Dr S M van Dyk (DA) to ask the Minister for Public Enterprises:

(1) Whether the Second Defined Benefit Fund (SDBF) has suffered financial losses as a result of (a) poor management by the Board of Trustees and (b) government policy regarding investment directives for the Transnet Pension Fund; if so, what are the relevant details;

(2) whether his department will request the Transnet management to authorise the trustees of the fund to amend the rules of the fund in order to realise a growth rate exceeding 2% per year in pensions; if not, why not; if so, what are the relevant details;

(3) whether his department will fund this specific pension fund so that a larger than the 2% statutory remuneration in pensions can be granted; if not, why not; if so, what are the relevant details? NW2538E

REPLY

(1)(a-b)The fund is controlled by a Board of Trustees and not Transnet. However, Transnet is not aware of any financial losses suffered by the TSDBF due to poor management by the Trustees of the TSDBF or investment directives from government.

2) Rule 9(1) of the Pension Fund Rules provides that the Board of Trustees may, with the approval of the Managing Director and the Minister, acting in concur­rence with the Minister of Finance, prescribe the manner in which the award of benefits shall be considered by the Fund. Changes to the Rules are initiated by the Board of Trustees.The Department of Public Enterprises cannot therefore request Transnet management to authorise the trustees of the fund to amend the rules. In July 2007, the Department and Transnet took various steps to improve the financial position of pensioners and Fund beneficiaries, which included the amendment of the Fund Rules (with the Minister's approval and the concurrence of the Minister of Finance) to include a bonus payment to supplement a pensioner's annual income. The Fund Trustees have the discretion to pay the bonuses depending upon the Fund's financial performance, affordability and other considerations.

(3) In terms of Section 2 of the Transnet Pension Fund Act, the Fund is vested with its own legal personality which is distinct from Transnet or the Department. The mandate of the Department is to provide shareholder oversight over the state-owned enterprises, it is therefore not within its mandate to fund the Pension Fund.

REPLY:

(a-e) There are Members of Parliament who are in arrears with respect of payment of accommodation at Parliamentary Villages. The list is known at Parliamentary administration.

As a practice, the Department constantly send reminders to individual Members of Parliament to make payment of arrears.

In certain instances, the Department enters into negotiation with Members concerned to agree on the repayment options on the outstanding amount.

THE MINISTER FOR AGRICULTURE AND LAND AFFAIRS:

(a) The Regional Land Claims Commission: Western Cape (RLCC: WC) is in the process of appointing a service provider to conduct historical valuations on the subject land, in order to determine whether the claimants received just and equitable compensation at the time of dispossession.

(b) The RLCC: WC deemed the land claim non-compliant with the Restitution of Land Rights Act, 1994, as it appeared that the claimants received just and equitable compensation at the time of dispossession. The claim therefore did not meet the requirements of section 2(2)(a) and (b) of the Act.

(c) The Commission undertakes to finalize the matter expeditiously; however, a specific time frame cannot be pronounced due to the nature and complexity of the process of conducting historical valuations.

REPLY:

(a) Yes, the DoE has training programmes for grade R teachers. Most teachers are being trained as part of the NPDE programme. Some provinces have made agreements with institutions of higher learning in their areas to provide training programmes for the teachers. All current teacher development initiatives include grade R practitioners.

(b) Yes, the multi-media information campaigns conducted every year to remind parents to register their children (for all grades) for the next academic year includes grade R learners.

REPLY:

(1)(a) Yes. There are various programmes, facilitated by state departments and non-governmental organizations, aimed at preventing people from using and/or abusing substances including heroin, which is sometimes referred to as "sugars".

Department of Social Development plays a leading role in the implementation of the government's anti-drug campaign ("Ke moja: No thanks I'm fine without drugs") targeting the youth, parents and educators. This programme is aimed at preventing the abuse of substances. It promotes healthy life style and makes provision for skills development.

(b) Yes. Currently there are 5 public and 80 registered private treatment centres offering treatment programmes to persons affected and/or abusing substances such as heroin etc.

(2) Yes. The South African Community Epidemiology Network on Drug Use (SACENDU) conducted a study in 2006/7on the levels of substance abuse in the country. The study indicated that there is a sharp increase in patients admitted for treatment for heroin use in Durban. The proportion of patients who reported heroin as their primary substance of abuse increased from 2% to 32% between 2006 and 2007 in Pietermaritzburg and Durban.

