Adv A de W Alberts (FF Plus) to ask the Minister of Mineral Resources:

Whether she will consider for the sake of fairness, regardless of the ruling by the Constitutional Court in the AgriSA matter, in which it was found that the State cannot expropriate the property rights in minerals of landowners without compensation, a regime whereby the landowners and the community on the land must receive a statutory tantieme from any profitable mining activities taking place on the land in question; if not, why not; if so, what are the relevant details? NW1029E

REPLY
On the Agri-SA case, the constitutional court found that the Mineral and Petroleum Resources Development Act (MPRDA) did not expropriate old order mineral rights. The MPRDA furthermore provides sufficient mechanisms for consultations, which would include socio-economic matters, with interested and affected parties.
