Report of the Portfolio Committee on Employment and Labour on the Compensation for Occupational Injuries and Diseases Amendment Bill [B 21B – 2020], dated 31 August 2022:

 

The Portfolio Committee on Employment and Labour, having considered the Compensation for Occupational Injuries and Diseases Amendment Bill [B 21B-2020] (National Assembly – sec 75) and the proposed amendments of the National Council of Provinces (Announcements, Tablings and Committee Reports, 23 March 2022, p101), referred to the committee, reports the Bill with amendments [B 21C – 2020].

 

  1. Process followed by the Committee on the NCOP’s proposed amendments on Compensation for Occupational Injuries and Diseases Amendment Bill

 

 

  1. The NCOP passed the Bill on 17 May 2022, subject to proposed amendments.

 

  1. The Bill was returned to Assembly and referred to the Portfolio Committee on Employment and Labour for consideration of the Council’s proposed amendments (Announcements, Tablings and Committee Reports, No.72 of 17 May 2022)

 

  1. On 24 August 2022, the Committee received a briefing from the Department of Employment and Labour on the proposed amendments. The Committee deliberated and agreed on the proposed amendments, as follows:

 

CLAUSE 39

  1. On page 15, in line 51, after "least" to omit "[30] 60" and to substitute "60".

 

CLAUSE 43

  1. On page 16, in line 52, to omit "2021" and to substitute "2022".

 

CLAUSE 63

  1. On page 24, in line 26, after "Domestic", to omit "workers" and to substitute "employees".
  2. On page 24, in line 28, after “Act,” to omit "2021" and to substitute "2022".

 

CLAUSE 64

  1. On page 24, in line 34, after “Act,”, to omit “2021” and to substitute “2022”.

 

B.      Minority views

 

The Democratic Alliance, although agreeing to the above proposed amendments, reiterated its original objection to the entire Bill.

 

C.         Recommendation

The Portfolio Committee on Employment and Labour recommends that the House passes the Bill with amendments.
