The Department hosted six conferences, seminars and workshops during the 2009-2010 financial year. The details are as follows:

Name of conference: National Language Forum (6 – 7 August 2009)

1. (a) No specific theme fixed although the purpose of the event was to align and integrate local, provincial, organizational and stakeholder's language development strategies with that of the National Language Policy Framework.

1. (a) No specific theme was fixed although the conference was to launch Language Commissions (LCs) towards implementing the AU initiative of developing identified vehicular cross border languages for regional economic development and integration.

(1) No, due to circumstances beyond its control the Department could not manage to complete the plan before the due date.

2911. Dr A Lotriet (DA) to ask the Minister of Arts and Culture:

(1) Whether the chief executive officer of the Performing Arts Centre of the Free State (Pacofs) has been suspended; if not, what is the position in this regard; if so, (a) when was he suspended and (b) what were the reasons for his suspension;

(2) whether there has been an investigation into his suspension; if not, why not; if so, what are the relevant details;

(3) whether he has been reinstated; if not, why not; if so, (a) when and (b) why? NW3600E

The Minister of Arts and Culture:

1. Yes, the Chief Executive Officer (CEO) of the Performing Arts Centre of the Free State (PACOFS) has been suspended.

(a) The Chief Executive Officer of PACOFS was suspended on the 15th June 2010.

(b) The reasons are for alleged misconduct relating to the following matters:

  • Irregular appointment of personnel without proper procedures and without an approved micro-organisational structure.
  • Mishandling of the Theatre Truck Agreement with the Transnet Foundation.
  • Irregular over-payment to a service provider without Council approval.
  • Arbitrary alteration of conditions of service of employees.
  • Alleged harassment of employees and further by entering into computer equipment of an employee without consent of the employee concerned.
  • Bringing Council into disrepute by publicly attacking senior employees in the media without consultation with Council.
  • Failure to put measures and systems in place as required by the PFMA and as outlined in the internal audit report for the period ended 30 September 2009 as audited by Ramathe Chartered Accountants.
  • 2. Yes, an independent company was appointed to investigate the alleged misconduct. The Council have received a second draft report of the investigation and is waiting for the final report.

    3. No, the CEO of PACOFS has not been reinstated. An independent company was appointed to investigate the alleged misconduct, and Council is waiting the finalisation of the report.

    (1) What was the (a) total cost of the activities and programmes that her department hosted during heritage month and (b) cost of each specified activity;

    (2) whether the cost is within the amount budgeted for heritage month activities; if not, what is the position in this regard; if so, what are the relevant details? NW3459E

    The Minister of Arts and Culture:

    (1) The Heritage Month activities included the Launch of Heritage Month, the Heritage Day Celebrations and the Living Human Treasures workshop. The total cost of the above mentioned activities was R4 530 978.36.

    (2) The budget for the Heritage Month activities was R5 500 000.00. The total cost of the Heritage Month activities was R4 530 978. 36. Therefore, funds used for the Heritage Month activities did not exceed the approved budget allocated for Heritage Month.

    2691. Mr J H van der Merwe (IFP) to ask the Minister of Arts and Culture:

    (1) Whether any funds have been made available for the commemoration of the events that occurred in 1987 to 1988 at Cuito Cuinavale, Angola; if not, what is the position in this regard; if so, what are the relevant details;

    (2) whether any funds have been made available for the erection of a memorial in remembrance of these events; if not, why not; if so, what are the relevant details;

    (3) whether any funds have been made available to arrange visits for members of the public to the memorial; if not, why not; if so, what are the relevant details? NW3356E

    The Minister of Arts and Culture:

    (1) The project to commemorate the Battle of Cuito Cuanavale was initiated and managed from the then Office of the Speaker Ms Baleka Mbete in 2008. Funds were made available in the 2008/2009 financial year to organize an event in South Africa. The project was an intergovernmental cooperative project between South Africa, Cuba, Mozambique and Angola. The project was launched at the Freedom Park in 2008. The project ceased due to the fact that Ms Mbete was appointed as Deputy-President. The project is not budgeted for in the 2010-2011 financial year.

    (2) As per the same reasons above, under point 1, no capital funds have been made available in the 2010-2011 financial year for the development of a monument.

    (3) No funds have been made available for members of the public to undertake site visits to Angola.

