Whether he had taken continuous steps to establish mechanisms within his department to ensure that employees who fought against corruption and testified against officers who had committed fraud or acted in a corrupt manner were guaranteed safety from any kind of victimisation and/or loss of standing; if not, why not; if so, what are the (a) relevant details and (b) outcomes thereof?

REPLY:

Yes.

(a) Members of the South African Police Service have, inter alia, been sensitized about the provisions and the impact of the Protected Disclosures Act, No. 26 of 2000. The mechanisms of the Witness Protection Act, No 112 of 1998, administered by the Department of Justice and Constitutional Development, are also available to any member of the SAPS who is a witness in a criminal trial.

(b) In terms of the Protected Disclosures Act, the SAPS as an employer, is prohibited to subject such employees to any form of occupational detriment as defined by the Act. Any employee(s) who is/are of the opinion that they have been or may be subjected to any form of occupational detriment may approach any court having jurisdiction for appropriate relief or pursue any other process allowed or prescribed by any law. In terms of the provisions of the Witness Protection Act, 1998, any witness who has reason to believe that his or her safety or the safety of any related person is or may be threatened, by reason of his or her being a witness, may apply for protection as provided for in the Act. Such applications are considered by the Director of the Office for Witness Protection who may approve or refuse the application.

(1) (a) How many vehicles were bought by (i) his department and (ii) its institutions for the 2010 Fifa Soccer World Cup tournament and (b) what (i) amount was spent on these vehicles, (ii) happened to these vehicles and (iii) amount is spent to maintain them;

(2) whether he will make a statement on whether this was value for money?

(1)(a) 109 Vehicles were bought for the 2010 FIFA Soccer World Cup tournament.

(b)(i) An amount of R113 629 468-83 was spent on these vehicles, which also includes expenditure for accessories (e.g. sirens, blue lights, marking of vehicles etc) which is an operational requirement.

(b)(ii) All of these vehicles were distributed within the SAPS to be utilized for operational policing duties.

(b)(iii) A total amount of R14.82 Million has been used since the purchase thereof for servicing and repairs of these vehicles.

(2) Yes. Due to the fact that these vehicles were deployed to combat crime after this event, this was definitely value for money.

Whether the fraud and ethics hotline of the Private Security Industry Regulatory Agency (PSIRA) is still in operation; if not, what are the reasons for the suspension of this service; if so, what (a) number of calls were received in the 2012-13 financial year, (b) was the cost of the specified line in the specified financial year and (c) number of complaints received pertaining to (i) fraudulent, (ii) corrupt or (iii) unethical practices led to successful (aa) investigations and/or (bb) prosecutions?

PSIRA has an operational independent hotline facility run by KPMG to address issues of corporate governance and unethical behaviour. The hotline number is 0800 22 09 18.

(a) Two complaints were reported in 2012/2013 as follows:

· T21355: Allegations of corruption against an employee of the Authority;

· T21616: Allegations of fraud against a security service provider.

(b) During 2012/2013 PSIRA paid R55 860.00 (incl.vat) towards the costs of KPMG's services.

(c) Fraud – 01, Corruption – 01

I have asked the new Council of PSIRA to look into this matter as I feel that we are not getting value for money.

REPLY:

SAPS recently presented to the Portfolio Committee a full report on misconduct and disciplinary process where they reported on the audit of persons in SAPS who had been investigated and criminally convicted and are now being processed through SAPS. I would refer the member to this report for further clarity.

Also SAPS reports annually in its annual report on all disciplinary charges instituted against SAPS members and I would refer the member to these annual reports. In particular pages 193 to 194 for the 2012/13 annualreport, pages 229 to 230 in the 2011/12 annual report and pages 217 and 218 in the 2010/11 annual report.

