1792.Mr I M Ollis (DA) to ask the Minister of Labour:

With regard to the R2,3 billion set aside over the medium-term in the Estimates of National Expenditure for the study and evaluation of the proposed national minimum wage, has her department determined how the allocation will be spent over the three-year period; if so, what are (a) the relevant details and (b) breakdown of expenditure?          

MINISTER OF LABOUR REPLIED:

According to National Treasury, Estimates of National Expenditure (ENE) published on 25 January 2015 (Page 509) the Department will transfer R2.3 billion over the medium term to the Commission for Conciliation Mediation and Arbitration and R90.9 million to the National Economic Development and Labour Council. Therefore the 2.3 billion stated in the ENE is not for research purposes. Hence, it should not be linked to the research study on “national minimum wage”.                                                 NW2011E

  1. Has  she presented the National Economic Development and Labour Council (Nedlac) special audit investigation report into fraud, corruption and maladministration, as conducted by AFCA & Partners and presented to Nedlac and to her in November 2012, to the SA Police Service (SAPS);
  2. has she laid any charges with the SAPS in connection with (a) allegations detailed in the abovementioned report or (b) any fraud or criminal activity arising from work performed at or on behalf of Nedlac in the period between 1 January 2011 and 30 March 2015; if so, (i) when and (ii) against whom;
  3. has she received any feedback from (a) the SAPS or (b) the Minister of Police in connection with any of the abovementioned matters;

  1. The forensic audit was commissioned by the Nedlac Audit Committee and not the Minister of Labour. The Report by AFCA & Partners was then given to Nedlac to deal with, and I am advised that they dealt with it in the manner they deemed fit.  By the way, Honourable Ollis has obtained a copy of the report in question therefore he knows the answers to most of the questions he is posing.
  1. I am advised that the Portfolio Committee has agreed on a date when Nedlac will again brief the Committee on this matter. Therefore all these questions will best be dealt with by the Nedlac Representatives in that meeting as it is very much a Nedlac internal matter.

Minister of Labour replied:

The Department of Labour does not have a specific Regulatory Burden Reduction strategy in place.  There is a project in government which is conducted in consultation with business and labour to identify and eliminate unnecessary regulatory burdens so as to foster investment and growth. 

Moreover, the Department will conduct socio-economic impact analysis of its legislation and regulations, as required. 

Finally, through consultation with organized business and labour under the auspices of the National Economic Development and Labour Council (NEDLAC) around labour policy matters, there is a regular focus on policy and regulation and its likely impact.

These initiatives provide sufficient focus and attention to the impact of regulation so that a specific strategy is not required.

The Minister of Public Works

Yes, there are processes. For example, at community level, the Expanded Public Works Programme (EPWP) Projects are managed through steering committees or appropriate structures established at that level. These structures work with the public body (the implementing municipality/department) in charge of the project.  Any problem that the community might have regarding the implementation of the project is reported to this structure.

 

(a) These processes apply to all public bodies implementing the EPWP, and not only the NDPW.

 

(b) Like in any other form of employment the responsible public body working with the committee will investigate such claims and provide corrective measures where applicable, as guided by applicable laws such as Protected Disclosure Act, 2000 (Act No. 26 of 2000). Unfair practices and discriminations in the implementation of projects are discouraged and committees are empowered to deal with them informed by the laws of the Republic of South Africa.

 

(c) The speed with which problems are resolved depends on the nature of the problem and is subject to the due processes followed by the relevant implementing bodies.

The Department of Labour and its Entities do not intend to provide sponsorships or enter into contracts of any type at this moment. Only Productivity South Africa intends to enter sponsorship contract with Times Media and SA FM to get public relations coverage for its Brand and the contact suppose to commence in October 2015 during productivity month. Ekurhuleni Metropolitan Municipality promise to sponsor Awards Ceremony during the same productivity month.

The value estimations are as following: SA FM at R 250 000.00; Times Media at R 1.2 Million and Ekurhuleni at R 350 000.00.

REPLY:

The Minister of Public Works

  1. The Department of Public Works has widened its monitoring and evaluation process to now measure the performance of project managers, in order to expedite the delivery of public infrastructure. In addition to the above, the Property Management Trading Entity (PMTE) is focusing on strengthening the professional capacity within the PMTE through engaging professionals who will be placed at the Head Office, as well as the Department of Public Works’ (DPW) regional offices to support current operations. To date, expenditure management on infrastructure projects has improved and progress has been made in the clearing of backlogs in project planning and close out phases.

 

  1. (i) and (ii) In the past, the DPW has not directly contributed towards the vitalization and the integration of the rural economy. However, within the newly developed PMTE business plan for 2015/2016, Medium Term Strategic Framework (MTSF): Outcome 7, which is led by the Department of Rural Development and Land Reform,  the PMTE has initiated a research project that seeks to consolidate  the needs of Government Service Points/centers in 27 prioritized rural district municipalities. Acquiring funding for such a project has been prioritised the for 2015/2016 financial year.  The findings of the research will assist the PMTE in planning Government precincts or one-stop Government Service Centres, which will provide integrated Government services across all spheres. We believe that the infrastructure development of such precincts will in some way contribute to the vitalization and integration of the rural economy.

