The SA Law Reform Commission has published a discussion paper entitled ‘Review of Aspects of Matrimonial Property Law’ and is asking you to comment.
The document, published on the SALRC website, notes that the Matrimonial Property Act is almost 40 years old. In this time, SA has undergone significant social change. In light of the significant social change, and to ensure that section 9 of the Constitution is realised in the relationship sphere, this discussion paper makes a variety of proposals. These proposals are made to ensure that legislation around matrimonial property distribution is not discriminatory on the basis of, among others, sex, gender, sexual orientation, race, religion and marital status.
