The Portfolio Committee on Police, having considered its Strategic Plan: 2012, reports the plan as follows:

STRATEGIC PLAN: 2012
VISION
A Portfolio Committee that is responsive to the needs and views of the people and that is driven by the ideal of exercising its constitutional powers in a manner that is effective, efficient and sustainable in order to ensure a secure, peaceful and safe South Africa .
MISSION
Guided by our interest in promoting effective, efficient and professional policing in South Africa and our desire to see a reduction in crime, our mission is to represent and act as a voice of the people in fulfilling the constitutional function of:
· Passing legislation,
· Scrutinizing and overseeing executive action and organs of state such as the Department of Police, Civilian Secretariat for Police, Independent Police Investigating Directorate , and the Private Security Industry Regulatory Authority,
· Facilitating public participation and involvement in the legislative and other processes, and
· Engaging, participating and overseeing international treaties and protocols.

CORE OBJECTIVES
CORE OBJECTIVE 1:
To pass laws
· The Committee will pass Bills that will be introduced by the Executive, initiated by the Portfolio Committee or by individual Members of Parliament
· In terms of the Constitution the Committee will deal with Section 75 Bills (ordinary Bills not affecting provinces) and Section 76 Bills (ordinary Bills affecting provinces)
CORE OBJECTIVE 2:
Scrutinize and oversee Executive actions and organs of State
The Committee will use different mechanisms to oversee the executive actions such as:
· Committee Meetings
· Debates in Plenary
· Submit questions in the National Assembly for oral or written reply
· Oversight visits announced and/or unannounced
· Public Hearings
CORE OBJECTIVE 3:
Facilitate Public Participation and involvement
Public participation in the work of the Committee will be by means of:
· Public Hearings inside and outside parliament
· Invitation of written submissions on topical matters and legislation
· Involvement of organizations and entities
CORE OBJECTIVE 4:
To engage, participate and oversee International relations
In participating in international relations and related issues the Committee will:
· Meet with delegations from other countries and interact with parliamentary counterparts visiting South Africa
· Undertake International visits to learn from best practices in other countries
· Process treaties and protocols

To promote cooperation
The Committee will play a role in promoting cooperation between:

KEY ISSUES FACING THE COMMITTEE
Legislation that will be referred to the PC on Police during 2012
Priorities:
- Amendments to the SAPS Act relating to the Directorate for Priority Crime Investigation (DPCI)- 1 March 2012 (Has been tabled)
- Private Security Industry Regulatory Authority Bill- April 2012
- Dangerous Weapons Bill- April 2012
- Amendments to the Firearms Control Act- May 2012
Other:
- Criminal Law (Forensic Procedures) Amendment Bill Part Two (DNA)- No information available to date (but policy to be completed first)
- White Paper on Policing- No new date given but must be before tabling of the SAPS Bill projected for August 2012.
- South African Police Service Bill- after completion of the White Paper process (will probably be considered by Committee in 2013)
While it may not be possible to complete all Bills during 2012, it is essential that they are tabled during this period. Once the Bills are tabled they will be included in the programme.

Regulations, National Instructions and Proclamations
· Regulations to the Independent Police Investigative Directorate- must be submitted to Parliament and scrutinised before promulgation
· Regulations to the Firearms Control Act- no new date given
· Regulations to the Civilian Secretariat for Police Service Act- must be submitted to Parliament for notification before promulgation no date
· Regulations to the Second Hand Goods Act no date
· SAPS National Instructions/Standing operating procedures in terms of section 15C and 15D of the Criminal Law (Forensic Procedures) Amendment Act: must be completed within 6 months after commencement of these Sections. Do not need to be referred to Parliament.
· Proclamations on the Protection of Constitutional Democracy against Terrorist and Related Activities Act, 2004 (every 6 months).

