Report of the Select Committee on Communications and Public Enterprises on the Protection, Promotion, Development and Management of Indigenous Knowledge Bill [B 6B-2016], dated 22 August 2018 
 

The Select Committee on Communications and Public Enterprises, having considered the Protection, Promotion, Development and Management of Indigenous Knowledge Bill [B 6B-2016], referred to it, reports that it has agreed to the Bill without amendments.

 

1. Process followed by the Committee

 

The Protection, Promotion, Development and Management of Indigenous Knowledge Bill was referred to the Select Committee on Communications and Public Enterprises on 14 November 2017. 

 

The Committee received a briefing from the Department of Science and Technology on 25 April 2018.  The Committee, acting in accordance with its constitutional obligation to facilitate public participation, invited interested parties to submit written comments on the Bill.

 

The Committee advertised the Bill on 16 March inviting all interested stakeholders to submit written submissions, and requesting them to indicate whether they would like to make oral submissions to the Committee or not.  The invitation was advertised over a period of two weeks, from 23 March to 6 April 2018 in national and regional newspapers, in all eleven languages as well as on the parliamentary website.

 

The Committee received five submissions, which were considered on 16 May 2018.  None of the written submissions needed further oral submissions. 

 

The Committee’s Permanent Delegates also went to their respective provinces to brief the relevant Portfolio Committees, as this was a section 76 piece of legislation.  Briefings were done in all nine provinces. Negotiating mandates were received from all nine provinces. 

 

2. Final mandates

Final mandates were received from the following provinces and were discussed during the committee meeting held on 22 August 2018: Eastern Cape, Free State, Gauteng, KwaZulu-Natal, Limpopo, Mpumalanga, Northern Cape and Western Cape. The North West did not submit its final mandate to the Committee.
