Whether, with regard to the implementation of the Use of Official Language Policy Act, Act 12 of 2012 and since the reply of the Minister of Arts and Culture to question 990 on 6 June 2013, his department implemented the Act; if not, when will the Act be implemented; if so, which languages have been adopted as official languages of his department?

REPLY:

The South African Police Service (SAPS) has conformed to the Use of Official Language Policy Act, (Act No. 12 of 2012). It has a Language Unit that is in existence and is fully functioning. This Unit uses all languages and attends to all language-related queries. After soliciting inputs from employees, we are now in the process of finalising a Language Policy.

The due date for the completion was extended by the Minister of Arts and Culture to 2 May 2015. The SAPS envisage launching and marketing its Language Policy by the end of February 2015.

The Language Policy of the SAPS has been formulated in a manner that all 11 official languages are used at Head Office, and then each provincial office will then choose 3 appropriate languages per province (using the information from the STATS SA Census and the Provincial Language Policies which are already in existence) to choose these languages. In each case scenario, English will remain the business language to avoid communication breakdown.

(1)(a) On Monday, 27 October 2014.

(1)(b)(i) The Joint Security Committee (JSC) determined the need for additional SAPS deployment.

(1)(b)(ii) The JSC determined the need for additional deployment on 25 August 2014.

(1)(c)(i) 175 members of SAPS were deployed at the Parliamentary precincts on Thursday, 13 November 2014.

(1)(c)(ii) The 175 members consists of 57 members from Protection and Security Services, Parliament complex deployment; 20 members from Protection and Security Services, Chamber deployment; 10 members from the Public Order Police Unit (POPS); 88 members from Protection and Security Services, VIP Operations Unit (close protectors).

(2) The Parliament and Provincial Legislature Static Unit consists of 321 members for the 2014/2015 financial year.

(3)(a) (i) The Sergeant-at-Arms requested SAPS to enter the National Assembly (ii) and as the person designated by the Chairperson, authorized SAPS to enter the National Assembly.

(3)(b) The request was made (aa) on the 13th of November 2014 at 22:45 and (bb) on the 13th of November 2014 at 22:49 authorization was granted.

(4) (a) what is the (i) name and (ii) position of the person who supervised the placement of the deceased's fingerprints on the death certificate and (b) what are the person's qualifications?

REPLY:

(1)(a) The deceased was at a party and was admitted to a hospital later the evening presumably with a drug overdose. During examination at hospital it was discovered that that the deceased could possibly also have been raped. The deceased passed away on the same day that she was admitted to hospital.

(1)(b) The investigation has been concluded and the case has been set down for trial on 2 February 2015 in the Cape Town High Court.

(2) Witness statements have been obtained from 20 persons. The SAPS cannot reveal their particulars as the matter is sub judice.

(3) A post mortem was conducted.

(3)(a) The post mortem was conducted by Dr DK Abrahams.

(3)(b) The post mortem report is available and filed in the case docket.

REPLY:

(1) Yes, internal disciplinary actions have been taken against the official attached to the Provincial Tracking Team. He was departmentally charged with possession of suspected stolen property and not house breaking.

(2) No, the official was not promoted to the position of a Commander at Provincial Emergency Service. He was transferred to Provincial Emergency Service and he is not a Commander.

(3) No Commissioner prevented the arrest of the said official or authority given to prevent the arrest.

(4) No action was taken against anybody as there was no authority to prevent the arrest.

(1) A search has been conducted on all the SAPS systems as well as the Registration of Births and Deaths system of the Department of Home Affairs, but the particulars of the certain person could not be traced. The SAPS needs at least the following information to provide an answer to the question:

(i) The identity number of the deceased or that of the person who reported the matter to the police.

(ii) The name of the police station and the SAPS case number (CAS number) where the incident had been reported, or

(iii) Contact details and personal particulars of the next of kin of the deceased.

(2) did (a) a certain official (name furnished) of the Brixton Police Station and/or (b) any other member of the SAPS stationed at the station, at any point, have knowledge that the Dollar Table Bar operated illegally; if so, what action was taken against (i) the said person and/or (ii) any other member of the SAPS;

(3) who were the designated liquor officers for the specified police station for the (a) 2009-10, (b) 2010-11, (c) 2011-12, (d) 2012-13, (e) 2013-14 financial years and (f) from 1 April 2014 up to the latest specified date for which information is available;

(1) No, an inspection was conducted at the Dollar Table premises on 2014-09-01 and also on 2014-09-27. During both visits the premises displayed a valid license to trade as well as Section 104 (receipt for an application to transfer the license).

