(2) whether any of these funds were earmarked for (a) capital or (b) infrastructure-related projects; if so, (i) what are the names of these projects, (ii) where are these projects situated, (iii) what is the value of each project and (iv) how many jobs have been created by each project

(3) in each case, what process was followed to appoint project (a) implementers and (b) consultants;

(4) in each case, were funds transferred to project implementers (a) in a lump sum or (b) through progress payment;

Reply:

The Minister of Public Works:

(1) Yes, the National Department of Public Works received funds for the Expanded Public Works Programme (EPWP) for the 2010/11, 2011/12 and the 2013/14 financial years. The funding received was for EPWP incentive grants as follows: EPWP Integrated Grant to Provinces; EPWP Integrated Grant to Municipalities; EPWP Social Sector Grant to Provinces; and the EPWP Non-State Sector funding for non-profit organisations (NPOs).

(2) Funds from the EPWP Integrated Grant to Provinces and the EPWP Integrated Grant to Municipalities were used for infrastructure related and capital projects. The details of the projects funded can be seen in the attached spreadsheet.

(3) (a) and (b) The process to appoint project implementers and consultants was through open tender, after which appointments were made in terms of the winning bidders, wherein attention was paid to quality of proposal and price.

(4) Funds were transferred to project implementers in terms of progress payments. These payments were made after certification of work completed according to specifications at the different stages of the overall scope of work.

(5) No maladministration or corruption was detected and thus no project has been impeded as a result of that.

Thus, (a) and (b) fall away.

(3) whether the draft lease agreement policy he referred to in his reply to question 2021 on 6 November 2012 was finalised;

(1) 401 lease agreements were concluded during the period 1 January 2012 to 31 October 2013.

(2) A Service Provider has been appointed to conduct the Lease Audit Review. Among the deliverables, is the re-engineering of the business processes and the development of policies that will assist the Department to ensure that Supply Chain Management (SCM) processes and prescripts, including the Public Finance Management Act, 1999 [Act No. 1 of 1999] are fully complied with.

In addition to the above, the Department has appointed the Special Bid Adjudication Committee for Leases (BAC-L) to regularise procurement of accommodation. The BAC-L scrutinizes procurement of each lease to ensure that proper strategies are implemented by the 11 Regional Offices before entering into lease agreements.

(a) During the period 1 January 2012 to 31 October 2013 the Department procured 33 leases through a competitive bidding process.

(b) 368 leases were concluded outside a competitive bidding process.

(3) The policy relating to the lease agreements was finalised.

(4) Yes, the Departmental Standard Lease Agreement can be made available to Members of Parliament for scrutiny.

The Minister of Public Works

(1) The Task Team report does not specify irregular expenditure, but irregularities relating procurement of services.

(2) The matters pertaining to the project in question are still under investigation by various public bodies. The investigation is therefore still a work-in-progress. However, as part of the Turnaround, Departmental officials are subjected to disciplinary processes for irregularities and misconduct. The consequences for misconduct range from suspension, dismissal to recovery of funds. Where necessary, cases are referred to law enforcement agencies bodies for further investigation.

(3) As part of the Turnaround Project, all delegations to regions have been withdrawn. A Prestige policy with norms and standards dealing with security upgrades has been developed.

(4) Yes, the office of the Auditor-General has been requested to conduct a special audit on the project. The department will cooperate with the Auditor-General and comply with any reasonable recommendation.

(1) (a) Yes, the desktop exercise focused, firstly, on the reconciliation of the Department of Public Works' (DPW) Immovable Assets against the Deeds database, as well as national and provincial asset registers to determine deemed land parcels to be subjected to physical verification. Secondly, the cadastral information was verified against Deeds database and updated on the Master File.

(b) No, the physical verification focuses on the information that should be verified through site visits, such as street addresses, User Departments, Condition Assessments for buildings and Components, Measurements for the buildings, photos, etc. Physical verification has commenced and the target date for the completion of this exercise is 31 March 2014.

(2) Yes, the process of physical verification includes robust quality assurance and the Auditor-General will conduct an audit on DPW's Immovable Asset Register to determine the accuracy and authenticity of the records. Furthermore, DPW's Internal Audit will conduct an audit to confirm accuracy and authenticity on DPW's Immovable Asset Register (IAR).

(3) Yes, the information fields provided for verification through desktop and physical verification exercise are fully compliant to National Treasury's minimum requirements and the Generally Recognised Accounting Practices (GRAP) requirements.

(4) Yes, the Departmental officials, together with the programme manager appointed added significant acceleration in fully completing the Asset Register for the 2012/13 financial year. As a result, DPW's audit opinion has moved from a disclaimer to a qualified audit opinion on the Immovable Asset Register. The remaining qualification assertion is the valuation, which will be addressed by 31 March 2014. The reconciled land parcels deemed to be under DPW's custodianship (Master File) determined the scope of work for physical verification exercise. A custodial framework was developed to ensure proper and accurate disclosure for National custodians.

