(1) (a) How many copies of each annual report that was produced by (i) his department and (ii) the entities reporting to him were commissioned for print in the 2011-12 financial year, (b) how many copies were actually printed and (c) what were the (i) total and (ii) individual costs of printing these reports;

(2) (a) who printed each specified report, (b) how was the specified printing services provider decided upon and (c) on what date did the specified printing services provider deliver the report to the specified entity;

(3) whether any of the specified reports that had been printed were found to be unsatisfactory; if not, what is the position in this regard; if so, in each case, (a) which reports, (b) for which entity, (c) by which printing services provider, (d) what action was taken and (e) what were the costs?

SAPS

The South African Police Service (SAPS) produced 3000 copies of the Annual Report 2011/12 including the Annual Report of the Civilian Secretariat for Police and 2000 copies of the Addendum to the Annual Report (crime statistics). The total amount for the 3000 copies were R211 236-94 and for the 2000 copies of the Addendum R122 049-39. The individual cost for the 3000 copies amount to R70-41 and for the 2000 copies of the Addendum R61-02. The SAPS made use of the Government Printing Works. The Annual Report was delivered to Parliament on 27 September 2012 and the tabling took place on 27 September 2012. A few reports from the first batch of 70 of the Addendum were faulty, but were corrected within 24 Hours without cost implications.

IPID

Five hundred (500) copies of the annual report for the Independent Complaints Directorate (ICD) were produced by (ii) the Independent Police Investigative Directorate (IPID) for the 2011-12 financial year. The total cost to print 500 copies was one hundred and forty one thousand five hundred and thirty one rand (R141,531.00), inclusive of design and layout and each report cost two hundred and eighty three rand and six cents (R283.06) to produce, inclusive of design and layout. Three (3) quotations were requested from companies listed in the IPID's Supplier Database. The IPID's Bid Committee awarded the work to Basani Printers after adjudication, in line with the Supply Chain Management policies. The supplier delivered the reports to the IPID on 27 and 28 November 2012. None of the reports printed were found to be unsatisfactory

Formative fitness assessments comprise of physical health and fitness assessments

and are as follows:

Health related assessments

- SAPS Physical Ability Readiness Questionnaire (SAPS PAR-Q);

- Blood Pressure Measurement;

- Body Mass Index (weight and height measurement); and

- Waist circumference.

Fitness assessments

- 1,6 Km walk or

- Pacer (bleep test);

- One minute Bent-knee curl-up; and

- One minute Push-up.

Developmental assessments (baseline and orientation fitness assessments)

comprise of physical health and fitness assessments and are as follows:

Health related assessments

- SAPS Physical Ability Readiness Questionnaire (SAPS PAR-Q);

- Blood Pressure Measurement;

- Body Mass Index (Weight and height measurement); and

- Waist circumference.

Fitness assessments

- Including designated walks and runs, push up etc

Standards for males and females are done according to age category and are required to undertake the standard walk and run but the number of push up etc and the times vary according to the age of person. The variance is in line with best practise regarding fitness testing.

(1) Whether the Automated Fingerprint Identification System (AFIS) for criminal background checks directly link and verify the biographical data (details furnished) with the fingerprints when checking a person's convictions as processed by the AFISwitch system of Ideco (details furnished); if not, why not; if so, what are the relevant details;

(2) whether he has found that the AFISwitch system can be manipulated by synchronising the personal particulars for a person who has a criminal record with the fingerprints of someone who has a clean record; if not, why not; if so, what are the relevant details;

(3) whether a person with a criminal record can access the AFISwitch system as a user; if not, why not; if so, what are the relevant details;

(4) whether the SA Police Service (SAPS) has followed the relevant procedures in advertising the tender that led to the AFISwitch system being awarded exclusively to Ideco for a period of 15 years; if not why not; if so, what are the relevant details;

(5) whether it is normal practice to award a tender for such a lengthy period of time; if not, what is the position in this regard; if so, what are the relevant details?

REPLY:

(1) No, the biographical data is not verified with the finger prints when checking a person's previous convictions as the fingerprints are the primary medium to perform the person identification.

There is no interface between the Home Affairs system and the AFIS switch to verify biographical data.

A process is underway to interface SAPS AFIS and HANIS of Department of Home Affairs in line with the Criminal Law (Forensic Procedure) Amendment Act, 2010. It is never the intention to interface IDECO AFIS with HANIS or any other departmental system.