(2) No, after receiving correspondence from the Gauteng Liquor Board the license for Dollar Table Bar has been withdrawn, an inspection was conducted and the premises was vacated.

Whether, with regard to his reply to question 1132 on 12 October 2009, the fitness requirements for all other SA Police Service members, other than entry level requirements, have been finalised; if so, what are the fitness requirements?

REPLY:

Yes, all other South African Police Act members are requested to undergo, once annually, the fitness assessments that were implemented on 1 April 2010.

All SAPS Act members were subjected to a one day orientation and baseline evaluation for physical fitness levels and thereafter members had to follow self-exercise programmes and evaluations as directed in the self-study Physical Fitness Training Toolkit and Logbook. This programme was rolled-out to all provinces and divisions to implement on a continuous basis (annually).

After orientation and baseline evaluation, all SAPS Act members have to undergo bi-annual formative and summative fitness assessments as prescribed in the Physical Fitness Training Toolkit. The physical fitness assessments comprise the following health and fitness assessments:

Step 1: Body Composition, which includes:

(i) Completion of a Physical Activity Readiness Questionnaire (PARQ form);

(ii) Blood pressure measurement;

(iii) Body Mass Index (BMI), and

(iv) Waist circumference.

Step 2: Physical Fitness, which includes:

(i) 1.6 km Walk on an athletic field (mainly for unfit members who may possibly be at a health risk), or;

(ii) Bleeper/Pacer test on a flat surface of 20 metres.

Step 3: Muscular strength and endurance, which includes:

(i) One (1) minute push-ups, in counts/repetitions;

(ii) One (1) minute sit-ups, in counts/repetitions.

Since 1 July 2014 all Police Act members are subjected to annual Summative Fitness Assessments.

Each SA Police Service member has been granted 2 and a half hours per week throughout the year to attend physical fitness training, if work permits, as per the National Commissioner's letter 10/1/1 dated 2013-02-28.

How many Provincial Secretariats, in each province (a) are (i) planned to be formed and (ii) currently operational each province and (b) have made requestes to the national office of the Civilian Secretariat for Police for funding or subsidies; if so, what are the relevant details?

The information provided is based on the minutes of the HOD's meeting of 13 June 2014 reports given by the HOD's.

How many Provincial Secretariats:

There are 2 Provincial Secretariats that have been established namely ;

i) Kwa Zulu Natal and

The structure for the full-fledged Provincial Secretariat has been finalised and the HOD has been since appointed

ii) Western Cape

· Wrote a letter to the Minister of Police on the 13 May 2013 on the establishment of the Provincial Secretariat and have had a response through the Commissioner of inquiry

· The response spelt out how the Provincial Secretariat should look like and its relationships with Civilian Secretariat of Police at National

· This letter of the Western Cape was circulated to the other Provinces

iii) Provincial Secretariat currently Operational

All the other 7 provinces have Secretariat Offices, though mixed with other functionaries like Roads and Transport.

Mpumalanga has sent their structure to DPSA but have since not got a response of a full-fledged Secretariat. Their oversight programs are going on without a formal structure.

b) How many have made requests to the national office of the Civilian Secretariat for Police for Funding or subsidies:

Civilian Secretariat for Police at National does not provide funding, CSP has facilitated meetings between the Provinces and Treasury and DPSA to review their structures and ask for more funding. This exactly what Mpumalanga has done. The other Provinces still want to see their structures approved by their principals.

(1) With regard to the complaint of electoral fraud that was laid at the Vryheid SA Police Service (SAPS) by a certain person (name and details furnished) in March of 2013 which was followed by several pronouncements by the Electoral Court and the Constitutional Court (details furnished), what progress has the SAPS made with regard to the complaint

(2) how many (a) of the approximately 1800 voters who were removed by the Electoral Commission (IEC) from the Abaqulusi Ward 22 voters' roll have been charged in terms of Section 69(1) of the Municipal Electoral Act, Act 27 of 2000, for making false statements to the IEC relative to their residential address, (b) persons have been charged in terms of (i) Sections 67(1)(a) and (ii) 67(3) of the Municipal Electoral Act, Act 27 of 2000 for compelling or unlawfully persuading the specified voters to register as voters in Ward 22 of Abaqulusi Local Municipality and (c) persons have been charged in terms of Section 67(1)(b) of the Municipal Electoral Act, Act 27 of 2000, for interfering with the independence or impartiality of the IEC;

