has been performed on all contracts where performance bonds are required and the process was completed by 28 February 2015. The process will be maintained on a quarterly basis going forward.

  1. Procedures

 

                  All bidders that respond to Prasa tender documents in the form of Joint Ventures, Consortia, Contractor/Subcontracting, etc. are required to have co-signed agreements by both or more parties. The latter document which bridges the relationship between or among parties will then enable the Bids Evaluation Team to evaluate technical capacities of the relevant business formation. An Instruction Note has been circulated to enforce strict compliance with SCM Policy. Amongst others, the instruction note was issued to all divisional CFO’s (Chief Financial Officers) to check that performance bonds are furnished on qualifying contracts prior to any payment being made to a service provider or supplier.

  • Bid Specification Committee

            The Bid Specification Committee has been formed in November 2014 to ensure the comprehensiveness and integrity of specifications that are contained in an RFP prior to advertisement thereof.

  • RFP structured

            The standard RFP documents stipulate what different business formations, for instance JV ,  Consortia or Subcontractors are to submit as returnable in order to be recognised as such in subsequent compliance, evaluation and adjudication stages of the supply chain.

  • Evaluation Team

            Bids Evaluation Teams are fully oriented in terms of primarily evaluating compliance and technical capacity of a joint venture, consortium or contractor/subcontractor

  • Adjudication and Awarding Structures

Recommendation reports that are tabled at adjuration committees are referred back to Evaluation Team if there is missing evidence of compliance and competence of the recommended bidder. The overall process yielding the recommendation reports is tested for fairness, competitiveness, transparency, value for money and cost efficiency, and report are rejected if they are found wanting.

REPLY

  1. Various blitzes to all modes of transport including vehicles transporting school kids continued taking place during 2011/12 to 2013/14. These blitzes focused on drinking and driving, roadworthiness of vehicles, excessive speeding, child restraints in cars, wearing of seatbelts, overloading of passengers and goods, expired license disks, among others.

About 3% on average of vehicles checked at blitzes were found to be illegal nationally, some were stolen vehicles, some did not have valid licences, and some had number plates not corresponding with the licence disk, such vehicles got impounded and drivers charged accordingly.

We have the 365 days Road Safety program that addresses the variety of focus areas from legislation to road users. This is anchored around the 3Es i.e. Engineering, Education and Enforcement.

(a)(i)(aa)     No trains or buses were made available for free for delegates of any political organisation’s celebrations

(a)(i)(bb)    One Shosholoza Meyl train was made available at a negotiated cost to the organisers. Busses were offered to the ANC and Young Communist League at a negotiated cost.

(b)             A 5% was offered to the ANC and Young Communist League respectively. There were no discounts on commuter rail services for the January 10th event of the ANC.

(c)             The Shosholoza Meyl services were provided on 9 January 2015 and all other rail services were provided on 10 January 2015. On buses the services were provide to the following organisations on the following dates:

(a) i. The National Road Traffic Act (NRTA) forms as published in the schedule of forms (volume 1) are the only forms approved for use at DLTC's, vehicle testing stations and registering authorities. Published forms should not be copied for use at the Registering Authorities and all other vehicle and licencing centres in South Africa.

ii. Yes, when a member of public visits our various licensing offices they are provided with only the approved and published forms as per the NRTA and there should not be any copies provided to the public.

(b) Since the implementation relating to road traffic management.

(c) Department of Transport is not aware of any photocopying of the forms and the costs related thereto.

(a) (aa) (i) There were 146 accidents reported in the financial year 2013/14. (ii) There were 66 serious incidents reported in the financial year 2013/14. (iii) There were 4241 incidents reported in the financial year 2013/14.

{bb) (i) There were 112 accidents reported from 01 April 2014 to 28 February 2015. (ii) There were 71 serious incidents reported from 01 April 2014 to 28 February 2015. (iii) There were 3832 incidents reported from 01 April 2014 to 28 February 2015.

(b) The incidents reported follow the SMS principles where operators are required to investigate them and report to the Regulator (SACAA) and Investigating Authority (AJID) of the findings and interventions and these are kept in our database, analysed and lessons published in forums such as the National Aviation Safety Seminars, etc.

