Trade and Industry on the Broad-Based Black Economic Empowerment Amendment Bill

The Portfolio
Committee on Trade and Industry, having considered the subject of the
Broad-Based
Black Economic Empowerment Amendment Bill
[B 42 2012]
, referred to it
and classified by the Joint Tagging Mechanism (JTM) as a section 76 Bill,
reports the Bill with amendments [B 42A 2012].
The committee
further reports that the Democratic Alliance, the Congress of the People, and
the Freedom Front Plus (FF Plus) objected to the amendments in clause 1(b) only
as it relates to the definition of black people. The FF Plus objected to clause
3 for not including
subject to Section 63 of the Employment Equity Act.
The
following amendments were rejected:
1)
black people refers to historically disadvantaged
persons who:
a)
Are citizens of the
b)
Became citizens of the
i)
Before 27 April 1994; or
ii)
On or after 27 April 1994 and who would have been
entitled to acquire citizenship by naturalisation prior to that date but were
precluded from doing so by Apartheid policies; and
c)
Due to the apartheid policy that had been in place,
did not have the franchise in national elections between 1959 and prior to the
introduction of the Constitution of the Republic of South Africa, 1983 (Act No
110 of 1983) or the Constitution of the Republic of South Africa, 1993 (Act No
200 of 1993) (the Interim Constitution).

To insert the following words after Act in clause
3:
subject
to Section 63 of the Employment Equity Act.
