Ms A.T. Lovemore (DA) to ask the Minister of Human Settlements:

a) Whether, with reference to the need to conserve scarce water resources, an assessment of the ability of municipalities to supply treated water and waterborne sewerage systems to the population they serve on a sustainable basis is carried out before any new housing development is approved; if not, why not; if so, what are the relevant details;

b) whether, in instances where a municipality is unable to provide sustainable water and wastewater services to the population it serves, houses provided by the Government will, in future, be provided with rainwater collection systems, including guttering, the necessary pipes and storage tans; if not, (a) why not and (b) what alternative water supply facilities will be provided; if so, what are the relevant details;

c) whether, in instances where a municipality is unable to provide long-terms sustainable waterborne sewerage facilities to the population it serves, new housing developments will be provided with alternative ablution facilities; if not, why not; if so, what are the relevant details?

REPLY:

a) It is a prerequisite of the National Housing Programme that the approval of so-called "Greenfield" housing development projects are subject to the confirmation by the applicable services providers that the services [and amenities] planned for the residential development are sustainable and feasible and that it will be able to provide the required services on a sustainable basis. Therefore, in circumstances where developers are not able to provide the required services, the Members of the Executive Councils responsible for Human Settlements will not approve the project and/or township applications.

b) Effective and efficient resource-use is an issue wholly endorsed, not only by the Department, but by government as a whole. It should, however, be borne in mind that the limited fiscus coupled with the ever-increasing demand for shelter, demands that there be prioritization insofar as funding is concerned. While this does not negate the need to think creatively around the application of funding allocations set aside for shelter provision, it should be remembered that shelter provision – as set out in the Housing Act – is an incremental programme; more specifically, this allows for the provision of basic shelter which can be improved upon over time.

Where feasible and practicable, project developers may consider alternative water provision and sanitation systems, on condition that such alternative solutions are sustainable for the future, is acceptable to the community and complies with environmental sustainability requirements for the said areas.

c) The Ministerial National Norms and Standards in respect of Permanent Residential Structures that directs minimum standards for the housing subsidy programme, already provides for the use of alternative sanitation systems on condition that these sanitation systems are acceptable to the community, are environmentally acceptable and can be sustained. The nature of the alternative systems that might be considered will be determined at project level and will be directed by environmental considerations, geotechnical conditions, etc.

The deployment of such alternative systems is not necessarily linked to the capacity of the municipality to provide the required services. Alternative sanitation systems have become necessary to ensure that the country complies with the urgent need for environmental sustainable development, especially in regions where water is scarce commodity.

(1) (a) At least 14 upper-air soundings per day.

(b) Upper-air sounding are done twice daily at Gough and Marion Island, and at the Irene, Cape Town and Durban Weather Offices and once daily at Upington, Bloemfontein, De Aar and Port Elizabeth as well as on special request from the Forecasting Division at Polokwane, Bethlehem and Springbok when needed during extreme weather events.

(2) Yes, after careful consideration the upper-air programme was revised from 1 August 2009 to the level of 1(a) above as a cost saving intervention.

(3) Upper-air soundings are performed to obtain vertical profiles of the atmosphere in terms of pressure, temperature, humidity and wind speed and direction. This information, in combination with other sources of information on the atmosphere's structure (substantial amounts of satellite derived data and temperature and wind data collected by some commercial airlines during takeoff and landing at the major airports) are used as input in Numerical Weather Prediction Models to give guidance to Forecasters.

(2) whether, considering that this group was involved in formulating the long-term fishing rights policy, there is a conflict of interest now that this group was awarded the contract to conduct a performance review of all fishing rights holders; if not, how was this conclusion reached; if so, what are the relevant details;

882. THE MINISTER OF WATER AND ENVIRONMENTAL AFFAIRS ANSWERS:

(1) No. No company has been appointed to act as an arbitrator between the stakeholders in the formulation of the Small-Scale Fishing policy. A facilitator (Equillore Pty Ltd) was appointed to bring the Department and the stakeholders closer on some aspects of the policy on which there were divergent views. Once Equillore Pty Ltd has established if and on what matters mediation and arbitration are required, would source expertise in consultation with the stakeholders involved. At a National Task Team meeting, Equillore declared that Advocate Dumisa Ntsebeza owns interests in a certain fishing company. As the company is not involved in the determination of the substance of the policy, all stakeholders involved in the National Task Team supported the continuation of the facilitation services being provided by Equillore.

