QUESTION NO 1225 ( 347 ) NW1564E: Dr P J Rabie (DA) to ask the Minister of Labour:

(1) Whether his department has formulated a policy regarding labour brokers; if not, why not; if so, what are the relevant details;

(2) how would this position correspond with the State's response to the economic crisis in light of the fact that the automotive, clothing and textile industries that make use of labour brokers?

Minister of Labour replied:

1. The Department of Labour is in the process of formulating policy on the issue of labour broking. Discussions have concluded on the matter in NEDLAC and the Department is in the process of drafting a bill that will be tabled in Parliament during the course of 2010. As the Honourable member will know, the Parliamentary Portfolio Committee on Labour is also conducting public hearings on labour broking and will report to Parliament when the hearings have been concluded.

2. The Framework for South Africa's response to the international economic crisis makes reference to an agreement between the social partners that labour broking will be discussed in NEDLAC with a view to addressing concerns raised. As mentioned above, these discussions have taken place and the legislative amendments that will be tabled would apply to all sectors where labour brokers operate.


Question 1224

Dr P J Rabie (DA) to ask the Minister of Trade and Industry:

What costs were incurred by his department for the farewell function that was recently arranged for a certain person (name furnished)? NW1563E

Response:

The farewell function was for five (5) directors, including Ms Wendy Luhabe, whose terms of office on the IDC board were ending. The function was held on 11 September 2008 (before my term of office) at the IDC, and was funded by the IDC, not the dti. The function was attended by 120 people and the total cost for it, including vat, was R447 252.00.

Dr P J Rabie (DA) to ask the Minister of Economic Development:

Whether a time-frame for the implementation of the State's response to the economic crisis has been formulated; if not, why not; if so, what are the relevant details? NW1562E

REPLY

The response package consists of a number of different components. Each of these has its own timeframes. Two processes are taking place in parallel: while priorities where programmes have been agreed are being implemented, discussions are taking place in expanding the list of programmes.

For the initial list of priorities announced in parliament on 20 August 2009, the following details are relevant:

(a) The training layoff: the scheme is being launched in pilot form during September 2009. The first applications have now been received and are being processed. Subject to the progress made in the pilot phase, it is expected to be fully operational by November 2009.

(b) The IDC R6b Fund: this has been implemented and a number of applications have been approved and details were provided to the National Assembly on 20 August 2009. The IDC continues to receive more applications and will consider these on a case by case basis during the remainder of 2009 and during 2010.

(c) Distressed sector interventions: the non-fiscal components of the programmes are in the process of being implemented and those components requiring budget allocations will be dealt with through the Adjustment process. Subject to the outcome of the Adjustment process, it is planned that most of the programmes agreed to date will be implemented during the next two months.

(d) Customs fraud: the identified action is being implemented and prosecutions have been initiated in a number of cases. Details of the state of the process were provided in the Statement to the National Assembly made on 20 August 2009.

(e) Competition investigations in the food supply chain: the investigations have all commenced and some prosecutions have been initiated. Each area of the supply chain is at a different stage of progress.

(f) Debt management: Engagements with the banks are continuing. Banks reported to Nedlac that they have started implementing various measures to assist consumers in distress and these reportedly include increasing bridging loans, debt rescheduling, debt factoring, converting debt into equity and interbank lending guarantees.

In addition, as new areas of the Framework are finalised, they will have their specific time-frames for implementation. Details of these will be supplied to Parliament.

Whether her department intends establishing a physical science syllabus more aligned with engineering for learners who are interested in a technical field of study; if not, why not; if so, what are the relevant details? NW1561E

REPLY:

No, the Department is not aware of any factors that require a change in the Physical Science Curriculum. The Subject Statement for Physical Sciences in the National Curriculum Statement (NCS) specifies the standards of knowledge and skills in science to be achieved at each grade. The content is organized around six core knowledge areas which would prepare learners to follow further studies in both the pure and applied sciences, like engineering, medicine, etc. The curriculum provides learners with the opportunity obtain a good foundation in scientific knowledge, skills and processes that is necessary for further studies in both the pure and applied sciences career pathways.

There is no need to change the curriculum for Physical Science at this stage.

(1) (a) What is the full amount collected by the Road Traffic Management Corporation (RTMC) in respect of the R30 transaction fee since inception up to the latest specified date for which information is available, (b) how much has been transferred back to his department in accordance with Treasury instructions, (c)(i) how much was used internally and (ii) why was it used internally and (d)(i) what is the estimated amount of transaction fees that the RTMC has failed to collect from the relevant authorities and (ii) what were the reasons for not collecting these fees;

(2) what are the reasons for the proposed transaction fee increasing to R36 with effect from 1 October 2009?

