Supplementary Report of the Portfolio Committee on Women, Youth and Persons with Disabilities to identify suitable candidates for the filling of vacancies in the Commission for Gender Equality dated, 15 November 2022

 

The Portfolio Committee on Women, Youth and Persons with Disabilities (herein referred after as the Committee) in fulfilling its Constitutional mandate identified and recommended suitable candidates for the filling of vacancies of commissioners in the Commission for Gender Equality (CGE), as per the Commission for Gender Equality Act No. 39 of 1996, reports as follows:

 

1. Introduction

 

The Portfolio Committee on Women, Youth and Persons with Disabilities wishes to express the following clarification with reference to its Report dated 26 October 2022, which was tabled and adopted by the National Assembly on 1 November 2022.  The first category of commissioners have to fill the unexpired portion for part-timers and the other is for full-term commissioners comprising of a mixture of full-time and part-timers.

 

1. Unexpired portion office terms (2 x Part Time Commissioners)

 

i. Mr. Bongani Glenton Ngomane

ii. Ms. Leelambal (Prabashni) Subrayan Naidoo

iii. Ms. Sarah Charity Mokwebo

iv. Ms. Fundiswa Barbara Skweyiya-Gushu

 

The Committee recommends to the President to appoint 2-part time commissioners from the above list of candidates immediately as members of the Commission to complete the unexpired terms of office, which had been in existence since February and April 2022.  The unexpired portion refers to the remainder of the term of office in which the vacancy occurred which runs up to 31 July 2024.

 

 

 

 

 

2. Full Term – Full-time and Part-time Commissioners

 

i. Adv. Olave Nthabiseng Sepanya-Mogale

ii. Adv. Thando Gumede

iii. Ms. Leonashia Leigh-Ann van der Merwe

iv. Ms. Lindiwe Khonjelwayo

v. Ms. Bernadine Bachar (person with a disability)

vi. Ms. Mulalo Nemataheni

 

The Committee further recommends that the President to appoint 2 candidates on full-time basis and the other 2 candidates on a part-time basis for the vacancies that occurred on the 31st October 2022.

 

In the event that a vacancy immediately arises due to resignation/ non acceptance and or death, the President is advised to choose from the aforementioned lists the next available candidates.

 

Taking into consideration that former Commissioner Adv. Olave Nthabiseng Sepanya-Mogale who served as a part-time Commissioner, the Committee recommends that Adv. Mogale be appointed as a full time Commissioner so as to ensure continuity and preservation of institutional memory.

 

The Committee further recommends that Adv. Olave Nthabiseng Sepanya-Mogale be considered for the position of the Chairperson of the Commission for Gender Equality.
