Meeting Summary

The Committee was briefed on the three Select Committee proposed amendments. There was no discussion on these. As there was no quorum, the meeting ended without going through the clauses. The clause by clause finalisation of the Bill will take place on 24 October 2018.
 

Meeting report

The Chairperson welcomed the FPB Council Deputy Chairperson, Ms Modjadji Mangena, accompanied by Ms Abongile Mashele, Chief Operating Officer and  Mr Pandelis Gregoriou, Legal and Regulatory Affairs Manager. Also attending were two Department of Communications representatives, Freedom of Religion SA and Cause for Justice.

Ms Phumelele Ngema, Parliamentary Legal Adviser, went through the C List which contained the three Select Committee proposed amendments.

She noted that the Committee at the 15 August briefing meeting had expressed concern about the qualifications and extensive experience necessary for one to be a member of the Enforcement Committee. A proposed amendment to Clause 6 was therefore to remove Section 6A(3) which had these provisions. Instead, an amendment to Section 6A(1) would stipulate only that the Enforcement Committee chairperson should be a retired judge.

The final proposed amendment was to Clause 12 which added: "All monies lawfully acquired by the Board in the performance of its functions must be utilised to achieve the objects of this Act" as Section 13(1A).

Discussion
Ms C Labuschagne (DA, Western Cape), stated that she needed clarity on Clause 12.

Ms Ngema went over what she had said.

The Chairperson asked if the other legal advisors had anything to add.

Adv Mongameli Kweta, State Law Advisor, said that he had nothing to add at this stage.

The Chairperson noted that at this meeting they were supposed to have put each clause to the Committee but they did not have a quorum. There was no other option but to adjourn the meeting. The next meeting would be held on 24 October where they would do a clause by clause finalisation.