(3) whether (a) the Chief Electoral Officer of the IEC and/or (b) any or all of the five Commissioners have been charged in terms of Section 69(2) of the Municipal Electoral Act, Act 27 of 2000 for publishing false voters' rolls with the intent of influencing the outcome of the by-election in Ward 22 of Abaqulusi Local Municipality, and

(4) whether (a) any political party(s) (i) on behalf of which any or all of the approximately 1800 voters and other persons referred to in paragraphs (2) and (3) of this question may have acted have been identified and (ii) have been charged in terms of Section 66 of the Municipal Electoral Act, Act 27 of 2000, for (aa) contravening or (bb) failing to comply with any of the provisions of the Electoral Code of Conduct as set out in Schedule 1 of the Act and (b)(i) any person and/or (ii) any political party has been charged in terms of any other section of the Municipal Electoral Act, Act 27 of 2000; if so, which (aa) person(s) and (bb) political party(s),

(5) whether he has found that the failure to charge any persons and/or political parties is due to political interference in the work of the SAPS by any political party, in view of the fact that the IEC identified prima facie electoral fraud in Ward 22; if not, (a) what are the reasons for the SAPS' failure to charge even a single person and no political party for a period of no less than 20 months after the deposition of the criminal complaint and (b) when will this matter be concluded and those guilty face the consequences?

(1) The investigation of the two criminal cases which have been reported at Vryheid police station, namely Vryheid CAS 38/04/2013 and Vryheid CAS 447/08/2013 have not yet been concluded. Several witness statements have been obtained and several possible witnesses must still be traced and interviewed.

(2)(a) No person has been arrested because the investigation has not yet been concluded. The case dockets will be discussed with the Senior Public Prosecutor at Vryheid Magistrates Court regarding a decision on prosecution as soon as the investigation has been concluded.

(2)(b)(i)(ii) No person has been charged because the investigation has not yet been concluded.

(2)(c) No person has been charged because the investigation has not yet been concluded.

(3)(a)(b)No person has been charged because the investigation has not yet been concluded.

(4)(a)(i) Members of three political parties have been identified.

(4)(a)(ii)(aa) and (bb), (b)(i)(ii)(aa) and (bb) No person has been charged because the investigation has not yet been concluded.

(5) No, the investigation conducted thus far, has not been influenced by any political interference in the work of the SAPS.

(5)(a)The investigation is of a very complex nature and more than 1800 possible witnesses and suspects must be traced and interviewed. The SAPS should present a fully and complete investigated case docket to the Public Prosecutor in order to enable them to make an informed decision on prosecution.

(5)(b)It is almost impossible to predict when this matter will be concluded. The finalisation of the investigation is dependent on whether all the possible witnesses can be traced and interviewed. The Provincial Commissioner of KwaZulu-Natal has been requested to ensure that the finalisation of the investigation is expedited.

Since the South African Police Service did not embark upon promotion processes to the specified levels, for the periods mentioned above, vacancies on the respective levels were advertised for appointment purposes, either internally in SAPS or externally in the media.

Since September 2013, the South African Police Service introduced security screening (eg fingerprint verification) to form part of the internal appointment process with the appointment of a candidate from a lower to higher level. In all instances where candidates were appointed from outside SAPS, security screening was conducted and the candidates had to comply with Regulation 11(1)(a)(xii): "have no previous criminal convictions and such person shall allow his or her fingerprints to be taken and allow background enquiries to be made;" In this regard, no external candidates were appointed with criminal convictions.

Yes, SAPS launched the national festive season operation, "Operation duty calls" on 23 October 2014.

This operation commenced in the run up to the festive season on 1 October 2014 and will continue during the festive season and until the end of January 2015.

Operation Duty Calls will focus on the following 6 pillars:

• Combating of armed robberies including robberies at residential and business premises, malls and hijacking of vehicles.