(5) Yes, the physical verification for DPW's immovable assets is envisaged to be completed by 31 March 2014 in line with the Department's target of achieving a clean audit report. The DPW IAR function was transferred to the Departmental Property Management Trading Entity (PMTE) with effect from 01 April 2013, therefore requiring the Department to report on accrual basis of accounting (GRAP) as opposed to the previous modified cash-basis of accounting. The deadline for a GRAP compliant Immoveable Asset Register is 31 March 2016.

(1) The Department is following a draft language policy that is based on the Use of Official Languages Act, 2012 [Act No. 12 of 2012] and the National Language Policy Framework that is currently in the process of being refined and aligned following the recent promulgation of the Use of Official Languages Act.

(2) There is a draft language policy that is currently going through stages of approval and alignment with the Use of Official Languages Act and its proposed regulations.

(a) Taking into consideration the geographical spread of the Department, the policy proposes the use of all official languages, as well as making provisions for availability of sign language and Braille as and when required.

(b) The other relevant provisions as contained in Section 2 of the Use of Official Languages Act provide for the following:

· To regulate and monitor the use of official languages for government purposes by the Department;

· To promote parity of esteem and equitable treatment of official languages of the Republic;

· To facilitate equitable access to services and information of national government; and

· To promote good language management by the Department for efficient public service administration and to meet the needs of the public.

A project plan and schedule of events for Language Policy Implementation during the 2013/2014 financial year is in existence.

The Minister of Public Works

(a) Yes, the Department of Public Works has established the Inspectorate and Compliance Unit, whose critical role is, among others, to prevent, detect and report all irregular, fruitless and wasteful expenditure. The Department has also put in place internal control measures, such as checklists and tracking systems. The following are also activities that are performed to prevent and report irregular, fruitless and wasteful expenditure:

· Supply Chain Management (SCM) officials are required to sign the National Treasury's Code of Conduct for SCM Practitioners to ensure that they comply with in the highest ethical standards

· On a quarterly basis, officials are required to declare any interest or shares they may have in companies doing business with the Department and Government at large.

· For Bid Committees, members are required to declare any interest that they may have in bidding companies and are required to recuse themselves if conflict of interest is foreseen.

· Bidders are required to complete the SBD4 form to declare any relationship they may have with employees of the Department of Public Works.

· Invoice tracking systems have been developed to track invoices in order to pay on time and avoid interest charges that lead to fruitless expenditure.

· Policies, Directives and Circulars have been issued to the DPW employees to ensure that they familiarize themselves with due processes.

· Workshops have been held with officials to train them on the identification, detection and reporting of irregular and fruitless expenditure.

· The Department has developed a monthly reporting mechanism, which is mainly for purposes of detecting irregular and fruitless expenditure.

· The fraud line has been publicised on the Intranet for anyone who suspects fraud to report it.

(b) Transgressors are dealt with in line with the Public Service Disciplinary prescripts and processes, as well as the approved Policy on Management of Financial Misconduct. Such measures include, but are not limited to, written warning, suspension and recovery of amounts from officials and/or third parties. Already, there are officials in the Department who have been subjected to disciplinary processes for irregularities in the supply chain management area. The consequences for misconduct have ranged from suspension, dismissal, recovery of monies, and some cases have been referred to the Special Investigating Unit for further investigation.

(1) With regard to the unoccupied building at Number 4, Ehmke Street, Nelspruit, Mpumalanga, (a) for what reason has the building remained empty since being rented in 2010 to accommodate the logistics department of the provincial police and (b) why has the logistics department not been allowed to move to these premises since 2010;

(2) (a) what amount since 2010 has been paid for (i) monthly rent, (ii) water and lights, (iii) cleaning, (iv) maintenance and upkeep and (v) furniture and (b) why has his department continued since 2010 to spend these amounts on an empty building;

(3) what steps will he take to ensure that (a) the building is utilised or (b) his department ceases to rent it? NW3256E

The Minister of Public Works

(1) (a) The lease agreement for the Provincial SAPS offices was signed in 2010 and the keys were handed over to SAPS. An additional space of 614 square metres was signed for in March 2011, resulting to a total of 4637 square metres. The reasons for non-occupation of 402 square metres by SAPS are not clear to the Department of Public Works, since the space was procured on the basis of the Client's request and two Procurement Instructions were issued in that regard.

(b) The Department of Public Works only became aware in October 2013 that SAPS was not utilizing part of the building. The meeting to clarify the state of affairs was held on 06 November 2013.

(2) (a) (i) A monthly rental of R 88 502.00 has been paid since March 2011.

