Report of the Select Committee on Security and Justice on the Repeal of the Transkeian Penal Code Bill [B34-2022] (National Assembly – S75), dated 3 May 2023.

 

The Select Committee on Security and Justice, having deliberated on and considered the subject of the Repeal of the Transkeian Penal Code Bill [B34-2022] (National Assembly – S75), referred to it on 28 February 2023, reports that it has agreed to the Bill without proposed amendments and reports as follows:

 

  1. Background

 

The Repeal of the Transkeian Penal Code Bill [B34-2022] (National Assembly – S75) seeks to—

 

  • repeal the Transkeian Penal Code, 1983;
  • extend the application of certain laws to the area formerly known as the Republic of Transkei;
  • provide for transitional arrangements; and
  • provide for matters connected therewith.

 

  1. Public participation process on Repeal of the Transkeian Penal Code Bill [B34-2022] (National Assembly – S75)

 

The Select Committee on Security and Justice invited stakeholders and interested persons to make written submissions and published the adverts in all official languages on Parliament’s electronic platforms from 1 March 2023 to 17 March 2023.

 

  1. Summary of Submissions:

 

The Committee received no submissions on the Bill.

  

  1. Committee consideration of the Repeal of the Transkeian Penal Code Bill [B34-2022] (National Assembly – S75)

 

The Select Committee received a briefing on the Bill on 22 March 2023. On 19 April 2023, the Select Committee considered the Bill as tabled. On 3 May 2023 the Committee adopted the Bill as referred without proposed amendments. There were no objections or abstentions to the adoption of the Bill. The Committee further adopted the report on the Bill on 3 May 2023, there were no objections or abstentions.

 

  1. Consensus on the Bill

 

The Chairperson put the Bill for consideration: the majority of members supported the Bill. There were no objections or abstentions.

 

  1. Recommendation

 

The Select Committee on Security and Justice, having considered the Repeal of the Transkeian Penal Code Bill [B34-2022] (National Assembly – S75), referred to it on 28 February 2023 and classified by the JTM as a section 75 Bill, recommends the Council pass the Bill without proposed amendments.
