REPORT OF THE PORTFOLIO COMMITTEE ON COOPERATIVE GOVERNANCE AND TRADITIONAL AFFAIRS ON DETERMINATION OF REMUNERATION OF THE PUBLIC OFFICE BEARERS OF THE CRL RIGHTS COMMISSON, DATED 4 NOVEMBER 2020

 

The Portfolio Committee on Cooperative Governance and Traditional Affairs, having considered the Draft Notice on the Determination of Remuneration of Independent Constitutional Institutions, referred to it on 08 April 2020 reports as follows:

 

  1. BACKGROUND

 

The Speaker of the National Assembly referred to the Committee (ATC 38, 08 April 2020) the draft notice from the President of the Republic of South Africa (dated 26 March 2020) for consideration and report. The latter notified the National Assembly of the President’s determination of the salaries and allowances of members of the Independent Constitutional Institutions, in terms of the Determination of Remuneration of Office-Bearers of Independent Constitutional Institutions Laws Amendment Act, 2014 (Act No. 22 of 2014).

 

  1. CONTEXT

 

Section 14(1) of the Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Communities Act 19 of 2002, provides that Chairperson, Deputy Chairperson and other members of the Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Communities are entitled to annual salaries and such allowances, or benefits as determined by the President, from time to time, by notice in the Gazette, approved by the National Assembly.

 

The Independent Commission for the Remuneration of Public Office Bearers recommended to the President a 3 percent annual salary increment for all office bearers of the Independent Constitutional Institutions earning above R1.5m, and 4 percent salary/allowance increment for office bearers earning below R1.5m, with effect from 01 April 2019. Taking into consideration the economic challenges the country is experiencing, as well as the current fiscal constraints, the President proposed alternative recommendation as follows:

 

  • Salary freeze (0%) for office bearers earning R1.5 million and above;
  • 2.8% salary adjustment for office bearers earning between R1 million and R1.5 million; and
  • 4.5% salary adjustment for office bearers earning below R1 million.  

 

  1. COMMITTEE CONSIDERATION

 

Having considered the above, the Portfolio Committee on Cooperative Governance and Traditional Affairssupports and approves the intended Determination by the President of the Republic, in relation to the public office bearers of the Commission for the Promotion and Protection of the Rights of Cultural, Religious and Linguistic Communities.