(3) Yes. Durban, particularly Chatsworth has the high rate of heroin abuse. Heroin is also abused in other parts of the country under different names. Often heroin is mixed with cannabis (dagga). In Mpumalanga heroin mixed with dagga is called "pinch" and in Pretoria it is called "nyaope". The street name for heroin mixed with dagga is called "unga" in Cape Town. In Mpumalanga over 20% of patients admitted for substance abuse treatment in the second half of 2007 reported heroin as their primary or secondary substance of abuse. Generally Western Cape, Gauteng, Mpumalanga and KwaZulu-Natal provinces have a high rate of substance abuse.

(1)(a) Steps taken to curb the high level of car hijacking in Mobeni Heights include:

‑ Cluster task team and provincial task teams on carjacking are deployed according to the Crime Threat Analysis and the Crime Pattern Analysis. Mobeni Heights is given priority.

‑ Sector Policing has been implemented.

‑ Operation Vimbela has been initiated by the Chatsworth Cluster to address the high levels of carjackings in the Chatsworth and Bayview policing areas. In this operation, station commissioners within the Chatsworth Cluster provide resources to address this crime.

‑ Ongoing vehicle checkpoints and stop‑and‑search operations.

(b) (i) SAPS Bayview.

(ii) Superintendent R Ramchunder.

(2) Yes, a total of nine suspects have been arrested since the beginning of this financial year.

    1769 "Mr J P I Blanche to ask the Minister of Science and Technology:

    (1) (a) To what extent has research been done by the National Research Foundation (NRF) and his department to establish the economic feasibility of financing the power supply for electric-driven motor cars from the national grid and (b) what is the estimated additional annual electricity capacity required to supply the proposed conversion to electric-driven motor vehicles on roads;

    (2) Whether his department has been requested to research the feasibility of having to supply such a market; if so, what are the relevant details; if not,

    (3) Whether he will support such a study to be initiated to establish whether a market of electric cars can be sustained with the present capacity of electric produced by Eskom; if not, why not; if so, what are the relevant details;

    (4) Whether he will request the Council for Scientific and Industrial Research (CSIR) or any other state organization reporting to him, to investigate the quality of energy efficiency of electric appliances, equipment and machines marketed locally in order to ensure that more energy efficient appliances and machines are used; if not, what steps are his department taking to assist the government to regulate the more efficient use of electricity; if so, what are the relevant details?

    REPLY:

    (1) Optimal Energy has done extensive research to determine that there is sufficient capacity available to power its vehicles, as this is one of the building blocks of the business case.

    (ii) Optimal Energy's research findings, based on electricity demand patterns in South Africa, confirm that no extra electricity capacity is required to supply the proposed conversion to electric-driven vehicles on South African roads.

    (2) As indicated above, this has been done. In its recent Annual Report, Eskom shows a current installed capacity of about 38 000 MW, with the demand for electricity approaching this level during peak times. The peak demand is traditionally between 07:00 – 10:00 and 18:00 – 21:00, with lowest demand for power between 22:00 and 06:00. During off-peak times the demand drops to approximately 24 000 MW, which leaves an excess capacity of 12 600 MW.

    This excess capacity is enough to charge approximately 12.9 million vehicles every night. This is based on an annual travel distance of 20 000 kilometres and an upper quartile estimation of 150 watt hours of electricity usage per kilometre traveled. This is significantly more than the 9.2 millionregistered vehicles that are currently on South African roads. It is evident that Eskom has sufficient excess capacity to supply electricity for the purpose of charging electric vehicles during off-peak periods.

    (3) Given that the average number of vehicles on South African roads increased by 3.2%, annually between 2000 and 2005, this and the 9.2 million registered vehicles in 2008 as a base figure to predict the vehicle growth figures, there will be an estimated 13.4 million vehicles on our roads in 2020.

    If 20% of these are electrical, which is an optimistic scenario; it means that there will be only 2.6 million electrical vehicles on our roads in 2020. This is approximately a factor of five less than what Eskom's current excess capacity can handle. These calculations do not take Eskom's plans to double its capacity to 80 000 MWby 2025 into account.