The Minister of Transport:

(1) (a) The transaction fees came into operation since June 2007. The total transaction fees collected by the Road Traffic Management Corporation (RTMC) since inception and up to 30 November 2009 amounted to R606, 598,176. The transaction fees were collected as follows:-

(c) (ii) The decision by the RTMC to utilize the transaction fees was taken unilaterally by the RTMC in contradiction to a letter written in March 2007 by the former Minister of Finance and addressed to the former Minister of Transport in which it is stated that "revenue generated through the transaction fees are earmarked for eNaTIS operations and maintenance and any surplus collected will have to be paid into the National Revenue Fund." The utilisation of the transaction fees by the RTMC is also a direct contravention of National Treasury Practise Note 10 of 2007/08, which states that "the Road Traffic Management Corporation must transfer all funds received from Provincial Departments of Transport to the National Department of Transport."

Various meetings have been held with the RTMC to address this situation. The RTMC has undertaken to pay the outstanding amount to the Department of Transport.

(d) (i) The amount that remains outstanding as at the end of August 2009 is R87,772,202. The outstanding amount is arrived at as follows:-

(ii) The RTMC did not have the capacity to collect the fees and subsequently the RTMC appointed an official to maximise collection on transaction fees. The average collection rate since inception is 86% and efforts are being made to collect all outstanding revenue.

(2) The 20% increase from R30-00 to R36-00 in October 2009 is deemed reasonable to absorb the cost of the transaction on registration of a motor vehicle on the eNaTIS system. The increase was approved and gazetted.

(1) Whether she will consider revising or changing the current Morkel model used to determine the number of educators allocated per school; if not, why not; if so, (a) how will it be revised and (b) when will a revised model be in place;

(2) whether she will consider giving relief to principals and School Management Team (SMT) members so that they will have free periods to allow them to complete the increasing amount of administrative work expected of them; if not, why not; if so, what are the relevant details? NW1559E

REPLY:

(1) The current post distribution model, that the member refers to as the "Morkel model", is merely a tool to distribute posts to schools, given an available budget. The available budget is appropriated via the Provincial Legislature.

Yes, I am in the process of considering an alternative model –

(a) which will distribute posts according to actual class size per grade per subject; the size of the school; curriculum requirements with regard to learner contact time per week, per phase per subject; language needs per grade; ensure that each phase has a post irrespective of the number of learners and lastly that schools serving the poorest learners are allocated proportionally more posts.

(b) Currently the model is being piloted to determine its impact on the current system as well as its financial implications.

The Council of Education Ministers (CEM), will in their meeting of 1 and 2 October 2009 consider a report on the testing of the model and consider recommendations on the outcomes made to it by the Heads of Education Committee (HEDCOM).

(2) The draft revised model will provide for the Principal of a school to be relieved from teaching, however the option to teach or not will be left to the individual Principal concerned. As for the remaining members of management, they will still be required to teach the required number of hours. If the post allocation to a school is managed correctly on the timetable of a school, then sufficient time could be made available for administrative duties.

(1) Whether the Offender Rehabilitation Path (ORP) is operating and functioning in Leeuwkop Medium C facility; if not, (a) why not, (b) who is responsible for its implementation and (c) how are inmates (i) prepared, (ii) monitored and (iii) evaluated for parole; if so, what are the relevant details;

(2) Whether the ORP will be implemented in this facility; if not, why no; if so, (a) when, (b)what resources are directed to the ORP, (c) how many staff members are dedicated to this function, (d) who is responsible for ORP in this facility and (e) how many inmates have been prepared and evaluated in accordance with ORP in each of the past three years?

RESPONSE

1. The offender rehabilitation path is operating and operational in this Centre.

There are several functionaries responsible for its implementation, namely the four (4) Case administration clerks, four (4) nurses, four (4) unit managers and sixteen (16) Case officers, three (3) educationists, three (3) social workers, one (1) spiritual Clerk, one (1) sport and recreation officer, and eight officials in the case management committee as well as non-governmental organizations [Khulisa, Alcoholic Anonymous AA, Pillar to Post and IThemba] and community based organizations that volunteer their services.

2. Offenders upon admission in the centre are assessed by means of an admission risk assessment form, the comprehensive risk/needs assessment form, profile assessment form, sentence plan, sentence plan revision framework and relevant therapy assessment tools.