(2) It is a standard that the candidate must produce a South African identity document / passport or proof of identity. The fingerprint capturer must verify the identity of the person before he or she acquires the fingerprints on the system. The result of the search will correspond to the biographical information captured on the AFISwitch during the acquisition process.

(3) The SAPS has entered into an agreement with IDECO which provides that employees or agents appointed by IDECO will be subject to security vetting at the relevant level of clearance determined in accordance with the guidelines and / or directives issued by the National Commissioner. IDECO is obliged to appoint persons of high integrity which will exclude persons with criminal records.

(4) The South African Police Service procured the initial SAPS AFIS with the financial assistance from the Independent Development Corporation (IDC). As part of the contract, IDC was given exclusive rights to conduct commercial searches as a strategy to generate revenue to provide self-sustainable model as a gateway to debt repayment. The IDC subsequently appointed IDECO as their service provider to perform the commercial fingerprint searches for a period of 15 years which is part of exclusive rights which was granted to IDC. This contract was concluded with the involvement of the National Treasury, SAPS and IDC.

The SAPS engaged IDECO to revise the initial contract whereby an agreement was concluded in 2011 between SAPS and IDECO for a term of 5 years which commenced in September 2011 and will end in August 2016.

(5) The contract for a period of 15 years was reviewed and reduced to period of 5 years, which is in line with contract management practices. It is important to note that a 15 years contract to IDECO was not awarded by the South African Police Service, but by IDC. Therefore, the contract which is in place is valid for a period of 5 years.

(1) (a) and (b) Yes. Advertisements were placed in the New Age since the inception of the newspaper. The Department makes use of all newspapers when advertising.

(2) Yes. Some of the advertisements were placed through the Government Communication and Information System (GCIS) as indicated in reply (1)(a) and (b)(i) above.

(3) and (4) No independent analysis or studies were conducted with regard to the placing of the advertisements. The South African Police Service advertises in various media on an ongoing basis according to its needs determined by targeted recruitment.

(1) The department subscribes to a variety of newspapers, including The New Age, Cape Times, Argus, Die Burger), Mail and Guardian, Sunday Times , Rapport, Pretoria News, Sowetan, Beeld, Star, Citizen , Daily Sun, City Press, Sunday Independent , Sunday World and Sunday Sun . These subscriptions are procured by the South African Police Services National Library Services which resort under the Division Human Resource Development..

(b) The subscriptions for all paper are all initiated at the beginning of the financial year.

(c) Eight hundred and seventy five rand (R875-00) per annum.

(d) The purpose of all newspaper subscriptions is to allow SAPS employees to keep abreast of matters affecting the South African Police Service to enable proper planning.

(a) Three matters were reported – alleged fraud/ corruption in respect of grants awarded to the tenants of the Willows Resort and Van Staden Resort, and alleged fraud/ corruption in respect of awarding the tender for the Curio Shop at the Red Location Museum.

(b) The matters relating to the grants to the tenants of the Willows Resort and Van Staden Resort were investigated and no evidence of fraud or corruption was found. In the matter relating to the Curio Shop tender, a criminal case was opened vide Mount Road CAS 623/09/2012. The case is with the public prosecutor of the Specialised Commercial Crime Court for a decision pertaining to prosecution.

(c) The case Mount Road CAS 623/09/2012 is currently being decided and it is not known how long the process will take. The entire Kabuso Report was handed over to the prosecution for perusal.

The information is not readily available, as there is no indication on the Crime Administration System what the motive for a murder is. The system does not cater for the seperate registration of political related murders. All murders are registered as "murder". The requested information must be sourced from the provinces, where each murder docket must be drawn and perused individually to obtain the relevant information. This will be very time consuming and human resources must be withdrawn from operational duties to perform this task.

(1) No, the SAPS Division: Operational Response Services has not been withdrawn from the Kruger National Park (KNP).

(2) Members deployed from Operational Response Services will remain in the KNP. The tactical details of the deployment (i.e. number of SAPS personnel remaining) will remain strictly confidential.

(3) The SAPS and SANParks as well as the relevant departments have been and still are in constant liaison on the matter of combating Rhino poaching through the established Priority Committee at both National and Provincial levels.

1. In the Koppies area:

(a) 20 cases of which seven were false

(b) 35 cases

(c) 27 cases

2. The incidents reported involved the theft report involved thefts from Spoornet of metres and cabling, theft of municipal metres and cablin, theft of cables and transformers from Eskom as well as cases of theft of wire from private farms in the area. The dates on which these incidents occurred are attached.