(2) Yes. Stakeholders expressed a need for a facilitator and were invited to forward nominations. However, nominations were not forthcoming. In terms of Chapter 4 of the National Environmental Management Act, 1998 (Act No. 107 of 1998) ("NEMA"), the Director-General is empowered to appoint an independent institution for conciliation and/or mediation in the case of broad environmental matters. In this regard the Department has engaged Equillore, who is linked to the University of Stellenbosch, to provide such broad conciliation services. As Equillore Pty Ltd. was already involved in other projects in the Department they were appointed to act as facilitators in the small-scale policy process. Equillore Pty Ltd was introduced to the stakeholders and they were satisfied. All interactions so far with Equillore Pty Ltd have been described by the stakeholders as being very fruitful and encouraging.

(3) A maximum of R250 000 was budgeted.

(4) The Chairperson is not a director of any company that is holding a commercial fishing right.

(1) No. However, once-off critical and scarce skills allowances were paid to certain categories of staff (including Meteorologists) in April 2009.

(2) No. However, there is an Attraction and Retention Strategy approved by the Board, outlining various Programmes aimed at attracting and retaining employees. As part of the implementation of the Strategy, a Framework was then developed for the payment of the Critical and Scarce Skills Allowance.

(3) No. However, the Critical and Scarce Skills allowances were paid by Management, in accordance with the Framework referred to in (2) above.

886. The Leader of the Opposition (DA) to ask the President:

(1) Whether, with reference to his reply to Question 8 on 28 July 2009, he will appeal to SADC to send its own fact-finding mission to Zimbabwe to investigate the reports about Zimbabwe and the current situation there; if not, why not; if so, what are the relevant details;

(2) Whether he will intervene to ensure that President Robert Mugabe abides by the Global Political Agreement (GPA) to which he attached his signature; if not, why not; if so, what are the relevant details;

(3) Whether he will impose an embargo on all arms going to Zimbabwe; if not, why not; if so, what are the relevant details? NW1037E

REPLY:

(1) I will not appeal to SADC to send a fact finding mission to Zimbabwe as the matter was extensively dealt with at the recent Summit of SADC Heads of State and Government held in the Democratic Republic of Congo on 7-8th September.

(2) On 27 and 28 August 2009, in my capacity as Chair of SADC, I met in Harare with the three signatories to the Global Political Agreement (GPA) to discuss the critical issues relating to the implementation of the agreement.

On that occasion, I publicly called on all parties in Zimbabwe to work together to remove any remaining obstacles to the implementation of the agreement.

The parties agreed on the need to speed up implementation and to find solutions to the current points of disagreement.

The Democratic Republic of Congo took over as the chair of SADC at the Summit of SADC Heads of State and Government on 7-8th September.

However, South Africa remains ready to work with its SADC counterparts to assist Zimbabwe's unity government to resolve any outstanding issues.

(3) I will not impose a blanket arms embargo on Zimbabwe. Applications for sale of arms to another country are considered by the National Conventional Arms Control Committee (NCACC). This is done on a case-by-case basis, using the guiding principles and criteria contained in the NCACC Act of 2002. Among other things, the Committee is required to adhere to international law, norms and practices and the international obligations and commitments of the Republic, including United Nations Security Council arms embargoes.

Mr M H Steele (DA) to ask the Minister of Finance:

Whether, in light of concerns raised both by officials of the National Treasury and members of the provincial and national Standing Committees on Public Accounts (SCOPA) gathered at the recent workshop of the Association of Public Accounts Committees (APAC), he win institute a public consultation and review process of the Public Finance Management Act, Act 1 of 1999 (PFMA) and Municipal Finance Management Act. Act 56 of 2003 (MFMA) in their present forms; if not. why not; if so, when will such a process begin?

REPLY:

It would assist if the concerns that the honourable member is referring to was made clear in the question.

During 2008, the National Treasury published a draft Bill to improve the current PFMA. The Bill introduced provisions aimed at improving planning and budgetary processes, improving accountability, strengthening National Treasury's enforcement responsibilities, providing a supply chain management framework that is aligned with the Broad Based Black Economic Empowerment Act and effecting technical amendments to certain clauses to facilitate its easier interpretation and /or application. It is presumed that the aforementioned amendments would deal with the concerns referred to by the honourable member.

The National Treasury intends submitting an updated Public Finance Management Amendment Bill to Cabinet during 2010. After Cabinet's approval, the Bill will be submitted to the State Law Advisor for certification where after the Bill will be tabled in Parliament. The draft Bill will then be published for public comment in the Government Gazette. Comments received would be submitted to the National Treasury and to the Secretary to Parliament.

