Various Travel Agencies invoices not yet paid by 31 March 2015 for which provision has been raised to ensure that expenditure is recorded in the FY14/15.

 

Reason why invoice was not paid within 30 days

The State Security Agency (SSA) has raised queries with the service providers regarding invoices received where in some instances members reflected on the invoices are not from the Agency and the travel dates do not match the authorisation. The SSA has requested supporting documents and invoices from the service providers to ensure that the invoices correlate with Agency members and authorised trips.

 

Some of the invoices reflecting as outstanding have been paid and remittance advices have been forwarded to the service providers.

Mr D J Maynier (DA) to ask the Minister of State Security:

What authority in law did the State Security Agency have to conduct (a) domestic intelligence, (b) departmental intelligence, (c) counterintelligence and (d) any other specified intelligence operations related to the State of the Nation Address on 12 February 2015?             NW890E

REPLY:

The Department of State Security Agency (SSA) is part of the Security Services of the Republic of South Africa as defined in terms of section 199(1) of the Constitution of the Republic of South Africa, Act 108 of 1996.  The Constitution further deals with the mandate of Intelligence in section 209 and 210.  The National Strategic Intelligence Act, Act 39 of 1994 as amended in section 2 gives effect on the functions of Intelligence. The presence of SSA during the State of the Nation Address held on the 12 February 2015 was in accordance with the constitution and specifically the Powers Privileges and Immunities Act, 2004 (PPI) that governs the presence of security services in precincts of parliaments as outlined in chapter 2 of the PPI Act sections 4(1)-(2). Section 199(1) of the constitution describes security services as South African Police, the national army and intelligent services.

1 Whether his department is conducting an investigation into the leak of the so-called spy cables involving the State Security Agency; if not, why not; if so, (a) who is responsible for conducting the investigation, (b) what is the (i) purpose and (ii) scope of the investigation and (c) what is the duration of the investigation;

(2) Whether he will make the (a) findings and/or (b) recommendations of the investigation public; if not, why not; if so, when?

REPLY
(1) Yes

(a) A multi-disciplinary barn lead by the Director-General of the State Security Agency.

(b) A full investigation has been launched into the purported leakage, its veracity and verification will be handled in terms of the protocols governing the management of classified information

(c) An investigation is currently underway and the Joint Standing Committee an intelligence (JSCI) has been briefed.

(2) The findings of the Investigation will be made available to the Joint Standing Committee on Intelligence (JSCI). The SSA will do all in its power to expedite the investigation and to identify and act against those responsible for this serious act of security breach against the Agency and the Republic of South Africa.

REPLY:
No members of the State Security Agency (SSA) have been placed on suspension since 1 January 2014. There is however six members who were placed on suspension prior to the date above and whose disciplinary processes have commenced.

The cost implications for the period 1 January 2014 to date are R6, 984,614.00

Ms T Stander 9DA) to ask the Minister of State, Security:


(1) (A) When did the Minister of Environmental Affairs request the State Security Agency (SSA) to vet potential candidates for the Rhino Horn Trade Committee, {b) when did too SSA provide the Minister of Environmental Affairs with its findings and (c) what was the vetting criteria;

(2) Did the vetting criteria include {a) previous misconduct, (b) breach of ethics and/or (c) criminality on the part of candidates for the committee; if not, why not; if so, did the SSA give clearance to certain persons (names furnished);

(3) (a} was the SSA aware that a certain person {name furnished} had recently resigned as Vice Chairperson of the National Gambling Board after being suspended by the Minister of Trade and industry and (b) was this factored into the screening process;

(4) (a) was the SSA aware that a certain person (name furnished) was fired in 2005 as the Financial Director of !he Bohlabela District Municipality after a special disciplinary committee found him guilty of gross misconduct and financial mismanagement charges and (b} was this factored into too screening process;

(5) Was the {a) resignation and (b) firing of !he specified persons, respectively, factored into the screening process; if not, why not; if so, (i) did that influence the screening process and (ii) what are the further relevant details?

REPLY:

The state Security Agency conducts pre-employment screening of prospective candidates on request from government and stale agencies. This process is not exhaustive but is limited to information regarding the applicants' citizenship, credit record and SAPS records. Results of these inquiries are then shared with the requesting departments on the advice that a further detailed and involved vetting process be followed. In respect of the person in question, SSA conducted a pre screening inquiry which did no! yield any negative results. On 24 February 2015 a follow-up with the department was made to submit the completed Z204 forms to commence with the full vetting investigation process.
The other questions therefore aren't relevant given the aforementioned.
