Report of the Portfolio Committee on Justice and Constitutional Development on the draft notice and schedule determining the rate, with effect from 1 April 2023, at which salaries, allowances and benefits are payable to magistrates annually, for approval by Parliament in terms of section 12(1) of the Magistrates Act, 1993 (Act No 90 of 1993), dated 11 September 2024.

 

The Portfolio Committee on Justice and Constitutional Development, having considered the draft notice and schedule determining the rate, with effect from 1 April 2023, at which salaries, allowances and benefits are payable to magistrates annually, reports as follows.

 

  1. The Committee notes that the Independent Commission for the Remuneration of Public Office Bearers (Independent Commission) recommended a 3% increase for all public office bearers, including magistrates, for the 2023/24 financial year. 

 

  1. In arriving at the annual remuneration recommendations for the 2023/24 financial year, the Independent Commission considered the following, among others:
  • The affordability of different levels of remuneration of public office-bearers.
  • The available state resources.
  • Public service remuneration levels.
  • The role, status, duties, functions and responsibilities of the office-bearers concerned.

 

  1. The Committee notes that the President proposed a salary increment of 3% with effect from 1 April 2023, having considered the Independent Commission’s recommendations and the serious economic situation of the country.

 

Recommendation

  1. The Committee, having considered the draft notice and schedule determining the rate, with effect from 1 April 2023, at which salaries, allowances and benefits are payable to magistrates annually, recommends that the National Assembly approves the draft notice and schedule.
