Supplementary Report of the Portfolio Committee on Women, Youth and Persons with Disabilities on filling of vacancies in the Commission for Gender Equality, dated 15 November 2022

 

The Portfolio Committee on Women, Youth and Persons with Disabilities (herein referred after as the Portfolio Committee), in fulfilling its mandate, identified and recommended suitable candidates to fill vacancies in the Commission for Gender Equality (CGE), as per the Commission for Gender Equality Act (No. 39 of 1996) and reports as follows.

 

1. Introduction

 

The Portfolio Committee wishes, with reference to its previous report, dated 26 October 2022, which was adopted by the National Assembly on 1 November 2022, to clarify certain matters contained therein.  

 

The first category of commissioners have to fill the unexpired portion for part-time commissioners, while the other is for full-term commissioners, comprising a mixture of full-time and part-time commissioners.

 

2. Unexpired portion office terms (2 x Part Time Commissioners)

 

i. Mr. Bongani Glenton Ngomane

ii. Ms. Leelambal (Prabashni) Subrayan Naidoo

iii. Ms. Sarah Charity Mokwebo

iv. Ms. Fundiswa Barbara Skweyiya-Gushu

 

The Committee recommends that the President of the Republic immediately appoint two-part-time commissioners from the above list of candidates, as members of the Commission to complete the unexpired terms of office, which had been in existence since February and April 2022 respectively.  The unexpired portion refers to the remainder of the term of office in which the vacancies occurred which runs up to 31 July 2024.

 

3. Full Term – Full-time and Part-time Commissioners

 

i. Adv. Olave Nthabiseng Sepanya-Mogale

ii. Adv. Thando Gumede

iii. Ms. Leonashia Leigh-Ann van der Merwe

iv. Ms. Lindiwe Khonjelwayo

v. Ms. Bernadine Bachar (person with a disability)

vi. Ms. Mulalo Nemataheni

 

The Committee further recommends that the President appoint two candidates on a full-time basis and the other two candidates on a part-time basis for the vacancies that occurred from 31 October 2022.

 

In the event that a vacancy immediately arises due to resignation/ non-acceptance and or death, the President is advised to choose another candidate from the aforementioned lists.

 

Taking into consideration that former Commissioner, Adv. Olave Nthabiseng Sepanya-Mogale, served as a part-time Commissioner, the Committee recommends that Adv. Sepanya-Mogale be appointed as a full-time Commissioner so as to ensure continuity and preservation of institutional memory.

 

The Committee further recommends that Adv. Sepanya-Mogale be considered for the position of the Chairperson of the Commission.