3. However as the honorable member would be aware these cases are difficult to address unless the suspect is caught in the act or there are witnesses. During this period however 12 suspects have been arrested and in two instances the suspects have been found guilty and sentenced to imprisonment.

4. The SAPS has taken the following measures to address cable theft some of these apply across the country and are not only applicable to this area:

· Crime prevention patrols by visible police

· Engagements with role players through formal localized structures as well as the establishment at a national level of a Non Ferrous Metal Committee involving both business and other government departments

· Closer scrutiny of second hand metal dealers

· Investigation by the detective division and where applicable DPCI

Statistics on the number of farm dwellers that have been murdered and violent attacks perpetrated on farm dwellers are not captured separately or released as special statistics, but are released as part of the general contact crime statistics.

However, the South African Police Service Divisions: Visible Policing and Crime Intelligence monitor all incidents of violence against persons residing on farms and small holdings in rural areas on a daily basis. Weekly incident analysis meetings, involving all stake holders, take place to discuss these incidents to determine flash points, particular crime trends, modus operandi employed by criminals involved and other matters related to rural safety and security. This operational information forms the basis for presentations to the quarterly National Rural Safety Priority Committee meetings which is inter alia attended by organised agriculture and farming unions (NAFU, AGRI SA and TAU SA). When it is noted that incidents in an area increased, the relevant Provincial Commissioners are sensitised and instructed to ensure that preventative measures are being taken to prevent such incidents.

(4) The South African Police Service has developed a National Rural Safety Strategy which aims to address rural safety, including violent attacks and murders of farm dwellers, as part and parcel of an integrated and holistic day to day crime prevention approach.

This approach is further strengthened by a rapid reaction capacity, as well as integrating and coordinating local deployment along the borderline to combat illegal cross border movement of people, goods and contraband.

The above approach aims to sustain and integrate the Rural Safety Strategy by providing a properly trained and resourced capacity to implement rural safety measures.

The strategy further aims to promote effective and dedicated participation, establishment of partnership and involvement of internal and external stakeholders in an integrated, joint and coordinated manner.

The Rural Safety Strategy is based on the following four pillars:

· Enhanced Service Delivery

· Integrated approach

· Community Safety Awareness

· Rural Development

Rural Safety Coordinators are further appointed at local level to enhance interaction with the rural community and Rural Safety Plans and contingency plans are in place to, inter alia, deal with violent incidents on farms and small holdings. Safety hints in all eleven official languages were further developed and distributed to create awareness and safety networks amongst the rural community.

In addition to the National Rural Safety Priority Committee, Rural Safety Priority Committees also function at provincial and cluster levels to determine flash points, particular crime trends and modus operandi employed by criminals involved in incidents of violence on farms and small holdings, as well as other matters related to rural safety and security, in order to implement preventative measures and conduct crime prevention operations to prevent such incidents.

(a) and (b) The SAPS Crime Administration System (CAS) provides for the capturing of charges and also information on the offenders charged with the commission of specific crime, including the date of birth.

Children under 10 can however not be charged, as according to the provisions of the Child Justice Act, 2008, children under 10 do not have criminal capacity. Whilst the crimes they are allegedly involved in can be captured, the child cannot be charged as an offender of that crime. CAS's main purpose is to capture crime and can therefore not provide information relating offenders not linked to a charge as in the case of children under 10 years of age.

The SAPS is developing an information system in order to capture all data regarding children under 10 involved in crime. This information system has been tested for the required dimensions of information which include details of the nature of offence, any other person involved and the probation officer to whom the child is referred.

Arrangements have been made for the piloting of this information system. Once the pilot is complete and the efficacy of the system has been verified it can be rolled out nationwide in the 2013/2014 financial year. The new financial year will make it possible for funds to be available for the establishment of the new information system.

(a),(b) and (c) Data on the number of charges against children is available. The Crime Administration System captures charges against children and not the number of children arrested. The number of charges against children during the 2011/2012 financial year is 57 592.

Data on the detention of children is provided in the SAPS 14 custody register and captured manually. It is therefore not available for national information systems. This also pertains to information on children detained with adults. SAPS instructions specifically forbids the detention of children with adults and should this happen a departmental investigation would have to be instituted against the members responsible.

A process has been initiated to establish a Detention Management System that will electronically capture all data with regard to people held in police custody and will include children held in police cells. Children should however only be detained when there are compelling reasons as set out in the National Instructions for Children in conflict with the law (NI 2 of 2010).