Accidents and Serious Incidents are investigated by the AIID and reports with recommendations are published on the SACAA website and are shared in forums such as the National Safety Seminar, etc. The current findings of our investigations point to the last line/link in our safety chain which is the human being however not limited to the pilot. The human element will include maintenance mechanics/engineers, AMO/Operator management, the Regulator, manufacturers, etc.

(a)(i)&(ii)    The feasibility study which was undertaken in 2011, in conjunction with National Treasury, Department of Trade and Industry and Department of Public Enterprises concluded that approximately 7224 new coaches are required over a 20 year period to meet the current demand and cater for future growth in the commuter rail environment. Of the total number, PRASA requires 5256 new coaches by 2020. As part of the first phase of the implementation, PRASA is currently procuring 3600 vehicles to meet the current demand for the Metrorail service over the next ten years. This means there will still be a shortfall of coaches even with the introduction of 3600 new coaches in the next ten years.  The current General Overhaul (GO) Programme of the old fleet will therefore continue before PRASA can start with a retirement process. Therefore, PRASA will only be in a position to start with the retirement process of old fleet after the first phase of procurement. It is envisaged that after a second procurement is undertaken, the retirement process of the current fleet will commence, with the last old fleet retired by 2033.

(d)             PRASA will over the medium term develop a retirement plan of the current fleet in preparation of retiring the fleet 10 years from now. The retirement plan will consider the principles of recycling, and re-using the retired rolling stock or parts thereof.

a) The Department through its Inter-Provincial Policies and Procedures (IPPP) forum has developed a proposed "Fees Model" together with Provinces. There still needs to be discussions with the National Treasury on the proposed Model.

The Provinces submitted the model to their Provincial Treasuries to conduct an assessment of the financial implications. The Provinces whose fees were higher in a particular category of motor vehicles were supposed to decrease their fees or to perhaps not increase those fees for a certain period. So that other Provinces whose fees were lesser will be able to stabilize/catch up with Provinces whose fees were higher.

This has a huge financial implication on the own revenue generated by the Provinces and Local Authorities, therefore it is critical that the National Treasury should give guidance on the proposed model.

b) Once National Treasury has agreed and given its approval and the IPPP has reviewed the response, a statement will be made

(1)        The bus service between the former KwaNdebele area in Mpumalanga and Gauteng is being subsidised by the Gauteng Department of Roads and Transport in terms of Interim Contract 52 in the allocated amount of R 592.5 million for the 2014/15 financial year.

(2)(a)    The Passenger Rail Agency of South Africa, as the entity responsible for commuter transport, has submitted an application for funding of the project to Treasury.  The commencement of the project is dependent on the availability of funds from Treasury.

(2)(b)    It is estimated that the design and procurement process will take approximately two years from commencement, while construction will take approximately five years.

(a) The Department of Transport has, as pail of a Public Private Partnership initiative -Treasury Approval 1 process, concluded a feasibility study on the Moloto Rail Development Corridor in October 2014. The operational due diligence has identified two possible gauge variations being Standard and Cape gauge. The optimized rail option has recommended Cape Gauge as the preferred gauge to be used for the Moloto Rail Corridor.

(b) The Cape Gauge technology will integrate seamlessly with the existing rail system, which will be able Po distribute 84% of passengers to within walking distance of their destinations in Tshwane.

(1) (a) The S'hamba Sonke Program is funded through the Provincial Road Maintenance Grant (PRMG). The 201 5 Division of Revenue Bill allocates the PRMG fund amounting to R9.952 billion, R10.291 billion and R10.807 billion for the 2015/16, 2016117 and 201718 financial years respectively (the current MTEF).

(b) (i) (aa) All nine provinces are the Receiving Officers (RO) of the grant and therefore Implementing Authorities of the grant.

(bb) In the case of Limpopo, the Roads Agency Limpopo is sub-contracted to execute some of the capital works implementation whereas SANRAL also assists willing provinces through a Service Level Agreement (SLA).
 

(c) There are approximately 223 295, 234 460 and 246 183 work opportunities to be created for the 2015/16, 2016/19 and 2017/18 financial years respectively (the current MTEF).

(ii) Although no funding from the conditional grants of the S'hamba Sonke Dedicated Programme has been misappropriated there has been deviations which have been approved within the conditions set out in the Grant framework. When the Infrastructure Grant to Provinces was reconfigured to the PRMG.

