MS A M DREYER (DA) TO ASK THE MINISTER OF PUBLIC WORKS

(1) Whether residents of Acacia Park have been allocated with permits to enter the village; if not, (a) why not and (b) at what date will the issuing of permits be finalized; if so, what are the relevant details:

(2) Whether the police officer on duty checks the permits of every person entering the village; if not, why not; if so, what are the relevant details;

(3) (a) how many persons are living in Acacia Park without valid resident's permits and (b) what is the access procedure regarding persons entering the village without valid residents permits

REPLY:

(1) Members of Parliament, their spouses and sessional officials utilize their Parliamentary access cards to enter the villages. Dependents have not been issued with access cards.

(a) The accommodation of Members and sessional officials were only recently finalized.

(b) Dependents will be issued with access cards from Monday 31 August 2009 will be completed on 23 September 2009.

(2) The standard operating procedures of the SAPS dictates that all residents must positively identify themselves when entering the parliamentary Villages.

(3) (a) According to the records of the Department, some former MP's and Sessional Officials have requested extension to remain at the parks. They were granted extension to stay ranging from end August to October 2009. At present, there are ± 12 units affected resulting in a number of ± 39 illegal occupants known to the Department. These MP's, who have extension do not reside in MP units.

(b) Standard operating procedure dictates that residents entering without a permit should sign the visitor's book. The visitor will then remain at the gate until the resident, of the unit being visited, collects the visitor.

REPLY:

1 Yes the Director-General did sign a performance agreement, on 25 August 2009.

2. No, not all senior managers signed performance agreements with the Director-General

(a) The following senior managers did not sign the performance contracts:

o Carelse VC

o Mabizela M

o Matlole A

o Hoyi NW

o Motaung N

(b) Performance Agreements of Carelse VC and Mabizela M are in the process of being signed and will be forwarded to the DPSA soon, and that of Matlole A, Hoyi NW and Motaung N are delayed owing to changes in their respective job descriptions.

(c ) As soon as the Director-General has taken a final decision on the matters raised in these three officials' new job descriptions, they will be finalised.

DRAFT REPLY

(1) No Director-General has been appointed in the Economic Development Department (EDD) to date.

(2) Senior managers in my office have signed interim performance agreements pending finalisation of the strategic plan of the department. Final Performance Agreements will be concluded once the Strategic Plan of the Department has been approved and the information requested in 2 (c) will thereafter be provided to the Honourable Member.

REPLY

(1) No- Department of Energy has an acting Director-General who has signed her performance agreement with the previous Director-General: Mineral and Energy, in her capacity as the Deputy Director-General.

(2) Department of Energy does not as yet have a "staff Compliment" with the exception of the Ministry. The Department of Minerals and Energy staff signed the 2009/10 performance contracts

(a) Senior Managers in the ministry have been recently appointed and will be signing their contracts by end of October 2009. (b) Refer to (a) above

REPLY:

1 No, the Director-General assumed duty on 1 September 2009, however, she is in the process of signing the performance agreement and it will still be finalised and submitted within three months from her date of assumption of duty.

2. No, not all senior managers signed performance agreements with the Director-General

(a) The following senior managers did not sign the performance contracts:

  • Mabizela M
  • Motaung N
  • (b) Performance Agreement of Mabizela M is in the process of being signed and will be forwarded to the DPSA soon, and that of Motaung N is delayed owing to changes in her job description.

    (c) As soon as the Director-General has taken a final decision on the matters raised in the official's new job description, the contract will be finalised.

    (1). Whether the Director-General signed a performance contract with her; if not, why not; if so, when; whether all senior managers in her department signed performance contracts with the Director-General; if not, (a) which senior managers did not sign, (b) for what reason and (c) when will it be done; if so, on which date did each senior manager sign a performance contract?


    REPLY

    (1). The Director General, Mr Mavuso Msimang, entered into a Performance Agreement with me on 30 July 2009 for the 2009/10 performance cycle. The original Performance Agreement was also submitted to The Office of the Public Service Commission, as stipulated in the Guidelines for the Evaluation of Heads of Departments, as well as, per the Cabinet Lekgotla's Apex Resolution 15 of 2007.