It is also the intention to consider possible amendments to the Municipal Finance Management Act (MFMA). 2003 (Act No. 56 of 2003) during 2011. If such amendments are to be effected, the public consultation process for the Municipal Finance Management Amendment Bill will resemble the process to be followed for the Public Finance Management Amendment Bill.

ANSWER NO.

Guidance to municipalities on overall budget increases is dealt with through the Municipal Finance Management Act (MFMA) Municipal Budget Circulars. Please refer to the MFMA Circular No 48 of 2 March 2009 regarding the guidance to municipalities on the 2009/10 financial year budget preparation.

(1) Whether any national and/or provincial departments owe the SA Broadcasting Corporation (SABC) fees for any advertising; if so, (a) which (i) national and (ii) provincial departments, (b) what amount is owed by each department, (c) what is the nature of each advertisement for which money is owed and (d) on what date was it commissioned;

(2) whether the SABC has taken any action against any department to collect the outstanding monies; if not, what is the position in this regard; if so, (a) what action, (b) when was the action taken in each case, (c) against which departments and (d) what is the deadline given to each department for the payment of the outstanding monies?

REPLY

I was advised by the SABC as follows:

(1) A large number of national and provincial departments owe SABC fees for advertising.

(a)(i), (ii) and (b), (c) and (c). The information regarding which national and provincial departments owe what amounts, the nature of each advertisement and the commission date is indicated in the attached spreadsheet.

(2) The SABC did take the necessary action to collect the outstanding monies. Invoices with supporting documentation have been submitted to various Finance Heads.

The attached spreadsheet indicate (a) the action taken in each case, (b) when was the action taken and (c) against which departments.

(d) The deadline given to each department for the payment of the outstanding monies was specified from sixty (60) days off date of invoice during 2004 and over 180 days beyond deadline

(2) how many qualified graduate railway engineers are employed by Transnet Freight Rail;

(3) whether Transnet Freight Rail offers bursaries to any local or overseas universities or technikons for the railway engineering disciplines; if not, why not; if so, (a) which universities or technikons, (b) how many bursaries are offered and (c) how many students are being trained;

(4) (a) how many consultants are currently under contract to Transnet Freight Rail, (b) what did it cost to employ these consultants in each of the past three financial years for which information is available and (c) for what specific purpose or project was each of the consultants contracted? (1)(a-b) The following members of the Transnet Board of Directors have the requisite experience and qualifications in the railway engineering or related strategic planning fields;

(i) Dr Norman Haste

He has a BSc degree in Engineering and has the following accolades against his name:

· Fellow Royal Academy of the Engineering (FR Eng.);

· Fellow of the Institute of Civil Engineers;

· Fellow of the Institute of Highways & Transportation;

· Member of the American Society of Civil Engineers; and

· Member of the Chartered Institute of Management (MI Management)

He also has the following Honours and Awards:

· OBE for Services to Civil Engineering;

· Honorary Doctorate of Engineering (University of West of England);

· Honorary Doctor of Science (University of Salford); and

· Gold Medal of Institution of Civil Engineers, Institution of Highways and the Transportation Supreme Award.

(ii) Mr Peter Joubert

He has the following qualifications:

· BA (Rhodes);

· DPWM (Rhodes); and

· AMP (Harvard)

He is also a Director in the following engineering intensive companies:

· Sandvik (Pty) Ltd;

· Sandvik Mining and Construction RSA (Pty) Ltd; and

· Sandvik Mining and Construction Delmas (Pty) Ltd.

(iii) Ms Nomgando Matyumza

She has the following qualifications:

· BCom (University of Transkei);

· BCompt (Hons) (University of Transkei), CA (SA); and

· LLB (University of KwaZulu-Natal).

She has also previously served as the Deputy Chief Executive Officer of Petronet (now Transnet Pipelines) and as a General Manager at Eskom, both engineering intensive entities. Ms Matyumza also serves on the Board of Wilson Bayly Holmes-Ovcon Ltd, also an engineering intensive company.

(2) There are currently 124 fully qualified engineers employed by Transnet Freight Rail. They are in possession of BSc (Eng) and/or B (Eng) degrees.

(3) All full-time bursaries are budgeted for and administered at Transnet Group-level. Transnet awards 100 bursaries annually to aspirant engineers to undertake engineering degrees or diplomas. Transnet also offers training opportunities for 300 engineering technicians studying at universities of technology to complete their P1 and P2 practical training. Qualified students are employed by the Operating Divisions based on identified need, their area of specialty and suitable available projects. Transnet Freight Rail does not have any full-time students that are studying with overseas institutions.