• Contributing factors to crime including illegal firearms, illegal sale of liquor, drug trafficking and the market for stolen goods including compliance with the Second Hand Goods legislation

• Addressing crime against vulnerable groups and supporting the 16 Days of Activism against Violence against Women and Children

• Tracing of most wanted suspects

• Road safety and enforcement of road traffic legislation

• Border security

Operation duty calls will ensure an intensive and visible focus by police, in co-operation with all the other departments in the Justice, Crime Prevention and Security Cluster, on the above mentioned 6 pillars.

SAPS is also working closely with organizations such as the Consumer Goods Council of SA (CGCSA) Crime Risk initiative, and its associated partners, including the South African Council of Shopping Centres and the Jewellery Association of South Africa.

  • A strategic framework to address serious and violence crime in this sector is also being developed with the CGCSA and other stakeholders to ensure that co-operation and initiatives to address armed robberies continue in a sustainable manner after the conclusion of Operation Duty Calls.
  • The involvement of the Detective Service is reactive of nature. These types of crimes occur mainly in Gauteng, Western Cape, Eastern Cape and KwaZulu-Natal.
  • An Investigation task team has been established at provincial level in these provinces to investigate these crimes under the supervision of the Provincial Heads of the Detective Service.
  • Members of Crime Intelligence form part of these teams and the services of informers are also utilised.
  • Several suspects had been arrested in Gauteng, Eastern Cape and Western Cape.
  • Investigations are still being conducted to link the arrested suspects to reported cases.
  • Police detailed tactical plans and options are not for public consumption.
    The SAPS is currently employing its tactical measures and all available physical resources to mitigate all criminal threats, including shopping malls and business robberies.

    Community outreach is conducted on a regular and irregular basis using all available mass communication means.

    According to the Efficiency Indexing System the following number of days was utilized as sick leave (inclusive of incapacity leave) by employees within the South African Police Service:

    The information reflected above was retrieved from the Efficiency Indexing System. The counting rule for the calculation of the number of sick leave days utilized is as follows:

    · the number of days sick leave and incapacity leave utilized by each employee who made use of the specific benefit during the respective financial years is summed.

    The increase in the utilization of sick leave days reflected is due to the fact that the new sick leave cycle commenced in 2013. It is ordinarily expected that there is an influx in the utilization of sick leave in the beginning of a sick leave cycle and temporary incapacity leave at the end of the sick leave cycle.

    Another reason for the increase is as a result of the increase in the establishment. For the 2012/2013 financial there was an average of 170734 employees (excluding students). In 2013/2014 the total number of employees increased to 180208 employees (excluding trainees). There was thus an additional 9474 employees utilizing sick leave during the 2013/2014 financial year.

    It should also be mentioned that given the fact that each employee is entitled to 36 sick leave days within a three year leave cycle a total of 6 487 488 number of sick leave days are available for employees to utilize. A total of 1 647 229 days were utilized during the 2013/2014 financial year. Thus only 25% of the total sick leave benefit for the 2013-2015 sick leave cycle was utilized during the 2013/2014 financial year.

    (b) Strike action:

    (i) 2011-2012 Financial Year – no strike incidents

    (ii) 2012-2013 Financial Year – no strike incidents

    (a) The vacant posts of Provincial Head: Crime Intelligence for various provinces were advertised on the level of Major General, on 30 April 2012. The educational requirement stipulated in the advertisement was an applicable NQF6 qualification or higher qualification. During the evaluation of the applications received, a limited pool of experienced candidates was identified. Excellent candidates with experience and relevant training, exclusive to the Crime Intelligence environment, were excluded due to the qualification requirement.

    The South African Police Service Employment Regulations, 2008, provides in Regulation 43 for the National Commissioner to determine the composite requirements for employment in any post on the basis of the main objectives and inherent requirements of the job. The said Regulation inter alia provides further that the National Commissioner must ensure that requirements for employment do not unfairly discriminate against any person.

    To ensure that service delivery is not compromised, the posts were re-advertised on 4 March 2014 with at least a Grade 12 or a NQF level 4 qualification coupled with training and development in the field of Intelligence as a minimum requirement.

    It needs to be noted that legislation was split into two, namely the Criminal Law (Forensic Procedures) Amendment Act, Act 6 of 2010 regulates the powers in taking and processing of fingerprints, body prints and photographic images; and the Criminal Law (Forensic Procedures) Amendment Act, Act 37 of 2013 regulates the powers in respect of taking DNA buccal samples and the establishment of the National Forensic DNA Database.