(ii) Water and lights: The amount paid for water and electricity depends on usage. An amount of R3 565 679.00 for water and electricity used to date has been paid. SAPS had since March 2010 occupied 4235 out of 4637 square metres.

(iii) Cleaning: The Department of Public Works does not provide Cleaning Services for SAPS, hence no amount has been paid by the Department.

(iv) Maintenance and upkeep: This responsibility lies with the Landlord; hence no amount has been paid by the Department.

(v) Furniture: The Department of Public Works does not provide furniture for SAPS; hence no amount has been paid by the Department.

(b) As indicated in 1 and 2 above, the Department of Public Works only became aware of the non-utilization of the 402 out of 4637 square metre space in October 2013.

(3) (a) The Department of Public Works held a meeting with SAPS on 06 November 2013, to clarify issues, and SAPS stated in that meeting that they still required the additional space. It was also confirmed that the keys are still with SAPS.

(b) The Department will not cease to rent the building in the short and medium term, because SAPS has indicated that they still require the additional space.

(1) Whether, with reference to his reply to question 1921 on 17 September 2013 and with particular reference to the hiring of a Mercedes E-Class from 21 February 2013 to 29 March 2013, he can indicate (a) for what official purpose was the car hired in this period, (b) what official duties did he undertake in this period, (c) why was this vehicle hired for 37 consecutive days in total and (d) what was the reasoning or cost-value consideration behind the decision to hire this luxury model in particular;

(2) whether other less expensive options were considered or available; if not, why not; if so, why were these not hired;

(3) (a) what were the instances or the reasons for his official vehicle not being available in this period and (b)(i) for what purpose and (ii) by whom was his official vehicle being used in that period? NW3249E

The Minister of Public Works:

(1) (a) and (b) The vehicle was hired in order for me to fulfil my official duties as per the departmental assignments, mainly in the provinces of Limpopo, Mpumalanga and KwaZulu-Natal.

(c) The E-Class was hired only for a week. For the remainder of the period a C-Class hired motor vehicle was in use. The official vehicle had travelled for over 160 000 kilometres and as with any vehicle that has travelled the same distance or more it should be expected that many parts of the motor vehicle would have been worn out. As such, the official vehicle broke down and was sent for repairs on 22 February 2013. Parts were ordered from Germany but took longer than anticipated to arrive in South Africa for fitment and repairs. Thus, during this time a rental motor vehicle was used.

(d) The Department requested quotations from various service providers. But, a cheaper car with a petrol card was not available for rental in the market, including from the Government appointed service provider, Phakisaworld for fleet requirements. The Mercedes Benz E-Class with a petrol card was, however, available immediately. But, after a week the motor vehicle was changed for a C-Class based on cost considerations.

(2) Yes, the major consideration in the hiring of a motor vehicle is cost effectiveness. However, a cheaper motor vehicle with a petrol card was not available. A car without a petrol card would require drivers to be responsible for petrol and claims, which takes a huge toll on the drivers. At the time the option that came with a petrol card was a Mercedes Benz E-Class. But, as mentioned above, the vehicle was changed to a C-Class in order to reduce costs.

(3) (a) The car was sent for repairs.

(b) (i) and (ii) It could not be used.

(1) (a) and (b) Yes, the department does have anti-corruption systems in place to ensure that all procurement systems adhere to the Public Finance Management Act, 1999 [Act No. 1 of 1999] (PFMA) and Internal procurement policies to avoid corruption and fraud. The following are, amongst others, the details in that regard:

· In Bid Committee meetings, members sign declarations of interest to declare whether they are related anyhow to bidders.

· Supply Chain Management (SCM) Officials and other role players are obligated to sign the Code of Conduct to ensure that they conduct themselves ethically during the procurement processes.

· Service providers are required to complete and sign a declaration form (SBD4) declaring any relationship they may have with employees of the Department of Public Works (DPW).

· Related party forms are sent to DPW officials on a quarterly basis to declare any interest in the companies doing business with the Department.

· Internal controls were also enhanced to ensure that purchase orders cannot be issued without requisitions being signed off and that all Supply Chain Management processes have been complied with.

· The centralisation of lease management authorities has had the desired effect of combating fraud and corruption.

· The internal audit and fraud unit has been established in the department to audit and investigate cases of fraud and corruption.

· The Department has a Fraud Prevention Plan which is reviewed bi-annually (last reviewed 2010) that seeks to combat fraud and corruption and to reinforce existing systems, policies, procedures, rules and regulations of the Department aimed at deterring, preventing, detecting, reacting to and reducing the likelihood of fraud and corruption. As part of reviewing the Fraud Prevention Plan fraud risks assessments are conducted to identify possible fraud risks areas including within SCM. Mitigating factors are then recommended to curb the occurrence of fraud and corruption. All officials are encouraged to report all suspected incidents of fraud and corruption to a dedicated Unit within DPW as well as for investigation purposes. This is done through regular Fraud Awareness Workshops conducted across the Department.