3(a) There are 160 engineering students with Transnet bursaries allocated to Transnet Freight Rail. These students are studying with the following universities throughout the Republic of South Africa:

· University of Cape Town;

· University of Johannesburg;

· University of KwaZulu-Natal;

· North West University;

· University of Pretoria;

· Stellenbosch University; and

· University of the Witwatersrand.

There are 132 training opportunities that have been provided by Transnet Freight Rail to students studying at the following universities of technology:

· Central University of Technology;

· Durban University of Technology;

· University of Johannesburg;

· Mangosuthu University of Technology;

· Nelson Mandela Metropolitan University;

· Cape Peninsula University of Technology;

· Tshwane University of Technology; and

· Vaal University of Technology

3(b) Transnet provides full-time bursaries to 309 engineering students.

(c)Transnet Freight Rail is in the process of employing some of the 292 technicians who have completed their training through the bursary and training opportunities' schemes.

4(a) There are 24 consulting firms that provided consulting services to Transnet Freight Rail over the past two (2) years.

  1. Why are the results of learners who wrote their supplementary examinations in June 2009 delayed until January 2010;
  2. Whether the results will be released, if not, why not; if so, when?

REPLY:

1. There is no delay in the release of the 2009 supplementary examination results. The 2009 National Senior Certificate (NSC) supplementary examination was written in February/March 2009 and all results were released on 30 April 09. In addition the Department of Education conducted the 2009 Senior Certificate examination that allows learners that failed to complete the Senior Certificate ("old matric") prior to 2008, to write their outstanding subjects in a special Senior Certificate examination in May/June 2009. The results of this examination were released on 31 July 2009. Results were available at examination centres where the candidates wrote the examination. Therefore, based on the information available to the Department of Education, there are no outstanding results.

2. Based on the explanation provided in (1), there are no results that are outstanding. However, if there are candidates that have not yet received their results, they are requested to make contact with the provincial education department, and these results will be made available to them, immediately.

PARLIAMENTARY QUESTION NO. 897

Mr. A M Figlan, Member of Parliament, enquires from the Deputy Minister the following:

(1) Whether he and/or his department is taking any action to ensure that rent is paid in the N2 Gateway houses: if not, why not: if so, what action;

(2) Whether any action will be taken against a certain company (name furnished) for the mismanagement of funds; if not, why not; if so, what action?

REPLY

(1) Yes. In 2008, Thubelisha Homes appointed Trafalgar Property Management (Pty) Ltd to be the property management agent that would manage the rental units in Joe Slovo. The appointment of Trafalgar was necessitated by the low rate of rental payment in the N2 Gateway. The rate of rental payment improved in the months following Trafalgar's appointment. The rate of rental payment has declined once again, and in order to address this, the Minister of Human Settlements is in negotiations with the Premier of the Western Cape so that there may be consensus reached with regards to devolving the responsibility of managing the rental units to the Housing Development Agency.

(2) According to available information, records indicate that the Western Cape Department of Local Government and Housing undertook an investigation into payment requests made by Sobambisana Community developments. The payments were made for the services rendered by Sobambisana for road construction, services and top structure construction. The investigation did not reveal any marked discrepancies which may be construed as mismanagement of funds. The Western Cape Department of Local Government and Housing is of the view that Sobambisana Community Developments has remained financially diligent in the manner in which they have conducted business with the provincial Department. There will be no action taken against Sobambisana Community Developments as the investigation did not reveal any mismanagement of funds.

(1) Whether the SA Police Service (SAPS) in Jagersfontein were informed of the possible unrest over poor service delivery; if not, when were they first informed of the unrest; if so, what are the relevant details;

(2) whether the SAPS took any steps to prevent the burning down of the municipal offices during the recent unrest over service delivery in Jagersfontein; if not, why not; if so, what are the relevant details?

REPLY:

(1) No. The Police became aware of the incident on the day of the unrest. There was no situation of unrest prior to the incident.

(2) Yes. On the day of the unrest the Police ordered a crowd of 500 people to disperse from the Municipal Building because the march was unlawful. Eight Police members on the scene used the official tonfa batons to forcefully remove the crowd from the scene but did not manage to disperse the crowd. Crime Combating Unit, Bloemfontein was informed and arrived at the scene within one hour as Jagersfontein is 110 kilometres away from Bloemfontein. On their arrival the building was already on fire. The people were warned to disperse and when they failed, 15 people were arrested. Jagersfontein CAS 02/07/2009 - Public Violence.