    The Division: Forensic Services is progressively capacitating the environment to support the legislation and expected influx of expected forensic samples for examination. The capacitation includes the appointment and training of forensic examiners and acquiring of equipment to support the forensic examinations. Furthermore processes are underway to implement a forensic DNA capability in the Port Elizabeth facility of the Forensic Science Laboratory.

    In order to successfully implement the said legislation the following staff capacitation was planned for the Division: Forensic Services. 2012/13: 801 posts; 2013/14: 710 posts; and 2014/15:650 posts. The recruitment process of 801 posts for the 2012/13 posts have been concluded. Approval was received for only 327 posts from the 710 (2013/14) planned posts and most of these posts have been filled. The approval to commence with the recruitment of the balance (ie. 326) of the 710 posts (2013/14) and 650 posts (2014/15) posts is still pending.

    The following progress can be reported specifically to the implementation of the Criminal Law (Forensic Procedures) Amendment Act, Act 6 of 2010:

    · National Instruction compiled and issued - August 2013

    · Training interventions (National Instruction) developed and piloted in August 2013

    REPLY:

    (1)(a) On 14 August 2011 at about 12:55 the complainant in an Attempted Murder case, Loate CAS 65/08/2011 phoned the Investigating Officer, Warrant Officer van Schalkwyk of Loate Detective Service and informed him that the suspect in his case who fired shots at him a few days ago, was again in the area with a firearm and was looking for the complainant in order to kill him. Warrant Officer van Schalkwyk then requested the SAPS members on standby duties at SAPS Loate to attend to the matter.

    The SAPS members accompanied the complainant to the Beirut area of Winterveld where the complainant pointed out the suspect, Mr Samson Maimela, to the SAPS members. The suspect was in the street and he had a firearm in his hands. Two SAPS members approached the suspect from opposite directions and the suspect moved to a house in the street where he hid himself in a corner of the house. The suspect pointed his firearm at one of the SAPS members who approached him from the front. The second SAPS member who was approaching the suspect from behind, instructed the suspect to throw down the firearm but the suspect kept on pointing the firearm at the other SAPS member. The second SAPS member then fired a shot at the suspect fatally wounding him. The firearm which the suspect had in his possession was recovered at the scene. A case docket, Loate CAS 205/08/2011 (Murder) was registered relating to the death of the suspect.

    (1)(b)(i) The charge is murder.

    (1)(b)(ii)The suspect in case docket Loate CAS 205/08/2011 is Constable PI Makhubela

    (2) Yes, the case docket was thoroughly investigated and presented to the Senior Public Prosecutor who declined to institute prosecution into the matter and referred the matter to the inquest court for an inquest to be held. The inquest was finalized on 17 January 2013 at the Ga-Rankuwa magistrate court. The magistrate at the inquest court ruled that the deceased died of a "Perforating Gunshot – Chest (unnatural)" and further that Paul Makhubela was responsible for the death of the deceased "but he has a defence of necessity".

    (3) Yes, the standby members of the IPID were summoned to the scene on 14 August 2011 at approximately 13:15. They however arrived very late at the scene, and the body of the deceased had already been removed to the mortuary. The body had to be removed because the relatives of the deceased and members of the public became unruly as the body had been lying on the scene for more than two hours.

    Yes, SAPS launched the national festive season operation, "Operation duty calls" on 23 October 2014.

    This operation commenced in the run up to the festive season on 1 October 2014 and will continue during the festive season and until the end of January 2015.

    Operation Duty Call that will focus on the following 7 pillars:

    • Combating of armed robberies including robberies at residential and business premises, malls and hijacking of vehicles.

    • Bylaw-enforcement

    • Contributing factors to crime including illegal firearms, illegal sale of liquor, drug trafficking and the market for stolen goods including compliance with the Second Hand Goods legislation

    • Addressing crime against vulnerable groups and supporting the 16 Days of Activism against Violence against Women and Children

    • Tracing of most wanted suspects

    • Road safety and enforcement of road traffic legislation

    • Border security

    Operation duty calls will ensure an intensive and visible focus by police, in co-operation with all the other departments in the Justice, Crime Prevention and Security Cluster, on the above mentioned 6 pillars.

    SAPS is also working closely with organisations such as the Consumer Goods Council of SA (CGCSA) Crime Risk initiative, and its associated partners, including the South African Council of Shopping Centres and the Jewellery Association of South Africa.