Lieutenant General CN Mbekela as Deputy National Commissioner: Corporate Service Management

Lt Gen Mbekela joined the SAPS on 1November 2003 in the then rank of Director (now Brigadier) and was appointed as the Section Head: Skills Development and Quality Management. On 1 September 2010 she was appointed to the rank of Major General as Head: ETD Systems, Skills Development and Quality Management. Due to her managerial experience, excellent planning, problem solving and strategic abilities and sound knowledge of relevant SAPS policies and procedures, she was appointed to the rank of Lt Gen on 1 January 2011 as Divisional Commissioner: Human Resource Development.

Prior to her appointment in the SAPS, Lt Genl Mbekela served in the following areas within the Department of Education:

- Head of Department: Sciences, Idutywa, Eastern Cape;

- Head of Department: Sciences: Ngangelizwe School, Mthatha;

- Senior Lecturer: Biology, Transkei College of Education;

- Subject Advisor: Department of Education, Mthatha;

- ETQA Coordinator: South African Qualifications Authority.

Given her vast experience and expertise in senior management positions she was identified as an excellent candidate for appointment as the Deputy National Commissioner: Corporate Service Management.

Lieutenant General KJ Sitole as Deputy National Commissioner: Policing

2013-09-01

Lt Gen Sitole joined the South African Police Service on 9 April 1986. From 1988 until 1990, Lt Gen Sitole was stationed at Kwa-Ndebele Police. He served as a strategic management and work study officer in the Efficient Services environment and subsequently became the head of finance in the Kwa-Ndebele Police for three years (1990 - 1993). He was appointed Head: Support Service at Kwa-Ndebele from 1994 -1996. From 1996 to 2000 he functioned as the Head: Financial Service: Mpumalanga.

Lt Gen Sitole served for three years (2000 - 2003) as the Head of Operational Service in Mpumalanga and also served as Deputy Provincial Commissioner: Support Service: Mpumalanga for a period of three years. He was deployed to the Northern Cape during September 2006 where he was appointed as the Deputy Provincial Commissioner: Policing. He was subsequently appointed as the Deputy Provincial Commissioner: HRM: Free State from December 2010. On 1 November 2011 he was appointed as the Provincial Commissioner: Free State.

Lt General Sitole acquired a wealth of knowledge and experience that qualified him to be appointed as Deputy National Commissioner: Policing.

Lieutenant General SJP Schutte as Deputy National Commissioner: Resource Management

Lt Gen Schutte joined the South African Police Service on 1 April 1999. Prior to his appointment in the SAPS he was employed at the Department of Mineral and Energy Affairs in the personnel environment (1985 -1989) He was then employed at the Office of the Commission for Administration and Economic Co-ordination (1989 – 1993). In October 1993 he joined the Department of State Expenditure (now part of National Treasury) and functioned in the financial environment until 31 March 1999.

Lt Gen Schutte was appointed in the SAPS as the Head: Financial Services (1999–2004) and subsequently appointed on 1 November 2004 as the Divisional Commissioner: Financial & Administration Services.

Since his appointment as Divisional Commissioner: Financial and Administration Services, his responsibility included rendering a financial & administration support function to the management and the SAPS together with being responsible for national standards and policy relating to the above issues.

He was furthermore responsible to ensure that the budget of SAPS is managed in the most cost effective manner and that an effective auxiliary service be rendered and ensured that SAPS received an unqualified financial report over the last 10 years. Lt Gen Schutte's vast experience rendered him an excellent candidate for appointment as the Deputy National Commissioner: Resource Management.


(c) No interview panels were appointed. The officers were already at the level of Lieutenant General (DDG level), and given their career profiles and performance, they were identified by the National Commissioner for appointment in the posts.

(c)(i) all complaints against the South African Police Service are dealt with inaccordance with Standing Order 101,which requires that a commissioned officer (Lieutenant and higher rank) interview the complainant and investigate the complaint to the satisfaction of the complainant.

(1) Psychological evaluations are done within the South African Police Service during application for entry into the organisation where specific valid and reliable cognitive and personality tests are completed by the applicant. This forms part of the total recruitment process with various selection criteria. These psychometric tests have been selected due to various researches for unbiased properties.