· Further interventions include National Treasury having selected the Department as a pilot project for the review of its SCM practices.

The fight against fraud and corruption requires more than policies and procedures. To this end, the Minister had advocated for the creation of a separate Governance Risk and Compliance branch in the Department to consolidate and synchronise governance interventions in the Department, including spearheading the fight against fraud and corruption.

(2) Mrs Yakhe Kwinana has been appointed to head the Property Management Trading Entity. She is a qualified Chartered Accountant (South Africa) and has over 25 years' experience in Accounting (well versed in GAAP, GRAP and IFRS), Financial Management, External Audit, and Internal audit, Forensic Audit, Performance Audit, Financial Training and Taxation. She has chaired Audit Committees, including the SITA and SAA Audit Committees.

Juanita Prinsloo: Chief Director: Financial Planning & Reporting. Her qualification is a Bachelor of Commerce in Financial Management.

T. Seletela: Director: Financial Reporting. The qualifications are Bachelor of Commerce: Accounting; Higher Diploma in Taxation; Diploma Financial Management; and Diploma in Corporate Law.

S Ngamlana: Director: Billing and Revenue. The qualifications are Bachelor of Technology: Cost and Management Accounting, CIMA: Operational level

(1) Yes, performance bonuses were paid out to employees of the Department of Public Works in the 2012/13 financial year. However, it should be mentioned that although the said payments were effected in the 2012/13 financial year, the bonus payments were in recognition for performance in the previous financial year (2011/12).

(a) 2 858 employees received bonuses. These were payments in recognition of payments that relate to levels 1 to 12, where the overall under-performance of the Department cannot be attributed. No performance bonuses were paid to SMS members in recognition of overall performance at that level.

(b) The total amount paid out for these bonuses was R16 132 000.00.

(2) 42 percent of outputs were achieved by the Department as measured against each target set in the Annual Performance Plan for the Financial Year 2012/13.

(1) Yes, the Department of Public Works is responsible for the maintenance of the sports grounds at the Fernwood Estate.

(2) The Department has no maintenance plan in place in respect of the specific grounds.

(b) The Department intended to undertake routine maintenance, but this was stopped, because the area in question was declared a wetland in June 11.

(c) A security company has been appointed to deal with access control and to protect the grounds.

(3) There were no security breaches in 2012.

(4) The Department of Public Works has a term contract in place for pest control within the grounds at the Fernwood Estate. The contractor deals with the problem, as and when the need arises. The Facilities Management contractor has pest control facilities in place (for example, rat boxes) for the house at the Fernwood Estate and regular fumigation is done.

(a) There are 90 data capturers, 30 of which were appointed as part of the on-going support provided across four sectors and three spheres of government and state-owned entities. Sixty (60) data capturers were appointed and placed at the Expanded Public Works Programme (EPWP) Data Centre to support Public bodies in processing data.

(b) (i) All 90 data capturers appointed under EPWP and have been trained.

(ii) System users were trained by the EPWP Monitoring and Evaluation Capacity Building Unit, supported by the Independent Development Trust (IDT).

(iii) EPWP users were trained on data collection, data capturing, and use of the EPWP systems (data viewing and data sign-off), EPWP Monitoring and Evaluation processes and general overview of the EPWP.

(c) All registered users who are using the EPWP reporting systems and those identified by Provincial Coordinators were trained and are given refresher training whenever there are changes in the reporting system. Training on the EPWP reporting system is an on-going matter to make provision for new appointees, staff turnovers and any system enhancements.

In addition, neither the Auditor-General nor the Special Investigating Unit has uncovered any such case where orders were split to avoid a tender process over the period in question. The splitting of orders to avoid putting them to tender is tantamount to financial misconduct in terms of Section 38 of the Public Finance Management Act, 1999 [Act No. 1 of 1999] and the National Treasury Practice Note 8 of 2007/08.

(a) The Department of Public Works initiated Zimisele Project as part of the change management programme in the year 2005 to implement Service Delivery Improvement Programmes (SDIP) in line with requirements by the Department of Public Service and Administration (DPSA). The objective of the project/programme was to determine the Service Delivery Standards at which clients and the general public would be able to measure the performance of the departments in general in delivering on the constitutional mandates.

From the perspective of the Department of Public Works, the programme was aimed at refocusing the business of the Department towards Customer Service Orientation. Key areas identified for improvement were Project Management, Property Management, Facilities Management, and Key Accounts Management (KAM).

