Final Mandates (awaited documents)

The Select Committee convened virtually to consider the Final Provincial Mandates on the Climate Change Bill [B9B–2022]. All nine provinces adopted the bill. The Bill was adopted without amendment.

The accompanying report was approved.

In addition, the Committee adopted its report on the Deeds Registries Amendment Bill. The Bill was adopted in the previous meeting.

Meeting report

The Chairperson apologised for meeting in the afternoon instead of at 11:30am as originally scheduled. Most legislatures only sent their final mandates in the morning; hence, the meeting was postponed. It was important to have the mandates from all the provinces.

Ms C Labuschagne (DA, Western Cape) indicated that she would be staying to vote on the two Bills but requested to be excused after 40 minutes to attend another meeting.

The Chairperson could not hear Ms Labuschagne, who then repeated her request to leave early. The Chairperson noted her request.

Final Mandates: Climate Change Bill
Mr Kobus Jooste, Committee Content Advisor, was tasked with reading the final mandates of the provinces into the record except in the cases of the Eastern Cape and Mpumalanga. The respective delegates, Mr Z Mkiva and Mr J Nyambi, preferred to read the final mandates of their provinces.

Eastern Cape
The Eastern Cape Legislature voted in favour of the Bill on 22 April 2024 and mandated the Eastern Cape permanent delegate to the NCOP to do the same.

Free State
The Free State Legislature voted in favour of the Bill on 23 April 2024.

Gauteng
The Gauteng Legislature supported the principle and detail of the Bill and voted in favour of the Bill on 22 April 2024.

KwaZulu-Natal
The KwaZulu-Natal Legislature met on 23 April 2024 and agreed to mandate the provincial delegation to the NCOP to support the Bill.

Limpopo
The Limpopo Legislature voted in favour of the Bill on 19 April 2024.

Mpumalanga
The delegation representing the Mpumalanga province in the NCOP was conferred with the mandate to vote in favour of the Bill on 22 April 2024.

Northern Cape
The Northern Cape Legislature voted in favour of the Bill on 19 April 2024.

North West
The North West Legislature voted in favour of the Bill on 23 April 2024.

Western Cape
On 19 April 2024, the Western Cape Provincial Parliament conferred on the Western Cape delegation in the NCOP, the authority to support the Bill.

Committee Report on the Climate Change Bill
Mr Asgar Bawa, Committee Secretary, read the content of the Committee Report on the Climate Change Bill into the record.
The report was subsequently adopted without amendments.

Adv Thiloshini Gangen, Parliamentary Legal Advisor, thanked the Committee for walking this journey with the legal team. The State Law Advisor, Parliamentary Legal Advisor, and the Department would be cleaning up the numerical inconsistencies in the Bill.

The Chairperson requested Adv Gangen to repeat her statement as she could not hear her clearly the first time. She thanked the legal team for their assistance and acknowledged that it was not an easy task. She also thanked the Deputy Director-General, Mr Kekana, and his team for their contribution in finalising the Bill. The Bill will be presented in the plenary on Thursday, 25 April 2024, as a final step in the process.

Committee Report on the Deeds Registries Amendment Bill
Mr Bawa read the content of the Committee Report on the Deeds Registries Amendment Bill into the record. The report was subsequently adopted without amendments.

Minutes
The Committee adopted the minutes of 16 April 2024 without amendments.

The Chairperson thanked Members for participating in the meeting and congratulated the Committee for adopting the two Bills.
