ANNUAL REPORT ON THE ACTIVITIES OF THE PORTFOLIO COMMITTEE ON BASIC EDUCATION JANUARY 2023 TO DECEMBER 2023

 

 

1. Overview of the Chairperson:

 

According to the Rules of the National Assembly, Rule 137 2 (b) A committee must report to the Assembly - on its activities at least once per year, and this Annual Report documents the activities of the Committee between January 2023 until December 2023.

 

Key Highlights

 

2023, heralds as a year in which the Portfolio Committee on Basic Education successfully performed to achieve   its mandate, by accomplishing five out of 6   strategic objectives of the 6th Parliament Administration. In exactly one year, the Committee 95% of the work was achieved as follows:

 

  • On the Legislative aspect, the Portfolio Committee considered and later adopted the BELA Bill. Thereafter it was submitted at   National Assembly, and on 26 October 2023 the NA passed the Basic Education Laws Amendment Bill [B2- 2022] with 283 in support of the Bill and 83 not in favour of the Bill with fewer abstentions. This is a true testament to the democratic principles applied by the work of the Portfolio Committee on Basic Education to process legislation for the benefit of the people of SA. For concurrence purpose, the BELA Bill   was referred to the National Council of Provinces.

 

  • Regarding Public Participation, Section 59 (1) (a) of the Constitution of RSA, the National Assembly required public involvement in legislative and other processes of Parliament. Members of the Portfolio Committee conducted Public Hearings in all 9 provinces, where the public was   afforded an opportunity to make their inputs / views on the Bill. The BELA Public Hearings drew large public interest, because the Committee ensured that Constitutional obligation to facilitate public involvement was adhered to responsively through appropriate public participation driven initiatives.

 

  • On Oversight and Accountability, the Sector performance highlights   the strength of the Committee oversight which resulted in the achievement of set targets by DBE and its 2 entities   as reported in   BRRR  2022/23, where AGSA highlighted    the following:   
    • DBE    -         Budget Spent - 99% and Targets Achieved - 90%
    • SACE  -         Budget Spent - 100% and Targets Achieved - 90%
    • Umalusi-        Budget Spent - 100% and Targets Achieved - 100%

 

The key endeavour of the committee priorities focused on implementing oversight on fiscal discipline and ensuring government compliance with budgetary regulatory frameworks. As per 6th Administration strategic objectives on Co-operative Governance, and SONA policy priorities the PC had briefing meetings with sector stakeholders, with meeting objective linked to the Goals of the National Development Plan, meeting the strategic objectives of MTSF 2019-2024. The PC also put strategic thrust on Budget Review for 2022/23 of DBE and 2 entities i.e., Umalusi and SACE as well as the First Quarterly Performance Report 2023/24 of DBE.

 

To incorporate excellence amongst the highlights achieved by the Committee’s oversight on DBE, is the outcomes of 2022 NSC results. The Committee attended   the release of Matric results Gauteng and thereafter were briefed by DBE on the outcomes of the Examination results. 2022's impressive pass rate of 80.1%, is recorded to be the second best since 2019’s outstanding 80,3%   as compared to (Covid) pass rates of 2021 (76,40%, and 2020 76,2%).    

 

On Co-operative Governance / Intergovernmental program the focus of the Committee program ensured that the focus is to ensure implementation of strategy framework   on 3 key policies i.e.  the National Development Plan, MTSF policy priorities and SDG Quality Education Goal 4 by deliberating with DBE and its 2 entities on its Strategic plans (2019-2024), APP (2023/24), Budgets, and the 4th Quarterly Performance Report 2022/23. The Committee aligned its work in line with the Parliament mandate and the above policy imperatives such that in the 4th term, the committee planned to review its own 5-year Draft Strategic Plan, ensuring it delivered its determined activities effectively, efficiently, and collaboratively   in line with 6th Parliament strategic objectives. Members participated in the Floods Ad hoc Committee working jointly with other Committees of Parliament and attended the ELRC initiative in Gauteng.

 

In the 4th term, the Committee as per strategic plan embarked on International Participation through a study tour to Finland. The program of the study tour was premised on benchmarking the education system in Finland and sharing best practices. Lessons learned include quality, free education entrenched in the Finnish Education, investment in ECD and Teacher Education, research outputs, ICT technological advancement for learners,

 

Notable Challenges - The committee received a Petition which addressed the issue of Pit latrines. The petitioners were invited to table their concerns and the department was guided to resolve the concerns as tabled. Regarding infrastructure the Committee received briefs /updates, on the status of ASIDI, SAFE, and infrastructure related issues. Even though there is progress in this regard, non-delivery requires intervention of consequence management to those project managers who do not comply. On the aspect of NSNP challenges reported in KZN, the Committee focus remains to ensure that DBE makes nutritious meals a priority to every deserving learner. On Scholar Transport, challenges noted include insufficient modes of transport to ferry children to school.

 

 

 

PC Recommendations for consideration in 2024/25

 

To provide access to quality education, the recommendation below focuses attention on the urgency to improve the ICT model thus addressing inequalities in the education system. Addressing Learner Transport, ECD provisioning, support towards Special Needs Education and Presidential Youth Initiative for unemployed youth. Enhancing the strategy on foundational literacy and numeracy, for learner improvement on TIMMs and PIRLS, adjust learner assessment preparation accordingly. Strengthening the role and responsibilities of SACE to ensure effective delivery of Continuing Professional Development of Educators is paramount. DBE should mitigate irregular, wasteful, and fruitless expenditure as expressed in AGSA audit outcomes of 2022/23. The Committee enhancement of oversight as per mandate would ensure AGSA recommendations are strengthened to   monitor adherence of PFMA compliance and Reporting Framework by DBE /PED. Further that   budget should translate to achievement of targets.  The Provincial Education Department should be encouraged to align their Annual Performance targets with DBE strategic plan /APP and working together for realization of quality education.

Department of Basic Education

 

The Department of Basic Education (DBE) derives its mandate firstly from the Constitution of the Republic of South Africa (1996), which requires education to be transformed and democratised in accordance with the values of human dignity, equality, human rights and freedom, non-racism, and non-sexism. The Constitution guarantees access to basic education for all, including adult basic education. Secondly, the National Education Policy Act, 1996 Act 27 of 1996 (NEPA), inscribes into law the policies for the national system of education, the legislative and monitoring responsibilities of the Minister of Education, as well as the formal relations between national and provincial authorities. In terms of the NEPA, the DBE’s statutory role is to formulate national policy, norms, and standards as well as to monitor and evaluate policy implementation and impact.

South African Council for Educators

 

The mandate of the South African Council for Educators (SACE) is to enhance the status of the teaching profession. Key to this is for SACE to promote professionalism, empowering educators through development and ensuring that educators are committed to the teaching profession such that they adhere to the ethos as enshrined in the Constitution of the Republic of South Africa.

The mandate of Umalusi was determined by Chapter 2 of the Constitution which states that everyone has a right to education, the National Qualifications Framework which establishes Umalusi as a Quality Council and the GENFETQA Act assigning Umalusi the responsibility for quality assurance of general and further education and training
