Report of the Portfolio Committee on Justice and Correctional Services on Draft regulations made in terms of section 23(1) of Legal Aid South Africa Act, 2014 (Act No. 39 of 2014), tabled in terms of section 23 (2) of the Act, dated 13 February 2019:
 

The Portfolio Committee on Justice and Correctional Services, having considered the Draft Regulations made in terms of section 23(1) of Legal Aid South Africa Act, 2014 (Act No. 39 of 2014), recommends that the National Assembly approves the Regulations.

 

The Committee further reports as follows:

 

1. The Regulations to the Legal Aid SA Act 39 of 2014 (the Act) came into operation on the 22 August 2017.

 

1. The Committee, when considering the approval of the Regulations during 2017, requested the Minister to consider a review of the means test.

 

1. Consequently, Legal Aid SA considered the impact of inflation on the appropriateness of the current means test and recommended an increase on the means test.

 

1. The Committee is of the view that the revised means test will further increase access to justice for poor people.