    No. Out of the seventy one (71) members of the Senior Management Service (SMS) on the fixed establishment of the Department, only sixty two (62) members have entered into a Performance Agreement with the Director-General / their respective supervisors for the 2009/10 performance cycle.

    The information, in this regard, is attached, here, as Annexure A.

    (2). (a) to (c). Of the nine (9) SMS members who have not entered into a Performance Agreement with their respective supervisors for the 2009/10 performance cycle, two (2) SMS members are newly appointed employees who have three (3) months to enter into a Performance Agreement with their supervisors, three (3) SMS members are newly transferred employees from the Department of International Relations & Cooperation and are in the process of structuring their performance agreements. The remaining four (4) SMS members were issued with Audi Alterem Partem letters, affording them the opportunity to provide reasons why the Department should not institute disciplinary measures against them for non compliance. The table below indicates the information in respect of each of the nine (9) SMS members concerned:

    1. PURPOSE

    To submit a draft reply in respect of Parliamentary Question no 918 received from Mr. A C Steynof the Democratic Alliance (DA).

    2. DETAILS OF THE QUESTION 918.

    Mr A C Steyn (DA) to ask the Minister of Human Settlements:

    1. Whether his Director-General signed a performance contract with him, if not, why not, if so, when;

    2. whether all senior managers in his department signed performance contracts with the Director-General; if not, (a) which senior managers did not sign, (b) for what reason and (c) when will it be done; if so; on which date each senior manager sign a performance contract?

    3. REPLY

    1. The performance agreement of the Director General is awaiting endorsement by the Minister. This is to be filed with the Public Service Commission on the due date of 31 August 2009.

    2. Only 33 of the 63 senior managers have concluded performance agreements with their respective supervisors. The Performance Agreements were concluded before 31 July 2009 as required.

    (a) The following senior managers did not conclude the Performance Agreements for the year 2009/10:

    (b) The reasons for non compliance vary. In most of the cases, the agreements are signed by one party and are awaiting concurrence by the supervisors. In other instances, there is no reason given.

    (c) The Department issued communiqué to senior managers to give them a period of grace until 31 August 2009. This was a final reminder and the necessary correction steps will be taken for non-compliance.

    (1) Whether his National Commissioner signed a performance contract with him; if not, why not; if so, when;

    (2) whether all senior managers in his department signed performance contracts with the Director-General; if not, (a) which senior managers did not sign, (b) for what reason and (c) when will it be done; if so, on which date did each senior manager sign a performance contract?

    REPLY:

    (1) National Commissioner Bheki Cele was appointed as Director-General of the South African Police Service on 1 August 2009. A performance contract has been drafted for National Commissioner Cele in accordance with the prescripts of the Public Service Commission. The performance contract has also been aligned to the SAPS Annual Performance Plan for 2009/2010.

    The National Commissioner has, since his appointment, visited all provinces and has had numerous discussions with role players from various levels in the South African Police Service as well as external to the Service in order to determine whether the current strategic direction should be maintained. During his deliberations and visits additional strategic priorities were identified which are to be collated and finalised during September 2009. It is expected that this process will impact on some of the existing plans in the Service.

    Once the above process has been completed, the priorities will be included in the performance contract of the National Commissioner. It is estimated that signing of the performance contract will occur not later than 31 October 2009.


    The South African Police Service Employment Regulations, 2008, states that AThe National Commissioner, must, as soon as reasonably possible after his or her date of appointment and the beginning of each financial year, enter into a performance agreement@. The signing of the performance contract within 3 months of his appointment we believe is reasonable.

    (2) The National Commissioner of the South African Police Service signs performance contracts with the Deputy National Commissioners and Provincial Commissioners within the Service. All of these senior managers have performance contracts but none of them have signed these contracts with the new Director-General as yet. This is due to the identification of additional priorities and expected impact on existing plans (as previously mentioned).

    Once strategic priorities for the Service have been confirmed and the performance contract of the National Commissioner has been finalised, the performance contracts of the above mentioned senior managers will be aligned to his contract. Signing of these performance contracts should also be finalised by 31 October 2009.
