SUMMARY
The Committee met to hear final provincial mandates on Choice on Termination of Pregnancy and Sterilisation Amendment Bills. The Department of Health outlined amendments proposed by the Committee and Members agreed to the Bills on a clause by clause basis.

Sterilisation Amendment Bill
Mr Motsapi (Legal Advisor-Department of Health) reminded the Committee of proposed amendments to be considered. Amendments would occur in clause 2(C)(ii) and clause 3(b)(viii).

Mpumalanga
The Bill was supported without further amendments.

Kwa-Zulu-Natal
The Bill was supported on condition that the proposed amendments of the Committee were included in the final Bill.

Eastern Cape
The Bill was supported without further amendments.

Limpopo
The Bill was supported without further amendments.

Western Cape
The Bill was supported without further amendments.

Free State
The Bill was supported without further amendments.

North West
The Bill was supported without further amendments.

Gauteng
The Bill was supported without further amendments.

The Members agreed to all the proposed amendments without discussion and the Bill was accepted.

Choice on Termination of Pregnancy Amendment Bill
Mr Motsapi stated that one amendment had been proposed to clause 6(d) where "or not contemplated in section 3(3)(a)" would be inserted after "3(1)".

The Chairperson asked for final mandates.

Free State
Mr C Van Rooyen (ANC) expressed the province's dissatisfaction over the lack of opportunity provided to publish the proposed amendments in order to allow meaningful public discussion. The Bill was supported without amendments.

Mr B Tolo (ANC) stated that the concerns regarding the publishing of amendments were issues introduced by the State Law Advisors and not by Members or provincial committees. The Committee should consider political mandates and not be hampered by regulatory matters. The matter in question would be discussed with the Free State provincial committee in due course.