Oversight
1. Intersectoral
- Assess implementation of the Integrated Justice System and the Criminal Justice System Revamp. A meeting will be held by the PC on Police where SAPS will be called to report on progress. Other departments in the CJS will also be invited. The Chairpersons of the other relevant committees will be informed. A meeting at the Peace and Security Cluster level will also be arranged.
- Parliaments oversight over implementation of the Domestic Violence Act- (Report outstanding)
2. SAPS
A decision has been made to limit the focus of the Committee to 3 main issues in 2012/13 but to ensure that oversight over these areas is intensive. These are:
· Training- Basic and specialised: While the focus will be on basic training (as the core of development) attention will also be given to specialised training. In order to assist the members in their oversight function and to ensure that they are capacitated on their proposed Study Tour, a 2-day workshop on training will be organised by the Committee. Stakeholders to be invited include experts in the NGO and academic community, international experts from countries with best practice training including the Netherlands (to be invited through the embassies), trainers from the academies, and selective field trainers from the nine provinces. A working team will be established to facilitate this process. It is suggested that the workshop take place at a training institution and that it includes an oversight visit of the/a basic training facility. The Committee will develop a Monitoring Tool for assessment of training academies.
· Detective environment: Assess functioning of detectives in terms of numbers, resources, training, retention, performance, relationship to other crime intelligence, forensics, crime scene investigators; assess performance and achievement of targets by the DPCI; assess functioning of the selective specialised units including Family, Child and Sexual Offences Units( FCS).
· Building environment: The Committee has overseen the building environment within SAPS and has already identified critical problems. However, despite assurances of intervention, the crisis seems to have increased. Thus further oversight is required. This focus does not preclude oversight over a number of other key areas involving resources including the Technology Services Management environment. The Minister will be called to respond to issues arising from the budget/strategic plan hearings including serious problem with infrastructure spending. The Department will be expected to present a plan to address this and other concerns.
In addition, in terms of Oversight of service delivery at station level: Provinces that were outstanding for oversight for 2012 include:
· Limpopo
· North West
· Northern Cape and
· Free State
· Eastern Cape
The Committee has already visited Limpopo (January 2012) and has scheduled to visit North West in March 2012. Northern Cape and Free State will be put on the programme for end July 2012. Eastern Cape will need to be visited in 2013.
3. Secretariat of Police
· Monitor implementation and rollout of new legislation by the Civilian Secretariat of Police
· Monitor budget including Secretariat presentation to National Treasury on budget requirements for 2012/13.
· Monitor, oversee and assess the Secretariats achievement of targets
· Scrutinise Domestic Violence Reports
· Receive briefings on the state of policing in terms of the monitoring of police performance by the Secretariat. This includes briefings on the outcome of their station visits.
The Secretariat should be asked to brief the Committee on specific issues that they have oversight over, when these are on the Committee programme. They should therefore be invited to all relevant Committee meetings and will be asked to prepare inputs.
4. IPID
· Monitor implementation and rollout of new legislation by the IPID
· Scrutinise Domestic Violence Reports (until function is transferred to Secretariat)
· Monitor, oversee and assess the IPID achievement of targets including the reduction of backlogs
· Scrutinise ICD Business Plan and costing document for implementation of IPID Act
· Monitor budget including IPID presentation to National Treasury on budget requirements for 2012/13.
· Oversight visit to the IPID head office.
· Receive briefing on their assessment of their state of policing, in terms of their areas of responsibilities.
4. PSIRA
· Assess functioning of the PSIRA and progress taken to address challenges
· Monitor, oversee and assess PSIRA achievement of targets
· Oversight visit to PSIRA training institutions to assess quality of training programmes. An oversight visit to PSIRA head office and training body will be coordinated with scrutiny of the PSIR Bill when it is tabled and considered by the Committee.
Improve Cooperation
· Improved cooperation with Select Committee, MECs and Parliamentary Committees in the National Assembly and National Council of Provinces
Administrative Support
In order to achieve its core objectives, the Committee will be provided with research, legal and administrative support.
· Utilisation of Recommendation Tracking Tool (RTT)
o Noting, tracking and follow up of Recommendations
- Committee minutes of meetings to be adopted by the Committee on a weekly basis i.e. the minutes of the previous week to be adopted the following week. Committee minutes must all include a section on:
· Outstanding information requested
· Recommendations made by the Committee
- Committee Secretary to alert Departments one week before deadline that the information must be submitted.
- All deadlines already missed must be noted and new deadlines given to the Department.
- The Committee will report in written form annually on all recommendations made by the Committee, including a report on deadlines missed by the Department.
- This report will be submitted to Parliament and to the Minister of Police.
o Research Unit to scrutinise responses to recommendations to ensure that consistent and to assess whether follow up is required.
o Research Unit to summarise responses. All responses must therefore be sent to the researchers as soon as they are received.
· Develop and maintain electronic diary of meetings and deadlines for Members and support staff.
· Briefings by researchers: Researchers will be expected to brief the Committee a half an hour before each scheduled meeting begins (where no separate briefing sessions are arranged).
· Receipt of Departmental briefing documents: All presentations should be submitted to Parliament 10 days prior to the scheduled meeting. The Committee Secretary will send out letters to the departments at the beginning of each term/end of the last term identifying the dates and topics of the meetings and deadlines for the submission of the information.
· BRRR: Researchers must begin inserting information and recommendations into the BRRR reports throughout the year.
· Monitor progress with the Strategic Plan: Progress in attaining the goals of the Strategic Plan of the Committee must be monitored throughout the year.