    A strategic framework to address serious and violence crime in this sector is also being developed with the CGCSA and other stakeholders to ensure that co-operation and initiatives to address armed robberies continue in a sustainable manner after the conclusion of Operation Duty Calls.

    Through these industry associations information is analysed and shared and guidance given to member businesses.

    The Ministry of Police and the SAPS has over many years maintained a call to all individuals, communities, and organisations to work with police to prevent crime, to provide information about crime and criminals and report corrupt activities.

    SAPS has established its own tip-off line in this regard and also partner with CrimeLine in this regard.

    SAPS support the call to end crime and violence and will continue to do so in the execution of its functions at all levels in communities and also from national and international platforms.

    In the 2013 / 2014 financial year, the Minister and or the National commissioner was personally involved in 19 crime awareness campaigns where communities were engaged and called upon to assist the SAPS in the fight against crime.

    (1) SAPS is working with private sector stakeholders including the Consumer Goods Council of South Africa, the South African Banking Risk information Centre, the Private Security Industry Authority and owners and management of shopping malls to analyse and share information that can be used to prevent robberies, track down offenders and expedite responses. In addition to an intensive focus from police and law enforcement agencies like Metropolitan Police Services, shopping malls are engaged to improve their security measures to ensure early warning, rapid response, capturing of information that can assist to apprehend offenders and close working relationships with police and security services to ensure the safety of the public.

    (2) Specific measures in place during the festive season include the following:

    SAPS launched its festive season operations, Operation Duty Calls in Wembezi in KwaZulu-Natal on 23 October 2014. The operation will focus on 6 pillars including:

    · Combating of armed robberies including robberies at residential and business premises, malls and hijacking of vehicles.

    · By-law enforcement

    · Factors that contribute to crime including illegal firearms, illegal sale of liquor, drug trafficking and driving under the influence of liquor and drugs and the market for stolen goods including compliance with the Second Hand Goods legislation

    · Addressing crime against vulnerable groups including children, the elderly and disabled and gender-based violence including sexual offences, domestic violence and violence against Lesbian, Gay, Bi-sexual, Transgender and Intersex individuals.

    · Focusing tracing of most wanted suspects

    · Road safety and enforcement of road traffic legislation

    · Border security including a focus on ports of entry, border patrols, and rural safety patrols.

    (3) During the weekend of 25 and 26 October, three suspects were arrested in connection with at least two robberies in malls in Pretoria. This follows the arrest of four suspects in the Western Cape on 24 October 2014 and brings the total arrests related to mall robberies in the recent months to 30.

    (a) No. Kayamandi Satellite Police Station is a "Leased Police Station" and does not feature on the 2014/2015 Annual Performance Plan of the SAPS.

    (b) It must be noted that Kayamandi police station is a satellite police station within the greater Stellenbosch policing area, and as such functions as an extension of the main police station.

    Considering the staffing level at the Operational Environment (Visible Policing and Detective Service) – juxtaposed to the overall staffing level for the Western Cape province (which currently is at 89%) - Stellenbosch SAPS is currently staffed at 92% (which is above the current provincial average), in order to perform its constitutionally mandated functions.

    With the conversion from the Resource Allocation Guide (RAG) to the Fixed Establishment (FE), an allocation of fifteen [15] (additional) operational posts have recently been added to the Fixed Establishment of Stellenbosch SAPS, in order to improve the policing capacity.

    From the recruitment process (as per the allocations made in the 2013/2014 Financial Year), the Provincial Commissioner approved an allocation of six [6] recruits to Stellenbosch.

    The allocation of Entry Level Constables for the 2014/2015 Financial Year is expected in due course, which will further provide an opportunity to address staff shortfalls at this and other police stations.

    All crimes reported to the South African Police Service (SAPS) are registered and recorded on the Crime Administration System (CAS), which serves as a record of all the reported crimes.

    Occult-related crimes are included and recorded as either common law or statuary offences and not as separate "occult-related" crimes.

    (2) The SAPS has indeed quantified occult-related crimes and this resulted in the training of individual investigating officers on the subject, and the monitoring of these investigations on national and provincial level.

    (3) Hotspots were identified in certain provinces - only because occult-related crimes are not prevalent in all provinces.