The progress made in the implementation of the project in relation to business management and control systems include the following, amongst others:

· Review of business processes for Project Management, Property Management, KAM, and Facilities Management;

· Analysis of the value chain or workflow process to determine the effectiveness and efficiencies for delivering service in particular construction projects;

· Short-term training for project managers on the basics of project management

· Establishment of stakeholders consultative forums;

· The development of the Management Control System for Property Management and Property Practitioners; as well as

· Mapping of common process to attend to day-to-day maintenance into an electronic format (Piloted in Johannesburg Regional Office).

(b) The number of persons who benefited cannot be given at this stage, as the project has been implemented over a number of years, information which was not readily available at the time of completing this response.

(a) The allocation for the accessibility programme for the 2013/14 financial year is R25 000 000. The programme has incurred an expenditure of about R3 328 459 by 31 August 2013. This leaves 21 671 541 that is remaining to be spent during the current financial year.

(b) The Department of Public Works has not been able to achieve 100 percent expenditure on the accessibility programme for the last four consecutive years (2009/12-2012/13) for various reasons, including delays in departmental processes and poor performance by contractors. Measures have been put into place to address these challenges and ensure that the Department meets its objective of making Government building accessible to persons with disabilities.

(1) Stipends for the Expanded Public Works Programme (EPWP) are governed by the Ministerial Determination of 4 May 2012, which prescribes annual increases that take effect on the 1st of November of each year. It should be noted that EPWP programmes are implemented in the main by provincial and local government bodies. As the department that is responsible for the overall coordination of the EPWP, the National Department of Public Works communicates with implementing bodies to make them aware of the obligation to increase stipends by November of each year for workers employed under EPWP, including those under the Zibambele Model in line with inflation, as per the Ministerial Determination.

(2) (a) The 88 technical and professional services positions were advertised in the media with the closing date of 26 April 2013. Short-listing for all the positions has been concluded. Offers of employment have been made in respect of 37 positions. 23 offers of employment have been accepted and the persons shall assume duty shortly in the coming few weeks.

The Department could not find suitable candidates during the short-listing and interview process for 32 positions. The positions that could not be filled through the normal processes of advertising are targeted for filling through pro-active skills searches and head-hunting.

(b) The delays in the filling of the positions are due to the fact that the positions are in highly technical areas for which skills availability is scarce, thus posing a challenge of attracting the right people. The head-hunting process is underway and is scheduled to be concluded by 30 November 2013.

(1) National Department of Public Works registered eight (8) criminal cases of alleged fraud and corruption against the officials of the Department and service providers. No arrests have been made as yet with regard to the above. The cases are still under investigation by the South African Police Service.

(2) (a) Through the Presidential Infrastructure Coordinating Committee (PICC) in particular Strategic Infrastructure Project 13, the Department of Public Works is to construct 64 schools, of which the Independent Development Trust (IDT) has been allocated 30 schools to construct as an implementing agent. Construction is underway in the Accelerated School Infrastructure Development Initiative (ASIDI) schools building programmes in Eastern Cape and Free State. It has been planned that Alternative Construction Methods shall be used for the Department of Basic Education Schools Building Programme in the Eastern Cape, in order to to reduce the construction time and costs. The IDT was appointed as Implementing Agent in June 2013 and the procurement process is underway.

(b) A total of 64 schools in the Eastern Cape are to benefit from this programme.

(3) The National Department of Public Works (DPW) signs Incentive Agreements with eligible municipalities in which they indicate projects to be implemented using the grant. In order to avoid fraud and corruption, the municipalities submit monthly expenditure reports signed off by the accounting officers. These reports are monitored by the Department of Public Works. DPW also carries out project verification visits to ensure that information reported is in line with the information on the ground.

(a) The Department of Public Works has conducted an extensive reconciliation of immovable assets in its Asset Register against Deeds Registry data. The reconciliation exercise was conducted in conjunction with all national and provincial custodians and has achieved a substantial improvement in the completeness assertion, as evidenced by Audit Report for 2012/13 financial year. The key milestone is to achieve a GRAP compliant Immovable Asset Register in the 2015/16 financial year. In order to achieve this milestone, the Department will conduct a physical verification of immovable assets and address the management assertions (e.g. property valuations) in the 2013/14 and 2014/15 financial years.

(b) The final report on the lease audit is being prepared by the service provider and is expected to be submitted to the Department by 31 October 2013. It is then that the Department of Public Works will be in a position to report on the deliverables of the entire lease review project.

(1) The National Department of Public Works (NDPW) is complying incrementally with GIAMA, and has developed its User Asset Management Plan (U-AMP) and its Custodian Management Plan (C-AMP) over the last two years.

(a) The U-AMP and the C-AMP will achieve greater refinement as the Department's immovable asset register is enhanced over the next two years, along with the necessary Information Systems Development. Capacity and skills to implement GIAMA in the Department's immovable asset portfolio is being enhanced as part of the Department's Business Improvement (Turnaround) initiatives to stabilise and improve efficiencies within the organisation. User forums will be established to facilitate training on U-AMPs and making them available by all user departments, which will enhance the depth and quality of the information in the NDPW's C-AMP.