  1. ZS-HPC an accident involving a hot air-balloon which occured on 14 April 2012 at Nooitgedacht Wine Eastate in Stellenbosch-Western Cape. It had four people on board and three were injured. We hope tro release the final report on or before end June 2015.

 

  1. The delay is as a result of capacity in terms of skill and knowledge of the operation of a hot ballooon. This has been overcome by the utilization of expertise from the Aero Club of South Africa. We should also note that hot air ballooons do not fall in the definition of an aircraft nor that of an accident thus the reason for not capacitating the division with these skills.

Air Traffic Control (ATC) related safety events are those events where either an error occurred whereby the prescribed separation was not achieved. This includes a loss of separation between airborne aircraft and runway incursions.

These safety events are reported to the CAA on the day of occurrence as per the ATNS Safety Management System. The CAA is also provided with a final investigation report detailing the root cause and remedial interventions to ensure that any risks are mitigated.

The only costs associated with safety events relate to the costs of the investigators involved.

South African Civil Aviation Services (SACAA)

  1. The Air Traffic and Navigation Services reported (i) 2020 incidents in 2011-12, (ii) 2308 incidents in 2012-13 and (iii) 3898 incidents were reported in 2013-14 financial years.  (b) Incidents are reported (i) before the seventh (7) of every month for the previous month in line with the Safety Management Systems (SMS) programme. Note that only serious incidents are reported as soon as practically possible as required by Civil Aviation Regulations (CAR). (b) The incidents reported by ATNS follow the SMS principles where operators are required to investigate them and report to the Regulator (SACAA) and the Investigating Authority (AIID) of the findings and interventions that have been taken, thus (c) the cost of these is only limited to the cost of maintaining and analysing the database which is kept and maintained by the investigating authority.

  1. ATNS utilises operational personnel to conduct safety event investigations at unit level and a component of 8 Investigation and Safety Specialists to provide assurance from a Corporate perspective.
  1. During 2011-12 - ATNS appointed and trained 20 operational investigators. 15 of these were Air Traffic Controllers (ATC) and 5 were Technical Support staff. The requirements for ATC investigators are validated ATC qualifications as detailed in Civil Aviation Regulations Part 65 and Technical Support staff a National Technical Diploma, specialising in aviation system. Requisite training is provided in-house. One Investigation and Safety Specialist was appointed during 2012 to fill a vacancy.
  2. During 2012-13 and 2013-14 2 new Investigators were appointed to replace 2 that were terminated in the same financial year.

The Chairperson of SAMSA has not acted at any stage as the Chief Financial Officer.

Historically, the CFO position was at 2nd-tier Executive management level, reporting to the Corporate Services Executive. The current Chief Financial Officer, Mr Tudor Hungwe was appointed in December 2013 at this level in line with the internal promotion policy after acting as the CFO.

However, in 2014 the Board agreed to permanently remove the frozen and redundant Corporate Services Executive position and elevate the position of CFO to full Executive level, largely due to added corporate governance responsibilities resting upon the shoulders of the appointee. Mr Tudor Hungwe continues to be the CFO until the process to appoint the CFO at full Executive level.

As a consequent, the process to appoint a full Executive CFO had to be run based on an public recruitment approach with the incumbent free to participate. It is aimed to be concluded by end of March 2015.

  1. Section 5 of the Road Accident Fund Act, No. 56 of 1996, provides that the Road Accident Fund (RAF) is funded by the Road Accident Fund fuel levy. The RAF does not determine the fuel levy and therefore has no control over the income it receives to pay claims. The February and March fuel levies, due on the 25th of each month and amounting to approximately R 1.8 billion per month, will be available to the RAF to honour claims for the rest of the 2014-15 financial year. However, for the 2014-15 financial year, to date, claims settlements amount to R2.5 billion, on average, per month. With the fuel levy being R1.8 billion per month, the monthly funding shortfall is R700 million. At the end of January 2015, claims awaiting payment amounted to R5.4 billion across all categories of claims.  

 

  1. The RAF has planned and implemented a cash management strategy which provides for: (i) the segmentation of the various stakeholder groupings into different categories of claimants; (ii) ring-fencing a portion of the monthly fuel levy for payment to each of the respective stakeholder groupings, thereby ensuring that the fuel levy income is distributed across the stakeholder base; and (iii) retaining a small buffer of cash, in the interest of risk management.

