(ii) Number of past members of Parliament receiving special pension is 58.
I am advised that the information sought concerns personal information and that I am not at liberty to disseminate it without the consent of the individuals concerned. The member is referred to the Members Interest Disclosure register should he wish to obtain the information.
(b) The Code of Conduct for Assembly and permanent Council members, classifies the value of pension for Members of Parliament as confidential. Therefore, we cannot disclose the amount.

The Department of Cooperative Governance and Traditional Affairs does not monitor constituency/party funding by municipalities. As a result the department does not have this information at its disposal.

(1) and (3) Yes, there are 23 state sponsored drug rehabilitation centres and the state plans to establish seven new drug rehabilitation centres.
In addition there are six public treatment centres that are owned and fully funded by the state.

I have been advised by ICASA as follows:
1. (a) MTN and Vodacom will not be declared major operators as the Electronic Communications Act No. 36 of 2005 (ECA) does not provide for the declaration of certain operators as major operators.
(b) The Telecommunications Act No. 104 of 1996 provided for the declaration of certain players as major operators. However this was repealed by the ECA.
2. No, there is no report on the public hearings as Cell C withdrew its request to declare MTN and Vodacom major operators. As a result, the matter was not taken forward and ICASA published a Notice of withdrawal in the Government Gazette.
3. No, I will take no steps to declare these operators as major operators in view of the fact that the ECA does not provide for the declaration of major-operator status.
4. Not applicable.

(1) Yes, a summary on the key finding of the study conducted by a certain company (name furnished) into communications costs in our peer countries in comparison to South Africa is available to the public.
The key findings were published in booklet format and booklets were distributed to the relevant Parliamentary Committees in June 2009. Copies of the booklet can be obtained from our Cape Town and Pretoria offices.
(2) Yes, the study is available to the Independent Communications Authority of South Africa (ICASA) and the Competition Commission.
Copies of the full report were given to ICASA. The report was also presented to and discussed at Cabinet's Industrial Policy Focus Group, which includes the Department of Trade and Industry, who has oversight over the Competition Commission.

REPLY:
The Minister of Transport:
(1) (a) and (b)
No. The National Treasury, and not the Department of Transport (DoT), keeps a database of companies (a) that failed to deliver on tenders and (b) with whom business relations have been terminated for this reason.
The DoT does not know how many companies are on this database. The National Treasury keeps the list confidential. The DoT did not yet restrict a supplier in terms of Practice Note Number SCM 5 of 2006.
Paragraph 1.2 (2) (d) of Practice Note Number SCM 5 of 2006 states that "an organ of state may restrict the contractor, its shareholders and directors from obtaining business from any organ of state for a period not exceeding 10 years"
Paragraph 23.6 of the General Conditions of Contract further states that if a restriction is imposed, the purchaser must, within five (5) working days of such imposition, furnish the National Treasury, with the following information:
(i) the name and address of the supplier and/or person restricted by the purchaser;
(ii) the date of commencement of the restriction;
(iii) the period of restriction; and
(iv) the reason for restriction.
These details will be loaded on the National Treasury's central database of suppliers or persons prohibited from doing business with the public sector.
(2) Yes. The list is consulted when new tenders are received.
The Department of Transport confirms with National Treasury by e-mail whether a contract may be awarded to a particular supplier to determine whether a supplier is on the list of restricted suppliers before any bid is awarded. The National Treasury does not make the complete list available.
According to Treasury Regulations 16A9.1(c) an Accounting Officer/Authority must check the National Treasury's database prior to awarding any contracts to ensure that no recommended bidder or any of its directors are listed as companies or persons prohibited from doing business with the public sector.
The Department of Transport complies with the stipulations of the said Regulations as written confirmation pertaining to the status of all bidders is obtained from National Treasury and placed on record prior to the awarding of any contracts.

(2) how will his department ensure that any deficiencies do not occur at the Fifa 2010 World Cup Tournament?