The following cases were investigated by Capt Vilankulu –Kliptown CAS 360/09/2011, Jeppe CAS 70/08/2011, Hillbrow CAS 560/12/2010 and Parkview CAS 465/04/2010.

Pretoria West CAS 430/12/2011-Capt Masilela- it is not linked with the other cases as the perpetrator must be someone very close to the deceased according to Capt Masilela.

Norwood CAS 336/09/2011-SGT Manyanda-it is not linked with the other cases the deceased was strangled warrant of arrest was issued for the suspect that was identified.

Sophia Town CAS 227/08/2011-Cst Mthetwa- it is not linked with the other cases –the suspect could not be linked with the murder.

Hillbrow CAS 1269/02/2012-W/O C Muller-Hillbrow- it is not linked with the other cases.

(3)Capt Vilankulu dealt with four of the cases and had one person convicted for possession of stolen property and the main suspect in the cases is still outstanding. His identity is still unknown at this stage only known as Tony Boy. There is no task team.

- Sophia Town CAS 227/08/2011-CST Mthetwa-feedback was given to the brother of the victim during July 2012.

- Jeppe CAS 70/08/2011-CST Ndlovu-feedback was given to family during September 2012.

- Pretoria West CAS 430/12/2011-Capt Masilela-feedback was given to the sister of the victim during July 2012.

(5) (a) A common perpetrator was identified in the following cases – Kliptown CAS 360/09/2011, Jeppe CAS 70/08/2011, Hillbrow CAS 560/12/2010 and Parkview CAS 465/04/2010 one suspect, a Nigerian National was convicted for possession of stolen property on the Parkview CAS 465/04/2010. The main suspect is only known as Tony Boy. He is still outstanding.

The other cases could not be linked as there is no evidence to indicate that there is common perpetrator in the other mentioned cases.

(b) There is a no common modus operandi in these cases.

Hillbrow CAS 1269/02/2012: there are two (2) suspects in this case. One is known as Thuba Nube. He visited the victim six (6) times before the murder. He visited on the day of the murder. There is video footage of suspects leaving with stolen property in black bags.

Norwood CAS 336/09/2011-one suspect was identified through fingerprints found on the scene. The suspect has been circulated.

(1) Representatives of the Commission held a meeting with a member of the Directorate for Priority Crime Investigation (DPCI), who briefed the Commission on the investigations that the Directorate had conducted. The briefing session occurred over a period of two days in August 2012 in Pretoria.

(2) Pursuant to the aforesaid briefing and at the request of the Commission, the DPCI handed over documents to the Commission which are relevant to the Commissions' Terms of Reference and would assist the Commission in its investigations. The documents were handed over in August 2012.

However, it is SAPS departmental standing operating procedure that all members who report for duty must have the necessary equipment to effectively execute their policing duty. The numbers, availability, location and serviceability of equipment is confirmed during inspections and annual stocktaking.

(1)(a) A total number of 22 SAPS members are currently on suspension with remuneration and the information is as follows:

(1)(b) Number of days for suspensions with full remuneration varies according to the nature of the case. However of the 22 personnel suspended five have been of suspension less than 90 days and 12 have due to the nature of their suspension been on suspension for more than 12 months. The latter situation, in most cases, involve situations where legal representatives have become involved in the suspensions.

(2) A total amount of R 3,671,787.25 was spent on suspended SAPS members.

(3) Bi-Lateral meetings between SAPS and IPID are now held monthly with the purpose of exchanging information on new and outstanding IPID cases. All members of the Police Service have been informed of the coming into operation of the IPID Act and have been provided with a copy of the Act and Regulations. Furthermore, all senior officers have also been provided with the contact particulars (telephone numbers and fax numbers) of IPID in the provinces. Members were instructed to telephonically report to IPID all incidences referred to in section 28(1)(a) to (f) of the IPID Act. Members were furthermore instructed to follow up (within 24 hours) every such telephonic report with a fax to the relevant fax number (also provided).

(1) No, at no stage was any enquiry received from any department pertaining to the availability of footage or any progress regarding the mentioned case.

(1)(a) There are no CCTV cameras in the area and therefore no footage could be requested. None of the complainants in the under mentioned cases indicated to the police that they have any video material regarding the incident.

(1)(b) Two police officers responded to a complaint where approximately sixty members of the community were fighting. The police officers tried to defuse the situation. The complainant was not assaulted in the presence of any member who attended the complaint.

The complainant, Miss N Nqgingo registered a case of Assault GHB, Harare CAS 372/07/2012. Three suspects were positively identified by the complainant and were arrested. The case was postponed to 6 September 2012.