    (3)(a) The hotspots are in the following provinces:

    § Limpopo (Thoyandou area)

    § Mpumalanga (Nelspruit and Siyabuswa area)

    § Free State (Ficksburg area)

    § North West (Rustenburg area)

    The subsection commander at Head Office, who has been appointed to coordinate the investigation of occult- related crimes, regularly conducts information sessions, lectures and awareness campaigns with SAPS members, government departments including the Department of Justice and Correctional Services, the National Prosecuting Authority, Traditional Healers, non-government organizations, churches and schools.

    (1) The SAPS does not have a dedicated Occult Crimes Unit. It is merely an added investigation support responsibility to General Crime Investigation detectives, who received additional training in the investigation of what is referred to as Occult Crimes.

    The South African Police Service in discharging its legal duties to prevent, combat and investigate crime recognizes and respects the fundamental right of every person to freedom of conscience, religion, thought, belief, opinion and expression.

    Investigations include but are not limited to:

    · Muthi related offences (mostly committed by unethical Sangomas

    (1)(a) In terms of Regulation 20(2)(b) of the South African Police Service (SAPS) Employment Regulations, 2008, the SAPS is required to develop a Fixed Establishment while remaining within the current (annual) budget and medium-term expenditure framework. Due to current pressures on the SAPS's compensation budget and the allocation received there was no increase in the establishment of the SAPS since 2012/2013. The current approved Fixed Establishment of the SAPS is maintained at a targeted figure of 199 537. It is not foreseen that there will be any increase in the Fixed Establishment of the SAPS over the medium term. All available funded posts for 2014/2015 were already allocated to business units. A principle of equitable distribution was applied and given the current financial constraints all organisational demands could not be addressed. The allocation to police stations was maintained at 100% of the previous allocation (not reduced). It is important to note that all current and new organisational demands must be addressed within the framework of the current Fixed Establishment. Increasing the allocation of any business unit will require the reallocation of posts from other business units that may impact on the latter's ability to render services.

    (2) In terms of the 2013/14 allocations for enlistment, the Western Cape province has been allocated 668 entry level constables. The candidate constables are now at the Police College for basic police training. Allocation for 2014/15 shall be made in due course. The programme allows members to attend a baseline evaluation regarding their fitness against the SAPS set standards. Members who do not meet the required SAPS fitness standards are mentored by the fitness assessors during the structured exercise sessions regarding their status of fitness and given advice on how to strive towards attainment of the set standard. The fundamental aim is to improve the readiness of police officials to face the physical challenges required by police work and to instil the culture of healthy lifestyle. Upon failure, members have to participate in the structured exercise program to improve their fitness levels before they are reassessed. Fitness is a continuous process that members need to engage in; in order to attain the SAPS standards and this cannot be achieved in a short term period.

    The fitness standards are however an entry level requirement and aspirant employees are required to pass the SAPS standards in order to fulfil one of the entry requirements.

    (2)(b) The SAPS fitness programme was designed to introduce a mindset change of police officials regarding their health and fitness. The programme allows members to attend a baseline evaluation regarding their fitness against the SAPS set standards. Members who do not meet the required SAPS fitness standards are mentored by the fitness assessors during the structured exercise sessions regarding their status of fitness and given advice on how to strive towards attainment of the set standard. The fundamental aim is to improve the readiness of police officials to face the physical challenges required by police work and to instill the culture of healthy lifestyle. Upon failure, members have to participate in the structured exercise program to improve their fitness levels before they are reassessed. Fitness is a continuous process that members need to engage in, in order to attain the SAPS standards and this cannot be achieved in a short term period.

    The fitness standards are however an entry level requirement and aspirant employees are required to pass the SAPS standards in order to fulfil one of the entry requirements.

    (a) (i) 261 police members attended fitness assessments during the period 2013 (1 April 2013 to 31 March 2014) .

    (ii) 47 police members attended fitness assessments during in 2014 (1 April 2014 to 30 August 2014).

    (b) 26 police members failed the fitness assessments during the period 2013 (1 April 2013 to 31 March 2014) and 9 police members failed the fitness assessments during 2014 (1 April 2014 to 30 August 2014).

    (2) Police members have the opportunity to undergo re-assessment until they are found competent. Members with a Body Mass Index of 40 and/or higher attend the Healthy Lifestyle Intervention for a duration of 6 weeks.