(b) It is envisaged that full compliance will be achieved by 31 March 2016 aligned to the development of the immovable asset register.

(2) Since 2012, the NDPW has, in consultation with provincial departments of Public Works developed customised performance indicators for the Public Works Sector. Included in this process is the development of Custodian Asset Management Plans. The provincial departments of Public Works are required to report annually to the NDPW and to National Treasury on the delivery of these performance indicators.

Reports on the 2013/14 targets will be assessed at the end of the financial year and corrective measures will be implemented where required. In addition, the NDPW is resuscitating the GIAMA Implementation Technical Committee to serve as an intergovernmental forum for custodial departments. The forum is set to meet quarterly and focus on (a) the promotion of best practice in immovable asset management and (b) and the identification of research areas, as well as prompt guidance and regulation where required.

(a) At this stage, the Department of Public Works' Internal Audit section is not fully capacitated.

(b) The process to capacitate the Unit is fully underway. All vacant positions in the Unit will be advertised shortly, with appointments expected to be finalised between July and August 2013. Currently, the Fraud Awareness and Investigations sub-unit is being assisted by three service providers with the investigation of reported allegations of fraud and corruption. Funds have been allocated to appoint a panel of service providers, who will be assisting with both investigations and audit services.

We have also strengthened the processes and procedures for the prevention and detection of fruitless, wasteful and unauthorised expenditure. These processes and procedures are underpinned by the principle of addressing accountability with Branch Heads (Deputy Directors-General) for fruitless, wasteful and unauthorised expenditure that occur within their functional areas of responsibility.

In addition to the above, the following measures are in place to prevent fruitless, wasteful and unauthorised expenditure:

· The Department is only making appointments in funded positions and no appointments are made where vacant posts are not funded.

· The spending on goods and services is taking place on activities that are funded through the MTEF. Any new activities under goods and services are implemented after the confirmation of funds. No expenditure will be incurred in activities where funds are not confirmed.

· The spending on transfers is in line with the Public Finance Management Act, 1999 [Act No. 1 of 1999], as amended, and Treasury Regulations, and no new transfers will be introduced without approval by National Treasury.

· Lastly, spending on payments for capital assets is in line with the approved infrastructure project and planned acquisition of machinery and equipment, as per the procurement plan.

(1) (a) (i) Water Efficiency:

The Department of Public Works is in a process of developing a Business Case to provide for sourcing specialised services to establish a base-line study, which will provide for the necessary water efficiency interventions that are required. This process is set to be implemented in the 2013/14 financial year.

The water efficiency project was separated from the energy saving pilot programme.

(ii) Energy Efficiency:

A plan to undertake an energy efficiency base-line study on 100 buildings was developed in 2012 in partnership with the Department of Energy. Due to capacity constraints, the target for the number of buildings was reduced to 40.

The purpose of a base-line study is to establish current usage and energy measurements in buildings in order to determine the energy efficiency interventions that are required.

Planning for the base-line study pilot was undertaken in 2012/13 and the actual study was done in March 2013.

The roll-out of the base-line study in more buildings, as well as retrofitting work are planned to take place in the 2013/14 financial year.

(2) The Energy Efficiency base-line study and data capturing pilot project for the 40 buildings was spearheaded by the DPW Pretoria and Johannesburg regional offices. The subsequent broader 2013/14 project will target buildings located in other regions.

(3) The rehabilitation of buildings took place in the 2012/13 financial year, although focus was not on energy efficiency, which will be a function of retrofitting. In order to address specific requirements of sustainable building, the Department of Public Works is establishing a centralised Built Environment Green Economy Programme – Project Management Office (PMO) to manage the planning and roll-out of energy, water and waste management sustainability retrofitting projects. This is done in partnership with the Departments of Energy and of Environmental Affairs.

The National Department of Public Works (NDPW) will contribute to the priorities in the National Development Plan through the implementation of the following initiatives:

• The Expanded Public Works Programme (EPWP) is one of government's initiatives to bridge the gap between the growing economy and the large numbers of unskilled and unemployed people who have yet to enjoy the benefits of economic development. Phase 2 of EPWP which covers the period 2009/10 to 2013/14 aims to create 4.5 million work opportunities. More than 2.8 million work opportunities have been created between April 2009 and the end of December 2012. The EPWP is currently planning Phase 3 of the programme, which will be aligned with the National Development Plan by up-scaling the targets of work opportunities with respect to youth, women and persons with disabilities.

• Transition to a low cost carbon economy: The NDPW will continue to implement the energy efficiency programme, water efficiency programme and green buildings framework over the MTEF period in line with South Africa's strategies to mitigate the effects of global warming.