    2601. Dr C P Mulder (FF Plus) to ask the Minister of Arts and Culture:

    (1) Whether the Government is going to spend R1 billion in Matola, outside Maputo, as referred to by the SA High Commissioner in Mozambique (details furnished); if so, (a) from which budget will these funds originate, (b) over what period and (c) for what projects will these funds be utilised;

    (2) whether the Government will be erecting a monument and cultural centre to the value of R25 million in Matola; if so, (a) what is the objective with this museum complex and (b) what financial advantage does South Africa stand to gain from the construction of the (i) museum and (ii) cultural centre;

    (3) (a) which (i) South African and (ii) foreign companies will be used for the construction of the museum and cultural centre, (b) which tenders for the (i) construction and (ii) maintenance of the project have been awarded and (c) what amounts are under discussion;

    (4) whether the Government has conducted any investigation into the feasibility and advisability of the (a) activities and (b) upliftment projects as indicated by the said person; if not, why not, in each case; if so, in each case, (i) when and (ii) by whom was the investigation conducted and (iii) what were the costs involved;

    (5) whether the Government (a) has undertaken or (b) is undertaking projects similar to the one at Matola outside Maputo (details furnished) in other neighbouring countries; if so, (i) in which countries in each case and (ii) what are the costs of each specified project in each of these countries?     REPLY:

    1. No, the Department of Arts and Culture is not going to spend R 1 billion in Matola outside Maputo in Mozambique;

    (a) Not applicable;

    (b) Not applicable;

    (c) Not applicable;

    2. Yes, the South African Department of Arts and Culture, in collaboration with the Mozambican government, will be erecting the Matola Raid Monument and Interpretation Centre at Matola in Mozambique to the value of R 25 million.

    (a) The objective of the Monument and Interpretive Centre complex is to memorialise events of the Matola Raid of 1981 in which South African freedom fighters were killed by the then Apartheid Regime. The Interpretation Centre will be used for a variety of activities such as exhibitions, educational programmes, community activities as well as daily operational matters envisaged that with other similar sites in SADC will become part of UNESCO and African Union's Liberation Heritage Route;

    (b) The Monument and Interpretation Centre are not being considered for immediate financial gain for South Africa. However, parts of medium to long term regional heritage tourism infrastructure are development projects to stimulate regional economic development, bilateral and multilateral cooperation and stability through heritage;

    (i) There will not be a Museum constructed;

    (ii) The Monument and Interpretation Centre will benefit South Africa through tourism, exchange programmes on arts, culture and heritage;

    3. (a) (i) (ii) The companies that will be employed for the construction of the Monument and Interpretation Centre and not the museum will either be Mozambican or South African;

    (b) The Department of Public Works Procurement Framework is being used. So far Impendulo Design Architects have been contracted as the principal architects for the project. Khensani Heritage Consulting CC is contracted for research to inform the Concept Design. BKS Company is tendered for civil, contour, structural and electrical engineering while Davis Langdon Company is tendered for quantity surveying;

    (i) A tender for the construction Company has not been awarded as yet;

    (ii) There has not been a maintenance plan for the Monument and Interpretive Centre but the Memorandum of Understanding stipulates the establishment of a joint management structure which among others will come up with a maintenance plan;

    (c) There are no amounts that are under discussions as we have not yet invited bidding for the construction and maintenance tender. The Mozambican government still needs to approve the concept design before going out to tender for construction. The South African Government has already approved the Concept Design;

    4 The South African Government, through the Department of Public Works, requested by the Department of Arts and Culture, undertook feasibility and advisability studies;

    (a) The feasibility and advisability studies were undertaken to determine various planning and implementation activities of the project. The Department of Public Works conducted this study and drafted a project life cycle plan which has been used by our lead architects to draft the project execution plan outlining various project activities and timelines. In addition to this, an architectural investigation was undertaken by the Department of Public Works with the directive from the Department of Arts and Culture;

    (b) Lastly, the Department of Arts and Culture also conducted investigations and drafted a needs assessment document. The needs assessment investigation looked at how space for both the Matola Monument and Interpretation Centre is going to be utilised and this covers the community's inputs on space utilization;

    (i) All studies were conducted in 2009;

    (ii) The Department of Public Works conducted the architectural investigation and feasibility study to advise on the activities of the project as well as cost estimates. On the other hand, the Department of Arts and Culture was responsible for producing a needs assessment document;

    (iii) No costs were incurred except those related to travelling of officials involved in these investigations;

    (5)(a) The Government of South Africa has not undertaken similar projects outside Matola in Mozambique, and that means the Matola Raid Memorial Project blazes the trail;

    (b) The Government of South Africa, through the Department of Arts and Culture, is not undertaking similar kinds of projects in the neighbouring countries as yet;

    (i) Not applicable;

    (ii) Not applicable.

    Responses

    There are 6 Theatres (Playhouses) that are declared Cultural Institutions in terms of the Cultural Institutions Act 1998; they receive annual grants from the Department. These Playhouses are Artscape, Playhouse Company, Windybrow Theatre, Market Theatre Foundation, South African State Theatre and Performing Arts Centre of the Free State.     Whether her department has taken any additional measures, after receiving a financially unqualified opinion for the 2009-2010 financial year, to achieve a clean audit for the 2010-2011 financial year; if not, why not; if so, what are the relevant details?