Mr N Bonga registered a case of Assault GBH Harare CAS 362/07/2012. The complainant positively identified Miss N Ngqingo and two other suspects in the case. The case has been postponed to 6 September 2012.

There is a court case pending against the SAPS over the ex-Scorpions members' (a) salary deductions, (b) retirement terms and (c) medical aid. A group of 53 ex-Scorpion members have filed an application in the Labour Court with regard to their conditions of service in the SA Police Service.

(1)After a Disciplinary case has been heard and a guilty verdict has been pronouncedby the Presiding officer, the employer representative submits aggravating circumstances and the employee representative/employee submits mitigating circumstances for consideration by the Presiding Officer in determining an appropriate sanction.

The Severity of the sanction is dependent on the severity of the case as well as factors that may be argued in aggravation of circumstances by the employer and factors that may be argued in mitigation of the circumstances by the employee facing charges

(2) The processes given in response to 1 above are followed to determine the severity and the appropriateness of a sanction. The Chairperson will pronounce an appropriate or a combination of sanction(s) as per prescribed SAPS Discipline Regulations, 2006 from the following:

· Counseling

· Written warning which will be valid for six months

· Final written warning which will be valid for six months

· Suspension without remuneration for no longer than three months, subject to the consent of the employee.

· Dismissal

· Suspended dismissal for a period not exceeding six month

· A Fine

· A Combination of the above

All cases are referred to dedicated disciplinary functionaries for consideration and finalization.

(a) SAPS has not appointed permanent sign language interpreters. Prior to 2009, Language Section advertised a post at National Level but was unable to fill it due to poor response to the recruitment drive. Language Section (Corporate Communication), together with Disability Management (EHW) are in the process of developing a strategy to ensure that people with hearing disabilities are able to access SAPS's services.

(b) External registered sign language interpreters are being utilized, when the need arises to have sign language interpreters at police stations.

REPLY:

No, the SA Police Service does not arrest persons for merely being a member of a gang because being a member of any gang does not necessarily constitute an offence. If a member of a gang committed a crime, such member will be arrested for the suspected crime as committed in accordance with the provisions contained in the Criminal Procedure Act, 1977 (Act No 51 of 1977).

The membership of a gang is not necessarily illegal.

In terms of the Prevention of Organised Crime, Act No 121 of 1998, a criminal gang has been defined as:

"criminal gang includes any formal or informal ongoing organisation, association or group of three or more persons, which has as one of its activities the commission of one or more criminal offences."

Thus the individual crime needs to be linked to particular individual/s, gang and gang activity.

The number of gang related cases was obtained through information in the relevant case dockets and the actual number of victims and suspects varies per individual case.

The criminal profiles of victims and suspects are obtained and used to determine whether incidents are gang related.

The victims and suspects are reluctant to cooperate and their gang involvement is generally denied by their relatives and friends.

(a)

5 helicopters from Gauteng

· 2 were grounded in April 2011. One of these had to have the Engine was removed and sent to the USA after being under power the other's gear box was sent to the USA for repair

· Two were was grounded in October 2011and the delays have been caused by needing to get spare parts from Germany

· One was grounded in November 2011 and as with the two above delays have been cause by parts needing to be sourced from Germany.

1 helicopter from Western Cape (Grounded in December 2011 and special part is still awaited from Germany)

1 helicopter from Free State( grounded in February 2011 and was sent for upgrade The upgrade requires special spares as the helicopter has been operating more than 25 years)

(b) After every 100 flying hours.

(2) There are no delays in the appointment of service providers to perform maintenance on the helicopters. The original equipment manufacturers (service providers for the specific brand and model of helicopters) are appointed immediately after a requirement for maintenance is received.

(3)(a)(b) Armscor is in an advanced stage of establishing a term contract on behalf of the SAPS with the original equipment manufacturers for the various models of helicopters in the SAPS fleet. The original equipment manufacturers for the different models of helicopters are being utilized and contracted to perform maintenance and product support on the helicopters as and when a requirement arises.

REPLY:

(1) (a) (b) (i) (ii) The Forensic Science Laboratory in Pretoria received the DNA exhibits in respect of SAPS Mankweng Cas 723/12/2010 on the 7th of January 2011 for DNA analysis as per Lab Number 2562/11. The exhibits were accordingly processed and a forensic report was finalized on the 2nd of February 2011. The forensic analysis was finalized in 26 days from date of receipt which period did not exceed the 28 days predetermined for the processing of exhibits, thus there were no delays in the finalization hereof.