3. Offenders are subjected to development and rehabilitation programmes (Drug Awareness 198 offenders, Life Skills 138 offenders, Way to Happiness 341 offenders, Prison Smart 136 offenders, HIV Programmes 248 offenders, 12 Steps Narcotics Awareness 71 offenders, Orientation 576 offenders, Sexual Offender Programmes 33 offenders, Anger Management 73 offenders, Alternative to Violence 264, Restorative Justice 15, Heart Lines 55] and projects in order to address offending behavior.

They are monitored during this process by the case review team with the intervention of the case management committee as well as other relevant stakeholders to determine further needs for intervention and preparation for placement on parole.

4. Between 2006 and 2007 prior to the full introduction of ORP, the centre was running rehabilitation programmes such as Spiritual Care, Educational, Health and Social Work programmes. Since ORP was implemented in 2007, correctional officers had to be capacitated, and as a result this centre has subjected eight hundred and ninety four (894) offenders between January 2008 to date to Correctional Supervision and Parole Board (CSPB) for consideration for placement on parole, and they have been successfully placed out.

(a) The Deputy Minister inherited a Mercedes-Benz E350, 2006 model from the previous Deputy Minister. The mileage was 150 228km. In terms of Chapter 5, section 1.2.5 of the Ministerial Handbook the vehicle exceeded 120 000km which is prescribed. Hence it was replaced because it was a security risk.

(1) I would like to inform the Honourable Member that my Department did not purchase a new vehicle on the Deputy Minister's appointment to this office.

(2) Yes. The Deputy Minister inherited two vehicles. In Pretoria, the Deputy Minister uses a BMW X 5, 2005 model ( 4 years and two months) and in Cape Town, the Deputy Minister uses a Mercedes Benz ML500, 2006 model (2 years and 10 months).

REPLY:

The Deputy Minister inherited extsting vehicles: Audi A8 of 2006 and Mercedes Benz E-300 of 2007, used for Pretoria and Cape Town respectively.

The Audi A8 is due for disposal and a new BMW was ordered as a replacement vehicle. The particulars of the vehicle ordered are as follows;

(a) a BMW 530d of 2009.

(b) the price of the vehicle is R 576 444.14 VAT. Inclusive.

(c) (i) no extras above and beyond the vehicle's purchase price were bought with the vehicle.

(ii) no cost for the extras as the vehicle was bought without extras.

REPLY:

(1) The Department of Public Service and Administration did not purchase a new vehicle for the Deputy Minister on his appointment to office.

(a) The Deputy Minister's vehicles are on a full maintenance lease and there was no need to replace the current vehicles.

(b) No new vehicle was purchased on the appointment of the Deputy Minister for Public Service and Administration.

(c) No costs related to the purchase of a vehicle are applicable.

(d) (i) No accessories applicable as there was no vehicle purchased.

(ii) No costs related to accessories are applicable.

(2) The Deputy Minister for Public Service and Administration is currently making use of the two vehicles (one vehicle for use in Cape Town and one vehicle for use in Pretoria which were sourced via a full maintenance lease agreement through the Department of Communication prior to the appointment to office.

(a) The make and model of the two cars are:-

· 2005 Mercedes Benz E350 (Pretoria)

· 2005 Mercedes Benz E350 (Cape Town)

(b) Both vehicles are four years old. The Mercedes Benz E350 in Pretoria has covered 103 067 km's whereas the Mercedes Benz E350 in Cape Town has covered a total distance of 64 647km as on the 15 August 2009.

The full maintenance lease expires in April 2010 for the vehicle located in Pretoria and May 2010 for the one in Cape Town, respectively.

REPLY

(1) A new vehicle was purchased for use by the Deputy Minister.

a) The former Deputy Minister expressed interest to purchase the vehicle she used during her term of office. Such was done in accordance with Schedule 11 of the National Department of Transport Services Agreement which states that the "Contractor will give the Participants first option to purchase the Leased Vehicle".(Schedule 11 – FMOL Agreement 4.2)

b) Porsche Cayenne, Year Model 2009.

c) The purchase price of the vehicle was R650 000.

d) (i) Accessories included necessities such as multi-function steering wheel, universal audio interface, park assistance, preparation for mobile phone, metallic paint, removable trailer hitch, manual roll-up sunscreen, cruise control and automatic climate control system.

(ii) Total cost of the vehicle was R759 070.00.

(2) Given 1 (a) above, there was no existing vehicle to be inherited by the Deputy Minister.