    (4) A preliminary study commissioned by the South African National Energy Research Institute (SANERI) has indicated that there is a need to regulate the quality of energy efficiency of electric appliances as there are wide variations in power consumption levels in appliances with the same functionality and capabilities. The large variations indicate that there is scope for effective minimum energy performance standards to eliminate poor performing appliances. While it was limited in scope, this study is being used to inform the labeling of appliances. There is also energy efficiency (EE) working committee that has been established within the South African Bureau of Standards (SABS) in order to co-ordinate standardizing of the quality of energy efficiency of electric appliances, equipment and machines that are marketed locally as well as internationally. EE has been also been identified as one of the themes for the SABS Expo, earmarked for 29-31 October 2008.

    I would like to inform the Honourable Member that disciplinary action was taken against officials found guilty of misconduct in my Department. The statistics, as requested by the Honourable Member for the period 2005; 2006 and 2007 are detailed below:

    1.1

    The Minister of Transport:

    (1) (a) The National Treasury has centralised the 2010 Fifa Soccer World Cup event operational budget under one grant, which is being administered by the Department of Sport and Recreation. The grant can only be accessed by Host Cities, and the allocations were made based on the number of venues and the number of matches each City will be hosting.

    (i) For 2009-2010, the total allocation is R488 million; and

    (ii) for 2010-2011 it is R196 million.

    (b) Host Cities are currently working out the final figures, which will differ from one City to the next.

    (c) (i) and (ii)

    It is the Department of Transport's view that, with adequate fare recovery, there should not be large budget shortfalls from hosting the event. Host Cities have been advised to start looking at alternative sources of funding, including borrowing, to overcome any identified budget shortfalls.

    (2) The budget for stadium construction is administered by the Department of Sport and Recreation and they should be in the best position to provide the exact figures of expected cost overruns.

    REPLY:

    (a) A final Communication reminder was published just before the closing date of 31 December 2006. A huge number of applications with incomplete information were received. Letters have been written to the applicants to request additional information with limited success. Additional capacity has been deployed to assist in research and verification of the eligibility of the applications.

    (b) Approval will be granted, once applicants' credentials have been verified and recommended by the adjudication panel and later approved by the Ministers' delegated officials.

    THE MINISTER FOR AGRICULTURE AND LAND AFFAIRS:

    No. The reason for this is that we have adequate programmes including restitution, redistribution and tenure reform which deal with past racially discriminatory laws and practices. It was considered unwise to consider any land dispossessions pre-dating 19 June 1913 as these included many tribal and ethnic wars. It would not be advisable to re-open that chapter.

    (1) Whether all or part of the R2 billion allocated for renewable energy in the 2007-08 budget had been spent; if so, (a) on what (i) vision and (ii) plan, was this spending based and (b) for which purpose; if not,

    (2) whether he will allocate the unspent amount towards the implementation of a feed-in tariff; if not, why not; if so, what are the relevant details? NW2578E

    REPLY:

    (1) There was no allocation of R2 billion for renewable energy in the 2007/08 budget. In the 2008 Budget Speech it was announced that

    "We are … setting aside R2 billion over the next three years to support programmes aimed at encouraging more efficient use of electricity, generation from renewable sources, installation of electricity-saving devices and co-generation projects. Intensive work over the next few months is needed to give content to these proposals, so that allocations for this year can be included in an Adjustments Appropriation".

    It should be noted that the amount of R2 billion refers to the MTEF period that it is not limited to renewable energy initiatives and it is not limited to the 2008/09 year. It should also be noted that this supplements existing allocations, such as the R84 million a year available on programme 7 of the Minerals and Energy vote for non-grid electrification. Details of the new allocations for the 2008/09 year were set out in the Adjustments Appropriation tabled in Parliament on 23 October 2008. These include R180 million earmarked for the Compact Flourescent Light (CFLs) bulbs roll-out by Eskom and R20 million allocated to the Department of Public Works (DPW) for retrofitting already-audited government buildings with energy efficiency devices, for which proposals and plans were submitted to National Treasury. Responsibility for implementation and monitoring rests with the departments of Minerals and Energy and Public Works, respectively.

    (2) As is evident from the above, there is no question of "unspent amounts" being available at this stage. It is the Treasury's understanding that questions relating to "feed-in" tariffs applicable to co-generators or other external suppliers to the Eskom grid are currently under review by the National Energy Regulator (NERSA), which has established a Working Group for this purpose. Possible expenditure allocations in support of renewable energy and co-generation projects are currently under consideration. Details of proposed expenditure allocations for future years will be made available in the 2009 Budget. At this stage no decision has been taken on the appropriateness or not of a direct tariff subsidy as part of these financing arrangements.