Employees are also selected for specialised units where psychometric tests are completed by the applicants. These psychometric tests are again only personality and cognitive tests for suitability into the specialised unit.

Psychological evaluations to judge mental status on a continuous basis are prohibited by the Employment Equity Act (Act 55 of 1998).

(2) Psychological illness is diagnosed by psychologists, psychiatrists or general practitioners. As in any illness, psychological illness may vary and differ in intensity and duration. The psychiatrist or general practitioner will place the employee on sick leave according to the specific diagnosis and recovery time to their discretion and professional opinion.

Treatment of such illness is usually done by means of psychiatric medication and therapy by a clinical psychologist and psychiatrist. Hospitalisation would only occur if the psychiatrist deems it necessary. Hospitalisation is covered by the medical aid of the employee.

Leave and incapacity leave is provided according to government regulations on leave and employees are provided with such leave according to the availability of sick leave or alternatively the necessity for incapacity leave and the approval thereof.

(3) When an employee has been diagnosed with a psychological illness that the possession of a firearm may be harmful to the individual or others, the firearm is temporarily taken from the employee. The decision to return a firearm is not made in isolation by one individual but by a multi disciplinary committee consisting of Employee Health and Wellness, Legal Services, the direct commander of the employee and management structures of the province. Accompanied with the request for return of firearm must be a written acknowledgement of the psychiatrist or general practitioner that the employee is able and recovered in such a way that he or she may carry a firearm. In this regard the Standing Order 48 (6 of 2011) and Firearm Control Act (no 60 of 2000) are applicable.

(a) Investigating Officers inform witnesses that should they be threatened or intimidated by an accused or any other person on behalf of the accused in a criminal case, that they should immediately report it to the Investigating Officer. The Investigating Officer will then obtain statements to the effect and approach the prosecutor in order for the bail of the accused to be revoked. Investigating Officers also oppose bail during bail applications and recommend to the prosecutor what bail conditions should be placed on the accused by the court to prevent intimidation and threats towards the witness. When a witness's life is in danger the Investigating Officer will apply to the National Prosecuting Authority for the witness to be admitted into the Witness Protection Programme.

(b) Where there is a threat or information that a witness is in danger of being hurt or injured during court proceedings the Investigating Officer will attend the court proceedings and arrange that other members of SAPS, eg the Tactical Response Team or Public Order Policing members be in court as protection for the duration of the court proceedings. It is difficult and almost impossible for the SAPS to provide protection to a witness after court cases had been concluded. Witnesses are however informed to contact the SAPS immediately should there be a threat towards them. In this instances case dockets will be opened, the perpetrators arrested and brought before a court of law.

(1) Yes. The acting Deputy National Commissioner: Human Resource Management was part of the panel who conducted the interviews which led to the appointment of a certain person (name furnished). The South African Police Service's National Instruction on Senior Appointments, provides for the National Commissioner to appoint a selection panel and, apart from the National Commissioner and the Deputy National Commissioner: Human Resource Management, the Divisional Commissioner: Human Resource Development and a representative from GCIS also formed part of the selection panel.

(2) Yes. During 2010, a work study investigation was commissioned to determine whether the then structure of SAPS Communication and Liaison Services is sufficient and proper to deal with all communication matters besetting the SAPS. The outcome of which proposed restructured Division with two components (PL16).

This was however, not implemented due to overall structural adjustment priorities identified thereafter. In 2010 an optimized structure for communication was approved with a new vision focusing on branding Corporate Image, hence a change in the name Corporate Communication.

Subsequently, the component Organizational Development was requested to continue with seeking options to optimize the structure, due to current and forecast demands for integrating the general vision of branding promise with international relations and obligations.

(3) Yes. All relevant organizational development processes, work study investigation, for establishing or redesigning organizational functions were done accordingly. Report is dated 2010-07-02. According to the current approved organizational structure, (functions and post), the SAPS Head of Communication is post level 15.