 

  1. The time frames in respect of the payment of claims in accordance with the cash management strategy are informed by: (i) the receipt of the monthly fuel levy, on the 25th of the month; (ii) prioritizing of payment of older claims awaiting payment, within a specific category, over newer claims awaiting payment in that specific category; and (iii) the availability of cash to make payment.

(a) The N12 bridge in Eldorado Park bridge, suffered major structural damage and repair work is scheduled to start in August 2015 and be completed by April 2016.
 
(b) No alternative measures are being put in place in the meantime, as all the lanes on the N12 freeway under the damaged bridge have been re-opened to traffic, however alternative routes can continue being used although all lanes are now open to traffic.

(c) Government does not provide public liability insurance to motorists, but the contractor doing the work does.

(d) (i) An open tender process will be followed to appoint a company to undertake the repairs on this bridge.

(ii) The two alternatives that have been considered with regard to the tender process was to either to put out two (2) tenders (one for the design and preparation of tender documentation and another tender for the appointment of a contractor) or to put out a single tender for the design and repair work (a so-called "turnkey" solution).

In order to expedite matters and to minimize the inconvenience to motorists, the Gauteng Department of Roads and Public Works has decided not to issue a tender for the design of the repair work and then another tender for carrying out the repair work, but rather to issue a single tender for the contractor to carry out the design and the repair work.

(1) (a) SANRAL is not aware whether the GEPF has invested directly in SANRAL. However, it may have done so indirectly through asset managers.

(b) In terms of JSE regulations, this information may not be disclosed without the permission of the investor. We are sorry that we are unable to assist the honourable member and suggest that the honourable member directs the request to the JSE.

{2)(a) Investors choose whether to invest in SANRAL's guaranteed or non-guaranteed Domestic Medium Term Note Programme (DMTN). The guaranteed bonds, depicted by the "HWA Y" abbreviation, carry an explicit government guarantee; whereas the non-guaranteed bonds, "NRA" reference, has no guarantee. These investors normally rely on a credit rating to determine their risk.

(b) SANRAL issues bonds with various maturities and each have a different coupon rate. Some bonds are fixed rate and some are linked to CPl. Details of these bonds are disclosed in SANRAL's Annual Report under Note 38 to the Financial Statements. As the bonds are listed on the JSE, the information can also be sought through the Exchange.

Currently, departmental above-the-line advertising campaigns are placed through the Government Communication and Information System (GCIS), in compliance with the Cabinet Memorandum No. 1 of 2011 which was adopted on 8 June 2011.

GCIS uses an independent tool to assist in determining the best mediums to procure from for any specific media campaign request.  The mediums chosen are based on the Telmar software tools which guide on the best option to propose to a department making the request. This tool is supported by Independent media research analysis based on South African Advertising Research Foundation, TAMS and RAMS complemented by Audit Bureau of circulation data.

Advertising is a standard line item in each department’s / entity’s budget, which is approved by Parliament annually.  Government departments and its entities accounts for expenditure by tabling annual reports every year and this document, inclusive of this line item (i.e. Advertising) are audited by the Audited General, who makes recommendations on any findings.  Annual Reports are widely available to the public.

The Road Accident Fund (RAF) claim system is not designed for the identification of claims relating to scholar transport, consequently the Department is not in a position to provide the information requested.

REPLY

(a)(i)        SANRAL appointed Estimating and Tendering Services CC and Messrs Joop van Dongen to assist with the estimating.

(ii)    Econex Trade, Competition & Applied Economics.

(b)(i)     The brief to the Econex was to ascertain if SANRAL was overcharged on the 17 SANRAL projects that were subject of a settlement process between the Competition Commission and the implicated construction firms in order to enable SANRAL (to the extent that there was an overcharge) to claim that amount in the form of damages from the implicated construction firm in the High Court.

(ii)    Estimating and Tendering and Joop van Dongen were briefed to assist Econex to determine the extent of the overcharge, if any, in each of the SANRAL Projects that were tainted by tender collusion.

 

(c)        1.1        Econex was appointed on 6 December 2013.

  1. Estimating and Tendering was appointed on 27 November 2013.

1.3        Joop van Dongen was appointed on 11 September 2014.

Both Econex and Estimating and Tendering and Joop van Dongen are still on brief from SANRAL and will continue to assist SANRAL in pursuing the claims for damages against the implicated construction firms.

(d)        No entities have been discharged.