    1792: Mr M Waters (DA) to ask the Minister of Minerals and Energy:

    (1) Whether any inspectors have visited mining site Witfontein R/33/151R; if not, (a) why not (b) when will this be done; if so, (i) when this was done, (ii) who were the inspectors and (iii) what were the findings;

    (2) Whether any inspection has been conducted to determine whether regulation 17(6) of the Mine Health and Safety Act, Act 29 of 1996, which prohibits mining within a horizontal distance of 100 metres from buildings ,roads railways, reserves, mine boundaries or any structure, is being adhered to; if not why not and when this will be done; if so, what are the relevant details;

    (3) Whether there are any laws or regulations that stipulate the number of inspections that the department should conduct at mining sites each year; if not, what is the position in this regard; if so, what are the relevant details;

    (4) Whether these conditions have been met with regard to Witfontein R/33/151R; if no, why not; if so, what are the relevant details?

    REPLIES

    (1) This mine was last visited on the 20th May 2008 and the inspection report is attached for your convenience and the names of the inspectors listed on the same report.

    (2) Regulation 17 (6) Mine Health and Safety Act, 29 of 1996 has been adhered to in that the nearest operating portion of the mine was situated approximately 150m from other non mining/non-mine neighbouring establishments (see the attached for inspection report), however, the developer of the Glen Erasmia Estate did violate the provisions of the regulation 17 (7) of the Mine Health and Safety Act 29 of 1996, in that structures were erected within 100m from the mine in the question. However rehabilitation of this old mine workings by the mine is in progress.

    (3) The Mine Health and Safety Act, Act 29 of 1996 and Mineral Petroleum Resources Development Act, Act 28 of 2008, which we administer, do not prescribe the number of inspections required. However, the inspections are conducted based on the risk ranking basis. High risk mines/working areas are inspected within six months and low risk mines are inspected within 12 months. The mine/working area in question is classified as low risk.

    (4) As per the answers to the above 1,2,3 questions.

    REPLY:

    The Minister of Transport:

    (1) (a) Johannesburg, Cape Town, Tshwane and Nelson Mandela Bay are well advanced in planning Bus Rapid Transit (BRT) systems (Phase 1 projects), that aim to be operational by May 2010.

    (b) Johannesburg and Tshwane have sufficient funding to commence with a basic Phase 1 system.

    Cape Town started slightly later, but has now made significant strides to gear up to roll out by April 2010. This included a City of Cape Town contribution of over R400m of local funds to the Phase 1 project. Currently the Department of Transport (DoT) and the National Treasury are exploring options for ensuring that funding from the outer years of the Public Transport and Infrastructure Systems Grant is made available to Cape Town in the 2008/09 and 2009/10 financial years in order to ensure implementation by April 2010.

    Nelson Mandela Bay is planning a BRT and at the same time intends to restructure public transport across the entire City. There is a funding shortfall in this regard and the City has been asked to prioritise a core network for 2010. At the same the DoT is in discussions with the National Treasury about increasing the funding allocation to Nelson Mandela Bay.

    (2) (a) The Department of Transport has held a workshop with the national leadership of both the South African National Taxi Council (SANTACO) and the National Taxi Alliance to explain the approach to the BRT system and that there will be no loss of legitimate jobs or profits. The taxi industry and the DoT have committed to holding a summit to discuss this further. This summit will also include the Provinces and Host Cities.

    (b) At the local sphere, Johannesburg is at an advanced stage of negotiations with the incumbent bus and minibus operators. It is expected that an agreement will be reached by February 2009.

    Nelson Mandela Bay has held extensive discussions with the incumbent bus and minibus operators over the past three years. There has been a recent objection from certain operators who feel they have been excluded from the consultations and the City is committed to ensuring a fully inclusive process.

    Tshwane and Cape Town are beginning the initial stages of consulting with the incumbent operators and as such will learn from the experience of Johannesburg and Nelson Mandela Bay and will also be guided by the outcomes of the national summit on the BRT system with the taxi industry.

    (1) Whether, with regard to the cooperation of and collaboration with the United States of America (USA), the Ambassador of the USA to SA has in the past 10 years offered (a) training, (b) funds and (c) support and cooperation or any other form of assistance to the SA Police Service; if so, what was the nature of the offers in respect of (i) rand value, (ii) contents and (iii) purpose;

    (2) whether the SAPS accepted the offers; if not, why not; if so, what are the relevant details?