Whether the Government intends to (a) introduce legislation that deals with the sentencing of police murderers and (b) review the deployment procedure of police into dangerous areas; if not, why not; if so, what are the details of the steps his department is taking in the short term to (i) stem the increasing police deaths and (ii) manage the cases of such criminals?

REPLY:

(a) No, Section 51 of the Criminal Law Amendment Act, 1997 Act No. 105 of 1997), read with Part 1 of Schedule 2 to the said Act, already provides for a discretionary minimum sentence of imprisonment for life in respect of, amongst others, the murder of any law enforcement officer performing his or her functions, whether on duty or not.

(b) No not at this stage, however when the number of Police officers killed increased in 2011/2012 financial year, a "re-skilling" course viewed also as a refresher course for police officers was introduced. Those provinces with a high number of police killings were targeted first and then cascaded down to other provinces.

The focus of the course is on tactical awareness, weapon skills, how to stop and search vehicles and suspects as well as approach and penetration techniques to affect an arrest. This project is ongoing.

Firearm competency is also continuing in support of the said project.

Various other tactical courses and general policing courses include training that contributes to the skills of Police officers to ensure their own safety. The project is ongoing.

(i) The following additional steps have been taken to stem the deaths of police members.

· All incidents were police members were killed, on or off duty, are analysed to determine trends and tendencies to inform the implementation of appropriate preventative measures. In this regard, safety hints are continuously developed and distributed to enhance operational awareness and tactical responses to serious crime amongst police members and instructions, which provides for the compulsory wearing of the bullet proof, were distributed.

· A multi-disciplinary National Police Safety Committee, which meets quarterly, was also established to initiate and manage programs and preventative plans to address the attacks on and murders of police members, enhance the investigations on attacks on and murders of police members, support the counselling of families, improve training, as well as address all other operational aspects in a coordinated and coherent manner.

· A comprehensive and integrated Police Safety Strategy to address police safety holistically was further developed.

A total of 23 police members were killed since 1 April 2013 to date (19 August 2013), five on duty and 18 off duty, in comparison to 33 during the same period of 2012, 14 on duty and 19 off duty. These statistics indicate an overall decrease of 10 or 30.3% in the murders of police members and if further broken down it indicates a decrease of 9 or 64.3% in the murders of police members on duty and an decrease of 1 or 5.26% in the murders of police members off duty, if compared with the same period in the previous financial year.

(ii) The Directorate for Priority Crime Investigation was given a Ministerial mandate to investigate all police killings:

· The Office of the Director of Public Prosecutions assists in the appointment of dedicated prosecutors in the prosecution process.

· Prescribed inspections of case dockets relating to police murders are conducted on a bi-weekly basis to monitor progress in investigations.

· Attempts by suspects involved in police killings to apply for bail are opposed by the Investigating Officers.

· Witnesses who warrant protection are placed in the Witness Protection Programme.

(a) The performance of work in addition to members' responsibilities is regulated by National Instruction 4 of 2012: Performance of remunerative work. The said policy provides for circumstances in which approval may not be granted to an employee to perform certain types of remunerative work and for circumstances in which approval may be granted to perform remunerative work.

(b) Applications to perform remunerative work are considered and approved by the relevant Provincial or Divisional Commissioner.

(c) The following number of contraventions were brought to the attention of SAPS:

(i) 2010-11 - 40

(iii) 2012-13 - 74

(d) The contraventions were brought to the attention of SAPS and are being investigated by the Special Investigation Unit (SIU) – the outcome of the investigation will direct the steps to be taken against transgressors.

(a) The SA Police Service prepares quarterly interim financial statements as required by National Treasury.

(b) The budgeted and actual revenue and expenditure figures, irregular expenditure, fruitless and wasteful expenditure and accruals/commitments are considered by the Audit Committee. In-year reports in this regard are thus considered by the Audit Committee.