• An inclusive and integrated rural economy: The NDPW rural development programme focuses on availing of state-owned immovable assets where required in rural areas for developmental purposes and facilitates the creation of remote area precincts.

· The NDPW has identified properties for the establishment of human settlements in the financial year 2013/14. The properties will be released to the Department of Human Settlements (Housing Development Agency) and/or Municipalities.

• Fighting corruption: The Department is committed to improving internal controls aimed at rooting out tender fraud and corruption.

· The Department is undertaking a review of the Supply Chain System in THE NDPW to align the system to more modernised approaches. The code of conduct applicable to Supply Chain Practitioners as well as key stakeholders in the Supply Chain System will be closely monitored for compliance. Non-compliance to the code of conduct will be reported to the relevant authorities for appropriate action.

· Back office administration of the procurement function is being strengthened to ensure strict compliance to the Supply Chain Management prescripts. Bid Committees have been restructured to ensure that a competent standard is maintained, and that the integrity of the bid process is upheld.

The NDPW is currently implementing an Immovable Asset Register Enhancement Programme, which is aimed at determining accurately all State-owned immovable assets under its custodianship by 31 March 2014.

State immovable assets (including farms) are under the custodianship of various custodians at the national and provincial spheres of government in terms of Section 239 of the Interim Constitution (1993) read with Item 28 (1) of schedule 6 to the current Constitution, 1996 [Act No. 108 of 1996, as amended] .

I was not made aware of the situation in Lusikisiki. However, based on the investigation by the National Department of Public Works Mthatha Regional Office, it was found that the majority of the client departments affected by the electricity cut off are serviced by the Eastern Cape Provincial Department of Public Works. The Regional Office has interacted with the provincial department to address the situation.

(1) Maintenance work was last done on 12 March 2013.

(2) (a) There is no planned maintenance in place currently for this facility. The Department uses Day-to-Day maintenance.

(b) There are no timeframes. Activity is determined by the logging of calls as part of the Day-to-Day maintenance.

(3) The Day-to-Day maintenance applies.

(4) The access for disabled persons is via Juta Street.

(5) (a) A waterproof wall was built to divert the water into the parking area so that it can drain to the outside. This has been partially successful, as the water has drained, yet further water seepage under the brick walls has occurred over some time.

(b) The wall that was built to drain the water ensures that toilets are fully functional.

(1) The National Department of Public Works (NDPW) has not been paying for municipal rates and utility services for this property, as it was mistakenly registered with the municipality as a provincial property.

(2) (a) The property is allocated to the South African Police Service (SAPS), but currently it is unoccupied.

(b) The NDPW owes rates and utilities, and this came to light when the records were checked and it was found that the Johannesburg City Council has been billing the Provincial Department of Public Works. It has been established that this property is allocated to the SAPS and therefore NDPW's Johannesburg Regional Office shall make arrangements with the municipality to settle the outstanding account.

(c) The property is currently in a poor state of repair.

(b) There has been no maintenance work done recently by NDPW on this property, as the house is still under the control of the SAPS. The latter carry out maintenance on all properties allocated to them, as per the devolution arrangement.

(3) The rates account is up to date, the latest payment made for this financial year 2012/13 amounts to R7 773.87. This building is vacant and unutilized and therefore the NDPW does not pay any utilities for it.

(4) (a) The house is currently in need of minor repairs.

(b) The house has not been repaired recently, as it was leased out and the tenants were responsible for maintenance for the duration of the lease period.

(c) The house is currently unoccupied and is safeguarded by security personnel.

(a) Yes. On 21 December 2012 the Department awarded a tender to a consortium consisting of two service providers to assist with the stabilisation of finance and supply chain management both in regional offices and at head office. The terms of reference of this project target the achievement of a clean audit outcome for the 2013-14 financial year. The Consortium commenced work on 14 January 2013. The Department is building internal capacity in the finance division by progressively filling vacant positions as well as using the expertise of the current service provider to transfer skills to the current departmental staff in addition to the seventy (70) interns from unemployed graduates engaged with the service provider as a pre-condition of the bid.

(b) Yes. The brief and deliverables of the Consortium includes preparation for the 2012-13 audit. Given the late commencement of this intervention as well as the huge volume of transactions relating to prior year qualifications that need to be validated, it is not expected that significant improvement will be evident in the audit outcome for the mentioned year.

Visible improvements are only expected to be achieved and evident from the end of the 2013/14 financial year on a progressive basis.

Deliverables for this cycle of the intervention are focussed on three functional areas being; the Property Management Trading Entity (PMTE); Departmental Main Account and Supply Chain Management (SCM). At a high level of reporting, the following has been achieved in the past two months:

· Developed guidelines, templates and year- end procedures for DPW and PMTE.

· Provided training on year end instructions to all regions.

· Assist with reconstruction of debtors going back as far as 2006.