The Minister of Transport:
(1) (a) and (b)
Yes, an investigation, in the form of a "FIFA 2009 Confederations Cup Transport Observations and Feedback" debriefing report has been conducted. The report was produced, after attendance and observations were implemented at selected matches during the tournament. The detailed report features the transport provisions made during the event, what difficulties and challenges were experienced, and recommendations for the 2010 Soccer World Cup™. The report can be viewed on the Department of Transport's website: www.transport.gov.za (under the link Special Projects).
The report provided an overall impression of the transport support from a spectator viewpoint, with observers attending matches as general spectators, with no pre-arranged, special transport. It does not cover the FIFA Family/ Special Travel Groups transport operations, as that was specially arranged and provided by the Local Organising Committee.
The report covered the transport offering that was available nationally and regionally, focusing on the following:-
Ø National coordination;
Ø aviation;
Ø national communications programme;
Ø rail (commuter and long distance), as provided by the Department's agency, the Passenger Rail Agency Of South Africa (PRASA); and
Ø on a regional level, the "Gauride" service provided by the Gauteng Department of Transport
On the Host City level, the observations were carried out covering the following areas:-
ü City transport serving strategy;
ü local communications programme;
ü event signage;
ü Park and Ride (P & R) sites;
ü P & R collection/drop-off points at stadia;
ü on the ground workforce-drivers/volunteers;
ü traffic management and security;
ü incident management;
ü post-match pick-up; and
ü finances
(2) The main observations were carried out during the attendance of selected games at each of the FCC venues (Rustenburg, Bloemfontein, Johannesburg and Pretoria) by individual observers. Immediate feedback and recommendations were given to the transport planners for each of the venues and a more detailed set of observation notes was prepared for each venue. All the observations were also shared with all nine World Cup cities, as part of the transport sector debriefing session, and have been used to influence the next level of transport operational planning for the upcoming 2010 World Cup™.

Reply
(1) The position for the Director-General is vacant from 1 April 2009 and has been advertised and a short-listing panel has already been approved accordingly. Therefore, the incumbent can only sign the performance agreement 3 months after appointment as prescribed in terms of the performance management and development system for Heads of Departments.
(2) No senior manager has signed a performance agreement with the Director-General for the reason stated on 1 above. However, all senior managers have signed agreements with their direct supervisors.

(a)-(b) As a result of the current restructuring process being undertaken, which was necessitated by the new mandates of the Department of Rural Development and Land Reform, all performance agreements of senior managers are currently being reviewed to ensure alignment between the organisational structure and the new mandates of the Department. Since the development of performance agreements are done in a top-down approach, the performance agreement of the Director-General that has recently been signed, will now guide the development of performance agreements for the next layer of senior managers.

REPLY:
(1) Yes, on the 02nd July 2009.
(2) No, only 98% of senior managers have signed performance contracts.
(a) Ms M Golden: Director Appeals Tribunal Services and Ms NE Shandu: Programme Manager Orphans and Vulnerable Children are the senior managers who did not sign their performance contracts yet.
(b) The main reason for not signing performance contracts is lack of compliance by the senior managers in question. The Director-General is addressing the issue. Disciplinary action will be taken against those senior managers who have not signed their performance contracts.
(c) By the end of September 2009. Annexure A also reflects the dates on which senior managers signed their performance contracts.

PRESS848. THE MINISTER OF WATER AND ENVIRONMENTAL AFFAIRS ANSWERS:
(1) The Director – General of Environmental Affairs has signed her performance contract with the Minister of Water and Environmental Affairs and with the Minister of Tourism, respectively, on 31 July 2009.
(2) Not all senior managers in the department have signed performance contracts with the Director-General.
a) Members of SMS who did not sign performance contracts are depicted in Annexure A (17 in total)
b) 17 managers have not yet signed agreements:
o Five of these members of SMS did not sign performance contracts due to the fact that they were recently appointed (2 months and less) and are still in the process of concluding their performance agreements with supervisors.
o Twelve remaining members of SMS who did not sign performance contracts are currently still negotiating and finalising their performance contracts with supervisors.
c) It is envisaged that all outstanding contracts will be finalised before 31 August 2009.
The dates of signed contracts of members of SMS are depicted in Annexure A.

REPLY:
The Minister of Transport:
(1) No. A draft performance contract of the Director-General: Transport was submitted to the Public Service Commission on 31 August 2009. Due to the fact that the Director-General's present contract comes to an end on 31 October 2009, the matter of her performance contract has not been finalized.
(2) All Senior Managers are not required to conclude performance contracts with the Director-General. They are, however, required to conclude performance agreements with their immediate supervisors. It is only the Deputy Directors- General heading the different Branches in the Department who are required to have their respective contracts signed off by the Director-General.
The Deputy Directors-General have submitted their performance contracts to the Director-General as required.
