Today, the Powers and Privileges Committee adopted two reports on the incident that occurred on 30 August 2022 and on the matter of Mr Mosebenzi Zwane.
 
The Committee adopted the Report on the incident that occurred on 30 August 2022 during the oral questions to the President at a sitting of the National Assembly, where four Members of Parliament disregarded the authority of the Chair and caused serious disruption in the House and refused to leave the House when directed to do so by the Speaker.  Mr Khanya Ceza and Mr Nazier Paulsen were found guilty of contempt of Parliament. The penalty levelled against them includes a calendar month suspension without pay, with effect from 1 March 2024.
 
The Committee also adopted the Report on the matter of Mr Mosebenzi Zwane, who, on two occasions, failed to make an apology in the House. Mr Zwane was also found guilty of contempt of Parliament. He was ordered to enter an apology in the House no later than the end of March 2024. His penalty was the reduction of half of his monthly remuneration, effective from 1 March 2024.

Report of the Powers and Privileges Committee into allegations of conduct constituting contempt of Parliament by members of the National Assembly during Oral Questions to the President on Tuesday, 30 August 2022

The Report was presented for consideration by the Committee.

In light of its findings of guilt against the two affected members, the Committee, with the exception of Dr Ndlozi who dissented, recommends that the National Assembly impose the following penalties with respect to the two affected members:

  1. An order to apologise in person in the House to the President, the Speaker and the people of South Africa as determined by the House as set out in section 12(5)(c) of the Act; and
  2. Suspension of the members without remuneration for a period of 30 days, whether or not the House or any of its committees is scheduled to meet during that period starting from 1 to 31 March 2024 as set out in section 12(5)(g) read with section 12(9) of the Act.

Report of the Powers and Privileges Committee into allegations of conduct constituting contempt of Parliament by Mr M J Zwane, MP

The Report was presented for consideration by the Committee.

The Committee recommended that:

Considering its findings of guilt against Mr Zwane, the Committee recommends that the National Assembly impose the following penalties:

a) An order to enter the apology in the House as was agreed by the House on 2 May 2023; and

b) Reduction of half of his remuneration effective from 1 March 2024 as set out in section 12 (5) (f) of the Act.
