REPORT OF THE PORTFOLIO COMMITTEE ON INTERNATIONAL RELATIONS AND COOPERATION ON THE ACCESSION TO THE REVISED COTONOU PARTNERSHIP AGREEMENT: AGREEMENT AMENDING THE PARTNERSHIP AGREEMENT BETWEEN THE MEMBERS OF THE AFRICAN, CARIBBEAN AND PACIFIC GROUP OF STATES, OF THE ONE PART, AND THE EUROPEAN COMMUNITY AND ITS MEMBERSTATES, OF THE OTHER PART, DATED 10 NOVEMBER 2009:

 

The Portfolio Committee on International Relations and Cooperation, having considered the request for approval by Parliament of the Accession to the revised Cotonou Partnership agreement: Agreement Amending the Partnership Agreement between the Members of the African, Caribbean and Pacific Group of States, of the one part, and the European Community and its Member States, of the other part, referred to it, recommends that the House, in terms of section 231(2) of the Constitution, approve the said Agreement.

 

The Committee would, however, like to register the following reservations:

 

·         The inclusion of the provisions of Article 11 of the Revised Agreement regarding the fight against terrorism, cooperation in countering proliferation of arms and Weapons of Mass Destruction and the International Criminal Court. It is the considered view of the Committee that the provisions of this Article do not fully link non-proliferation, disarmament and Weapons of Mass Destruction issues as well as a new oversight body.

 

·         The Committee would like to point out that the indication to be bound by the provisions of this Agreement, should not be construed to mean that South Africa is foregoing its principled stand on and its right to continue dialogue with regard to the processes and substantial matters around the emergence of the Economic Partnership Agreements (EPAs).