· Compiled a proposal on an interim solution with regards to the segregation of the PMTE and DPW functions and main accounts to be effective from 1 April 2013.

· Drafted a proposal for the early adoption of GRAP/GAAP accounting standards in the PMTE. This has been approved and implemented.

· Drafted various policies where they did not exist or needed enhancement or adjustment.

· Mapped system requirements for the procurement and implementation of an accrual accounting and billing system for PMTE.

· Drafted a related party disclosure framework and developed a process for identifying related parties.

· Sampling and testing of prior year irregular expenditure registers for DPW.

· Assisted with the clearing of suspense accounts, following up on action to be taken and obtaining supporting documentation.

· Guided the audit management process and do periodical review of progress with action plans to implement corrective action.

· Reviewed policies and Standard Operating Procedures for SCM.

· Reviewed and reconstructed the supplier database - developed an interim solution in anticipation of the roll out of enhanced software.

(c) The Department has not appointed staff to specifically assist the Special Investigating Unit (SIU). There is a healthy cooperative relationship between the Departmental staff and the SIU. The Department however, pays the SIU for the investigations that it performs. The Department is currently considering the implications and modalities of appointing dedicated capacity that must be utilised by the Department on a continuous basis to effect the necessary preventative, detective and corrective mechanisms necessary to reduce the level of maladministration and corruption that bedevils the Department at the moment.

(d) The recruitment process for the filling of 88 technical positions has started. The 88 technical positions were advertised on the 24th March 2013 and the closing date of is on the 26 April 2013. The selection process will commence after the closing date.

(1) The site at erf 10217, Sunrise Circle, Maitland, Cape Town, is currently an unutilised sports facility reserved for the South African Police Service (SAPS).

(b) The land is earmarked for the construction of a new building for the Provincial Commissioner of the SAPS.

(c) Since the devolution of properties and functions to SAPS the latter is responsible for the maintenance of the area. The grass on the site is cut every six weeks.

(2) Yes. Two families illegally occupied the site, but they have since been relocated.

(3) (a) As noted in (1) (c) above The SAPS is responsible for the maintenance of the property.

(b) Regular site inspections are done by the security unit of the Department of Public Works to ensure properties are secured.

(2) Specifications for future work to be done on this site all include heritage compliance.

(3) Future work on this site will include heritage assessments, and as per the established practice such work will be done by qualified specialists.

(1) The Cabinet Memorandum does not set any budget parameters and limits on the installation of security measures for the President. In terms of the Cabinet Memorandum, the main consideration shall be to ascertain the level of the security threat to the President, Deputy President, Former Presidents or Former Deputy Presidents or their immediate families, including their personal property, after which the relevant security requirements shall be prescribed for installation by the Department of Public Works.

(2) (a) The Cabinet Memorandum does not exempt security installation projects from the requirements of the Public Finance Management Act, 1990 [Act No. 1 of 1999], and (b) it does not exempt the Minister from his oversight role, which I have been playing, and can be seen in the manner in which I appointed a Task Team to look into the matter of the security upgrades at the President's private residence.

The amount spent for security installations at the private homes of former Presidents is relative to the extent of the requirements stipulated in the security analysis. The main consideration shall be to ascertain to what extent the safety of the subject and or his/her immediate family, including his/her personal property, is exposed to threats, as a direct result of the public position currently or previously held. This evaluation by the security cluster shall be based on the findings of the threat analysis done.

The same consistent approach has been applied in the cases of private homes of the former Presidents since 1994, and the same applies with the private home of the current President.

(1) With reference to his report regarding Nkandla, which mentions the expenditure of R135,4 million on operational costs, (a) what is regarded as operational costs, (b) over what period were these operational costs incurred and (c) what were the operational costs (i) in the (aa) 2010-11 and (bb) 2011-12 financial years and (ii) during the period 1 April 2012 up to the latest specified date for which information is available;

(2) whether other state departments besides the SA Police Service deployed or are currently deploying permanent or temporary officials at Nkandla; if so, in each specified case, (a) how many members of each department are or were deployed (i) temporarily and (ii) permanently and (b) what are the reasons for the deployment of staff from each specified department;

The Minister of Public Works

(1) The private residence of the President in Nkandla has been declared a National Key Point and information relating to a National Key Point should be dealt with utmost sensitivity as it relates to the security of the President.

(2) It is my view that disclosure of information particularly relating to the nature and number of security personnel deployed for the President's security would compromise the security of a National Key Point, which we are seeking to protect.

(3) I have released a detailed media statement on the matter, which the Honourable Member has apparently used resourcefully in his question. Nonetheless, the Honourable Member will concede that to protect the security of the Head of State at his private residence sensitive security information cannot be made public, unless a mechanism is found that will ensure that the security of the President is not compromised.