    REPLY:

    (1) For the past 10 years the United States (US) Embassy has been involved in various training programmes with the South African Police Service (SAPS), following bi-lateral relations between South Africa and the US Government.

    In 1997 the SAPS Detective and Crime Intelligence Academy in Silverton was opened and an Organized Crime programme was presented by the Federal Bureau of Investigation. Other US Government agencies also presented training to the SAPS such as the US Department of Justice, Drug Enforcement Agency, US Service and US Customs.

    The US Department of State, Diplomatic Security, initiated the Anti-Terrorism Assistance Training Program (ATAP) in 1999, which continued until 2003. During this period various training programs were offered to the SAPS. During the period 2003 to 2006, the programme was not seen as a priority in South Africa. SAPS had by that time done most of the courses that were part of the ATAP programme. In 2006 the programme was again offered to SAPS but was declined by the National Commissioner.

    In November 1999, 12 senior managers attended a Senior Crisis Management Course in Louisiana.


    During 2006, the US Embassy provided the SAPS with K9 training for two members for a period of three months in the United States, as well as two Crisis Response Team training courses presented to the SAPS Special Task Force at the SAPS Training Centre in Thabazimbi.

    In addition to the above-mentioned courses, various other courses such as the Crisis Response, Hostage Negotiation, Protection of Vital Installations, Rural Border Patrol, Officer Survival, Explosive Counter Measures, Post Blast Investigations, Canine Detection, Surveillance Detection and three courses on Weapons of Mass Destruction, were presented to members of the SAPS. ( List attached)

    A meeting took place on 22 October 2007, which was attended by representatives from the Division Training, Division Detective Services, Crime Intelligence, the Donor Office and the US Security Attache, in addition to the Programme Manager responsible for the ATAP programme in Washington. The discussions centered around broad needs from SAPS and possible areas of cooperation. From the discussions it is clear that there are several focus areas within the Programme which could support SAPS. Some of the areas mentioned were:

    n Crowd control when an act of terrorism happens

    n Preservation of a crime scene

    n Profiling of extremists

    n Cyber Crime

    n Leadership courses

    n Major events

    n Regional capacity building.

    On 29 May 2008, the annual bilateral forum took place at the residence of the US Ambassador. During this meeting the US indicated its intention to tailor-make training to adapt to the needs of the SAPS in various areas. A follow-up meeting took place between the Divisional Commissioner Training and a delegation from the US Embassy on 20 October 2008 to discuss further training assistance. The two offices agreed to prioritize needs and structure a business plan.

    The Criminal Investigation Course and the Law Enforcement Executive Development Programme that were presented at the International Law Enforcement Academy (ILEA) Academy in Gaborone, Botswana, were not a priority for the SAPS and were subsequently declined by the National Commissioner.

    In 2008 the FBI Academy offered follow-up training to SAPS on Trans-National Crime. Only one officer from the SAPS could attend the session.

    The areas that have been identified for cooperation are all relevant to the situation in South Africa and in the region that the SAPS and its regional counterparts are required to police.

    (i) An accurate rand value of the courses cannot be provided. An estimation of the value is between R 30 and R 40 million.


    (ii), (iii) Attached hereto please find the relevant information pertaining to Anti Terrorism Assistance Training Program Course Summary from 2000 to 2007.

    (1)(a) The Benguela Current Commission (BCC) Agreement was signed by the Ministers of the Republic of South Africa, Namibia and Angola in August 2006. The first Management Board Meeting was held in April 2007 and the first Ministerial Conference held in July 2007.

    (1)(b) The BCC was established to manage transboundary impacts on the Benguela system, such as environmental variations (South Africa's responsibility), migratory fish stocks (Namibia) and pollution threats (Angola).

    (2) The BCC has only recently become operational, with the appointment of the Executive Secretary. Other office-bearers will soon be appointed and thereafter the Commission will be fully operational. The BCC will also only become fully supported after the establishment, early next year, of the second phase of the Benguela Current Large Marine Ecosystem (BCLME) and Norwegian funding for research (around R70 million over 5 years) have been released.

However, the Department of Home Affairs has started with the implementation of its newly approved structure with effect from 01 June 2008 and 809 critical positions were identified for filling.

    (ii) All the critical identified positions (809) are still vacant. A total of 417 vacant positions have already been advertised. Another 476 vacant positions will be advertised soon.

    (b) The Department envisages to fill all remaining vacancies by the end of January 2009.