(2) (a) Due to the lapse of time between the commission of the crime and the reporting of the incident to the South African Police Service, no DNA crime kits were taken in respect of Mankweng CAS 529/05/2012.

(b) (i) The DNA exhibits in respect of SAPS Mankweng 206/06/2012, the third rape were received by the Forensic Science Laboratory on the 28th of June 2012 as per Lab Number 196600/12. The reference sample from the suspect was received on the 19th of July 2012. The Forensic Science Laboratory submitted a preliminary report on the 3rd of July 2012 six days after receiving the DNA exhibits and the final forensic report was finalized on the 19th of July 2012 twenty one (21) days from the date of receipt. There were no delays in finalizing the processing hereof as such processing is within the 28 days predetermined for the processing of forensic exhibits by the SAPS Forensic Science Laboratory.

(1) Whether the Independent Police Investigative Directorate (IPID), put aside as unsubstantiated over 81% of cases presented to them for investigation in the 2008-09 financial year; if not, what is the position in this regard; if so,

(2) whether a certain case (details furnished) was one of the cases; if not, what is the position in this regard; if so, what are the relevant details;

(3) whether the investigations by the (a) Public Protector, (b) Hawks and (c) a certain head (name furnished) highlighted the atrocities allegedly being committed by this unit to IPID in the same period; if not, what is the position in this regard; if so, what are the relevant details;

(4) whether the file was closed without any further investigation; if so, (a) who closed the file and (b) what are the further relevant details;

(5) whether any steps have been taken to improve the (a) case sensitivities and (b) investigative capacity of the department in the 2011-12 financial year; if not, why not; if so, what (i) steps and (ii) are the relevant details?

REPLY:

(1) No, the ICD/IPID closed 5 695 cases in the financial year 2010/11. Of the total 5 695 cases closed, 4 635 were closed as unsubstantiated, which represents 81% of all closed cases and NOT the ICD/IPID's workload for the period indicated. Since the ICD/IPID's workload was 8 424 and the number of cases closed as unsubstantiated was 4 635, the actual percentage of cases closed as unsubstantiated compared to the workload in 2010/11 was 55%. So the ICD/IPID closed 55% of cases presented to it as unsubstantiated not 81% as alleged. Similarly, in the financial year 2009/10, the workload was 10 437 and cases closed as unsubstantiated amounted to 5 427, representing 52% of the workload. In the financial year 2008/09 the ICD/IPID closed 3 882 cases closed as unsubstantiated against a workload of 11 193, working out to a percentage of 35%.

(2) Yes, some of the Cato Manor cases were closed as unsubstantiated due to lack of evidence at the time as well as the intimidation of witnesses which has since been confirmed by the investigation of the ICD/IPID Task Team. However, all the Cato Manor cases were reviewed by the ICD/IPID Task Team that was appointed to investigate all the cases in which the Cato Manor Unit was involved. The work done by that ICD/IPID Task Team has resulted in the arrest of the 20 members of Cato Manor squad. More suspects will be brought before the courts and additional charges will be added to the charge sheet when the accused appear again on 24 August 2012.

(3) None of the parties mentioned highlighted or investigated the atrocities involving the Cato Manor Unit during the period indicated. Contrary to media reports, the ICD/IPID was never made aware that there were improper investigations by any of its staff during that period. An internal investigation is underway to determine if anybody should be held accountable for any failure to conduct proper investigations. At this stage that process has not been concluded. However, should any evidence be established implicating any member of IPID staff, disciplinary action will be taken in line with the relevant public service prescripts.

(4) The Cato Manor investigation is comprised of many dockets from different incidents investigated by the ICD/IPID Task Team. An internal investigation is underway to determine if anybody should be held accountable for any failure to conduct proper investigations. At this stage that process has not been concluded.

(5) (a) The IPID Act No. 1 of 2011, the Regulations and the Standard Operating Procedures governing the investigations conducted by the IPID came into operation on 1 April 2012. These set out how investigations should be done as well as prescribe the timelines for each type of investigation. (b) the National Treasury has allocated an additional R45 million for the implementation of the IPID Act in the 2012/13 financial year, a large component of that allocation is for the appointment of additional investigators. There is an extensive training programme taking place covering the investigation of torture, sexual offences, corruption and DNA testing. The department is developing a training manual for investigators covering all aspects of investigation in line with section 28 of the IPID Act.