 

  1. Since the launch of the Turnaround, the Department has revised and adopted an Anti-Fraud and Corruption Strategy and great strides have been made in identifying areas where fraud and corruption were rife. The investigation backlog of 250 cases has been reduced significantly and investigations are currently instituted within 30 days of receipt of allegations.

 

With regard to the PMTE, numerous projects have been launched to ensure that procurement systems are intact and leasing processes are clear, transparent and well-articulated. This includes, among others, the introduction of a standardized lease agreement that ensures that all salient matters of the lease are captured clearly. Signing of leases has been centralised at Head Office, to the Head of the PMTE and other delegated officials at Deputy Director General level. Due to the unique nature of the property and construction environments, the Supply Chain Management (SCM) processes for leasing and construction procurement are also in the process of being revised, where unique SCM processes for each of these fields will apply.

 

The DPW has investigated 112 “unoccupied but paid for” leased properties, where 41 cases have been resolved and 71 have been handed over to the Special Investigating Unit (SIU) for forensic investigation. Of the 29 “Occupied by other” properties, 6 have been resolved and the remainder was referred to the SIU for forensic investigation.

  1. As the manager of the State assets that fall within the custodianship of the DPW, the PMTE has the key objective of optimising this portfolio to ensure effective, efficient and cost saving service delivery.

In this regard, the PMTE in collaboration with National Treasury has prioritised the auditing of lease-ins and the reengineering of the lease-in business process. The review of 2,162 office leases was completed and physical verification of occupancy and size was carried out on 2,143 leased buildings. National Treasury approved the DPW Dispensation on the renewal of leases that have expired.  1443 (92%) out of 1566 leases have been renewed with a fixed 5.5% resulting in an estimated annual saving of R33 million or an estimated 3 years saving of R99 million. Immense gains, an estimated R318 million saving on energy consumption has also already been achieved through the incorporation of energy efficiency into building design and energy efficient technologies (Smart Metering and Lighting) into existing buildings.

With regard to improving service delivery, an interdisciplinary approach has been adopted in the development of the new PMTE 5-Year Strategic Plan and Annual Performance Plan, where greater synergies now exist between the DPW’s traditional property and asset management functions. Projecting demand by establishing client needs over the planning period is at the centre of the PMTE strategy and plans.

With the Asset Registry in its finalisation stage, the Department has better knowledge of State assets under its control. However, without properly gauging its clients’ needs and predicting demand, it will not be able to provide accommodation that is fit for purpose. Therefore, priority has been given to establish a robust client liaison and servicing model with a Client-Centric approach, where expert teams will provide onsite technical support to client Departments, primarily to streamline their needs analysis processes.

Contributing towards the National Development Plan (NDP) and improving Service Delivery, the anticipated outcomes/outputs for the PMTE as per the newly developed plans are as follows:

  1. Cost savings to user departments and improved quality of Government services to the public by improving access and the quality of public buildings through productive utilisation of vacant properties to create a funding stream for capital maintenance and improvements to extend the life-cycle of existing properties;
  1. Contributing to MTSF National Outcome 12 (an effective, efficient, development oriented public service) by utilising the State’s immovable assets to deliver various Government services to yield functional economic and social benefits to the State through the provision of office, functional and official residential accommodation and ensuring optimal utilisation of immovable assets that contribute to improved service delivery. Through the development of the Custodian Asset Management Plan and (C-AMP) the User Asset Management Plan (U-AMP) as principle strategic planning instruments, the PMTE provides accommodation to user departments that promotes integration, accessibility, sustainability, environmental sensitivity, economic growth and social empowerment.
  1. Contributing towards job creation, black empowerment and skills development by leveraging the State’s property portfolio mainly through the reopening of the Facilities Management Service Centres (Workshops) and bridging service delivery gaps by targeting and engaging Co-operatives, Small and Medium Enterprises and Turnkey Solutions for procurement in the provision of construction, facilities management, and property management services for unutilised State-owned properties.
  1. Energy and water savings on newly constructed buildings and reducing the energy demand on existing properties by implementing strategies for redress mechanisms.

  1. The decentralization exercise and the implementation of the new system (Umehluko) were concurrent strategic decisions taken as an initiative to broaden the service delivery capability of the Fund.  The new technology that has been deployed since August 2014 has shown that it is capable of fulfilling the initial rationale that informed decentralization, therefore it is being reviewed with a view to redefine its scope.
  1. It has been established that Automated Adjudication is possible with the new system and the modalities of making it a reality are being considered.