    REPLY:

    The Department of Arts and Culture developed two policies (Framework for Managing Programme Performance Information and Monitoring and Evaluation Framework) in alignment with the Government-Wide Monitoring and Evaluation Frameworks. These policies assist to measure and understand the performance within the department which comprises strategic planning, performance budget and implementation and in-year reporting/monitoring.

    Structures such as task teams and committees have been established within the department to monitor the internal controls and strategically minimize significant audit queries on a continuous basis.

    1. The DAC Policy Task Team

  • This task team ensures that the DAC has and maintain policies to ensure compliance to the PFMA and Treasury Regulations.
  • 2. Management Committee

    • Management Committee is mainly responsible to ensure that there is a mechanism that continuously monitors and report the progress made on audit queries, whereby managers are expected to report on measures taken to clear the previously reported audit queries.
    • Key outputs for the MANCO are risks areas of the DAC (such as Assets, Expenditure trends by programmes, exception reports) and previously reported audit queries by both internal and external auditors. Management ensures that such risks areas are mitigated.
    • Financial reports are matched to the Trial Balance and notes are disclosed on a monthly basis to ensure that there will be no surprises and inconsistencies at the end of the financial year.

    3. Risk Committee

    • Risk Committee has been established to maintain effective, efficient and transparent systems of financial and risk management and internal controls as required by section 39 of the PFMA
    • A fraud Prevention Plan and risk Assessment were performed during 2010/11 financial year. The implementation of Enterprise Risk Management system has identified operational and strategic risks. The Risk Committee ensures that risks are managed within acceptable risk appetite in order to improve overall performance of the DAC, resulting in a clean audit.

    4. Asset Disposal Committee

    • Asset Disposal Committee to ensure amongst other things that asset register is complete and accurate.

    5. Monitoring and Evaluation Steering Committee

    • The monitoring and evaluation Committee is responsible for the implementation of the Monitoring and evaluation System to ensure that the monthly and Quarterly Reports are accurate and submitted on time as required by the Treasury Regulations.

    1. No, I was not informed about the Environmental Impact Assessment for a housing development in the Cradle of Humankind. However, I did receive the application to develop a Community Multipurpose Centre by the West Rand District Municipality, as an interested and affected party,. The application did not include the Heritage Impact Assessment.

    2. No.

    3. No, my department was never informed that there is a court order regarding the matter;

    (a) World Heritage sites management is the responsibility of the Ministry for Water and Environmental Affairs. It is therefore their responsibility to ensure compliance with the ruling in this regard.

    (b) Not applicable.

    4. No, I have not been informed of the threat to the Outstanding Universal Value to the property;

    a) However, when asked to comment on the application to develop a Community Multipurpose Centre, my department did not support the development because the following activities and assessments were omitted from the application:

    (i) Heritage Impact Assessment;

    ii) Environmental Impact Assessment;

    iii) Environmental Management Plan;

    iv) Public Participation process; and

    v) Traffic assessment report.

    5. As indicated above, the responsibility of World Heritage Management in the country is the responsibility of the Ministry for Water and Environmental Affairs. The Cradle of Humankind has got its own management authority that is empowered to deal with the matter of illegal occupiers.

    REPLY:

    Yes, my department did purchase the 2010FIFA World Cup Tournament clothing and other paraphernalia. The department had projects related to the tournament, one being Fly the Flag Campaign and My2010 School Adventure Competition, a joint venture with the National Department of Basic Education.

    In order to ensure that the tournament is well received and that everybody participate in one way or another, the department was oblige to purchase items that would create great interest to our target market, the overall number of items purchased and total costs are as follows:-

    220 South African Branded Scarves and Beanies at a total cost of R140 800.00

    1000 DAC Splash Logo T-shirts at total cost of R27 827.00

    1000 DAC Yellow Fleece Blankets at a total cost of R6 400.00

    These items were purchased as part of the department's campaign to strengthen our commitment to the successful hosting of the 2010 FIFA World Cup Tournament.

    (iii)(aa) and (bb)

    The purchased items were used as part of our campaign and were allocated to deserving participants at public venues, learners, educators and chaperons who were distinctive individuals in the competitions.

    (iv)(aa) and (bb)

    My department was one of the lead departments involved in the build-up towards the successful opening and closing ceremonies of the 2010 FIFA World Cup Tournament. In order to ensure our commitment we had to ignite the interest of South African Communities, through campaigns and competitions, (Fly the Flag and My2010 School Adventure competition), hence the items were purchased as part of the campaign.

    The purchase was made in consultation with senior managers involved in the 2010Project. As Minister of the National Department of Arts and Culture, playing lead role towards the success of hosting the tournament I gave authority to purchase items relevant to the campaign.
